Conditions of Approval for #ZP-22-043
1068 Williston Road
1. Will adhere to the General Performance and Maintenance Standards outlined in Section 3.16 of
South Burlington’s Land Development Regulations.
Purpose of Performance Standards. Consistent with the general purposes of these regulations,
performance standards (see Appendix A) shall set specific controls on potentially objectionable
external aspects of such non-residential uses so as to:
(1) Reduce to a reasonable minimum the dissemination of smoke, gas, dust, odor, or other
atmospheric pollutant outside the structure or beyond the property boundaries in which the use
is conducted.
(2) Control noise and light trespass beyond the boundaries of the site of the use.
(3) Prevent the discharge of untreated wastes into any watercourse or waterbody.
(4) Prevent the dissemination of vibration, heat, or electromagnetic interference beyond the
immediate site on which the site is located.
(5) Prevent physical hazard by reason of biohazard, fire, explosion, radiation, or any similar
cause.
(6) Regulate and control the generation and flow of vehicular traffic so as to prevent hazardous
conditions, traffic congestion, and excessive noise in the streets.
2. The City’s Public Nuisance Ordinance is also applicable.

Re: 1068 Williston Road Highway Impact Fee Credit
Dear Peter,
The City Council on Tuesday, January 18th, approved issuance of credit against Highway Impact Fees
associated with SP-21-045 at 1068 Williston Road in accordance with Section 8 of the City’s Impact Fee
Ordinance. This credit is being was approved as an addition to the credit authorized in April 2020. The
additional credit was sought following review and approval of an additional 74-dwelling unit building on
the site.
The applicant estimated the updated roadway construction cost for their segment at $440,643. The
applicant sought permissible credit for Highway Impact Fees that would be owed for the increase in p.m.
peak hour vehicle trips generated by the new development. Site plan approval #SP-21-035 estimated 25
additional p.m. peak hour trips beyond those previously approved and credited. Highway Impact Fees are
levied at a rate of $999 per p.m. peak hour trip generated, less credit for past taxes paid and future taxes
to be paid via property tax.
Pursuant to the Impact Fee Ordinance, the Administrative Officer recommended the issuance of the credit
for these 25 trips in SP-21-035. As this figure is significantly less than the total estimated construction
costs for the roadway, the Administrative Officer recommended that a full credit is warranted.
The City Council approved the highway impact fee credit for the 25 additional pm peak hour trip ends at
their January 18, 2022 meeting.
