FINDINGS OF FACT & DECISION

Re: Findings of Fact, #SP-01-42 of Leonard Charland and Donald Jones to amend a
previously approved site plan for a 5,000 square foot manufacturing and warehouse
building. The amendment consists of constructing a 240 square foot addition for a total
of 5,240 square feet of manufacturing and warehouse use, 38 Commerce Avenue.
On the 26th day of July 2001, the Director of Planning and Zoning approved the request of
Leonard Charland and Donald Jones for site plan review under Section 26.10 of the South
Burlington Zoning Regulations based on the following findings:
This project consists of amending a previously approved site plan for a 5,000
square foot manufacturing and warehouse building. The amendment consists of
constructing a 240 square foot addition for a total of 5,240 square feet of
manufacturing and warehouse use, 3 8 Commerce Avenue.
2. This property is located within the Mixed Industrial and Commercial District. It
is bounded on the north by Ethan Allen Drive, on the east by an industrial
building, on the south by Commerce Avenue, and on the west by a
warehouse/office building.
3. The record owners of the property are Leonard Charland and Donald Jones
4. Access/circulation: Access is provided via a 30-foot curb cut on Commerce Avenue.
No changes are proposed. Circulation on site is adequate.
5. Coverage/setbacks: Building coverage will remain 12% (30% max). Overall
coverage will remain 52.4% (70% max). Front yard coverage is unchanged at
28.3% (30% max). All setback requirements are met.
6. Parking: Ten parking spaces are required and 12 are being provided. One
handicapped space is being provided as required.
7. Landscaping; No landscaping revisions are proposed at this time. As the addition
was calculated into the original minimum landscaping requirement in the Planning
Commission's July 13, 1993 approval of the site plan the current minimum
landscaping requirement is zero.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Director of Planning and Zoning
approves site plan application #SP-01-42 of Leonard Charland and Donald Jones to amend
a previously approved site plan for a 5,000 square foot manufacturing and warehouse
building. The amendment consists of constructing a 240 square foot addition for a total
of 5,240 square feet of manufacturing and warehouse use, 38 Commerce Avenue, as
depicted on a one (1) page set of plans, entitled, "Lot 15 Ethan Allen Drive," prepared by
Jim Wood, dated 5/11/93, last revised on 8/3/94, with the following stipulations:
1) All previous approvals and stipulations, which are not superseded by this approval, shall
remain in effect.
2) All exterior lighting shall consist of down -casting shielded fixtures. Any change to
approved lights shall require approval of the Director prior to installation.
3) The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the zoning regulations or this approval is null and void.
4) The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to the use of the addition.
5) Any change to the site plan shall require approval by the South Burlington Development
Review Board.
