Hi Marla, Please see below for responses to staff comments for # SP 22-004 510 Shelburne Road in advance of the DRB hearing. Also attached are revised plans and supplemental information that address some of the below comments. 1. (a) Provision of Options to acquire all necessary TDRs from a designated Sending Area as part of any application to the Development Review Board or Administrative Officer in accordance with Article 9 of these Regulations. The applicant must provide an option agreement to purchase one (1) TDR, equal to 0.83 acres, from a designated sending area, prior to approval. Response: The Applicant is reviewing this comment and options, and will provide a response at or before the DRB hearing. 2. Staff considers some of the requested uses are not compatible with the proposed building and therefore should not be permitted under an umbrella. Exclusion of a use from the umbrella permit does not prohibit the applicant from applying for that use; they simply must obtain a site plan approval to do so. Staff recommends the Board exclude the red italic uses from the umbrella permit, principally because these uses require different site amenities to function, with the exception of Cannabis Dispensary which may not be located within 1,000 ft of the property line of an existing childcare use. 2 Response: The Applicant would like to include the Cannabis Dispensary use in the Umbrella Permit in the circumstance the regulations are revised to reduce setback distances from childcare use. The Applicant is otherwise ok with removing other uses Staff has identified as “not compatible” from the umbrella permit that include Food Hub, Bank or Credit Union with drive-though, Hotel, and Seasonal Mobile Food Unit. 3. No information is provided regarding whether the proposed glazing is transparent. Staff recommends the Board ask the applicant what their intention is regarding transparency, and, if their proposal meets the minimum requirement, include it as a condition of approval. Response: The final glazing plan will be developed once a tenant has been determined, however the applicant will ensure all glazing for the project will meet the minimum requirements per the LDR’s. See attached for updated architectural plans showing additional information on the building glazing. 4. Some glazing is proposed to be more than 7-ft high, but not all. Staff recommends the Board ask the applicant to identify what percentage of the width of the building facades are glazed with glazing 7-ft in height or greater. Response: All glazing has a height of 7-feet or greater. See revised exterior elevations with dimensions added to confirm. 5. On Shelburne Street, first stories must have a minimum of 60% glazing when measured by width. It appears approximately 58% glazing is provided, and some of the provided glazing is less than the required minimum height of 7-ft. Staff recommends the Board require the applicant to modify their plans as necessary to meet this criterion, and to demonstrate compliance with this criterion through dimensional information. Response: All glazing meets the 7-foot height requirement, dimensions have been added to the exterior elevations for clarification. The glazing facing Shelburne Street has been revised. The two entrances on each side of the building have been revised to have a single door and sidelights. The overall dimension of this glazing is 1’-0” larger than the previously shown elevations. Calculations are provided with the West elevation showing that the glazing now meets the 60% requirement. 6. On Bacon Street, first stories must have a minimum of 40% glazing across the width of the building façade. Staff estimates approximately 53% is provided, but some of the glazing is less than the required minimum 7-ft in height. Staff therefore recommends the Board require the applicant to provide dimensional information demonstrating that the width of glazing that is greater than 7-ft in height is 40% or more of the facade. Response: The North Elevations facing Bacon Street has been updated to show the height of all glazing, which is all over 7-feet, and the calculations for required glazing width. 7. Staff recommends the Board ask the applicant whether rooftop elements are proposed. Rooftop elements must be screened or grouped and integrated into the architecture of the building. Response: The mechanical plans not have been finalized, however some rooftop elements are anticipated at this time. The Applicant will screen and/or group the rooftop elements and integrate them into the architecture per the LRDs and applicable requirements. 8. (c) Parking Area Width. Surface parking areas and affiliated drive aisles located to the side of buildings shall not exceed the building width along any street frontage. This may be calculated separately or cumulatively for corner lots. This criterion is not met. Calculated cumulatively, the width of the building is approximately 103 ft, while the width of parking and affiliated drive aisles is approximately 120 feet (excluding the center parking lot island). Staff recommends the Board require the applicant to modify their plans to meet this criterion. 3 Response: We believe there is an error in the Staff calculation. The project is located on a corner lot and, per the regulations, the building width can be calculated cumulatively. The cumulative building width is 152 feet (103 + 49) and the parking lot width is 120 feet (excluding the interior parking lot island), which does meet the criteria. See the attached Supplemental Information exhibit showing the calculations and dimensions. 9. There is an existing 50-ft wide access easement on the southwest corner of the site indicated on the provided plans as “To Farrell Street.” The applicant is proposing to reduce the connection between the site and the adjoining site from being completely open to a 25-ft driveway to the south. Staff supports this modification, but recommends the Board ask the applicant to describe the restrictions of the existing 50-ft wide access easement for the purposes of evaluating whether the proposal is consistent with the requirements of that easement. Response: The 50’ access easement is described in the deed as benefiting the Champlain Oil Company and to be used in common with others for access “to Farrell Street.” Our interpretation of “others” is primarily meant to be the users of the project parcel and Champlain Oil Company customers because the easement provides access to the Farrell Street and the signalized intersection; there is no specific designation or definition of “others” in the deed. Even if “others” is interpreted to mean the adjoining lot to the south, we believe the proposed project is consistent with the easement because the site layout provides access between the two parcels and to Farrell and Bacon Streets. The proposed access is shifted to an area that better ties into the circulation of the parcels, will be more safe for vehicular traffic, and is not directly parallel to Shelburne Road. 10. There is a bike storage room on the first floor. Staff recommends the Board require the applicant to demonstrate that the storage room accommodates the required minimum bicycles, and that the commercial tenants have access to it’s use. Response: The project provides the required long term storage for both residential and commercial users in the bike storage room as shown on the revised architectural plans, see attached revised first floor plan. 11. Staff recommends the Board require the applicant to demonstrate that the crabapples in the Shelburne Road ROW will be allowed by the City of Burlington prior to allowing them to count towards the minimum required landscaping budget. Response: The Burlington City Arborist, V.J. Comai, has confirmed the crabapples in the Shelburne ROW are allowed. See attached email correspondence with V.J. Comai confirming the planting is permitted. Per the Burlington City Arborist’s recommendation, the species of crab apples has been revised to be the ‘Donald Wyman’ cultivar. 12. (2) In all parking areas containing twenty-eight (28) or more contiguous parking spaces and/or in parking lots with more than a single circulation lane, at least ten percent (10%) of the interior of the parking lot shall be landscaped islands planted with trees, shrubs and other plants. Such requirement shall not apply to structured parking or below-ground parking. 33 parking spaces are provided. Staff recommends the Board require demonstration that this criterion is met prior to closing the hearing. Response: The interior parking lot area is 15,421 SF and the required 10% interior landscaped area is 1,542 SF. The interior landscape plan provided is 1,724 SF, therefore this criterion is met. See attached plan for calculations. 4 13. Staff recommends the Board determine whether to allow the proposed landscaping elements to count towards the required minimum landscaping budget. Staff has some increasing concern about the likelihood of perennial plantings to be maintained “in perpetuity” and recommends the Board consider a more general approach should they wish to continue allowing perennial plantings toward required minimums, such as allowing a certain value per square foot of perennial bed. Response: The Applicant requests the Board allow credit for the perennial planting because there are locations where planting woody material (trees and shrubs) is inappropriate, impracticable, or infeasible. For instance, parking lots, sidewalks, drive aisles, and circulation routes have winter maintenance considerations like plowing, where woody plant material along perimeters or in interior planting islands are more likely to be damaged by plowing and snow removal. Public Works Comments as noted in the Staff Report: The Acting Director of Public Works reviewed the plans on February 16, 2022 and offers the following comments. 1. The applicant will need to prepare and submit a Grease, Oil and Sand Interceptor Permit as part of this application. Response: This Grease, Oil, and Sand Interceptor permit application was submitted and received by Todd Gregory of the South Burlington Public Works on January 25, 2022. 2. All connections and work proposed in the Route 7 ROW are outside of South Burlington. The applicant will need to coordinate with the City of Burlington for work proposed in these areas. Response: This is understood. The South Burlington Water Department Director reviewed the plans on February 14, 2022 and offers the following comments. 1. The water line on Bacon Street is owned and supplied by the City of Burlington. They must be contacted to approve the proposed connection and use. Response: The City of Burlington has provided Water allocation and approval for this connection. 2. As shown on these plans the wastewater connection appears to flow to the City of Burlington. There have been some changes made to wastewater flows that might make this plan incorrect. Prior to connecting to the sewer main on Bacon Street, the flow direction and ultimately the receiving WW facility must be confirmed, and that information provided to the City of South Burlington and the South Burlington Water Department for correct billing information. Response: It is understood that the sewer main on Bacon Street, proposed for connection from this project, goes to the City of South Burlington wastewater treatment plant based on previous discussions with both municipalities. It should also be noted that preliminary wastewater allocation was issued on June 8, 2020 from the City of South Burlington (as the wastewater connection on Bacon Street was directed toward the South Burlington WWTP) for the previous version of this project. A separate preliminary wastewater allocation request, for the proposed project, was submitted to the South Burlington Public Works on January 20, 2022 and is pending. 3.The SBWD will bill the property owner for stormwater based on South Burlington Stormwater information provided to this department. Response: Understood City Arborist 5 • Due to existing site conditions i.e. pavement/compacted soils, soil replacement and/or decompaction of soils will most likely be necessary to provide conditions suitable for tree and shrub growth Response: Yes. • Be aware that crabapples slated to be planted in the greenbelt along Shelburne Rd are in the city of Burlington’s Right of Way Response: Understood.
