HomeMy WebLinkAboutMinutes - City Council - 04/27/1982CITY COUNCIL APRIL 27, 1982 The South Burlington City Council held a special meeting on Tuesday, April 27, 1982 at 7:30 P.M., in the Mini-Conference Room, 575 Dorset Street, South Burlington, Vermont. Members Present Paul Farrar, Chairman; Michael Flaherty, Howard Perkett, William Burgess. Member Absent Hugh Marvin Others Present William Szymanski, City Manager; David Minnich, Assistant City Manager; Richard Carter, Police Chief, Lance Reinholz, Police Negotiator; and Police Officers, Kevin Hayes, Thomas Fraga, Charles Balserus, Gregory Mitchell, Peter Lavallee. Meet with Police Union to continue review of contract Mr. Reinholz suggested we begin the evening at Article I and attempt to settle all differences this evening. In Article I, Section 4 and 5 as purposed by the Union, the City suggested the following wording to replace these sections. "The City agrees not to eliminate a bargaining unit position from the complement, defined as of the date of this agreement's signing. The Police Department may from time to time have under staffing on shifts." In Article II, Mr. Reinholz suggested dropping all the City's proposed language after the third paragraph. The City suggested replacing their latter paragraphs with: "In addition to the rights defined above the Union agrees that all rights and privileges previously enjoyed by the City will remain in effect." The South Burlington Police Officer's Association agreed. In Article IX, Section 15, Mr. Reinholz suggested accepting the Union's language. The difference has been whether all detectives or just bargaining unit members are included when determining weekly stipeds. The City agreed to the Union's original proposal of including only bargaining unit members. In Article X, the Union would agree to the City's proposal of 7% increase to the present base and longevity providing all SBPOA members are frozen at level 3, until the City and Union agree to an acceptable merit pay plan. Employees who have not passed their probationary period would be paid at level 1. The City agreed to this contract language. In Article X, Section 2, Mr. Reinholz suggested using the Union's original proposal for compensation while temporarily occupying a higher rank. The City agreed. In Article X, Section 3, Mr. Reinholz would drop SBPOA's request for additional vacation leave. In Article X, Section 4, Mr. Reinholz asked whether the ERT is active. The Chief of Police responded that it is not active because present members lack adequate training. Mr. Reinholz asked whether assignments to this team would be voluntary. The Chief replied that assignments would be voluntary to ERT as a team, but assignments to situations similar to what ERT was designed for would not be voluntary and would be handled, similar to assignments to other police functions. Mr. Reinholz asked whether motorcycle unit assignments are voluntary. The Chief stated they are. Mr. Reinholz said, SBPOA would drop all of Section 4. In Article X, Section 7, concerning compensation for performing police functions out of the City, Mr. Reinholz restated the Union's position of defining this to include only hazardous, life threating duty. When asked whether the Spring Fling in Burlington is hazardous duty, Mr. Hayes said it was. The City had problems with this section and suggested further review, next meeting. In Article XII, the City presented an alternative to how promotions and transfers would be made. The Union questioned what work performance meant. The Chief responded by stating it included the volume of work an officer preformed. The Union wanted to have more time to study this proposal. In Article XIII, Mr. Reinholz said the Union would agree to the City's language on Section 1Ah, which would be "1 revolver-357 Magnum". The City agreed to the Union's proposal in Section 1Bb and 1Bc for increasing the detectives uniform stipend by $50.00. The Union will drop their proposal in Section 7 and 8, which was for protective screens, take down and alley lights. The City has funds budgeted for these purposes in fiscal 1982-83. In Article XIV, Section 2, Mr. Reinholz proposed the language to be, "Court duty required on scheduled days off will be paid at the rate of one and one-half (1½) times the regular rate of pay for a minimum of three (3) hours, providing this court duty is not contiguous to regular scheduled duty". The City agreed.
