HomeMy WebLinkAboutMinutes - City Council - 06/06/1981CITY COUNCIL JUNE 6, 1981 The South Burlington City Council held a Special Meeting in the Mini-Conference Room of the City Hall on Dorset Street at 10:00 AM. on Saturday, June 6, 1981. MEMBERS PRESENT Paul Farrar, Martin Paulsen, William Burgess, Michael Flaherty. MEMBERS ABSENT John Towne. OTHERS PRESENT William Szymanski, City Manager; David Spitz, City Planner. Authorize Council Chairman to sign letter of stipulation on Mitel. Chairman Farrar opened the meeting at 10:00 AM, which was solely for the purpose of authorizing the Chairman to sign the agreement for maintaining agricultural land at the proposed Mitel Company site on Hinesburg Road. A copy of this agreement is attached. Chairman Farrar explained the agreement, which was the result of District Environmental hearings on the project. It provided for leasing and maintaining agricultural use on the unused portion of the site purchased by Mitel. Mr. Burgess made the motion to authorize the Chairman to sign the agreement. Mr. Flaherty seconded the motion. There was no discussion, all present were in favor. On motion by Mr. Paulsen and seconded by Mr. Burgess, the meeting was adjourned at 10:15 A.M. STATE OF VERMONT DISTRICT ENVIRONMENTAL COMMISSION 14 Re: Mite1 Semiconductor Division : Application Y4C0473 of Mite1 of Delaware, Inc. : South Burlington, Vt. 05401 : STIPULATION OF PARTIES The undersigned parties to this action herewith agree and stipulate as follows: 1. Mitel agrees that it will, in good faith, use its reasonable efforts to construct first in the portion of the Wright Farm Property, so-called, other than Areas A, C and D (as designated on Mitel's Exhibit 76) any expansion of its presently proposed 59,800 square foot facility (the subject of the present application) or any Mitel facility not an expansion of the present building. However, the parties recognize that substantial economic, business or engineering or like reasons may necessitate expansion into areas A, C and D prior to full use of the balance of the property. 2. Mitel will maintain the balance of the land (Areas A, C and D - Mitel Exhibit 76) under an agricultural lease, in accordance with the terms thereof, with said lease being in the form annexed as Exhibit A hereto, until such time as it may need the land for corporate expansion as set forth in Paragraph 1, above. 3. The parties further agree that various non-Mite1 needed easements, namely several sewer easements and the Swift Street extension easement, will not be activated until a special agricultural-open space study of the whole Southeast Quadrant and Winooski River area is developed by the City with input from the Vermont Department of Agriculture as part of the City's comprehensive planning process and as suggested on page 3 of South Burlington City Planner, David Spitz's June 1, 1981 letter to the District Environmental Commisaion 14. In agreeing to this stipulation the City understands that the Department of Agriculture will cooperate with other municipal- ities in Chittenden County in undertaking similar studies at the earliest possible date. ite el agrees that the study is necessary, and agrees to consider it in light of its economic and business needs at the time, in further submission as may be re- quired by law.
