HomeMy WebLinkAboutMinutes - City Council - 07/06/1981CITY COUNCIL July 6, 1981 The South Burlington City Council held a regular meeting on Monday, July 6, 1981 at 8:00 p.m. in the Conference Room, City Hall, 575 Dorset Street. Members Present Paul Farrar, Chairman; Michael Flaherty, John Towne, William Burgess Member Absent Martin Paulsen Others Present William Szymanski, City Manager; Margaret Picard, City Clerk; Pat Burgmeier, The Other Paper; Fred Chamness Minutes of June 15, 20 and 29, 1981 On page 5 of the June 15 minutes, under the discussion of the new municipal building, the figure should be $6500, not $65,000. Mr. Towne moved to approve the minutes of June 15, 20, and 29 as corrected. Mr. Flaherty seconded the motion and all voted for it. Disbursement orders Disbursement orders were signed. Review City Attorney's memorandum regarding a proposed Peddler's Ordinance Mr. Towne said it seemed that the city would have a difficult time preventing peddler's sales from taking place. Mr. Burgess felt the attorney was referring to individual peddlers, but he wondered whether, if the business were taking place on a lot which was zoned and approved for a certain use, perhaps the owner of the lot was responsible for having a multiple use. Mr. Flaherty added that any other business owner would request a multiple use permit from the city. Mr. Farrar felt that if a person habitually allowed this, the city could proceed and seek relief from the courts and he said he would discuss that with the city attorney. Review Planning and Zoning agendas There were no comments. Personnel Rules and Regulations The Council reviewed proposed language for vacation and termination policy sections. The language is contained in memos to the Council dated May 7 and May 15. Mr. Burgess moved to approve the language set forth for section 6.4 in the May 7, 1981 memo and for section 6.7 in the May 15, 1981 memo for inclusion in the Personnel Rules and Regulations. Mr. Towne seconded the motion and all voted for it. Meet as the Liquor Control Board Mr. Burgess moved to meet as the Liquor Control Board to consider three liquor licenses and to then reconvene as the City Council. Mr. Flaherty seconded the motion and it passed 4-0. Mr. Szymanski said there had originally been three licenses to consider, but that two were being held, on the recommendation of the fire chief, until their State inspections were complete. These two are the Getty station on Shelburne Road and a bar on Queen City Park Road. The third application is from Brothers Two. They have been before the Zoning Board and were granted permission to sell wine only, on. the condition that if they want to sell beer at a later date, they will return to the Board for permission. Mr. Flaherty moved to sign the liquor license for Brothers Two under the stipulations set forth by the Zoning Board. Mr. Burgess seconded the motion and it carried 4-0. Mr. Flaherty then moved to reconvene as the City Council, Mr. Burgess seconded and none opposed the motion. Consider going into executive session to discuss personnel matters regarding two city employees, applications for Assistant City Manager position and appointments to city boards and commissions Mr. Flaherty moved to go into executive session to consider personnel matters regarding two city employees, appointments to boards and commissions, the resolution of the police grievance and applications for the post of Assistant City Manager and to then reconvene as the City Council to make appointments to boards and commissions and perhaps rule on the police grievance. Mr. Burgess seconded the motion and it passed 4-0. At 8:35 p.m., Mr. Flaherty moved to reconvene in regular session, Mr. Burgess seconded the motion and all voted for it. Mr. Flaherty then moved to reappoint Sidney Poger to the Planning Commission for a 3 year term and Robert Walsh to the Planning Commission for a 4 year term. Mr. Burgess seconded the motion and all were in favor. Mr. Burgess moved to appoint Wayne Jameson for a 2 year term on the Regional Planning Commission as South Burlington's representative. Mr. Flaherty seconded the motion and all voted for it. Rule on Police Grievance Mr. Farrar said the question was one of interpretation of the contract as to whether a patrolman should have been called to fill in when one was not available, and it was a planned absence. The city attorney has submitted comments on the issue and the Council has heard evidence. Mr. Flaherty moved that the City Council finds that the weight of the evidence and the city attorney's opinion in this particular case do not support the grievance, and therefore, it is denied. Mr. Burgess seconded the motion and it carried unanimously. Other business Mr. Farrar said he would like to discuss the speed limit on Hinesburg Road and the advisability of having traffic lights on Shelburne Road operate in an on-off fashion on Sundays at the next meeting.
