Findins of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on October 19, 1998 by
application of Jeffrey Arel, for a conditional use approval to occupy 6800 square feet of an existing 13,600
square foot structure for automobile repair, d.b.a. Crash Auto Glass at 34 Commerce Avenue according to
plans submitted. The Board of Adjustment finds as follows:
1) Area zoned Industrial -Commercial Mixed District.
2) Section 15.20 requires conditional use approval by the Zoning Board of Adjustment.
3) Section 26.65 Multiple uses requires conditional use approval.
4) The building under consideration contains 13,600 square feet and will be divided into equal square
footage and occupied by two uses.
5) The lot contains 40,740 square feet and fronts on Commerce Avenue and Ethan Allen Drive.
6) The existing use being Kitchen World, Inc., and the proposed use Crash Auto Glass.
7) Traffic impacts should be less than previous tenant (long term parking).
8) No negative impact of municipal sewer and water.
9) General character of the area not adversely affected by the proposed use.
ORDER
The conditional use to occupy 34 Commerce Avenue with an automobile repair shop, d.b.a. Crash Auto
Glass, is hereby GRANTED
