HomeMy WebLinkAboutMinutes - City Council - 07/13/1979SPECIAL CITY COUNCIL MEETING WITH CITY CHARTER COMMITTEE JULY 13, 1979 The South Burlington City Council held a special meeting with the City Charter Committee on Friday, July 13, 1979 at 7:30 P.M. in the Conference Room, City Hall, 1175 Williston Road. Members Present Chairman Paul Farrar, Michael Flaherty and William Burgess Members Absent Martin Paulsen and Kenneth Jarvis City Charter Committee Members Present Chairman Wayne Jameson and Fred Maher City Charter Committee Members Absent Harold Nolting, Robert Irish, Dale Kleppinger and John Dinklage Others Present Nick Bogert and Allen Hamelin from WCAX-TV and one other unidentified person. Chairman Farrar called the meeting to order at 7:30 P.M. with the Pledge of Allegiance to the Flag. He then, said that the only item of business that the chair was aware of was discussion of the City Charter Committee's recommendations in regard to the budget surplus, what method to use in order to return the Grand List surplus to the taxpayers, and to sign the warning. He asked if there were any additions to the agenda and it was agreed by all not to add to the agenda. Chairman Farrar explained that the City Attorney had prepared two resolutions and two notices of public hearing for the Council's consideration. The main difference in the warnings, he said, was that the one numbered "1" would refund any surplus to the taxpayer if the Grand List resulted in more than a 3% increase over the estimated Grand List. The one numbered "2" would refund any surplus over a 3%. increase in the estimated Grand List. City Charter Committee Chairman Wayne Jameson added to the explanation saying the Committee wanted to be sure that a Charter Change would not have to go before the people if the surplus was less than 3%. Chairman Farrar agreed, saying that a small surplus was not a problem, and then he asked for a motion. Mr. Burgess made a motion to adopt Resolution #1 as presented. Mr. Flaherty seconded the motion. There was a short discussion and Chairman Farrar called for a vote which was unanimous in favor of the motion. After a short discussion it was unanimously agreed to set the date for a public hearing for Monday, August 20, 1979 and for the election on Tuesday, September 11, 1979. Chairman Farrar then read the Proposed Amendment to the Charter of the City of South Burlington in full as follows: Chapter 13, Section 1309 shall be amended by adding the following subsection: "1309.8 Refund of Surplus Tax Revenues Should the actual Grand List, filed with the City Clerk prior to the grievance hearings, be more than three (3%) percent higher than the estimated Grand List as furnished by the Department of Assessment in accordance with Section 1309.4. the City Council shall compute the resulting surplus and refund said surplus by equally crediting each taxpayer's remaining installments for the balance of the fiscal year. Actions under this subsection shall not affect the budget limitations for the following year as set forth in Section 1309. Such limits shall be computed using the estimated Grand List for each year, and the tax rates based upon the operating budgets and estimated Grand List or the maximum allowable tax rates, prior to any vote, whichever are less."
