HomeMy WebLinkAboutMinutes - City Council - 09/11/1978CITY COUNCIL & PLANNING COMMISSION SEPTEMBER 11, 1978 JOINT MEETING (SPECIAL) The South Burlington City Council and the City Planning Commission held a special joint meeting on Monday, September 11, 1978 at 7:30 P.M. in the Conference Room, 1175 Williston Road, South Burlington, Vermont. Members Present City Council: Paul Farrar, Chairman: Michael Flaherty, William Burgess, Kenneth Jarvis. Planning Commission: Ernest Levesque, Vice-Chairman: W. Kirk Woolery, George Mona, James Draper, James Ewing Members Absent City Council: Martin Paulsen Planning Commission: Sidney Poger, Peter Jacob. Others Present William Szymanski, City Manager; James Goddette, Stephen Page, John C. Fitzpatrick, Sterling Emerson, Catherine Neubert. Minutes of September 5, 1978 Not acted upon. Sign Disbursement Orders None Pending Litigation: Red Coach Inn City Attorney Richard Spokes stated that due to the pending litigation, which is scheduled for trial tomorrow, September 12, 1978, that any discussion should be held in executive session. Mr. Flaherty made the motion that the Council and Planning Commission go into executive session to discuss the litigation with the City Attorney. The motion was seconded by Willism Burgess. All members were in favor. Regular session reconvened at 8:00 P.M. Kirk Woolery made the following motion: That the applicant Edward Smith, represented by Attorney Peter Collins, for the subdivision of a parcel of land that includes the Howard Johnson Motel & Restaurant denied at the Planning Commission meeting of June 6, 1978 is now within the standards established by the commission as to the level of traffic service at the newly reconstructed intersection of Dorset Street and Williston Road and that the City Council instruct the City Attorney to settle the pending litigation. It was seconded by Planning Commission Member George Mona. No discussion followed. All Planning Commission Members present were in favor. Councilman Flaherty made a motion that the City Council accept the Planning Commission recommendations, which are that the City Attorney settle the litigation. The settlement to include: (1) That all conditions set by the Planning Commission in the site plan review be adhered to. (2) That an agreement acceptable to the City Attorney be drafted, which will include the stipulation that a restaurant comparable to the standards of the Red Coach Inn be built. (3) That the proposed restaurant be substantially completed by June, 1980. The motion was seconded by Councilman Kenneth Jarvis. No discussion followed. All the Council were in favor. General Discussion with the Planning Commission The first item discussed was the property at the corner of the intersection of White Street & Williston Road, the so called Perlman property. The site plan for the use of the property was disapproved by the Planning Commission on August 22, 1978. Attorney John Fitzpatrick, representing the owners, described the history of the problem, stating that the property has been offered to the City for purchase and that the owners were frustrated by the denial for the use of the property. He said that the City should remove the property from the tax rolls if use by the owner is denied. Chairman Farrar stated that when the offer for purchase of the property was made to the City, it was too short a period of time for the city to pursue and acquire. Jim Ewing of the Planning Commission asked if Urban Systems funds could be used to acquire this property. Chairman Farrar said that it would probably be five years before this came about. Planner Steve Page said that action, in this matter, must be quick because the appeal period is almost up. The Attorney John Fitzpatrick was requested to check with his client to see if the property can be reoffered for purchase by the City, and if so can the offer time be for a period that would give the City sufficient time to go to the voters for a bond issue, preferably at a scheduled election, such as the regular meeting in May. Jim Ewing brought up the southern connector extension through South Burlington as to any preference the City Council might have as to the construction route. He questioned Whether the Council had any preference to building the road on the east or west side of the railroad track. The Council requested more data as to the cost of road construction and rights-of-way from the State Highway Department, before any preference is made. George Mona brought up the capital budget, as to time projections, five years versus ten years. A short discussion followed. It was decided that another joint meeting be held on September 19, 1978 at 7:30 P.M. (Tuesday) in the Conference Room at City Hall.
