CITY COUNCIL - PLANNING COMMISSION JOINT MEETING MARCH 16, 1978 The City Council and Planning Commission of South Burlington held a joint meeting on Thursday, March 16, 1978 at 8:30 p.m. in the Conference Room, City Hall, 1175 Williston Road Members Present Paul Farrar, Chairman, City Council; Frank Armstrong, Michael Flaherty, William Burgess, Martin Paulsen, William Wessel, Chairman, Planning Commission; Sidney Poger, David Morency, Kirk Woolery (late) Members Absent Ernest Levesque, George Mona, James Ewing Others Present William Szymanski, City Manager; Stephen Page, Planner; Richard Spokes, City Attorney Discussion of on site sewer policy Mr. Farrar asked Mr. Spokes whether a blanket prohibition on site sewers in the city in areas served by municipal sewers which are filled to capacity was a reasonable way to proceed and Mr. Spokes replied that he had looked at the ordinances and that he did not see anything that would let the city take that stand. He said that cases should be looked at on a case-by-case basis. There was further discussion on the question of prohibiting on site sewers. Mr. Poger said that the Commission did not wish to see on site sewers in areas served but without capacity in municipal sewer lines. Mr. Morency said that the Commission had the authority to phase developments and he asked if they could phase until after the sewer plant was built. He was told that would probably be OK. Mr. Wessel asked what the Council and Attorney wanted to do about handing out sewer capacity between now and when the expanded plant comes on line. If people are put in line, in two years, their approved plans may not be what the city wants. Mr. Spokes said that would have to be forecasted. Mr. Page pointed out that the Commission had decided to have a priority list for sewer capacity based on the date of action on a completed preliminary plan. Mr. Poger asked whether, when the plant was finished, the Commission could give out only a certain amount of capacity a year and was told that it could be done but would take a lot of work to put it in the ordinances. At this point, Mr. Woolery came in. The Council discussed factors other than sewer capacity which tended to put limits on growth. Mr. Spokes discussed several unrelated items. Mr. Wessel asked if, if it got to the point where a development could have on site sewers on nothing, would the Council like the Commission to consider on site sewers or not. Mr. Armstrong said no. Mr. Paulsen said yes, if they could meet state standards, which he felt were stringent. Mr. Burgess said yes, if there was no objection to the system itself, and Mr. Flaherty said no, because it robbed the Commission of its planning function. Mr. Farrar said that he would not like to see residential units with on site sewer systems unless a new plant was not going to open at all. Resolution warning interim zoning hearing Mr. Flaherty moved to sign the resolution that warns the interim zoning hearing on April 10, 1978. The motion was seconded by Mr. Paulsen and passed unanimously. Salary Review Board recommendations Mr. Flaherty moved to officially approve the recommendations of the Salary Review Board.
