CITY COUNCIL MINUTES SPECIAL MEETING AUGUST 12 1978 The South Burlington City Council held a special meeting on Saturday, August 12, 1978, at the City Hall, 1175 Williston Road, South Burlington. Members Present Paul Farrar, Chairman; Michael Flaherty, William Burgess. Members Absent Martin Paulsen and Kenneth Jarvis. Others Present William J. Szymanski, City Manager; Richard Spokes, City Attorney. Chairman Farrar opened the meeting at 8:30 A.M. Mr. Spokes stated that he had reviewed the Petition for Enactment of Ordinance, submitted pursuant to Sec. 506 of the City Charter. He indicated that he had no difficulty with the proposed language of the Ordinance, but suggested that a section be added which would provide for the deletion of Section 14 (d) of the present sign ordinance. This recommendation was based upon inconsistencies between the proposed changes to Section 14 (c) and the present Section 14 (d). Mr. Spokes also stated that from a general standpoint, he had some reservations whether the City had expressed enabling authority to phrase out non-conforming signs by use of an amortization schedule. In spite of this reservation, the City Attorney suggested that the Council proceed with a special city meeting for two reasons. The first is that Section 506 (b) of the City Charter does not permit the City Attorney to materially change the meaning and effect of the petitioned ordinance. The second reason is that the present sign ordinance requires non-conforming signs to be taken down within (5) five years of the original adoption of the ordinance. If anything, the proposed amendment offers more legal sanctity to the amortization requirement than the present ordinance does. Mr. Spokes advised the Council that he would submit a formal written opinion on the subject which hopefully would be available for the Council meeting scheduled for Monday, August 21, 1978. Upon motion by Mr. Flaherty and seconded by Mr. Burgess, it was: "RESOLVED, that the Council sign the Warning drafted by the City Attorney for a Special Meeting to be held on September 12, 1978."
