32 of the Ethan Allen Farms Industrial Subdivision. The project involves construction of a
10,000 sf building and outside storage area. The proposed building will have approximately 900
SF of office space with the remainder being warehouse. This project is currently on the June 8t"
Planning Commission agenda.
In addition to Site Plan approval, we are requesting sewer allocation of 300 GPD for this
project. This is based upon a maximum of 20 employees at 15 GPD/employee as required by
the Environmental Protection Rules.

& Joyce Belter. This property is served by the Airport Parkway Wastewater Treatment Facility
which has sufficient capacity to handle this additional demand.

32 of the Ethan Allen Farms Industrial Subdivision. The project involves construction of a
10,000 sf building and outside storage area. This project is currently on the June 81h Planning
Commission agenda.
When this project was originally approved, sewage and water allocation was granted by
the City to the serve the commercial lots. State Subdivision Permit EC-4-1183-1 (see enclosed)
approved the subdivision and municipal sewage allocation for Phase Ill. Lot: 31 & 32 were
included in this Subdivision approval. The Commerce Avenue, including the municipal water
system and sewage collection system were constructed by John Belter to serve then: lots.
We are currently applying for a Water Supply and Wastewater Disposal Permit for the
proposed building on Lots 31 & 32. The Regional Engineer has requested a letter from the City
stating their ability to provide water and sewer service for this project even though allocation
was previously granted. An updated letter is necessary to verify that this allocation is still
available and has not been rescinded.
We are requesting that you provide a letter confirming that this allocation is still
available. We understand that sewer allocation is usually granted by the Planning Commission.
However, in this case the capacity has already been granted. In addition, with the Planning
Commission review of this project scheduled for June, combined with the State review time, this
project may not be able to be constructed this year.

We are writing on behalf of SAME -VT, LLC (c/o Sheldon Nierman) regarding
development of Lots 31 & 32 of the Ethan Allen Farms Industrial Subdivision. The 1.85 acre
site is located on the southerly side of Commerce Avenue. We are requesting your review of the
enclosed application and plans, and placement on the agenda for Site Plan review before the
Planning Commission.
The project is located within the Mixed Industrial and Commercial District (IC). The
project proposes a 10,000 sf building for use as a warehouse and distribution facility, including
wholesale activity. The rear portion of the project site will be used for outside storage of
materials. A 8 feet high chain link fence is proposed around the perimeter of the storage area.
As discussed with Ray Belair, webbing within the chain link fence will be used for screening
purposes. In addition, landscaping around the perimeter of the building and storage area will
also provide screening.
The project will be served by the existing municipal water and sewer systems located
along Commerce Avenue. There are no manufacturing or industrial processes proposed with
this project. The project will also connect to the existing stormwater collection system located
along Commerce Avenue, as well as an existing catchbasin located near the rear of the site. A
single curb cut off Commerce Avenue will provide access to the site. The second existing curb
cut located in front of the proposed building will be closed.
Exterior lighting is proposed for security purposes. Lighting will be 70 watt metal halide
building mounted fixtures located along the westerly side of the building. Cut sheets for a
typical cutoff fixture are attached. Areas along the northerly and westerly sides of the parking
area will be used for snow storage. A bike rack has been shown in the paved area between the
parking spaces and building.

We understand that a lot merger agreement will be required prior to obtaining a zoning
permit. This will be coordinated between the City attorney and the applicant's attorney
following Site Plan review.

This project consists of the construction of a 10,000 square foot warehouse & distribution facility
including outside storage.
This property located at 19 - 25 Commerce Avenue lies within the IC District. It is bounded on the
north by Commerce Avenue, on the east and west by industrial buildings, and on the south by
undeveloped land.
Access/circulation: Access is proposed to be via a 24 foot curb cut on Commerce Avenue.
Circulation on the site is adequate.
Coverage/setbacks: Building coverage is 12.4% (maximum allowed is 30%). Overall coverage is
69.5% (maximum allowed is 70%). Front yard coverage is 10.1% (maximum allowed is 30%).
Setback requirements are met.
Parking: A total of six (6) spaces are required and 30 spaces including one (1) handicapped space and 4't'r
a bike rack are provided. The plan should be revised to add one (1) additional handicapped space.

Landscaping_ The minimum landscaping requirement based on building costs, is $7200 which is being
met. Proposed landscaping includes Red Maple, Honeylocust, Red Oak, Dogwood, Serviceberry,
Spirea, Cedar, Arrowwood and Crabapple.
Sewer: The sewer allocation requested is 300 gpd. The applicant shall be required to pay the per `
gallon fee prior to permit issuance.
Lot merger: The applicant is proposing to construct this facility on two (2) contiguous lots (lots #31
and 32). Prior to issuance of a permit, the applicant should record a lot merger agreement approved f5 ,
by the City Attorney which merges these two (2) lots.
Traffic: The subdivision approval from which this lot was created required a traffic impact fee of $880
per lot. The applicant should be aware that the traffic impact fee is $1760.
Sidewalk: The subdivision approval which included this lot required that the developer either
contribute $15 per linear foot frontage or build the sidewalk along the frontage. Staff recommends

We are writing on behalf of SAME -VT, LLC (c/o Sheldon Nierman) regarding
development of Lots 31 & 32 of the Ethan Allen Farms Industrial Subdivision. The 1.85 acre
site is located on the southerly side of Commerce Avenue. We are requesting your review of the
enclosed application and plans, and placement on the agenda for Site Plan review before the
Planning Commission.
The project is located within the Mixed Industrial and Commercial District (IC). The
project proposes a 10,000 sf building for use as a warehouse and distribution facility, including
wholesale activity. The rear portion of the project site will be used for outside storage of
materials. A 8 feet high chain link fence is proposed around the perimeter of the storage area.
As discussed with Ray Belair, webbing within the chain link fence will be used for screening
purposes. In addition, landscaping around the perimeter of the building and storage area will
also provide screening.
The project will be served by the existing municipal water and sewer systems located
along Commerce Avenue. There are no manufacturing or industrial processes proposed with
this project. The project will also connect to the existing stormwater collection system located
along Commerce Avenue, as well as an existing catchbasin located near the rear of the site. A
single curb cut off Commerce Avenue will provide access to the site. The second existing curb
cut located in front of the proposed building will be closed.
Exterior lighting is proposed for security purposes. Lighting will be 70 watt metal halide
building mounted fixtures located along the westerly side of the building. Cut sheets for a
typical cutoff fixture are attached. Areas along the northerly and westerly sides of the parking
area will be used for snow storage. A bike rack has been shown in the paved area between the
parking spaces and building.

WHEREAS, a condition of the site plan approval is that Lot
31 and 32 be legally merged for purposes of south Burlington
Municipal Land Use ordinances, and that a Lot Merger Agreement be
executed and recorded in the South Burlington Land Records prior
to the issuance of a zoning permit to construct the approved
improvements.
NOW, THEREFORE, in consideration of the city of south
Burlington issuing a zoning permit under its zoning Regulations
for development of the two above -described parcels of land as a
single parcel by SAME -VT, LLC, the parties hereto agree as
follows:
1. From the date of this instrument, Lots 31 and 32, as
described herein shall constitute a single lot for purposes of
compliance with the City of South Burlington zoning Regulations
and Subdivision Regulations, which may not be conveyed
separately, or otherwise subdivided, without the express written
approval of the south Burlington planning Commission.
2. This Lot Merger Agreement shall be binding upon the parties
hereto, their successors and assigns, and shall run with the

District #4 Environmental Commission hereby issues Land Use Permit Amendment 4C0643-16,
pursuant to the authority vested in it by 10 V.S.A., §§ 6001-6092. This permit amendment applies to the
lands identified in Book 148, Pages 225, of the land records of the Town of South Burlington, Vermont,
as the subject of a deed to John & Joyce Belter and subject to a purchase and sales agreement with
SAME -VT, LLC, the Permittees as Grantees.
This permit specifically authorizes the Permittees to construct a 10,000 square foot warehouse on
lots 31 & 32 of the Ethan Allen Farms industrial subdivision to be served by municipal water,
sewer, and storm drainage systems..
The proposed project is part of a previously approved commercial subdivision approved in Land Use
Permit #4C0643 and is located in Phase III consisting of lots 22-42 approved in Land Use Permit
#4C0643-4.
The project is subject to Act 250 jurisdiction because the project involves the construction of
improvements for a commercial purpose on more than ten acres and thus constitutes "development"
pursuant to 10 V.S.A. § 6001(3) and Environmental Board Rule 2(A)(2), and the project is a material
change to a development over which the Commission has jurisdiction and thus constitutes "development"
pursuant to Environmental Board Rule 2(A)(5).
The Permittees, and their assigns and successors in interest, are obligated by this permit to complete,
operate and maintain the project as approved by the District Commission in accordance with the
following conditions:
All conditions of Land Use Permit 4C0643 and amendments are in full force and effect except as
amended herein.
2. By acceptance of this permit, the Permittees agree to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose of
ascertaining compliance with Vermont environmental and health statutes and regulations and
with this permit.

The project shall be completed, operated and maintained in accordance with: (a) the plans and
exhibits on file with the District Environmental Commission; and (b) the conditions of this
permit.
4. The approved plans are:

Sheet 2 - "Typical Details & Specifications - Roads, Water, Storm & Sewer", dated 4/1/99, last
revision 5/11/99

No changes shall be made in the design or use of this project without the written approval of the
District Coordinator or the Commission, whichever is appropriate under the Environmental
Board Rules.
6. The District Environmental Commission maintains continuing jurisdiction during the lifetime of
the permit and may periodically require that the permit holder file an affidavit certifying that the
project is being completed, operated and maintained in accordance with the terms of the permit,
as provided by 10 V.S.A., Chapter 151 and the rules of the Environmental Board.
7. By acceptance of the conditions of this permit without appeal, the Permittees confirm and agree
that the conditions of this permit shall run with the land and the land uses herein permitted, and
will be binding upon and enforceable against the Permittees and all assigns and successors in
interest.
The project is approved for the following maximum impacts:
30 - vehicle parking spaces (134 spaces remaining in phase III);
900 - gallons per day of wastewater (4835 GPD remaining in phase III);
100 - vehicle trips per day (918 vehicle trips remaining in phase III);
12 - AM peak hour vehicle trips (74 AM peak hour trips remaining in phase III); and
12 - PM peak hour vehicle trips (90 PM peak hour trips remaining in phase III)
This permit hereby incorporates all of the conditions of the Water Supply and Wastewater
Disposal Permit #WW-4-1290 issued on June 16, 1999 by the Regional Engineer, Wastewater
Management Division, Agency of Natural Resources.
10. The building approved herein is not approved for any manufacturing use or the on -site disposal
of any process wastes. The Permittees shall apply and receive amended approval from the
District Commission for any change in the use of the buildings which involves the storage or
handling of any regulated substances or the generation of hazardous wastes.
11. There shall be no floor drains installed within the building without first acquiring the required
Underground Injection Control Permit from the Water Quality Division of the Agency of Natural
Resources or approval from the Wastewater Management Division for discharge into the
municipal wastewater disposal system.
12. The Permittees and all subsequent owners or lessees shall install and maintain only low -flow
plumbing fixtures in any buildings. Any failed water conservation measures shall be promptly

replaced with products of equal or better performance.
13. The Permittees shall comply with Sheets 1 and 2, and Exhibit #5 for erosion control. The
Permittees shall prevent the transport of any sediment beyond that area necessary for
construction approved herein. All erosion control devices shall be inspected after each rainfall
event, periodically cleaned as necessary, repaired promptly, and maintained until vegetation is
permanently established on all slopes and disturbed areas. Sediment deposits shall be removed
when they reach approximately one-half the height of the hay bale or silt fence barrier.
Removed sediments shall be disposed in a stable upland area. The Commission reserves the
right to schedule hearings and site inspections to review erosion control and to evaluate and
impose additional conditions with respect to erosion control as it deems necessary.
14. All mulch, hay bales, siltation dams, water bars and other temporary devices shall be installed
immediately upon grading and shall be maintained until all roads are permanently surfaced and
all permanent vegetation is established on all slopes and disturbed areas. Hay bales shall be
incorporated four inches into the soil and equipped with filter fence on the upstream side, butted
together and all joints filled with loose hay. Topsoil stockpiles shall have the exposed earth
completely mulched and have siltation checks around the base.
15. All disturbed areas of the site shall be stabilized, seeded and mulched from October 1 to April
15. No earth disturbance is permitted during this period regardless of whether final grading has
been finished unless it conforms with the "Winter Construction" standards and specifications of
the Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites., and if the
following winter erosion controls are added to the approved controls:
a. Oat seeds shall be substituted for any other annual grass seeds.
b. All exposed earth shall be mulched with 6 inches of hay or straw. Slopes over 5% shall
have an additional covering of staked jute mat or its equivalent.
c. Snow shall be removed from exposed earth before seeding and mulching.
16. The new grassed swale shall be installed in accordance with the detail provided on Sheet 2 and
protected from erosion as required in conditions 13, 14 and 15, above.
17. The Permittees shall apply and maintain calcium chloride and/or water on all roadways or
disturbed areas within the project during construction and until pavement and/or vegetation is
fully established to control dust.
18. In addition to conformance with all erosion control conditions, the permittees shall not cause,
permit or allow the discharge of waste material into any surface waters. Compliance with the
requirements of this condition does not absolve the permittees from compliance with 10 V.S.A.,
Chapter 47, Vermont's Water Pollution Control Law.
19. All stumps shall be disposed of on -site above the seasonal high water table or at a State approved

20. The Permittees and all assigns and successors in interest shall continually maintain the
landscaping as shown on Sheet 1 by replacing any dead or diseased plantings within the season
or as soon as possible after the ground thaws, whichever is sooner.

21. The installation of exterior light fixtures is limited to those as shown on Sheet 1 and in Exhibit
#8. All exterior lighting shall be installed or shielded in such a manner as to conceal light
sources and reflector surfaces from view beyond the perimeter of the area to be illuminated.
22. The building mounted sign shall not exceed the dimensions shown in Exhibit #9. The Permittees
shall not erect additional exterior signage without first obtaining approval from the District
Commission.
23. The installation and/or use of electric resistance space heat is specifically prohibited without the
prior written approval of the District Environmental Commission.
24. The project shall conform with the Vermont Consolidated Act 250 Energy Guidelines for
Typical Commercial and Industrial Buildings promulgated by the Vermont Department of Public
Service. In addition to meeting the above referenced guidelines, the applicant shall incorporate
any additional energy efficiency measures that are determined by custom analysis to be cost
effective for the project.
25. No further subdivision, alteration, and/or development of any parcel of land approved herein
shall be permitted without the written approval of the District Commission.
26. A copy of this permit and approved plans shall be on the site at all times throughout the
construction process.
27. The Permittees shall reference the requirements and conditions imposed by Land Use Permit
#4C0643-16 in all deeds and leases.
28. Pursuant to 10 V.S.A. § 6090(b), this permit amendment is hereby issued for an indefinite term,
as long as there is compliance with the conditions herein.
29. Notwithstanding any other provision herein, this permit shall expire three years from the date of
issuance if the permittees have not commenced construction and made substantial progress
toward completion within the three year period in accordance with 10 V.S.A. § 6091(b).
30. All site work, building construction and landscape installation shall be completed in accordance
with the approved plans within two (2) years from the date of this permit, unless an extension of
this date is approved in writing by the Commission. Such requests to extend must be filed prior
to the deadline and approval may be granted without public hearing.
31. Failure to comply with all of the above conditions may be grounds for permit revocation
pursuant to 10 V.S.A., § 6090(b).

2. The project shall be completed as shown on the plans proj. no. 99036, sht. no. 1 "Site
Plan" dated 4-1-99 prepared by Lamoureux & Dickinson Consulting Engineers, Inc.
which have been stamped "approved" by the Wastewater Management Division. The
project shall not deviate from the approved plans without prior written approval from the
Wastewater Management Division.
3. No alterations to the building that would change or affect the exterior water supply or sewage
disposal, or the approved use of the building shall be allowed without prior review and
approval from the Agency of Natural Resources.
4. The Wastewater Management Division now reviews the sewage and water systems for public
buildings under 10 V.S.A., Chapter 61 - Water Supply and Wastewater Disposal Permit.
5. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations,
with this permit.

as modified or amended herein.

WATER SUPPLY
The project is approved for water supply by connection to the municipal water system
depicted on the stamped plans. No other means of obtaining potable water shall be allowed
without prior review and approval by the Wastewater Management Division.
9. The connection of a sprinkler fire suppression system to a public drinking water system shall
require the installation and maintenance of backflow prevention devices which conform to
the standards of the Department of Labor & Industry.
SEWAGE DISPOSAL
10. The project is approved for wastewater disposal by connection to the municipal sewer system
as depicted on the stamped plans for a maximum of 300 gallons of sewage per day. No other
method of wastewater disposal shall be allowed without prior review and approval by the
Wastewater Management Division, and such approval will not be granted unless the proposal
conforms to the applicable laws and regulations.

Please enter the appearance of the Agency of Natural Resources ("Agency"), State of
Vermont, by and through its attorney, Jon Groveman, Esq., in the above -captioned
matter.
Criterion 1(B) -WASTE DISPOSAL
Carol Carpenter, Environmental Engineer, with the Wastewater Management Division
(WWMD) of the Department of Environmental Conservation has reviewed the
application and communicated with the applicant's consultant. Ms. Carpenter
requested a letter from the applicant demonstrating compliance with existing permit
#1-0621 as well as a maintenance report (an annual requirement of the permit). No
LUP should be issued for this project until the Agency has received a compliance letter
and the required maintenance report.
In addition, Sherri Kasten with the Waste Management Division of the Department of
Environmental Conservation has reviewed the application and reports that Section 7-
104(a) of the Vermont Hazardous Waste Management Regulations specifies that "Any
person who generates or transports hazardous waste ... shall notify the Secretary of
such activity." Notification is also required of facilities that manage
used oil. The above -listed facility will therefore need to notify as a hazardous waste
handler if used oil or any hazardous wastes are/will be generated from on -site
operations (e.g., vehicle service or machine maintenance wastes, tank bottoms, etc.)
and if a notification hasn't yet been made. There is no fee involved with this notification
requirement. The applicant may contact Sherri Kasten by electronic mail at
sherrik dec.anr.state.vt.us or by telephone at 241-3867 for more information and to
request a copy of the required form.

consisting of 244 residential units and an 18 hole golf course. We have been including the

maximum density of 540 units (450 acres x 1.2 units/acre), 244 units have been approved to
date. Based on the recent opinion from the City Attorney regarding interpretation of Section
6.601, we should separate out the land devoted to the golf course use and then multiply the
remaining acreage devoted to residential use by the maximum residential density. This
method yields a maximum allowable residential density of 198 units (165.2 acres x 1.2
units/acre). Again, we have approve 244 units. The Commission is considering a zoning
amendment to allow those nonresidential uses that are currently allowed in the SEQ zoning
district to be part of a PRD. This would allow the City to base the maximum density on the
entire golf course property. Until such time as this amendment is effective, the Commission
could not approve additional density proposed by this project.

Craig Leiner said he is not sure the trip generation method
used was the best. He has other concerns that the rates are
as much as half the ITE rates. Mrs. Lafleur suggested the
Planning Commission not necessarily agree with the proposed
improvements but that the City Engineer, Craig Leiner, and
the applicant and his traffic consultant get together and
come up with a list of improvements and associated costs.
The developer would then pay a share of these improvements
based on the traffic he is adding to the probelm. Mrs. Maher
suggested the Commission review the project every few years
to see what is happening.
Mr. Sutton of Shamrock Rd. opposed the project on the grounds
of the dangerous traffic situation. He said on weekends, Air
Guard traffic is so heavy they can't get in or out of their
driveway. At least 3 people hit the pole last winter, and
there have been many other serious accidents. It is one of
the most dangerous intersections in the city. He felt that
concessions should not be made at the risk of people's lives.
Mr. Audette said he needed to know what will happen soon so

Mrs. Hurd moved that the Planning Commission approve the
final plat of John H. Belter,Jr, for a 21 lot industrial -com-
mercial subdivision as depicted on a 10 page set of plans en-
titled "Ethan Allen Farms Industrial Subdivision, Phase 3,
lots 22-42" prepared �2y Fitzpatrick -Llewellyn, dated February
1987, stamp dated August 5,_ 1987 with the following stipula-
tions:
1. A landscaping bond for street trees in an amount deter-
mined by the City Planner shall be posted prior to any con-
struction. A suitable street tree shall be substituted for
the Ash. All trees shall be at least 2-1/2 inch caliper, not
2 inch.
2. A bond shall be posted for streets prior to construction.
The amount shall be determined by the City Engineer.
3. The following changes shall be made to the plan within 90

days prior to beginning of road construction. Upon comple-
tion of the work, the architect and/or engineer shall certify
that the work is in conformance with the approved plan, stip-
ulations and any other requirements and/or changes that the
City requests.
6. The existing trees along Shamrock Road bordering lot #41
for a depth of 15 feet shall not be removed.
7. The private drive serving lots 39 and 40 shall be 24 feet
wide within a 50 foot right of way. This shall be shown on
the plans.
8. A sewer allocation of 6,000 god is made for the 20 lots.
The $2.50 per ag llon fee shall be paid prior to permit. No
construction can occur on lots 29 through 41 until capacity
is available at the Airport Parkway Treatment Plant. It
shall be the responsibility of the developer to see to it
that lots 23-28 with on -site sews a disposal hook into the
sewer s stem when it is completed_. Prior to approval on
29-41, the pump station shall be in.
9. A plan detailing the location of gas, telephone, elec-
tricity, TV cable and street li hts shall be submitted for
review and approval.
10. Water fittings shall be wrapped with polyethylene where
concrete thrust blocks are used.
11. Trees shall be planted at least 5 feet from the water
main. r
12. Depth of topsoil replacement (4 inches) should be noted
on typical detail on page 8.
13. The applicant shall be responsible for paying a share of
the required improvements to the intersection or other
solutions to traffic and safelly problems based on the trips

generated by these industrial lots. The total cost and scope
Of improvements shall be established 1?y the City Engineer in
consultation with the Street Supervisor, City Planner, and
the Regional Planning Commission Traffic Engineer. The share

the Regional Planning Traffic Engineer.
14. The developer shall have the option of contributing $15
per linear frontage foot toward the city sidewalk fund or
building a sidewalk along his frontage on the unnamed new
city street.
15. It is the applicant's responsibility to record the
corrected final plat with the City Clerk within 90 days or
this approval is null and void. They shall be approved
the City Planner and signed �2y the Chairman or Clerk of the
Commission prior to recording.

5. Site plan application of Orchard Lake Road Properties for
construction of -a 96,200 sq. ft. building for light manu-
facturing on the 80 acre ap rcel south of Lane Press, 1020
Hinesburg Rd.
Dick Trudell explained the development is on the former Semi -
con property bounded by the Interstate and Hinesburg Rd. It
was subdivided from the Lane Press property. An agreement
exists between Semicon and Orchard Lake Properties for an
easement.
Peter Pollak, president of the company, said they manufacture
high precision electrical equipment. It is a clean industry
with no oils, no pcb's. They make their own electric current
boards. 90% of their work is custom -build. They employ
about 100 people now and plan to hire 75 new employees for
this facility. These are mainly skilled jobs. Their
ultimate aim is to locate the parent company here.
The building will be south of Lane Press with access off the
Lane Press road. the Sewer will connect through an easement
to the pump station. The building will be completely sprink-
lered. 160 parking spaces are provided.
Mr. Trudell explained there will be a 3-foot berm around 1
side of the building with some screening from the Interstate.
He said it is not their intention to hide the building but to

We are writing on behalf of SAMENT, LLC in regards to the development of Lots ,3 I &
32 of the Ethan Allen Farms Industrial Subdivision. The project involves construction of a•
10,000 sf building and outside storage area. This project is currently on the June 81 Planning
Commission agenda.
When this project was originally approved, sewage and water allocation was granted by
the City to the serve the commercial lots. State Subdivision Permit EC-4-1183-1 (see enclosed)
approved the subdivision and municipal sewage allocation for Phase III. Lots 31 & 32 were
included in this Subdivision approval. The Commerce Avenue, including the municipal water
system and sewage collection system were constructed by John Better to serve these lots.
We are currently applying for a Water Supply and Wastewater Disposal Permit for the
proposed building on Lots 31 & 32. The Regional Engineer has requested a letter from the City
stating their ability to provide water and sewer service for this project even though allocation
was previously granted. An updated letter is necessary to verify that this allocation is still
available and has not been rescinded.
We are requesting that you provide a letter confirming that this allocation is still
available. We understand that sewer allocation is usually granted by the Planning Commission.
However, in this case the capacity has already been granted In addition, with the Planning
Commission review of this project scheduled for June, combined with the State review time, this
project may not be able to be constructed this year.

WATER SUPPLY
(0) The project is approved for water supply by construction and
utilisation of the municipal water service depicted on the
approved plans. No other means of obtaining potable water
shall be allowed without prior review and approval by tba

SEWAGE DISPOSAL

Dear Mr. Rowe:
We have reviewed the proposed site plan for Lots 31 & 32 of the Ethan Allen Farms Industrial
Subdivision. There are several concerns that we need to address.
The VELCO circuit passing through this site is 115,000 volts. Safe approach distance with any piece of
equipment is 15 feet from any conductor, either from below or from any side. This will limit the type of
material handling equipment that can be used in the storage area.
The height of any stored material must not exceed 14 feet above the pavement.
The fence must be properly grounded, The National Electric Safety Code, (ANSI Std C2), Section 92E
describes the frequency of grounding points for the fence fabric. At a minimum there should be a ground
rod driven near each fence corner, and a 02 copper wire run in a continuous loop about 30" outside the
fence perimeter tying the ground rods together, with branches up the fence fabric as appropriate. I would
like to see, and approve of, a plan showing this grounding system.
Due to the critical nature of our transmission circuits, we must maintain access to our structures at all
times. Since one of our structures will be within the enclosure, we will need to have a VELCO Iock on the
access gate to insure our ability to reach the structure. In addition, a clear path to the structure must be
maintained_ Also, a phone number for after hours emergencies would be very desirable. This number
would be available to our system operators and line personnel.
Our approval for this development is contingent upon the owners recognition of our requirements, and his
concurrence -in writing- that he will construct and operate the facility accordingly.

19-25 Commerce Avenue, as depicted on a two page set of plans, page one entitled, "Independent
Pipe & Supply Corp., Lots 31 & 32. Site Plan," prepared by Lamoureux & Dickinson Consulting
Engineers, Inc, dated 4/l/99, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. Prior to issuance of a zoning permit, the applicant shall pay the sewer allocation fee for the 300gpd
of improved sewer allocation.
4. The plans shall be revised prior to issuance of a zoning permit to show the changes listed below
and shall require approval of the Director of Planning & Zoning (hereinafter Director). Three copies
of the approved revised plan shall be submitted.
a) The site plan shall be revised to show one additional handicapped space.
b) The site plan shall be revised to include boundarxdistances.
c) The site plan shall be revised to show screened dumpster.
4. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast

5. The applicant shall post a $7,200 landscape bond prior to issuance of a zoning permit. The bond
shall remain in effect for three years to assure that the landscaping takes root and has a good chance
of surviving.
6. The applicant shall gay the sidewalk fee of $15 per linear foot of frontage as required by the
original subdivision approval prior to issuance of a zoning permit.
7. The applicant shall submit a lot merger agreement for approval by the City Attorney. This
agreement shall be recorded in the land records prior to issuance of a zoning permit.
8. The applicant shall pay a traffic impact fee of $1,760 as required by the original subdivision
approval prior to issuance of a zoning permit.
9. The applicant shall obtain a zoning permit within six months pursuant to Section 27.302 of the

7. The lighting for the freestanding signs shall be sufficiently screened or placed in a manner so that

Section 4 of the Sign Ordinance. Whether or not the signs comply with all other sections of the Sign
Ordinance shall be determined by the Code Officer. Final design of each sign may be approved by
Planning staff provided each sign complies with the approved typical (i.e., dimensions hand Painted
not interior lit, etc.). Any change to the sign typical shall require approval by the Planning
Commission.

Mr. Rowe said these are lots 31 and 32 of the Ethan Allen Farms subdivision. The site is now open
and relatively flat. They will merge the 2 lots for use by a pipe supply company. The building would
have 900 square feet of office space and 9100 square feet of warehouse space. There will be outside
storage of materials (pipe, fittings, etc.)
The project would use existing city water and sewer. The building will be sprinklered.
The rear of the lot is to be enclosed by a 8 foot chain line fence with webbing in the links.
Mr. Rowe then showed landscaping screening. The dumpster will be inside a screened storage area.
The applicant will pay the sidewalk fee in lieu of building the sidewalk.

SAME - VT, LLC
I move the South Burlington Planning Commission approve the ite plan application of SAME -VT, LLC to
construct a 10,000 square foot warehouse and distribution facility ncluding outside storage, 19 - 25 Commerce
Avenue, as depicted on a two (2) page set of plans, page one entitled, "Independent Pipe & Supply Corp., Lots
31 & 32, Site Plan," prepared by Lamoureux & Dickinson Consulting Engineers, Inc., dated 4/l/99, with the
following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect.
2) Prior to issuance of a zoning permit, the applicant shall pay the sewer allocation fee for the 300 gpd of
approved sewer allocation.
3) The plans shall be revised prior to issuance of a zoning permit to show the changes listed below and shall
require approval by the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the revised
plans shall be submitted.
a) Site plan shall be revised to show one handicapped space.
b) Site plan shall be revised to include property boundary distances.
c) Site plan shall be revised to show screened dumpster.
4) Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the
property line. Any change in lighting shall be approved by the Director prior to installation.
5) The applicant shall post a $7,200 landscape bond prior to issuance of a zoning permit. The bond shall
remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving.
6) The applicant shall pay the sidewalk fee of $15 per linear foot of frontage as required by the original
subdivision approval prior to issuance of a zoning permit.
7) The applicant shall submit a lot merger agreement for approval by the City Attorney. This agreement shall
be recorded in the land records prior to issuance of a zoning permit.
8) The applicant shall pay a traffic impact fee of $1,760 as required by the original subdivision approval prior
to issuance of a zoning permit.
9) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning
regulations or this approval is null and void.
10) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior
to occupancy of the building.
Any change to the site plan shall require approval by the South Burlington Planning Commission

the southerly side of Commerce Avenue in the City of South Burlington. Ethan Allen Farms
Industrial Subdivision received Master Plan approval for the subdivision and construction of the
roadways and related utilities in 1988. in accordance with condition 46 of that approval, we are

will be located at the new facility. The project will utilize existing municipal water and sewer
service along Commerce Avenue.
The project is located within the Mixed Industrial and Commercial District, and within a
previously approved industrial subdivision. The project site is surrounded by compatible

Ethan Allen Farms Industrial Subdivision are located to the south.
The project is scheduled for Site Plan review before the South Burlington Planning
Commission on June 8. Following Site Plan review, a municipal impact questionnaire will be
submitted to the Commission. In accordance with condition #22 of the Master Plan approval,
the Site Plan has been reviewed by Green Mountain Power and Vermont Electric Power
Company (see criterion 9J and attachments). A Water Supply and Wastewater Disposal Permit
was submitted to the Regional Engineer on April 14, 1999.

VELCO transmission lines cross the rear of the parcel. The site is
relatively flat, with the roadway located slightly higher than the site.

transmission lines cross the rear of the parcel.
b) Demonstrate that the project's visual appearance from a highway, community
center, or nearby residences is consistent with the visual appearance of the
existing area as described in a) above:
i) Demonstrate that the project use (residential, retail, industrial, etc.) is
consistent with the existing or planned land uses in the area. Will the
project generate any significant noise related impacts during and/or after

The project site is located in the Mixed Industrial and
Commercial District. The parcel is within the Ethan Allen
Farms Industrial Subdivision, which is located to the north of
the Burlington International Airport and the Air National
Guard Base. The proposed uses will not generate any
significant noise related impacts during or after construction.
ii) Demonstrate that the building size, density, and location are not out of
character with the terrain of the site, the size of nearby buildings,
surrounding vegetation, and nearby scenic vistas from highways or
community centers. (Show details on site plan.)
The building (30% maximum) and total (70% maximum) lot
coverage are in conformance with the South Burlington
Zoning Regulations. The building is similar in size and
compatible with other existing buildings along Commerce
Avenue and Ethan Allen Drive. The relatively flat site is an
open plowed field. The Site Plan proposes landscaping
around the perimeter of the lot in addition to the existing
street trees.
iii) Demonstrate that the architectural style and building materials and colors
are not out of character with the style of area buildings (provide drawings
of building).
The proposed building will be a pre-engineered steel
structure with sloped roof. The building will be brown with
white trim. The building style is similar those located on
adjacent lots along Commerce Avenue and Ethan Allen
Drive. A masonry facing will be constructed along the side
of the building near the office space area (see attached
building sketches). The building height will be 16 feet at the
eaves, and approximately 20 feet at the peak.
iv) Demonstrate that parking areas are designed to minimize their visibility
from the highway or nearby residences. (Show on site plan.)
The project is located within a commercial and industrial
zoning district, with similar uses along Commerce Avenue
and Ethan Allen Drive. The parking area is located on the
westerly side of the building with landscaping proposed
within the front yard. A chain link fence with webbing and
landscaping are proposed to screen the outside storage
area at the rear of the building.
v) Demonstrate that any project signs are designed to minimize their visual
impact on the surrounding area (include size, illumination, and colors).

A building mounted sign is proposed (see attached photos). The sign will
consist of red and black lettering against the brown color of the building.
The building mounted sign will be approximately 48" high and 25 feet
long.

highway or nearby residences (include size, wattage, fixture style, and

Exterior lighting will be building mounted, downshielded, and cutoff to
conceal the light source substantially beyond the perimeter of the area to
be illuminated. The light fixtures will be GE Wallighter 250 or equal with
100 watt metal halide bulbs mounted at a maximum of 15 feet (see
attachments).

This project involves the construction of a typical steel
building with approximately 900 sf of office space and 9100
sf of warehouse area. The final design and interior layout of
the building has not been completed. The applicant will
construct the building to meet the Vermont Consolidated
Act250 Energy Guidelines for Typical Commercial and
Industrial Buildings. Where custom or site specific
conditions require a variance from these guidelines, they will
be evaluated on a cost benefit basis by working with the
electrical or gas utility. We have reviewed this project with
Randall Lloyd, who will comment through the Inter -Agency
Review process.
b) If the project involves commercial, institutional, or industrial buildings,

the Site Plan has been provided to GMP and VELCO for
comment. The project complies with the conditions set forth
in condition 21 regarding the use of the lands within the

In reference to the agreement of sale between Independent Pipe and Supply Corp., the Purchaser, and John
and Joyce Better, the Sellers, dated March 17, 1999, covering the real property commonly known as Lot #31 &
Lot #32, Ethan Allen Industrial Park, Commerce Avenue, South Burlington, VT, the undersigned hereby agree to the
following terms and conditions:
State of Vermont Land Use Permit #4C0643 and 4C0643-3, together with the subdivision permits
referred to therein.
The Terms and Conditions imposed by the City of South Burlington.
Terms and Conditions of the Protective Covenants governing the Park.
An allocation of cumulative impacWresources from the Park's "umbrella" Act 250 permit shall
include 30 parking spaces, 900 gallons of wastewater and water, 100 vehicle trips, and 12 peak hour
trips. If more resources are needed, it shall be Buyer's responsibility to have the cumulative
impacts increased, so as to provide the needed amount of parking spaces, gallons of water, and
vehicle trips for this project without further depleting cumulative impacts allocation in the umbrella
Act 250 permit.
All other terms and conditions as set forth in the lease agreement remain in effect. The herein agreement,
upon its execution by all parties, is to be made an integral part of the aforementioned purchase and sale agreement.

Vermont Gas Systems (VGS) will be pleased to serve the above referenced project. We have reviewed the
proposed building site and have determined that a feasibility study will not be required since the necessary
infrastructure is very close to the proposed site and we can serve the additional load of the proposed project
%vithout affecting our present firm customers.
Enclosed please find a copy of Vermont Consolidated Act 250 Energy Cruidelines for Typical Commercial and
Industrial (C & I) Buildings prepared by the Vermont Department of Public Service. These guidelines are being
used to determine compliance with criterion 9(F) of Act 250.
Our Technical Services Department is available to assist you in using and interpreting these guidelines. To make
the process as smooth as possible, %ve encourage you to contact our Technical Services Department as early in your
planning process as possible. Technical assistance and life cycle cost analyses may be provided through our
WorkPlace New Construction Program when requested. It is our hope that VGS' WorkPlace New Construction
Program can help you not only comply with the Act 250 permit requirements, but help your building projects be
very energy efficient and lower operating costs.
Please note that it has been our experience that these guidelines are the minimum standards and that higher
efficiency equipment including high efficiency condensing equipment and air to air heat recovery units for
ventilation may be required, if cost effective In addition, the Department of Public Service has authorized Act
250 inspections by an Act 250 inspector and permit compliance with regards to Criterion 9(F) may be reviewed

Dear Mr. Rowe:
We have reviewed your letter of April 14, 1999 which requests Green
Mountain Power's ability to serve the electric load for the proposed warehouse and
distribution facility for Independent Pipe & Supply Corporation on Lots 31 and 32
of Ethan Allen Farms Industrial Subdivision on Commerce Avenue in South
Burlington.
As you know, our comments are required so that a meaningful assessment
can be made under 10 VSA Section 6086 (a) (9) (J).
When load data is not available, Green Mountain Power Corporation
forecasts an average use for each structure. You have informed us that this project
will consist of 10,000 square foot facility including 900 square feet of office space.
Our review of this project assumes that all three phase motors larger than 10 H.P.
and all single phase motors larger than 5 H.P. meet the requirement for reduced
voltage starting unless written approval has been received from Green Mountain
Power, and that none of the proposed structure(s) will have electric space heating.
Based on this information and other developments* with similar parameters, it is
estimated that the electrical panels will be 240/i20 volts single phase, and the total
project as described will result in an estimated peak demand of 21 KW. This
requirement can be supplied from Green Mountain Power's existing and planned
generation sources. If this estimate is not consistent with your load projections,
Green Mountain Power Corporation should be made aware of the situation for
planning purposes.
We have evaluated the transmission and distribution system that will be
used to serve your project's requirements and have determined that existing
facilities are adequate for that purpose. We do not anticipate that your addition
will require distribution or transmission improvements at this time or accelerate
routine system improvements planned for the near future. Any new line extension

construction necessary to provide service will be administered under GMP's line
extension tariff. This tariff provides that line extensions will be installed in a right-
of-way granted by the customer. GMP requires that these rights -of -way be
unencumbered, a minimum of 10' wide and be protected by a legally binding
easement.
In view of these facts, we conclude that the proposed development will not
put an excessive or uneconomic demand on Green Mountain Power's facilities.
Details concerning service size, scheduling, costs, etc., should be discussed
with Dave Murray of the Colchester District Office.

with permit requirements regarding criterion 9 (F), energy efficiency. You may
