HomeMy WebLinkAboutSP-99-16 - Decision - 0019 0025 Commerce Avenue#SP-99-16 FINDINGS OF FACT AND DECISION Re: Findings of Fact, site plan application of SAMENT, LLC to construct a 10,000 square foot warehouse and distribution facility including outside storage, 19-25 Commerce Avenue. On the 8"' day of June 1999, the South Burlington Planning Commission approved the site plan application of SAMENT, LLC, under Section 26.10 of the South Burlington Zoning Regulations, to construct a 10,000 square foot warehouse and distribution facility including outside storage based on the following findings: 1. This project consists of construction of a 10,000 square foot warehouse and distribution facility including outside storage. 2. This property located at 19 - 25 Commerce Avenue lies within the IC District. It is bounded on the north by Commerce Avenue, on the east and west by industrial buildings, and on the south by undeveloped land. 3. The owners of record of this property are John and Joyce Belter. 4. Access/circulation: Access is proposed to be via a 24 foot curb cut on Commerce Avenue. Circulation on the site is adequate. 5. Coverage/setbacks: Building coverage is 12.4% (maximum allowed is 30%). Overall coverage is 69.5% (maximum allowed is 70%). Front yard coverage is 10.1% (maximum allowed is 30%). Setback requirements are met. 6. Parking: A total of six (6) spaces are required and 30 spaces including one (1) handicapped space and a bike rack are provided. The plan should be revised to add one (1) additional handicapped space. 7. Landscaping: The minimum landscaping requirement based on building costs, is $7200 which is being met. Proposed landscaping includes Red Maple, Honeylocust, Red Oak, Dogwood, Serviceberry, Spirea, Cedar, Arrowwood and Crabapple. 8. Sewer: The sewer allocation requested is 300 gpd. The applicant shall be required to pay the per gallon fee prior to permit issuance. 9. Lot merger: The applicant is proposing to construct this facility on two (2) contiguous lots (lots #31 and 32). Prior to issuance of a permit, the applicant should record a lot merger agreement approved by the City Attorney which merges these two (2) lots. 10. Traffic: The subdivision approval from which this lot was created required a traffic impact fee of $880 per lot. The applicant was made aware that the traffic impact fee is $1760. 11. Sidewalk: The subdivision approval which included this lot required that the developer either contribute $15 per linear foot frontage or build the sidewalk along the frontage. Staff recommended that the developer pay the fee. 12. Lighting: Exterior lighting will consists of the following: -three (3) 70 watt building mounted metal halide lamps with downcasting shielded fixtures. 13. Outside storage: The applicant is proposing an outside storage area of approximately 33,000 square feet. This area will be screened with a six (6) foot chain link fence with webbing. 14. Dumpster: The plan should show a screened dumpster storage area if a dumpster will be used. 15. Other: -the plan should be revised to include property boundary distances (east and west sides). DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of SAME -VT, LLC to construct a 10,000 square foot warehouse and distribution facility including outside storage, 19 - 25 Commerce Avenue, as depicted on a two (2) page set of plans, page one entitled, "Independent Pipe & Supply Corp., Lots 31 & 32, Site Plan," prepared by Lamoureux & Dickinson Consulting Engineers, Inc., dated 4/1/99, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) Prior to issuance of a zoning permit, the applicant shall pay the sewer allocation fee for the 300 gpd of approved sewer allocation. 3) The plans shall be revised prior to issuance of a zoning permit to show the changes listed below and shall require approval by the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the revised plans shall be submitted. a) Site plan shall be revised to show one additional handicapped space. b) Site plan shall be revised to include boundary distances. c) Site plan shall be revised to show screened dumpster. 4) Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the Director prior to installation. 5) The applicant shall post a $7,200 landscape bond prior to issuance of a zoning permit. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 6) The applicant shall pay the sidewalk fee of $15 per linear foot of frontage as required by the original subdivision approval prior to issuance of a zoning permit. 7) The applicant shall submit a lot merger agreement for approval by the City Attorney. This agreement shall be recorded in the land records prior to issuance of a zoning permit. 8) The applicant shall pay a traffic impact fee of $1,760 as required by the original subdivision approval prior to issuance of a zoning permit. 9) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 10) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the building. 11) Any change to the site plan shall require approval by the South Burlington Planning Commission.
