HomeMy WebLinkAboutMinutes - City Council - 04/09/1973SOUTH BURLINGTON CITY COUNCIL MEETING APRIL 9, 1973 PUBLIC HEARING WITH PLANNING COMMISSION MEMBERS FOR DISCUSSION ON PROPOSED ZONING REGULATIONS AND MASTER PLAN The City Council held a public hearing at the regular meeting of the Council on Monday, April 9, 1973 in the Central School Gym, Williston Road. Council Chairman Frederick G. Blais called the meeting to order at 7:45 P.M. MEMBERS PRESENT Chairman Frederick G. Blais, Walter Nardelli, Doctor Harold P. Brown, Michael D. Flaherty, and Brain J. Gee. Members of the Planning Commission present were Acting Chairman Douglas I. Tudhope, Mary Barbara Maher, Arthur Bailey, Ronald Schmucker, and Hugh Marvin. OTHERS PRESENT There were approximately 250 to 300 residents present. Among those who discussed the regulations were City Manager Szymanski, Zoning Administrative Officer Ward, City Attorney Ewing, Former Chairman of the Planning Commission Lamphere, Mr. Raymond Danis, Kay Neubert, Mr. Abbott, Mr. Donald Moser, Mr. Dick Bingham, Jean Hildick, Frederick Fayette, Charles Lewis, Mr. Lothar Vogel, Barbara Bull, Mrs. DesLauriers, Arlene Krapcho and William Robenstein. DISCUSSION ON PROPOSED ZONING REGULATIONS This public hearing was taped on a recorder and the handwritten transcript of the meeting is filed with and made a part of the minutes. Because of the length of the transcript, and the fact that the recorder was not strong enough to pick up all comments from the audience, a short resume follows: Chairman Blais discussed the numerous meetings held on the Zoning Regulations and Master Plan, and outlined the proposed amendments to be considered as recorded on the transcript. A motion was made seconded and unanimously passed to have the explanation of PUD made at this time in lieu of going over the amendments. Mr. Blais reviewed Section 13.202, Specific Standards of Planned Unit Development, and then there was a long discussion on the April 9th proposed amendments to the Master Plan, Zoning Map and By-Law Amendments that were drafted April 9, 1973 for this meeting. A copy of the April 9, 1973 proposed amendments is attached to and made a part of these minutes. Mr. Blais then explained the following articles: 12.803, 14.50, 14.51, 15.40, saying it was a summary of the prime areas of amendments. Doctor Brown made a motion to adopt the Zoning Regulations as warned. Mr. Gee seconded the motion. The motion carried by a vote of three to two, with Chairman Blais casting an "aye" vote with Dr. Brown and Mr. Gee - Mr. Nardelli and Mr. Flaherty voting "no". There was considerable discussion about amending the motion, and the following motion resulted. Dr. Brown made the following motion: Resolved that we initiate immediately to the Planning Commission the amendments as proposed tonight and as altered by the makers and the seconders to incorporate Item #5, proposed new highways, as well as expanded present highways, and to add a new item - densities be reviewed in all areas of the City in considering amendments, and, finally, adding to the amendments as proposed tonight, freezing on the P.U.D. concepts until further study can be done on them. Mr. Gee seconded the motion. The motion carried by a vote of three to two, with Chairman Blais casting an "aye" vote with Dr. Brown and Mr. Gee - Mr. Nardelli and Mr. Flaherty voting "no" Mr. Blais was asked by Mr. Bingham about the referendum process. Mr. Blais turned the question over to Attorney Ewing who said "The referendum process is that if a petition is submitted within 20 days of tonight, signed by 2% of the legal voters, then there must be a vote of the City before the Zoning Regulations adopted by the City Council would go into effect." A resident noted that a petition for a referendum had already been presented with the proper number of signatures. The petition reads as follows: "We, the undersigned residents and legal voters of the City of South Burlington, request the Comprehensive Plan and the South Burlington Zoning Regulations not be effective until approved by a majority of the legal voters of the municipality present and voting by Australian ballot at a meeting of the municipality duly warned for the purpose of acting upon the Plan and Zoning Regulation." Mr. Ewing, Attorney said that the Comprehensive Plan as included in the petition is not subject to public referendum by virtue of the Planning Act. The Zoning Regulations, which has the force of law, is subject to the referendum. Mr. Nardelli made a motion that the referendum vote on the South Burlington regulations be warned simultaneously with the Parks question for the May election. Mr. Flaherty seconded the motion which passed unanimously. The vote was called the "Rescinding Referendum" vote, during discussion on the motion. APPROVE BALLOT ITEMS On motion duly made, seconded and so passed the Council approved the ballot items to be warned for the May 15, 1973 meeting. APPOINTMENT OF CITY SERVICE OFFICER On motion duly made, seconded and so passed the Council reappointed William J. Szymanski, City Manager as South Burlington's Service Officer. Motion was made, seconded and passed to adjourn the meeting at 11:35 P.M, at which time the Council convened as the Liquor Control Board. LIQUOR CONTROL BOARD The Liquor Control Board reviewed, approved, and signed the following applications for liquor licenses: First Class: Ramada Inn, Williston Road Quarry Hill Golf Course, Spear St. Rene & Rita Barsalou, Shelburne Rd. Aunt Sara's, Shelburne Road Dunfey-Vt. Corporation, Williston Rd. Claird Corp-Howard Johnson's Williston Road 2nd Class: Grand Union, Hinesburg Road Grand Union, Shelburne Road The Great A & P, Shelburne Road The Liquor Control Board meeting was adjourned at 11:55 P.M. upon motion made, seconded, and unanimously passed.
