Re: Findings of Fact, application of Jeff Nick to consruct a 3,150
square foot office building for a pest exterminating business, 15
Commerce Avenue.
On the 29th of March, 1994 the South Burlington Planning Commission
approved the request of Jeff Nick for site plan review under
Section 19.10 of the South Burlington Zoning Regulations based on
the following findings:
1. This project consists of constructing a 3,150 square foot
office building for a pest exterminating business.
2. This property located at 15 Commerce Avenue (lot #33) lies
within the I-C District. It is bounded on the north by Commerce
Avenue, on the west by an auto repair business, and on the east and
south by vacant lots.
3. Access/circulation: Access will be provided by a 20 foot curb
cut on Commerce Avenue.
Circulation is adequate.
4. Coverage/setbacks: Building coverage is 7.8% (maximum allowed
is 30%). Overall coverage is 37.6% (maximum allowed is 70%).
Front yard coverage is 16.7% (maximum allowed is 30%).
Setback requirements will be met.
5. Parking: This project requires a total of 13 parking spaces
and 27 spaces including one (1) handicapped space will be provided.
The additional spaces are needed for the company vehicles.
6. Landscaping: The minimum landscaping requirement, based on
building costs, is $3,780 which is being met. Plantings will
include White Pine, Yew, Juniper, Crabapple and Burning Bush. The
site plan should be revised to indicate the correct number of White
Pine trees proposed.
7. Traffic: The applicant will be required to contribute $880 for
improvements to the Ethan Allen Drive/Shamrock Road intersection.
This was a requirement of the subdivision approval.
8. Sidewalk: The subdivision approval required that the applicant
either contribute $15 per linear frontage foot or construct the
sidewalk. The plan should be revised to show the sidewalk.

9. Lighting: Exterior lighting consists of five (5) 150 watt wall
mounted high pressure sodium lamps with cut-off luminaries.
10. Dumpster: The dumpster will be screened with mesh or a
stockade fence.
11. Sewer: A sewer allocation of 270 gpd is required based on a
maximum of 18 employees. The applicant will be required to pay the
per gallon fee prior to permit.
12. Other: The developer, John Belter, has not met his
obligations to post a bond for the road construction and street
trees, the road does not meet City standards and the street trees
have not been planted. Staff recommended that the zoning/building
permit for this building not be issued until the Administrative
Officer is satisfied that the developer has met his obligations for
final plat approval.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Jeff Nick to
construct a 3,150 square foot office building for a pest
exterminating business, 15 Commerce Avenue, as depicted on a plan
entitled "Ethan Allen Farms Industrial Park, Lot 33 - South
Burlington, VT, Proposed Orkin Pest Control" with a last revision
date of 3/15/94, with the following stipulations:
1) All previous approval and stipulations which are not superseded
by this approval shall remain in effect.
2) The plan shall be revised prior to issuance of a
zoning/building permit to show the changes listed below and shall
require approval of the City Planner. Three (3) copies of the
approved revised plan shall be submitted to the City Planner prior
to permit issuance.

3) A sewer allocation of 270 gpd is approved. The applicant shall

5) Any new exterior lighting shall consist of downcasting shielded
fixtures so as not to cast light beyond the property line. Any
change in lighting shall be approved by the City Planner prior to

installation.
6) The zoning/building permit for this building shall not be
issued until the Administrative Officer is satisfied that the
subdivision developer, John Belter, has met his obligations for
final plat approval.
7) The applicant shall post a landscape bond in the amount of
$3,780 for the new landscaping. This bond shall be posted prior to
issuance of a zoning/building permit. The bond shall remain in
effect for three (3) years to assure that the landscaping has taken
root and has a good chance of surviving.
8) The applicant shall obtain a zoning/building permit within six
(6) months or this approval is null and void.
9) The applicant shall obtain a Certificate of Occupancy from the
Administrative Officer prior to use of the office building.
10) Any change of the site plan shall require approval by the
South Burlington Planning Commission.
11) Prior to issuance of a zoning/building permit, the applicant
shall pay the $15 per linear foot of frontage sidewalk fee which
was required as a condition of subdivision approval.
