SOUTH BURLINGTON CITY COUNCIL NOVEMBER 20, 1972 EXECUTIVE SESSION The South Burlington City Council held an Executive Session on Monday, November 20, 1972 at 7:00 P.M. in the Conference Room, City Hall, Williston Road. Chairman Blais called the meeting to order. MEMBERS PRESENT Chairman Frederick G. Blais, Walter Nardelli, Dr. Harold P. Brown, Michael D. Flaherty and Brian J. Gee. OTHERS PRESENT City Manager W. J. Szymanski, City Attorney John T. Ewing, Douglas Tudhope, Hugh Marvin, Henry Caswell and several other citizens. DISCUSSION ON CORRECTIONAL PRISON SITE AND FUNCTION OF EMERGENCY BOARD Chairman Blais asked the City Attorney what the legal effect would be if the question of the location of a correctional center was put to the voters by referendum. Mr. Ewing said it would not have any legal effect but might have political effects. It would effect the Emergency Board. He said the Emergency Board got into the site selection of a center by act of the Legislature, that there was no appeal to the Emergency Board because it was a legislative act. Mr. Flaherty asked if the Emergency Board can reverse its decision. Mr. Tudhope stated that the Emergency Board is a Legislative body that functions when the Legislature is not in session, that the Legislature can reverse the decision of the Emergency Board. Mr. Nardelli asked if the prision was subject to building permit requirements. Mr. Ewing seemed to think that it was. He went on to say that there was also the possibility of control by the Planning Commission regarding the subdivision of land, both under the new and the old subdivision regulations. He said that at this time the best course for the Council to take was to approach the Emergency Board through a resolution. Mr. Flaherty asked if a building permit can be withheld. Mr. Ewing said that the state would probably proceed without the permit and the city would have to seek an injunction. Mr. Nardelli asked if ground could be broken at any time. Mr. Ewing said yes, and we would have to get an injunction and require the state to comply as to the legal requirements - set back, height, etc., as per our new subdivision regulations.
