District Environmental Commission #4 hereby issues Land Use Permit Amendment 4C0643-9A,
pursuant to the authority vested in it by 10 V.S.A. §§ 6001-6092. This permit amendment applies to the
lands identified in Book 272, Pages 293, of the land records of the City of South Burlington, Vermont, as
the subject of a deed to Alan Bruscoe & Ann Marie Soutiere, the Permittees as Grantees.
This permit specifically authorizes the Permittees to construct a 2,344 sf. addition to the existing
building on Lot #34 of the Ethan Allen Farms Industrial subdivision with no change in allocations.
The project is located on Commerce Avenue in the City of South Burlington.
The project is subject to Act 250 jurisdiction because the project is a material or substantial change to a
development over which the Commission has jurisdiction and thus constitutes "development" pursuant to
EBR 2(A)(1)(e). Accordingly, a land use permit amendment is required pursuant to EBR 34.
The Permittees, and their assigns and successors in interest, are obligated by this permit to complete,
operate and maintain the project as approved by the District Commission in accordance with the
following conditions:
1. All conditions of Land Use Permit #4C0643 and amendments are in full force and effect except
as amended herein.
2. By acceptance of this permit, the Permittees agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose of
ascertaining compliance with Vermont environmental and health statutes and regulations and
with this permit.
3. The project shall be completed, operated and maintained in accordance with: the plans and
exhibits on file with the District Environmental Commission, and the conditions of this permit.
4. The approved plan is:
Sheet 1 - "Drainage Site Plan, Al-An's Auto Service" dated 8/4/05.
A copy of this permit and approved plans shall be on the site at all times throughout the
construction process.
6. No changes shall be made in the design or use of this project without the written approval of the
District Coordinator or the Commission, whichever is appropriate under the Environmental
Board Rules.

Pursuant to EBR 51(G), the permit application and material representations relied upon during
the review and issuance of this permit by the District Commission shall provide the basis for
determining future substantial and material changes to the approved project and for initiating
enforcement actions.
The District Environmental Commission maintains continuing jurisdiction during the lifetime of
the permit and may periodically require that the permit holder file an affidavit certifying that the
project is being completed, operated and maintained in accordance with the terms of the permit,
as provided by 10 V.S.A. §§ 6001-6092 and the rules of the Environmental Board.
9. By acceptance of the conditions of this permit without appeal, the Permittees confirm and agree
that the conditions of this permit shall run with the land and the land uses herein permitted, and
will be binding upon and enforceable against the Permittees and all assigns and successors in
interest.
10. The project is approved for the following maximum impacts:
16 - vehicle parking spaces (no change from previous permit - 33 spaces remaining in Park);
150 - gallons per day of water and wastewater (no change from previous permit - 2380 gpd
remaining in Park);
30 - vehicle trips per day (no change from previous permit);
12 - AM peak hour vehicle trips (no change from previous permit - 6 trips remaining in Park).
11. This permit hereby incorporates all of the conditions of the following Agency of Natural
Resources Permits:
Potable Water Supply and Wastewater System Permit #WW-4-0043-1 issued on
September 27, 2005 by the Wastewater Management Division.
Any subsequent nonmaterial changes to these permits shall be automatically incorporated herein
upon issuance by the Agency of Natural Resources. Subsequent amendments involving material
changes to the Act 250 permit shall not be constructed prior to review and approval of the
District Coordinator or the District Commission under applicable Environmental Board Rules.
12. The Permittees shall apply and maintain calcium chloride and/or water on all roadways or
disturbed areas within the project during construction and until pavement and/or vegetation is
fully established to control dust.
13. The Pe='ttees and all subsequent owners or lessees shall install and maintain only low -flow
plumbing fixtures in any buildings. Any failed water conservation measures shall be promptly
replaced with products of equal or better performance.
14. The Permittees shall prevent the transport of any sediment beyond that area necessary for
construction approved herein. All erosion control devices shall be periodically cleaned, replaced
and maintained until vegetation is permanently established on all slopes and disturbed areas. The
Commission reserves the right to schedule hearings and site inspections to review erosion control
and to evaluate and impose additional conditions with respect to erosion control as it deems
necessary.

15. All mulch, siltation dams, water bars and other temporary devices shall be installed immediately
upon grading and shall be maintained until all roads are permanently surfaced and all permanent
vegetation is established on all slopes and disturbed areas. Topsoil stockpiles shall have the
exposed earth completely mulched and have siltation checks around the base.
16. All disturbed areas of the site shall be stabilized, seeded and mulched immediately upon
completion of final grading. All disturbed areas not involved in winter construction shall be
mulched and seeded before October 1. Between the periods of October 1 to April 15, all earth
disturbing work shall conform with the "Winter Construction" standards and specifications of the
Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites (1987).
17. A copy of the approved erosion control plan shall be on the site at all times during construction.
18. In addition to conformance with all erosion control conditions, the Permittees shall not cause,
permit or allow the discharge of waste material into any surface waters. Compliance with the
requirements of this condition does not absolve the Permittees from compliance with 10 V.S.A.
(§§ 1250-1284) Chapter 47, Vermont's Water Pollution Control Law.
19. The Permittees shall maintain a 50-foot undisturbed, naturally vegetated buffer strip between all
watercourses on the project site and any disturbed areas.
20. All stumps shall be disposed of on -site above the seasonal high water table or at a State approved
landfill so as to prevent groundwater pollution.
21. - No new pole mounted or building mounted lights are proposed.
22. The Permittees shall not erect additional exterior signage without first obtaining approval from
the District Commission. Signage includes banners, flags, and other advertising displays,
excepting temporary real estate marketing signs.
23. If the existing building contains floor drains which discharge underground on -site, the Permittees
shall either register the floor drains with the ANR Underground Injection Control (UIC) Program
or close the floor drains after filing the proper notification with the UIC Program.
24. The project shall conform with the 2001 Vermont Guidelines for Energy Efficient Commercial
Construction, promulgated by the Vermont Department of Public Service. Any design or
equipment features that do not comply with the 2001 Guidelines, or any custom measures not
installed, shall be brought promptly to the attention of the Department of Public Service for
comment and to the District Commission for approval prior to construction.
25. The installation and/or use of electric resistance space heat is specifically prohibited without the
prior written approval of the District Environmental Commission.
26. Each prospective purchaser of this lot shall be shown a copy of the approved plot plan, Potable
Water Supply and Wastewater System Permit, the Land Use Permit and amendments and the
Findings of Fact before any written contract of sale is entered into.
27. No further subdivision, alteration, and/or development of any parcel of land approved herein
shall be permitted without the written approval of the District Commission.

28. The Permittees shall reference the requirements and conditions imposed by Land Use Permit
#4C0643-9A in all deeds of conveyance and leases.
29. Pursuant to 10 V.S.A. § 6090(c) this permit amendment is hereby issued for an indefinite term,
as long as there is compliance with the conditions herein. Notwithstanding any other provision
herein, this permit shall expire three years from the date of issuance if the Permittees have not
commenced construction and made substantial progress toward completion within the three year
period in accordance with 10 V.S.A. § 6091(b).
30. Failure to comply with all of the above conditions may be grounds for permit revocation pursuant
to 10 V.S.A. § 6090(c).

GENERAL
1. This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from the Act 250 District Environmental Commission, the Department
Public Safety, Division of Fire Safety— telephone (802) 828-2106 or (802) 879-2300, and
local officials rn for to proceeding with this project.
2. The project shall be completed as shown on the plan proj. no. 04101, sht. no. 1 "Drainage
Site Plan" dated 8/04/05 prepared by Lamoureux & Dickinson Consulting Engineers,
Inc. that has been stamped "approved" by the Wastewater Management Division.
3. The project shall not deviate from the approved plans in a manner that would change or affect
the exterior water supply or wastewater disposal systems, building location or the approved
use of the building, without prior review and written approval from the Wastewater
Management Division.
4. The conditions of this pen -nit shall run with the land and will be binding upon and enforceable
against the permittee and all assigns and successors in interest. The permittee shall be
responsible for the recording of this permit in the South Burlington Land Records within
thirty, (30) days of issuance of this permit and prior to the conveyance of any lot subject to the
jurisdiction of this permit.
5. All conditions set forth in Permit #WW-4-0043 shall remain in effect except as modified or
amended herein.

6. The Wastewater Management Division now reviews the water and wastewater disposal

7. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose of
ascertaining compliance with the Vermont environmental and health statutes and regulations.
8. A copy of the approved plans and this permit shall remain on the project during all phases of
construction, and upon request, shall be made available for inspection by State or local
personnel.
WATER SUPPLY & WASTEWATER DISPOSAL
9. The project is approved for water supply by connection to the municipal water system as
depicted on the approved plans. The Wastewater Management Division shall allow no other
method, or location of obtaining potable water without prior review and approval.
10. The project is approved for wastewater disposal by the construction of a connection to the
municipal wastewater treatment facility as depicted on the approved plans. The Wastewater
Management Division shall allow no other method, or location of wastewater disposal without
prior review and approval.

Dear Sir/Madam:
I reviewed the application and technical information submitted for the above referenced project. Unfortunately, there
were items that were not included or were insufficient and I was unable to determine if this project meets the
minimum standards of the Environmental Protection Rules. Please provide the following information:
Condition #9 of Permit #WW-4-0043 requested a written certification by a State of Vermont registered
professional engineer that the sanitary sewer system was installed in accordance with the stamped approved
plans. I do not find that certification of construction. The other issue is that the sanitary sewer and water
services depicted on the plans submitted for application #WW-4-0043-1 are different than the plans stamped
approved by Permit #W-4-0043. Therefore, I ask that your consultant submit the following certification so
that I may approve the accurate location of the water and sewer systems:
No permit issued by the Secretary shall be valid for a substantially completed potable water supply
and wastewater system until the Secretary receives a certification from a designer or the installer,
signed and dated, that states:
"I hereby certify that, in the exercise of my reasonable professional judgment, the installation -
related information submitted is true and correct and the potable water supply and wastewater
system were installed in accordance with the permitted design and all permit conditions, were
inspected, were properly tested, and have successfully met those performance tests."
Please respond within thirty, (30) days fi•om the date of this letter. Re -submittals that are incomplete, or made after
thirty days may result in the denial of the project. Once I receive the information requested, I will continue my
review of the project. If you have any questions as to what is needed, please contact me.

Mr. Dietrich said this will improve the level of service at Nowland Farm Road in the
morning.
There is adequate sight distance at the driveway, but they recommend the hedges be cut
back.
The left turn lane need is a "grey area."
Mr. Cimonetti noted that when Pinnacle was put in, Spear St. was widened within the city
right-of-way. Long-time property owners have fences right on the city line. This
"'killed" the rec path there. The proposed plan comes out at the Bailey house with a white
picked fence. Mr. Cimonetti felt the rec path issue has to be solved there so a cyclist isn't
faced with cars.
Members want a left turn lane and the rec path.
The draft motion was amended as follows:

lot # 19.

SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Regulations establishes the followinq
general review standards for all site plan applications:
(a) The site shall be planned to accomplish a desirable transition from structure to site,
from structure to structure, and to provide for adequate planting, safe pedestrian
movemen4 and adequate parking areas.
According to Table 13-2 of the Land Development Regulations, an automobile and motorcycle
sales, service, and repair facility requires two (2) parking spaces for every 1,000 square feet of
gross floor area (GFA). The existing 2,584 square -foot building will require six (6) parking spaces.
The proposed 2,344 square -foot addition will require five (5) parking spaces. Thus, a total of
eleven (11) parking spaces are required for the subject property; fifteen (15) parking spaces are
provided.
(b) Parking shall be located to the rear or sides of buildings to the greatest extent
practicable.
The parking spaces are located to the sides and rear of the existing and proposed buildings.

(c) Without restricting the permissible limits of the applicable zoning district; the height
and scale of each building shall be compatible with its site and existing or adjoining
buildings.
The maximum height of the existing building is 17', which is consistent with the development on
surrounding properties.
(d) Newly installed utility services and service modifications necessitated by exterior
alterations or building expansions shall, to the extent feasible, be underground.
1. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines,
services, and service modifications shall be underground.
(e) The DRB shall encourage the use of a combination of common materials and
architectural characteristics, landscaping, buffers, screens and visual interruptions
to create attractive transitions between buildings of different architectural styles
The applicant submitted building elevation plans for the proposed addition (attached). Staff feels
that the above -mentioned requirement is being satisfied.
(f) Proposed structures shall be related harmoniously to themselves, the terrain, and to
existing buildings and roads in the vicinity that have a visual relationship to the
proposed structures.
The existing building is consistent with the terrain and the surrounding buildings in the area.
Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the
South Burlington Land Development Regulations:
(a) The reservation of land may be required on any lot for provision of access to
abutting properties whenever such access is deemed necessary to reduce curb cuts
onto an arterial of collector street; to provide additional access for emergency or
other purposes, or to improve general access and circulation in the area.
Staff does not feel it is necessary to create access to the properties that abut the subject property.
(b) Electric, telephone and other wire -served utility lines and service connections shall
be underground. Any utility installations remaining above ground shall be located so
as to have a harmonious relation to neighboring properties and to the site.
Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines,
services, and service modifications shall be underground.
(c) All dumpsters and other facilities to handle solid waste, including compliance with
any recycling or other requirements, shall be accessible, secure and properly
screened with opaque fencing to ensure that trash and debris do not escape the
enclosure(s).
The plan depict an adequately -screened dumpster on the subject property.

(d) Landscaping and Screening Requirements
Pursuant to Table 13-9 of the Land Development Regulations, the proposed project will require a
minimum of $4,980 of landscaping. The application states that $5,558 of landscaping will be
provided. However, the landscaping plan was prepared by the applicant's architect; it needs to be
prepared by a landscape professional. Thus, the applicant shall submit a letter from a landscape
professional indicating that the plan was prepared by them.

Pursuant to Section 13.06(B) of the Land Development Regulations, snow storage areas must
be specified and located in an area that will minimize the potential for run-off. The plans do not
depict proposed snow storage areas.
3. Pursuant to Section 13.06(B) of the Land Development Regulations, the plans shall be
revised to clearly depict the proposed snow storage areas, prior to issuance of a zoning permit.
Lighting
Pursuant to Section 13.07(A) of the Land Development Regulations, all exterior lighting shall be
shielded and downcasting to prevent light from spilling onto adjacent properties and rights -of -
way. The applicant is not proposing any changes.
Access/Circulation
Access to the subject property is currently provided by a 24' wide curb -cut on Commerce
Avenue. No changes are proposed.
Circulation on the site is adequate.
Traffic
Traffic impact fees were paid for the property at the time the lot was developed. Thus, no
additional traffic impacts fees are required.
Other
The proposed parking lot expansion will eliminate a Class III wetland on the subject property.
The Natural Resources Committee reviewed the plans for the proposed project on April 7, 2005
and recommended approval as submitted (minutes enclosed).
4. If necessary, the applicant shall obtain wastewater allocation approval from the Director of
Planning and Zoning, Juli Beth Hinds, prior to issuance of a zoning permit.

P.M.

The meeting was called to order with a quorum of committee members present at
approximately 7.10 P.M.
Alan's Auto — Site Plan #SP-05-13
Julian introduced the project and explained the site layout to the Committee. He explained how
the drainage and overall runoff on the property works, pointing out the collection pond to the
west of the subject property.
Peter inquired about site conditions during heavy rain, and wanted to know how the applicant
anticipated the site to handle heavy rain with the additional impervious surface proposed
through this project. Julian responded that the large amount of pervious surface that would
remain on the site would adequately handle heavy rains.
Alan explained that the Class III wetland that is proposed to be impacted is a result of the
surface runoff accumulating at the end of the pavement, which created and artificial wetland that
served as a drainage way. Julian explained that a similar artificial wetland and drainage way
would reestablish at the end of the proposed pavement boundary.
The Committee agreed that the proposed impacts are reasonable and justifiable. Due to the
anticipated re-establishment of the artificial wetland, the Committee did not see it necessary to
recommend and mitigation measures.
Therefore, the Committee recommended approval of the project as submitted to the
Development Review Board. The motion passed unanimously 3-0.
Spear Meadows — Master Plan #MP-05-01
Eric explained the project and gave an overview of the site. He explained where the wetland
boundaries and buffers were located, and stated that his wetland consultant believes the
wetland on the south side of the property are class II, while the wetland on the north side of the
property is class III.
Eric stated that the main difference between the classifications of the wetlands is that he will
have to obtain a CUD from the State if the northerly wetland is a class III. He also explained
that the proposed roadways will cross the wetlands at the points of least impact, in terms of
area. The Committee also discussed the proposed culverts for the wetland crossings. Peter

suggested that Eric consider wetland crossing that would be "wildlife friendly." Eric agreed to
research these "wildlife friendly" crossings.
The Committee also discussed the stormwater management systems on the property. Eric
explained, in very general terms, how they would work and which lots were served by which
detention pond.
The Committee recommended approval to the Development Review Board for the master plan
and preliminary plat plan, with the following conditions:
1. there should be no application of pesticides within the wetlands or their 50' wide buffers;
2. there should be no mowing within the wetlands or their 50' wide buffers;
3. the natural vegetation should be retained within the wetlands and their 50' wide buffers;
4. the road widths at the wetland crossings should be permitted at the narrowest width
permissible by the Development Review Board;
5. the NRC should review the plans again prior to final approval.
The meeting was adjourned at approximately 9:00 P.M.

9 PROTECTION AND REPAIR OF EXISTING UTILITIES -Whenever culverts,
manholes, catch basin connections, wafer mains, gas mains, calve

firmly supported by the CONTRACTOR at his own expense• by methods
approved by the ENGINEER or involved utility, until the excavation is back
filled and the existing structures are made secure. Extend existing valve
boxes and manholes in fill areas. Injury to any such structures caused
by or resulting from the CONTRACTOR'S methods will be repaired or
replaced of the CONTRACTOR'S expense within a time period that will not
place an unreasonable burden on the users The OWNER, ENGINEER and

10 RECONSTRUCTION OF EXISTING UTILITIES -In case it shall become

8. All hydrants shall be Kennedy Model K81D, Muuller Super Centurlon 50,
or Woterous Pacer, and conform to AWWA C-502 with a 5 1/4" calve
opening, a mechanical joint inlet, a 6" mechanical pint shoe, left opening,
with notional standard threads. The CONTRACTOR shall provide and install
on auxiliary volve of the type indicated on the contact drawings and a
length of 6" ductile Iron pipe sufficient to connect the hydrant to the
main. Direction of opening should be counter clockwise, color to be
enameled red. In oil cases. it is the CONTRACTOR'S responsibility to
check with the OWNER to secure approval, in writing, of the selected
hydrant(s) and assure compatibility. Curb boxes shall be buffalo -type
with telescoping tap.
9 The hydrant drain(s) shall be permanently plugged, or a non-droining
hydrant shall be Installed.
10 Ail hydrants shall be located between the curb and sidewalk, and be
set back a minimum of 4.0 feet from the face of the curb, in no cases
more than 6 feet. The hydrant shall have at least 18" between the
bottom of the steamer cap and the ground. Wherever a traffic hazard
appears to exist, the hydrant shall be protected by curbing and/or
bollards.
11. Topping sleeves k tapping calves -South Burlington Water Department.
All materials used when tapping for a branch connection or
interconnection from The South Burlington Water Department water
transmission or distribution pipelines shall be as specified below:
A. Tapping sleeves
Al. For use on existing asbestos cement, gray cost iron, ductile iron or

A1.1 Topping sleeves sholl be of the split sleeve design constructed with
two solid half -sleeves bolted together Sleeves shall be constructed of
cast iron or ductile iron, shall have a working pressure of at least 150
psi., and sholl hove mechanical pint ends with end and side gasket seals.
A 1.3 All bolts and nuts for mechanical joints of tapping steams shall be
of high -strength cost iron or high -strength, low-olloy steel conforming to
ANSI/AWWA C111/A21.11-90.
Ai.4 All bolts and nuts for flanged joints of tapping sleeves shall be
type 304 or 302 stainless steel.
Ai.S AII bolts and nuts shall be type 304 or 302 stainless steel
A 1.6 AII exposed surfaces shall be fusion bonded 10 mill epoxy and upon
final tightening and testing, be brush coated heavily with bitumostic
cold -applied material to thoroughly cover oil exposed surfaces of the
bolts and nuts.

Resilient -Sealed Gate Valens for Water and Sewage Systems, except as
modified herein. Valves shall open counter clockwise and shall have a
minimum working pressure of 150 psi, Inlet Ranges shall be Class 125
conforming to ANSI specification 816.1 or ANSI/AWWA ClIOIA21 10, and
outlet connection shall be standardized mechanical pint unless specified
otherwise on the contract drawings far the type of pipe required for the
branch or loterol pipeline
81.1 Topping valves 16" diameter and larger shall be installed with their
stems horizontal, shall be equipped with rollers, tracks and scrapers, and
shall be provided with bypass valves unless otherwise specified.
Bf.2 Buried topping valves shall be provided with a 2 inch square
wrench nut and shall be installed with a cast iron valve box as required
to allow positive access to the valve operating nut at oil times. In
Installations where the depth from grade to top of valve operating nut is
greater than 6'0", a volve stem riser shall be provided and installed such
that the depth from valve stem riser nut to grade is from 4'O" to 6'0"
(minimum length of valve stem riser is 2'0"). Valve stem riser sholl be
of high strength steel and of welded construction.

valve with a "a" ring type seal and manufactured of waterworks brass.
Curbstops shall be Mueller 15200 or equal and shall rest on a concrete
block for support All brass unions and adopters shall be Mueller or
approved equal.

15. It is the CONTRACTOR'S responsibility to secure all necessary permits
and permission to make connections, and to coordinate oil parties
involved with the project. No existing calves, hydrants, curb stops, etc.
shall be operated without prior approval of the OWNER.
76. The CONTRACTOR shall review oil relevant state permits associated
with this project, and it sholi be the CONTRACTOR'S responsibility to
assure all relevant requirements regarding construction, testing, and report
are met. Upon request, the ENGINEER shall furnish all copies of relevant
permits to the CONTRACTOR.
17. As builts prepared by the ENGINEER, are required at the completion
of the water system construction.
18. The South Burlington Water Department shall be notified 24 hours
before any testing is performed
19. The South Burlington Water Department sholl inspect all mechanical
pint fittings prior to burial.
SEWER SPECIFICATIONS
1. All gravity sanitary sewers shall be PVC sewer pipe meeting ASTM
Standard 03034-SOR35, cement -lined Ductile Iron pipe, minimum Class
52, or an approved equal Polyvinyl chloride PVC sewer pipe shell conform
to the latest ASTM Standard D-3034 Wall thickness of all PVC gravity
sewer pipe shall meet ASTM Standard for SDR-35. Joints shall be
push -on type using elostomeric gaskets conforming ro ASTM 0-3272 For
PVC sewer pipe, the OWNER requires the use of sand or Type III material
for bedding and lining• as indicated art the typical details.

allowable sustained pressure per ASTM 02241. Ductile iron pipe shall be

the plans
3 Ail sanitary sewer manholes sholl be constructed as detailed on the
plans. All manholes shall haw smooth inverts, rounded to the radius of
the sewer pipe. Every sonifory sewer manhole sholl haw a concrete
bench, as shown on the plans, which shall slope toward the invert and be
finished smoothly. All sanitary manholes shall be constructed watertight,
with both inlet and outlet pipes joined to the manholes with a gasket.
Rolle watertight connection No sanitary sewer manholes shall be
located where they will normally be inuirdated by storm water.
4 It is the CONTRACTOR'S responsibility to insure that all manholes are
watertight in ALL places (joints, walls, base etc.) excluding the cover.
The CONTRACTOR shall hove the manhtle coated with a waterproofing
agent, to accomplish the watertight condition All lift stations and
manholes shall be tested for infiltration by one of two methods; the
water test of vacuum test. Such testing shall be conducted with prior
written notice to the OWNER and the ENGINEER.
5. Ail service lateral to be connected tc the main sewer shall utilize on
"elbow and wye" connection, minimum size is 4" diameter. Clean outs
shall be places at 100 foot intervals for long services. Where immediate
hook up of the building sewer in not coincident with sewer main
construction, a stable temporary morker shall be provided by the
CONTRACTOR.
6. The CONTRACTOR sholl notify the OWNER, and the ENGINEER, W
WRITING, before he commences any sanitary sewer construction.
7. Any conflicts between these drawings and/or specifications and other
contract documents shall immediately be brought to the attention of the
OWNER and ENGINEER for resolution. The OWNER shall not be responsible
for expenses incurred by the CONTRACTOR where discrepancies are not
resolved.

In August 2004, I delineated wetlands on the Al-An's Auto Service property. There are two State of
Vermont Class 3 wetland areas on the property and one Class 2 wetland beyond the rear property line. These
wetlands are shown on the attached plan and photos.
Wetland `A' formed along the rear edge of the parking lot, where stormwater runoff from the
pavement and the building roof is directed. Soil saturation is likely to occur for a short period of time with
each significant rainfall. The wetland is dominated by touch-me-not, joe pye weed, and grass -leaved
goldenrod. The soil profile is hydric and formed in very fine sandy loam. Much of this wetland would be
impacted by the proposed expansion that would extend the paved parking lot 40 to 50 feet toward the rear of
the property (reference is made to the attached plan by J.G. Architects, Inc. labeled "SK-1 "). The entire
wetland area on the property is approximately 1,300 square feet. While the wetland does provide some water
quality treatment, this function will be replaced by a connection to the existing stormwater basin. None of the
other typically recognized wetland functions (flood storage, fish habitat, wildlife habitat, threatened and
endangered species, uniqueness, educational/scientific value, recreation, aesthetics, and erosion control) are
provided by this wetland.
Wetland `B' is located in an elongated depression about 175 feet beyond the rear edge of the existing
parking lot. The wetland is dominated by small white aster, redtop, grass -leaved goldenrod, sensitive fern,
and boneset. The soil profile is hydric and formed in loamy very fine sand. No impact to this wetland will be
required as part of the proposed expansion.
Wetland `C' is located south of the rear property line. Neither the wetland or its 50-foot buffer zone
occur on this parcel.

bothered by it. She added that she would like to see some
way to define the corners of the lot. Mr. Webster said that
could be done. Mrs. Maher said she would also like to see
new healthy trees up front.
Ms. Peacock moved the Planning Commission approve the site
plan application of Community Lutheran Church for con-
struction of 2,432 sq. ft. of additions as depicted in a plan
entitled "elite Plan, Community Lutheran Church, Williston
Road, South Burlington, Vermont" prepared 12y Wiemann-Lamphere
Architects and dated 7/7/88 and revised 10/7 88 with the
following stipulations:
1. The applicant shall post a $6,000 3-year landscape bond or
letter of credit prior to permit. The plan shall be revised
prior to permit to show 3 new 3" caliper maple trees along
Williston Road.
2. The plan shall be revised prior to permit to show the
alternate parking layout titled "Alternate Parking Layout
Community Lutheran Church" dated 10/7/88.
3. Railroad ties shall be put in to define the corners of the
parking lot.
4. The revised plan shall be submitted to and approved 12Y the
City Planner and City Engineer prior to permit.
5. The parking lot use shall be reviewed in one year to
determine if it is satisfactory, and if it is not, the
Planning Commission may require the lot to be paved w4d slr�pe.d .
6. The building permit shall be obtained within 6 months or
this approval is null and void.
Mr. Burgess seconded. Motion passed 5-1 with Mrs. Maher
opposing because she felt the lot should be paved. She
indicated she would not have objected to phasing over 3 or 4
years.
3. Site Plan application of Cooley -Wood Corporation for
construction of a 2900 sq. ft. building for auto service and
repair, lot 34 Ethan Allen Industrial Subdivision.
Jim Wood indicated this will be the new location for Al -An$
Service Station. They have lost their Williston Rd. lease.
The new location will only service vehicles. No gas will be
sold. The project meets all setback and lot coverage re-
quirements. There will be Austrian pines up front with yews

and locust elsewhere on the site. The Fire Chief has
approved the access. The storm drain is now shown. Mr.
Weith noted that the City Engineer wants the easement shown
on the plan. Mr. Jacob noted that a grit and grease trap
must also be shown. Mr. Wood said there will be 3 overhead
doors in front leading to the bays. There is also a drive -
through for the wrecker to go through. The building will be
52' x 56'. There is parking for 17 cars, 8 more than would
be regUired. The lot will be paved. No cars will be sold
from this location. There will be one or 2 downshielded
security lights. Mr. Wood confirmed the curb will be de-
pressed concrete.
Ms. Peacock moved the Planning Commission approve the Site
Plan application of Cooley -Wood corporation for construction
of a 2900 sq. ft. building for automobile service uses as
depicted on a plan entitled "Al-An's Service, Lot 34, Ethan
Allen Industrial Subdivision, South Burlington, Vermont,
05403" prepared by Jim Wood and dated 9/6 88 with the fol-
lowing stipulations:
1. A $3,000, 3-year landscaping bond shall be posted prior to
permit.
2. A sewer allocation of 150 gpd is granted and will be
deducted from the entire Ethan Allen Industrial Subdivision
allocation. The $2.50 per gallon fee must be paid prior to
permit.
3. The applicant shall contribute, prior to permit, 880 to
the Airport Parkway/Ethan Allen Drive/Shamrock Road Inter-
section Improvement Fund. The proposed improvements for
which this fund will be used are described in a letter from
Jame LaFleur to John Belter dated 9/3/87.
4. The plan shall be revised prior to permit to show a 10 ft.
wide drainage easement along the pipe draining the street
along the west side of the site.
5. The site shall drain toward the south.
6. There shall be a gait and grease trap on all floor drains
in the building
7. Revisions to the plan shall be approved �2y the City Plan-
ner and City Engineer prior to permit.
8. The plan shall be revised to show a continuous depressed
concrete curb.

4. Discussion of South Burlington Zoning Regulations:
proposed amendments to Article II, Flood Plain District
Mr. Weith advised that the Regulations must be updated to
comply with new federal regulations in order to get flood
plain insurance. He then outlined the Flood Plain District
on the map. He suggested adopting a flood plain regulation
that overlays the Zoning Ordinance, instead of just a flood
plain district. If the City decides to keep a flood plain
district, they should indicate all the locations throughout
the city. Mr. Craig suggested having the City Attorney look
into the matter to see if the amount of State control is
really necessary. Members agreed Mr. Weith should come up
with wording and have it reviewed by the City Attorney before
bringing it to the Commission.
5. Possible Amendment to Article XIII, "Mixed Industrial and
Commercial District" to allow planned commercial developments
Mr. Weith said this is one zone in which the city wanted to
encourage grid development. Mr. Burgess recalled that pcd's
were specifically excluded though he could not recall why.
Mr. Maher said she would feel better if pcd's were made a
conditional use contingent upon Planning Commission judgment.
She suggested the Planner talk with Jane LaFleur and David
Spitz to find out the history of this. Others agreed.
6. Other Business
a) Pizzagalli/Brown subdivision: a sentence in the Minutes
noted that there would be no structures on the new lots. The
applicants have said they don't want to limit themselves.
Mr. Jacob said this was no problem as it was not the
Commission's intent to limit building on those lots. The
Minutes only quoted the applicants.
b) Pomerleau: David White called regarding the discussion on
the Shelburne Rd. property. He said they had been asked to
table their request and come in with a Master Plan. Mr.

1) 2-LOT SUBDIVISION, RIEHLE PROPERTY, SPEAR STREET
On June 21, 1988, the Planning Commission approved the Final Plat
application of Steve Pcolar and Jim LaPlant for a 2-lot
subdivision of the 1 acre Riehle property. The 6/21/88 Planning
Commission meeting minutes are enclosed. The applicant failed to
record the approved Final Plat within the 90 day period.
Therefore, the applicant is coming back to the Planning
Commission for reapproval.
2) COMMUNITY LUTHERAN CHURCH, WILLISTON ROAD
At the time of drafting this memo, I had not yet received a
revised plan. Therefore, I was not able to review the plan or
draft an approval motion.
3) COOLEY-WOOD, LOT 34, ALLEN INDUSTRIAL SUBDIVISION
Cooley -Wood Corporation proposes to construct a 2,900 square foot
building for automobile service use. The building will be used
for automobile service and repair only and will not contain gas
pumps.
The lot is bounded by vacant Ethan Allen Industrial Park lots on
the east and west, Commerce Avenue on the north and vacant land,
owned by either John Belter or the airport, on the south.
Access/Circulation: Access is shown from a 25 foot wide drive on
Commerce Avenue. Circulation is provided on the north, west and
south sides of the building.
Parking: The proposed use requires 6 spaces plus 3 spaces
for vehicle storage (9 spaces total). The plan shows 17 spaces,
which should be sufficient.
Landscaping: The project requires $3000 in landscaping. The
plan shows Shademaster Locust, Flowering Crab, Austrian Pine and
Spreading Yews. The proposed landscaping meets the required
value.

4) DISCUSSION OF PROPOSED AMENDMENTS TO ARTICLE II, -FLOOD PLAIN
DISTRICT
As I mentioned several weeks ago, I received a call from the
Federal Emergency Management Agency (FEMA) regarding necessary
revisions to the City's flood plain regulations. The gentleman I
spoke with said that the City must update its ordinance to
comply with recent revisions in the National Flood Insurance
Program regulations. He said that if the City does not update
its flood plain regulations accordingly, it will be suspended
from the National Flood Insurance Program.
Karl Jurentkuff of the Vermont State Agency of National Resources
has reviewed the City's ordinance and has made recommendations
on how we should revise it in order to comply. He has marked up
sections of the ordinance with suggested changes and
recommendations (enclosed). Also enclosed is a copy of a memo he
sent in January, 1988 regarding the provisions which flood plain
regulations should address in order to meet National regulations.
Please review Mr. Jurentkuff's recommendations so we may begin
discussions on amending the City's Ordinance. Give particular
attention to his recommendation that we should have a separate
flood plain regulation instead of a designated flood plain
district in our zoning ordinance. His reason for recommending a
separate regulation is based on Section 22.007 of the City's
zoning ordinance. Most flood plain regulations I have seen in
other municipalities have been in the form of separate
regulations rather than a designated district in the
municipality's zoning ordinance.

District Environmental Commission #4 hereby issues a Land Use Permit
Amendment #4C0643-9, pursuant to the authority vested in it in 10
V.S.A., Chapter 151. This permit amendment applies to the lands
identified in Book 148, Page 225, of the land records of the City of
South Burlington, Vermont, as the subject of a deed to John Belter,
the "Permittee" as "grantee". This permit specifically authorizes the
Permittee to construct a 2,900 square foot service station, to use
municipal water and sewer services, on Lot #34 of the Ethan Allen Farm
subdivision located off Ethan Allen Drive in South Burlington, Ver-
mont.
The Permittee, and its assigns and successors in interest, are
obligated by this permit to complete, operate, and maintain the pro-
ject as approved by the District Commission in accordance with the
following conditions:
1. All the conditions of Land Use Permit #4CO643 and amendments are
in full force and effect, except as amended herein.
2. The project shall be completed, operated and maintained as set
forth in accordance with the plans and exhibits stamped "Ap-
proved" and on file with the District Evi ronmental Commission,
and in accordance with the conditions of this permit. No changes
shall be made in the project without the written approval of the
District Environmental Commission.

3. The District Environmental Commission maintains continuing juris-
diction during the lifetime of the permit and may periodically
require that the permit holder file an affidavit certifying that
the project is being completed, operated and maintained in accor-
dance with the terms of the permit.
4. By acceptance of the conditions of this permit without appeal,
the Permittee confirms and agrees for himself and all assigns and
successors in interest that the conditions of this permit shall
run wi th the 1 and and the 1 and uses herei n permi tted, and wi 1 1 be
binding upon and enforceable against the Permittee and all as-
signs and successors in interest.
5. The project is approved for the following maximum cumulative
impacts:
16 vehicle parking spaces;
150 gallons per day of water and wastewater;
30 vehicle trips per day;
12 peak hour vehicle trips;
42 kilowatts of electricity.
6. This permit hereby incorporates all of the conditions of the
Water Supply and Wastewater Disposal Permit #WW-4-0043 issued on
November 10, 1988 by the Regional Engineer, Division of Pro-
tection, Department of Environmental Conservation, Agency of
Natural Resources. Conditions #2, #7, #8, and #9 of said permit
are as follows:
(2) The project shall be completed as shown on the plans "A1-
An's Service Lot 34 Ethan Allen Industrial Subdivision"
dated 9-6-88 revised 10-29-88 prepared by Cooley -Wood Corp.
and which have been stamped "approved" by the Division of
Protection. The project shall not deviate from the approved
plans without prior written approval from the Division of
Protection.
(6) By acceptance of this permit, the permi ttee agrees to allow
representatives of the State of Vermont access to the
property covered by the permit, at reasonable times, for the
purpose of ascertaining compliance with Vermont environmen-
tal/health statutes and regulations, and with this permit.
(7) The project is approved for water supply by construction and
utilization of the municipal water service depicted on the
approved plans. No other means of obtaining potable water
shall be allowed without prior review and approval by the
Division of Protection.

(8) The project is approved for connection to the South
Burlington Airport Parkway wastewater treatment facility for
a maximum of 150 gallons of sewage per day.
(9) A professional engineer, registered in the State of Vermont
is to generally supervise the construction of the sanitary
sewer line extensions and, upon completion of construction,
the supervising engineer is to submit to the Protection
Division a written certification stating all construction
has been completed in accordance with the stamped approved
pl ans. The engineer's certification is to be submitted to
the Di vi si on pri or to the occupancy of any uni t and the
certification shall include, but not be limited to, the
numerical results of all leakage testing performed on each
segment of the sanitary sewer extension and all manholes,
Pump stations and force mains as described in Appendix A, of
the Environmental Protection Rules.
7. The Permi ttee shall apply and maintain water and/or calcium
chloride on all roadways or disturbed areas within the project
during construction and until pavement and/or vegetation is fully
established to control dust.
8. The Permi ttee shall comply with all terms and conditions of the
Discharge Permit issued for the Ethan Allen Farm subdivision.
9. The building approved herein is not approved for any manufac-
turing use or the on -site disposal of any process wastes. The
Permi ttee shall apply and receive approval for any change in the
use of the buildings which involves the storage or handling of
any regulated substances or the generation of hazardous wastes.
10. Prior to commencement of construction the Permittee shall contact
the Division of Hazardous Wastes for review of the floor drain
plans.
11. The Permi ttee shall apply to the District Environmental Commis-
sion for approval for any change in the use of the building and
land which would cause noxious or unhealthy emissions into the
air or injection of toxic wastes into the soils.

'12. The Permittee and all assigns and successors in interest shall
install and maintain water conserving plumbing fixtures. The
plumbing fixtures shall operate with the following specifica-
tions: (1) internal system water pressure of 50 psi maximum, (2)
toilets with a maximum of 3.5 gallons per flush, (3) showerheads
operating with a maximum of 3 gallons per minute, and (4) faucets
on si nks and 1 ays shal 1 operate at a maximum of 3 gal lons per
minute. An alternative water conservation plan may be presented
to the Commission for approval before implementation. The ap-
proved alternate shall be implemented and maintained by the
Permittee for the duration of the permit.
13. The Permittee shall comply with Exhibit #4 for erosion
control. Hay bale dams and silt fences shall be installed as
depicted on the plans prior to commencement of construction. The
Permittee shall prevent the transport of any sediment beyond that
area necessary for construction approved herein. All
construction performed between October 15 and April 15 of the
calendar year shall be in conformance with all winter erosion
controls set forth in the "Vermont Handbook for Soil Erosion and
Sediment Control on Construction Sites." All erosion control
devices shall be periodically cleaned, replaced and maintained
until vegetatioin is permanently established on all slopes and
disturbed areas. The Commission reserves the right to schedule
hearings and site inspections to review erosion control and to
evaluate and impose additional conditions with respect to erosion
control as they deem necessary.
14. Prior to commencement of construction, the Permittee shall have a
professional engineer, or other qualified person certify that the
erosion control plan contains site specific erosion control mea-
sures necessary to provide a level of protection at least equiva-
lent to the procedures outline in the "Vermont Handbook for Soil
Erosion and Sediment Control on Construction Sites."
15. In addition to conformance with the requirements of condition
#14, the Permittee shall not cause, permit or allow the discharge
of waste materials into any surface waters. Compliance with the
requirements of this condition does not absolve the Permittee
from compliance with 10 V.S.A., Chapter 47, Vermont's Water
Pollution Control Law.
16. The Permittee and all assigns and successors in interest shall
continually maintain the landscaping as approved in Exhibit #9
by replacing any dead or diseased plantings as soon as seasonably
possible. Vegetation will have a mature height of no greater
than 15 feet.

17. The installation of exterior light fixtures is limited to those
approved in Exhibit 46, and shall be mounted no higher than
12 feet above grade level. All exterior lighting shall be in-
stalled or shielded in such a manner as to conceal light sources
and reflector surfaces from view beyond the perimeter of the area
to be illuminated.
18. Prior to occupancy the Permi ttee shall submit to the District
Commission for review and approval plans for all exterior signs.
19. All heated structures approved herein shall be constructed with
insulation with an R Value of at least R-19 in the exterior
walls, at least R-38 in the roof or cap and at least R-10 around
the foundation or slab to comply with the ASHRAE 90-80 standards.
20. The installation and or use of electric resistance space heating
is specifically prohibited without the prior written approval of
the District Environmental Commission.
21. The roof of this building shall be of a dark, non -reflective
color.
22. No snow shall be stockpiled in the utility easement unless the
Permittee is given written consent by the utilities.
23. The gasoline storage tank (s) at this facility shall be equipped
with a permament submerged fill pipe and be capable of being
converted to a vapor balance system without replacement of the
submerged fill pipe.
24. All construction on this project must be completed by December 15,
1989.
25. This permit shall expire on October 15, 2019 unless extended by
the District Commission. Notwithstanding, this permit shall
expire one year from date of issuance if the Permi ttee have not
demonstrated an intention to proceed with the project.
Failure to comply with all of the above conditions may be grounds for
permit revocation pursuant to 10 V.S.A. Section 6090(b).

Notice is hereby given that on October 11, 1988, an applica-
tion was filed by Al-An's Service Station, Williston Road, South
Burlington, and John Belter, 2 Country Club Drive, South Bur-
lington, Vermont to construct a 2900 square foot service sta-
tion, to use municipal water and sewer facilities, on Lot #34 in

The District Environmental Commission will treat this appli-
cation under Environmental Board Rule 51 -- Minor Applications
(amended effective 9-1-84). A proposed permit has been prepared

Findings of Fact and Conclusions of Law will not be prepared
unless a public hearing is requested. The request shall state
in writing with specificity why a hearing is required and what
additional evidence will be presented.

the above referenced project. As indicated in the Notice of Applica-
tion and Hearing, this application is being processed as a "Minor"
pursuant to Environmental Board Rule 51 (as amended on September 1,
1984) and no hearing will be held unless specifically requested. Any
hearing held at the request of a party would only be for the purpose
of considering issues raised by the requesting party under the appro-
priate criteria of Act 250. Because this proposed permit has been
prepared based upon consultations with only the Chairman of the Dis-
trict Commission, it is subject to further revision or amendment after

12. The Permittee and all assigns and successors in interest shall
install and maintain water conserving plumbing fixtures. The
plumbing fixtures shall operate with the following specifica-
tions: (1) internal system water pressure of 50 psi maximum, (2)
toilets with a maximum of 3.5 gallons per flush, (3) showerheads
operating with a maximum of 3 gallons per minute, and (4) faucets
on si nks and 1 ays shal 1 operate at a maximum of 3 gal lons per
minute. An alternative water conservation plan may be presented
to the Commission for approval before implementation. The ap-
proved alternate shall be implemented and maintained by the
Permittee for the duration of the permit.
13. The Permittee shall comply with Exhibit #4 for erosion
control. Hay bale dams and silt fences shall be installed as
depicted on the plans prior to commencement of construction. The
Permittee shall prevent the transport of any sediment beyond that
area necessary for construction approved herein. All disturbed
areas of the construction site shall be stabilized, seeded and
mulched within 1 to 14 days of initial disturbance, and prior to
October 1, to ensure proper stabilization of disturbed soils.
All erosion control devices shall be periodically cleaned, re-
placed and maintained until vegetati of n is permanently estab-
lished on all slopes and disturbed areas. The Commission re-
serves the right to schedule hearings and site inspections to
review erosion control and to evaluate and impose additional
conditions with respect to erosion control as they deem ne-
cessary.
14. Prior to commencement of construction, the Permittee shall have a
professional engineer, or other qualified person certify that the
erosion control plan contains site specific erosion control mea-
sures necessary to provide a level of protection at least equiva-
lent to the procedures outline in the "Vermont Handbook for Soil
Erosion and Sediment Control on Construction Sites."
15. In addition to conformance with the requirements of condition
#14, the Permittee shall not cause, permit or allow the discharge
of waste materials into any surface waters. Compliance with the
requirements of this condition does not absolve the Permittee
from compliance with 10 V.S.A., Chapter 47, Vermont's Water
Pollution Control Law.
16. The Permittee and all assigns and successors in interest shall
continually maintain the landscaping as approved in Exhibit #9
by replacing any dead or diseased plantings as soon as seasonably
possible. Vegetation will have a mature height of no greater
than #15.

17. The installation of exterior light fixtures is limited to those
approved in Exhibit #6, and shall be mounted no higher than
12 feet above grade level. All exterior lighting shall be in-
stalled or shielded in such a manner as to conceal light sources
and reflector surfaces from view beyond the perimeter of the area
to be illuminated.
18. Prior to occupancy the Permittee shall submit to the District
Commission for review and approval plans for all exterior signs.
19. All heated structures approved herein shall be constructed with
insulation with an R Value of at least R-19 in the exterior
walls, at least R-38 in the roof or cap and at least R-10 around
the foundation or slab to comply with the ASHRAE 90-80 standards.
20. The installation and or use of electric resistance space heating
is specifically prohibited without the prior written approval of
the District Environmental Commission.
21. The roof of this building shall be of a dark, non -reflective
color.
22. No snow shall be stockpiled in the utility easement unless the
Permittee is given written consent by the utilities.
23. All construction on this project must be completed by October 15,
1989.
24. This permit shall expire on October 15, 2019 unless extended by
the District Commission. Notwithstanding, this permit shall
expire one year from date of issuance if the Permittee have not
demonstrated an intention to proceed with the project.
Failure to comply with all of the above conditions may be grounds for
permit revocation pursuant to 10 V.S.A. Section 6090(b).

The Air Pollution Control Division notes that if
gasoline storage tanks are to be installed at this
project site, the following condition should be

The gasoline storage tank(s) at this facility
shall be equipped with a permanent submerged fill
pipe and be capable of being converted to a vapor
balance system without replacement of the
submerged fill pipe.
CRITERION 1(B) - HAZARDOUS WASTE
The Hazardous Waste Management Section notes that this
project is located approximately 2000 feet northwest
of the former Vermont Air National Guard Fire
Department training area/old landfill hazardous waste
site. The applicant should be aware that the project
may be located hydraulically downgradient from the
contamination. If there are any questions on this
site, please contac John Strunk of Hazardous Sites
Management Section at 244-8702. Also, the Section
requests the applicant file a Notification of Proposed
Hazardous Waste Activity for vehicle service
activities at this new location with the hazardous

District Environmental Commission #4 hereby issues a Land Use Permit
Amendment #4C0643-8, pursuant to the authority vested in it in 10
V.S.A., Chapter 151. This permit amendment applies to the lands
identified in Book 148, Page 225, of the land records of the Town
of South Burlington, Vermont, as the subject of a deed to Gary Riggs,
the "Permittee" as "grantee". This permit specifically authorizes the
Permittee to construct four 2,250 square foot storage/distribution
units, to use municipal water and sewer facilities, in Ethan Allen
Park located off Ethan Allen Drive in South Burlington, Vermont.
The Permittee, and its assigns and successors in interest, are
obligated by this permit to complete, operate, and maintain the pro-
ject as approved by the District Commission in accordance with the
following conditions:
1. All the conditions of Land Use Permit #4CO643-8 and amendments
are in full force and effect, except as amended herein.
2. The project shall be completed, operated and maintained as set
forth in accordance with the plans and exhibits stamped "Ap-
proved" and on file with the District Evi ronmental Commission,
and in accordance with the conditions of this permit. No changes
shall be made in the project without the written approval of the
District Environmental Commission.

3. The District Environmental Commission maintains continuing juris-
diction during the lifetime of the permit and may periodically
require that the permit holder file an affidavit certifying that
the project is being completed, operated and maintained in accor-
dance with the terms of the permit.
4. By acceptance of the conditions of this permit without appeal,
the Permittee confirms and agrees for himself and all assigns and
successors in interest that the conditions of this permit shall
run with the land and the land uses herein permitted, and will be
binding upon and enforceable against the Permittee and all as-
signs and successors in interest.
5. The project is approved for the

180 gallons per day of water

approved plans. No other means of obtaining potable water
shall be allowed without prior review and approval by the
Division of Protection.
8) The project is approved for connection to the South
Burlington Airport Parkway wastewater treatment facility for
a maximum of 195 gallons of sewage per day.
7. The Permittee shall apply and maintain water and/or calcium
chloride on all roadways or disturbed areas within the project
during construction and until pavement and/or vegetation is fully
established to control dust.

8. Prior to commencement of construction of this building the Per-
mittee shall file either an amended Discharge Permit issued by
the Agency of Natural Resources or evidence that such an amended
permit is not required.
9. The building approved herein is not approved for any manufac-
turing use or the on -site disposal of any process wastes. The
Permittee shall apply and receive approval for any change in the
use of the buildings which involves the storage or handling of
any regulated substances or the generation of hazardous wastes.
10. The installation of floor drains is specifically prohibited
without the prior written approval of the District Environmental
Commission.
11. The Permittee shall apply to the District Environmental Commis-
sion for approval for any change i n the use of the building and
land which would cause noxious or unhealthy emissions into the
air or injection of toxic wastes into the soils.
12. The Permittee and all assigns and successors in interest shall

Commerce Drive, South Burlington, Vermont.
Our office has completed an initial review of the above
referenced project and have determined that the additional
information listed below will be needed before approval can be
granted.
(1) Submit a letter from the municipality approving the water
and wastewater flows.
(2) The sewer and water services to the building shown on the
site plan do not coincide with the sewer and water shown on
DWG. No. P-1. Please revise as needed.
Please submit two copies of any revised plans.
Please note that no construction is granted until written
approval is issued by the Division and all other authorities.
Upon receipt of the above items, we shall continue our review.
