Timothy Duff Request for Conditional use - 500 Swift Street Findings of Fact, Conclusion of Law & Order This matter came before the South Burlington Zoning Board of Adjustment on November 24, 1997 by application of Timothy Duff agent for Temple Sinai, Inc. the appellant for a conditional use approval to construct two additions totaling 4794 squar feet at 500 Swift Street according to plans submitted. The Board of Adjustment finds as follows: 1) That 500 Swift Street is a Residential II District. 2) That churches are a conditional use within the Residential II District. 3) That the existing church contains 7,429 square feet and that the proposed additions are to classrooms, social hall and kitchen. 4) The lot is located at Swift and Dorset Streets and contains 3.9 acres. 5) The property is connected to City water and sewer facilities. 6) No adverse impact on municipal services are projected, the overall size of the assembly will not increase. 7) The proposed additions are to the social hall and kitchen, five additional fixtures will be installed. 8) No adverse impact of traffic, peak hour trip ends are projected to be 37.8 and average daily at 128.2 - before January 1, 1998 the Dorset and Swift Street intersection will be signalized. 9) Proposed additions are in compliance with setbacks and lot coverage. December 12, 1997 Mr. Richard Ward, Zoning Administrator City of South Burlington 575 Dorset Street South Burlington, VT 05403 Re: Site plan application for Temple Sinai expansion, 500 Swift street Dear Dick: I would like to respond to your comments regarding the apparent disparity between my testimony at the zoning board hearing on November 24 and the Burlington Freepress article of November 27. It has always been my position that we are planning to expand our social hall as well as our religious school. Our submitted plans indicate two additions to the temple; to the north we are doubling the size of our social hall as well as expanding our kitchen and storage. The addition to the south will add an education director's office and four new classrooms. Please refer to the enclosed floor plan, a copy of which was submitted with our planning application. Our current sanctuary seating of 151 will not be expanded. The social hall is being expanded so that we can accommodate the dinning and entertainment portion of life cycle events (weddings and bar mitzvahs). Typically attendance at these events is between 75 and 150 people. Our expanded social hall can accommodate 24 tables of 8 for a seated capacity of 192. The figure of 200 in the Free Press article i"s a bit of hyperbole. The typical event would not accommodate 192 people when you allow for buffet lines or dancing. We are in fact expanding our kitchen by one sink. Please refer to enclosed sketch plans of the existing and proposed kitchen layouts. Most of our kitchen area expansion is for food storage and prep area. December 12, 1997 Mr. Richard Ward Page Two Our proposed parking expansion is to 50 spaces total. By city standards (one space per three people) we are in compliance with the seating capacity of our sanctuary taken into account. In the event there is a function with greater attendance, which does happen four times a year during high holidays, we have a long standing agreement with the Church of Later Day Saints to share our parking resources. I do not believe the entire portion of the building footprint square footage should be used in calculating the required number of parking spaces. Temple Sinai is both a place of worship and religious education. The proposed expansion will be increasing the size of the religious school and the social hall with its' support spaces. There will be no increase in the sanctuary seating of 151. We are expanding the social hall to accommodate the dinning and entertainment portion of life cycle events (weddings, bat mitzvahs) we cannot currently hold in the social hall. Please note that the ceremonial portion of these life cycle events is currently held in our present sanctuary, which will not be expanded. Please refer to the enclosed breakdown of building square footage. We expect attendance at nearly all of our major functions and events will be between 100 and 150 people. There are only four days per year when we have a religious function with greater attendance. Please review the enclosed calendar chart, which depicts use of the temple on an annual basis. Our solution for overflow parking on these days has been our agreement with the Church of Later Day Saints to share our parking resources with each other I feel a more appropriate measurement by the city zoning regulations for religious institutions would be to use the school requirement of 4 spaces per assembly seat. Burlington, VT 05403 Dear Sirs: November 14, 1997 We would like to confirm the fact that since the original construction of the building of Temple Sinai next to our church building on the corner of Swift Street and Dorset Street we have had an ongoing agreement with Temple Sinai to share parking spaces to help lessen the burden on either congregation. This shared parking arrangement has worked out very well for both of us and we wish it to continue in the future with the understanding that the parking lots are still separately owned and neither party has or will have preemptive rights over the other parking lot or spaces and that either party is not bound to continue this arrangement in the future.
