Dear Ray:
Enclosed are copies of portions of the plans submitted and approved for the Temple Sinai
expansion project. Please note they indicate the removal and reinstallation of an arbor/play
structure, more accurately known as a sukka, the structure you refer to in your letter to the
temple.
When we rebuilt the sukka we decided to relocate it to the north side of our building adjacent to
our social hall from where it was originally indicated on the plans. Please let me know if you
require any more information or action on our part.

This project, consisting of a proposed 12,197 square foot addition to provide six classrooms and
larger social hall , served by municipal water and sewer services, located off Swift Street in the city
of South Burlington, Vermont is hereby approved under the requirements of the regulations named
above, subject to the following conditions.
GENERAL
This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from the Department of Labor and Industry -phone (802) 828-2106 or
(802) 658-2199 and local officials prior to proceeding with this project.
2. The project shall be completed as shown on the following plans which have been stamped
"approved" by the Wastewater Management Division:
Sheet C2, "Proposed Site Plan" dated November 1997 prepared by Engineering Ventures,
Inc..
The project shall not deviate from the approved plans without prior written approval from
the Wastewater Management Division.
3. No alterations to the building that would change or affect the exterior water supply or sewage
disposal, or the approved use of the building shall be allowed without prior review and
approval from the Agency of Natural Resources.
4. The Wastewater Management Division now reviews the sewage and water systems for public
buildings under 10 V.S.A., Chapter 61 - Water Supply and Wastewater Disposal Permit.
By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations, with
this permit.

6. All conditions set forth in Permit #PB-4-0990 shall remain in effect except as modified or
amended herein.
7. A copy of the approved plans and this permit shall remain on the project during all phases of
construction and, upon request, shall be made available for inspection by State or local
personnel.
WATER SUPPLY
8. The project is approved for water supply by connection to the municipal water system. No
other means of obtaining potable water shall be allowed without prior review and approval
by the Wastewater Management Division.
SEWAGE DISPOSAL
9. The project is approved for wastewater disposal by connection to the municipal sewer system
for a maximum of 1,383 gallons of sewage per day. No other method of wastewater disposal
shall be allowed without prior review and approval by the Wastewater Management Division,
and such approval will not be granted unless the proposal conforms to the applicable laws and
regulations.

Re: Findings of Fact, application of Timothy Duff to amend a
previously approved plan for a 7400 square foot synagogue. The
amendment consists of construction of two (2) additions with a
combined square footage of 12,140 square feet, 500 Swift Street.
On the 25th day of November, 1997, the South Burlington Planning
Commission approved the request of Timothy Duff for site plan
review under Section 26.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project consists of amending a plan previously approved
on 3/26/85 for a 7400 square foot synagogue. The amendment
consists of the construction of two (2) additions with a combined
square footage of 4740 square feet for a total square footage of
12,140 square feet. The ZBA on 11/24/97 approved a request from
the applicant for a conditional use permit for the expansion.
2. This property located at 500 Swift Street lies within the R2
District. It is bounded on the north by a single family
residence (under construction), on the east by Dorset Street, on
the south by Swift Street, and on the west by a church.
3. Access/circulations: Access is provided by a 20 foot curb cut
on Swift Street. No changes proposed. A pedestrian access to
the adjoining church is existing.
Circulation o the site is adequate.
4. Coverage/setbacks: Building coverage is 7..1% (maximum allowed
is 30%). Overall coverage is 22.7% (maximum allowed is 70%).
Front yard coverage (excluding the bike path) along Swift Street
is 5.8% and along Dorset Street is 0% (maximum allowed is 30%).
The plan should be revised to note the correct front yard
coverage information.
5. Setback requirements are met. Plan should be revised to note
that the front setback requirement from Dorset Street is 67 feet
not 66 feet.
6. Parking: A total of 50 parking spaces are required and 50
spaces including two (2) handicapped spaces and a bike rack are
being provided. This parking requirement is based upon the
applicant's expressed representation at the meeting that, with
the exception of several holidays during the year, there would be
no more than 150 people in the building at any one time. The
3/26/85 approved plan showed a total of 54 spaces, not all of
which were constructed. The applicant has an unofficial

amend a previously approved site plan for. a 13,900 sq. ft.
light manufacturing building, 78 Ethan Allen Drive. The
amendment consists of constructing a 60 foot long sidewalk
extension. APPROVED.
The chair asked if any members of the Commission or audience had
any issues to raise with the consent agenda. No such issues were
raised.
Mr. Teeson moved the Commission approve the application decisions
made by the City Planner subject to Findings of Fact in the City
Planner's memorandum of 21 November 1997. Ms. Barone seconded.
Motion passed unanimously.

approved plan for a 7400 sq. ft. synagogue. The amendment con-
sists of construction of two additions with a combined square
footage of 12,140 sq. ft., 500 Swift Street:
Mr. Duff explained that the congregation has outgrown the
facilities. The parking lot is dimensionally substandard and
is not striped. The plan is to add an addition to the north for
a social hall/support facility and an addition to the south for
classrooms. The Zoning Board has granted Conditional Use
approval.
Because of the CO Zone, the parking lot cannot be expanded in
that direction, but they have extended parking toward the
building for a total of 50 spaces. Landscaping has been de-
signed in accordance with regulations. There is a walkway to the
church on the adjacent lot, and an agreement exists with the
church to use each other's parking for special events.
Mr. Duff disagreed with how staff calculates parking (1 space
per 3 fixed seats) and said it should be more like schools (1
space for 4 seats in an assembly). Mr. Burgess had no problem
with this if there is a legal agreement regarding the shared
parking arrangement. Mr. Duff said he will look into that.
Three light poles are proposed in the parking lot and some
cut-off fixtures mounted on the building. The dumpster will be
at the extreme north of the property and will be screened with
a picket fence. Mr Duff showed members photos of the site.
Mr. Weith asked the maximum parking demand. Mr. Glazier said
there are 2 major spikes in parking at the High Holy Days.
This is not usually a problem because of the shared parking with
the church. During the regular year, there is no parking problem

as there are very few simultaneous events at the synagogue and
church. Mr. Rubin said the synagogue's major events occur on
Friday evening and Saturday morning. Those at the church occur
on Sunday. Mr. Burgess noted receipt of a letter from the Mormon
church indicating that the arrangement works well. Mr. Weith
said that as long as there is a statement in the Findings of Fact
that there are not usually more than 150 people in the synagogue
at one time, he had no problems.
Mr. Duff moved the Planninq_Commission�approve _the site__Plan ap-
licatiion of Timothyto amend__a previously approved plan
for. a 7400 sq ft. synagoque. The �amendment _consists of con-
struction of two additions with a combined square footage of
12,140 s . ft, 500_Swift Street, as depicted on a three page set
of plans, age one entitled "Existing Site Plan Temple Sinai Site
and Building Renovations South Burlin ton, Vermont," prepared by
Engineering Ventures, Inc, dated October 24,_1997, with the fol'
lowing stipulations:
1. All previous approvals and stipulations which are not suser�
seded by�this_approvall shall remain in effect.

South Burlington Impact Fee Ordinance, the Planning Commission_
estimates that the additions will generate 14.9�additional

Planner prior to installation.

5. Prior to issuance of a zoning permit, the applicant shall ost
a $12,820 landscape bond. The bond shall remain in effect for.
three years to assure that the landscaping takes root and has a
good chance of surviving.

previously approved site plan for a 3200 sq. ft. warehouse. The
amendment consists of 1) changing the use of the building to
light manufacturing, and 2) enclosing a 320 sq. ft. loading dock,

Mr. Berard explained that they had to give a tenant more space,
so they enclosed the loading dock.
Mr. Burgess said that a bike rack must be provided. Mr. Berard
agreed to do so.
Mr. Burgess noted a requirement for $85 in landscaping. Mr.
weith felt it wouldn't accomplish anything.
Mr. Berard said they don't have a dumpster yet, but if they get
one, they will enclose it.
Ms. Barone moved the Planning Commission approvethe site 21an

This project consists of amending a plan previously approved on
3/26/85 (minutes enclosed) for a 7400 square foot synagogue. The
amendment consists of the construction of two (2) additions with a
combined square footage of 4740 square feet for a total square
footage of 12,140 square feet. The ZBA on 11/24/97 will consider
a request from the applicant for a conditional use permit for the
expansion.
This property located at 500 Swift Street lies within the R2
District. It is bounded on the north by a single family residence
(under construction), on the east by Dorset Street, on the south by
Swift Street, and on the west by a church.

yard coverage (excluding the bike path). along Swift Street is
5.8% and along Dorset Street is 0% (maximum allowed is 30%). The
plan should be revised to note the correct front yard coverage
information.
Setback requirements are met. Plan should be revised to note that
the front setback requirement from Dorset Street is 67 feet not 66
feet.
Parking A total of 140 parking spaces are required and 50 spaces
including two (2) handicapped spaces and a bike rack are being
provided. This represents a 90 space or 64.3% shortfall. Section
26.256(b) of the zoning regulations allows the Planning Commission
to reduce parking requirements to as low as 50% of the requirement
which is 76, spaces. The 3/26/85 approved plan showed a total of 54
spaces, not all of which were constructed. The applicant has an
unofficial arrangement with the adjoining church to share parking
spaces (see enclosed letter).
The 140 space requirement assumes that all space in the synagogue
is used at once (i.e., assembly hall, synagogue, classrooms).
Since it is unlikely that all rooms will be occupied at the same
time, the realistic required parking is probably something less
than 140 spaces. The applicant should address this issue at the
meeting. Also, if the use of parking spaces on the adjacent
property is a weekly occurrence,. an "official" shared parking
arrangement should be developed.
Landscaping: The minimum landscaping requirement, based on building

costs, is $12,820 which is being met. Plantings include Norway
Maple, Birch, Honeylocust, Pin Oak, Spirea, Yew, and Viburnum.
Traffic: ITE estimates that the existing facility generates 22.9
vehicle trip ends (vte's) during the P.M. peak hour and with the
expansion to generate 37.8 vte's for a 14.9 vte increase. The
applicant should be aware that the road impact fee is $3367.40.
Sewer: No additional sewer allocation requested.
C .O. District: There is a C .O. District along the westerly boundary
which will not be impacted by this project.
Dumpster: A screened dumpster storage area will be provided. The
type of screening should be noted on the plan.
Lighting: Exterior lighting consist of the following:
--- six (6) 150 watt metal halide lamps with downcasting shielded
fixtures mounted on three (3) 18 foot poles.
--- two (2) building mounted 70 watt high pressure sodium lamps
with downcasting shielded fixtures.

amendment consists of: 1) changing the use of the building to light
manufacturing, and 2) enclosing a 320 square foot loading dock.
The change in use and loading dock enclosure have already been
completed. This property is also developed with a 40' x 60'
detached accessory building.
This property located at 60 Ethan Allen Drive lies within IC
District, the C.O. District and the Floodplain Overlay District.
It is bounded on the north by an industrial building, on the east
by Lime Rock Road, on the south by Ethan Allen Drive and on the

I move the South Burlington Planning Commission approve the site plan application of
Timothy Duff to amend a previously approved plan for a 7400 square foot synagogue. The
amendment consists of construction of two (2) additions with a combined square footage of
12,140 square feet, 500 Swift Street, as depicted on a three (3) page set of plans, page one (1)
entitled, "Existing Site Plan Temple Sinai Site and Building Renovations South Burlington,
Vermont," prepared by Engineering Ventures, Inc, dated October 24, 1997, with the following
stipulations:
1). All previous approvals and stipulations which are not superseded by this approval shall remain
in effect.
2) For the purpose of calculating road impact fees under the South Burlington Impact Fee
Ordinance, the Planning Commission estimates that the additions will generate 14.9 additional
vehicle trip ends during the P.M. peak hour.
3) Any new exterior lighting or changes to existing exterior lighting shall consist of downcasting
shielded fixtures. Any change to existing lights shall require approval of the City Planner prior to
installation.
4) The plan shall be revised to show the changes below and shall require approval of the City
Planner. Three (3) copies of the approved revised plan shall be submitted to the City Planner
prior to permit issuance.

Temple Sinai next to our church building on the corner of Swift Street and Dorset Street
we have had an ongoing agreement with Temple Sinai to share parking spaces to help lessen
the burden on either congregation.
This shared parking arrangement has worked out very well for both of us and we wish it
to continue in the future with the understanding that the parking lots are still separately
owned and neither party has or will have preemptive rights over the other parking lot or
spaces and that either party is not bound to continue this arrangement in the future.

Mr. Julian Goodrich said he had talked with the church next door, and
they had not wanted a connecting roadway between the two properties, fearing
that might lead to problems with people driving fast through the lots. They
would prefer a walkway instead. They feel that it will only be a few times
per year when the existing parking lots will be unable to handle the cars,
and the days when the Temple is crowded will not coincide with the days the
church is, so the parking can be shared those days.
Mr. Poger noted that Z8900 of landscaping was required and Mr. Goodrich
said they would comply with the regulations.
Mr. Dooley moved that the South Burlington Planning Commission apUrove
the site plan application of Julian GoodrichL Architect for Temple Sinai for
construction of a 7400 sq. ft. synagogue as shown on a elan prepared by
J.G. Architect, entitled "Temple Sinai, South Burlington", dated March lj._1985,
with the following stipulations.• - -
1. All parking aisles shall be 24 feet wide.
2. Legal documents for the dedication of 7 feet along__the-frontage _of.
swift Street shall be submitted to the City Attorney for approval prior to permit.

Dear Ray:
I would like to respond to your required parking space calculation of 150 parking spaces.
I do not believe the entire portion of the building footprint square footage should be used
in calculating the required number of parking spaces.
Temple Sinai is both a place of worship and religious education. The proposed
expansion will be increasing the size of the religious school and the social hall with its'
support spaces. There will be no increase in the sanctuary seating of 151. We are
expanding the social hall to accommodate the dinning and entertainment portion of life
cycle events (weddings, bat mitzvahs) we cannot currently hold in the social hall. Please
note that the ceremonial portion of these life cycle events is currently held in our present
sanctuary, which will not be expanded. Please refer to the enclosed breakdown of
building square footage.
We expect attendance at nearly all of our major functions and events will be between 100
and 150 people. There are only four days per year when we have a religious function
with greater attendance. Please review the enclosed calendar chart, which depicts use of
the temple on an annual basis. Our solution for overflow parking on these days has been
our agreement with the Church of Later Day Saints to share our parking resources with
each other
I feel a more appropriate measurement by the city zoning regulations for religious
institutions would be to use the school requirement of 4 spaces per assembly seat. That
measurement more accurately gauges the demand for parking created by the size of the
worship space.

Dear Mr. Wallman:
Our office has completed an initial review of the above
referenced project and have determined that the additional
information listed below will be needed before approval can be
granted. Site and foundation work approval has been granted in a
letter dated January 10, 1985. Exterior water and sewer
construction above the foundation is not approved until a Land Use
Permit is issued. Please note the the comments concerning
interior waste and water distribution and ventilation plans were
prepared by Mr. Robert Hood, Environmental Technician.
(1) Submit a fixture schedule and the type of pipe materials to
be used for waste, vent and water distribution piping above
and below grade within the building.
(2) Each of the 4 inch main soil lines within the building must
have at least one 3 inch vent stack or stack vent.
(3) Please be advised that only one set of the revised P-1
plumbing plans was received by this office on June 28, 1985.
Two sets of plumbing plans must be submitted, as one will be
returned to the owner upon approval of the project.
(4) Submit an engineer's estimate of wastewater flows based on
Appendix A of the Environmental Protection Rules. The
temple has already received approval for 300 gallons per
day. Any flows estimated over this figure will need a
municipal approval letter to be submitted.
(5) Show the type of pipe material to be used from the building
to the ejector station. Cast iron pipe is required for the
first 10 feet out of the building.

pump station.
Show water line type, size, and location on the engineer's
site plan.
Ejector Station - Show size and type of pipe in pump
station, specify alarm and level controls, dosing levels,

pump on and alarm on level shall be at the same elevation.
Upon receipt of the above items, our review shall continue.

Mr. Julian Goodrich said he had talked with the church next door, and
they had not wanted a connecting roadway between the two properties, fearing
that might lead to problems with people driving fast through the lots. They
would prefer a walkway instead. They feel that it will only be a few times
per year when the existing parking lots will be unable to handle the cars,
and the days when the Temple is crowded will not coincide with the days the
church is, so the parking can be shared those days.
Mr. Poger noted that $8900 of landscaping was required and Mr. Goodrich
said they would comply with the regulations.

on a 4.05 acre lot. The facility will have classrooms, a social
hall for 150 and a sanctuary for 150. These will not be used
simultaneously except once a year.

Church of Latter Day Saints to the west. They will be connected

7) WINDING BROOK II, FINAL PLAT REVISION
This is the Final Plat to the Sketch plan application entertained
by the Commission in November, 1984. Winding Brook I and II
received Final approval in November, 1983 for 72 units on approximately
12 acres. Each phase was approved at 36 units. This is a re-
vision of Winding Brook II that proposes to include the 2 acres of
the Church of God lot. The R7 zoning allows 7 units per acre; the
applicant proposes 12 additional units by replacing one 8 unit
building with 2 ten unit buildings. Phase I will have 36 units;
Phase II will have 48 units for a total of 84 units.
Landscaping: Additional landscaping is required and should be
shown as a revised plan for all of Phase II.
Parking: These 48 units require 2 spaces per dwelling plus one
guest space per 6 dwelling units, or 104 total spaces.
Eighty three are shown, including carport spaces.

1. Kimball Avenue sidewalk shall be continuous across the entrance
drive and tie into existing walk to the east.
5) PIZZAGALLI OFFICE BUILDING, JOY DRIVE
1. A sidewalk should be included along Joy Drive right-of-way and
considewalk on the drive to Meadowbrook.
(b) TEMPLE SINAI, ORSET STREET
1. Driving into parking space, especially to the left, in the
curved parking lot may be difficult in the 20 feet shown. This
should be checked.

I would like to remind the Commission of the serious need for an
additional fire station in the Shelburne Road vicinity. Additional
facilities and expansions place dozens of lives and valuable property
in danger due to the distance, traffic and time delays from our
only station on Dorset Street.
2) PAPPAS, SHELBURNE ROAD
This expansion requires a water supply of 1750 gallons per minute.
One hydrant must be placed either on Shelburne Road or Baldwin
Avenue`.
1"�3) BURLINGTON INTERNATIONAL AIRPORT
I do not have adequate information on water mains, water supply
and hydrant locations. At the very least this needs 3750 gallons
per minute, and 4 hydrants that are of National Standard Thread.
l4) O'BRIEN-MILOT OFFICE CONDOS
There is no problem giving proper fire protection to this building.
5) PIZZAGALLI
This building requires 2000 gallons per minute. One hydrant is
ne e _en- 1 operty in addition to the one on Joy Drive.
6) TEMPLE SINAI, IFT STREET
This building requires 1750 gallons per minute. Two hydrants are
needed in this area.
7) WINDING BROOK
I met with John Hausner and came to the following agreement:
a) A hydrant was left off this plan by units G. & F.. It will be
added.
b) The roadway by building G should be connected to 150 Kennedy
Drive for emergency use. The roadways between parking spaces and
garages will be 30 feet wide.
c) The roadway between the parking lot and the garage will be 30
feet wide by building H. The distance from the ridge to the paved
p,-irking area will he 47 feat. One hour fire rated w,il l!, from the
