HomeMy WebLinkAboutSP-97-0000 - Decision - 0500 Swift StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Timothy Duff to amend a previously approved plan for a 7400 square foot synagogue. The amendment consists of construction of two (2) additions with a combined square footage of 12,140 square feet, 500 Swift Street. On the 25th day of November, 1997, the South Burlington Planning Commission approved the request of Timothy Duff for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a plan previously approved on 3/26/85 for a 7400 square foot synagogue. The amendment consists of the construction of two (2) additions with a combined square footage of 4740 square feet for a total square footage of 12,140 square feet. The ZBA on 11/24/97 approved a request from the applicant for a conditional use permit for the expansion. 2. This property located at 500 Swift Street lies within the R2 District. It is bounded on the north by a single family residence (under construction), on the east by Dorset Street, on the south by Swift Street, and on the west by a church. 3. Access/circulations: Access is provided by a 20 foot curb cut on Swift Street. No changes proposed. A pedestrian access to the adjoining church is existing. Circulation o the site is adequate. 4. Coverage/setbacks: Building coverage is 7.1% (maximum allowed is 30%). Overall coverage is 22.7% (maximum allowed is 70%). Front yard coverage (excluding the bike path) along Swift Street is 5.8% and along Dorset Street is 0% (maximum allowed is 30%). The plan should be revised to note the correct front yard coverage information. 5. Setback requirements are met. Plan should be revised to note that the front setback requirement from Dorset Street is 67 feet not 66 feet. 6. Parking: A total of 50 parking spaces are required and 50 spaces including two (2) handicapped spaces and a bike rack are being provided. This parking requirement is based upon the applicant's expressed representation at the meeting that, with the exception of several holidays during the year, there would be no more than 150 people in the building at any one time. The 3/26/85 approved plan showed a total of 54 spaces, not all of which were constructed. The applicant has an unofficial 1 arrangement with the adjoining church to share parking spaces. 7. Landscaping: The minimum landscaping requirement, based on building costs, is $12,820 which is being met. Plantings include Norway Maple, Birch, Honeylocust, Pin Oak, Spirea, Yew, and Viburnum. B. Traffic: ITE estimates that the existing facility generates 22.9 vehicle trip ends (vte's) during the P.M. peak hour and with the expansion to generate 37.8 for a 14.9 vte increase. The applicant was made aware that the road impact fee is $3367.40. 9. Sewer: No additional sewer allocation requested. 10. C.O. District: There is a C.O. District along the westerly boundary which will not be impacted by this project. 11. Dumpster: A screened dumpster storage area will be provided. The type of screening should be noted on the plan. 12. Lighting: Exterior lighting consists of the following: — six (6) 150 watt metal halide lamps with downcasting shielded fixtures mounted on three (3) 18 foot poles. — two (2) building mounted 70 watt high pressure sodium lamps with downcasting shielded fixtures. DECISON & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Timothy Duff to amend a previously approved plan for a 7400 square foot synagogue. The amendment consists of construction of two (2) additions with a combined square footage of 12,140 square feet, 500 Swift Street, as depicted on a three (3) page set of plans, page one (1) entitled, "Existing Site Plan Temple Sinai Site and Building Renovations South Burlington, Vermont," prepared by Engineering Ventures, Inc, dated October 24, 1997, with the following stipulations: 1). All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the additions will generate 14.9 additional vehicle trip ends during the P.M. peak hour. 3) Any new exterior lighting or changes to existing exterior lighting shall consist of downcasting shielded fixtures. Any change to existing lights shall require approval of the City 2 Planner prior to installation. 4) The plan shall be revised to show the changes below and shall require approval of the City Planner. Three (3) copies of the approved revised plan shall be submitted to the City Planner prior to permit issuance. a) The site plan shall be revised to show the correct front yard coverage calculations (excluding the bike path). b) The site plan shall be revised to note that the front yard setback requirement from Dorset Street is 67 feet not 66 feet. c) The site plan shall be revised to note the type of screening proposed for the dumpster will be solid fence panel. d) The site plan shall be revised to show the bike path easements. 5) Prior to issuance of a zoning permit, the applicant shall post a $12,820 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 6) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 7) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the additions. 8) Any change to the site plan shall require approval by the South Burlington Planning Commission.
