Request for conditional use permit 7 Commerce Avenue Findings of Fact. Conclusions of Law & Order This matter came before the South Burlington Zoning Board of Adjustment on July 12, 1999 by application of Tamarack Services of VT, Inc. seeking conditional use approval from Section 26.05 Conditional Uses of the South Burlington Zoning Regulations. Request is for permission to use a portion of a vacant lot for the storage of auto rental vehicles, 7 Commerce Avenue. The Board of Adjustment finds as follows: 1) This project consists of using a vacant lot to store rental vehicles. This property would not be used to rent vehicles but to store vehicles which are not being rented. 2) This property located at 7 Commerce Avenue lies within the IC District. 3) The proposed use complies with the stated purpose of the IC District. The purpose states in part, "a range of individual commercial uses may be permitted in locations that will serve adjacent areas and/or the traveling public that will be mutually compatible with industrial activity." 4) It is not expected that auto rental storage use would have an adverse affect on any existing or planned community facility. No building would be constructed so their would be no water or sewer usage. 5) The area is characterized by auto repair and service businesses, warehouses and light manufacturing within an industrial park. No adverse affect on the character of the area is expected. 6) Traffic generated by the proposed use is expected to be minimal. The general public will not be going to this property and generating traffic. 7) This application complies with the bylaws in effect. 8) There is no utilization of renewable energy resources in the vicinity to be affected by this proposal. 9) It is not expected that the general public health and welfare would be adversely affected by the proposed use. ORDER The conditional use permit to use a portion of a vacant lot for the storage of auto rental vehicles, 7 Commerce Avenue is hereby GRANTED subject to the following condition: "Applicant is responsible for maintaining retention pond in a condition to treat storm water runoff from areas contributing from Commerce Avenue and adjacent lots as well as maintaining any right-of-way easement."
