Dear Mrs. O'Brien:
This letter is to comply with your request for written
authority for you to conduct dancing classes in your proposed
new home at Tanglewood Drive in South Burlington.
This matter was discussed by me with Mr. Albert Reynolds,
Chairman of the Board of Adjustment of South Burlington. His
opinion, in which I concur, was as follows: Section IX of the
Protective Zoning Ordinance of the Town of South Burlington provides
that in Residential Districts customary home occupations may be
carried on by a resident of the dwelling. In this town, kinder—
gartens have been recognized as home occupations, as have baby—
sitting, music teachers, etc. It is felt that dancing teachers would
fall in this category and as such, you would not be prohibited from
carrying on this work by the Zoning Ordinance.
It is also felt, however, that unreasonable traffic hazards
created in ,your residential neighborhood by work of this type would
not be tolerated or intended to be allowed under this ordinance.

aid as we may give you:

WOW COMES, THE CITY OF SOUTH BURLINGTON, by and through
its attorneys, Ewing & Spokes, and answers the Complaint of the
Plaintiffs as follows;
1. The Defendant admits the allegations contained in P
graphs 1, 2, 3, 6, 8, and 11 of the Complaint.
2. The usfendant denies the allegations cx tained in Par
graphs 7, 14 and 15 of the Complaint.
3. The Defendant is without knowledge or information
sufficient to fora a belief as to the truth of the allegations
contained in Paragraph 10 of the Complaint.
4. The Defendant admits that the petitioners purchased a
persoQal residence at 29 Tanglewood Drive, South Burlington,
Vermont, in 1959, but the Defendant is without knowledge or
information sufficient to form a belief as to the truth of the
remaining allegations contained in paragraph 4 of the Complaint.
5. The Defendant admits that on Clctober 16, 1958, David
T. Clark, the then Town Manager of the Town of South Burlington
sent a letter to the ]Petitioner, Mrs. Donald O'Brien, Jr.,
EWING & SPOKES stating that it was his opinion that dancing teachers would fall

within the category of customary home occupations as defined by
the then existing South ;Burlington zoning ordinance. The
Defendant denies each and every other allegation contained in
Paragraph 5 of the Complaint.
6. The Defendant admits that under the provisions of
Article V1 of the zoning ordinance for the City of south
Burlington, in Paragraph 6.10, Sub --paragraph 12, it provides that
buildings in. Residential District (B) may be used for home occu-
pation purposes as alleged in Paragraph 9 of the Complaint, but
the Defendant states said use may only be acoessory to any of
the uses not forth in Paragraph 6.10, Sub -paragraphs 1 through
11 of the zoning ordinance.
7. The Defendant admits that the City of South Burlington)
Zoning Board of Adjustment ruled that the home business war not
incidental or secondary to the use of the dwelling; that it would)
be detrimental to the surrounding neighborhoods and that strict
compliance with the ordinance would not deprive owner of reason-
able use of the land, bist the Defendant denies each and every
other allegation contained in Paragraph 13 of the Complaint.
9. The Defendant admits that the provisions of the South
Burlington zoning ordinance relating to the conduct of home
occupations as defined in the Ordinances in Residential District
(E) ate reasonable, but the Defendant denies'each and every other
allegation contained in Paragraph 16 of the Complaint.

Now come the Petitioners, DONALD R. O'BRIEM, JR. and
ROSEMARY O' BRIM, of the City of South Burlington, County of
,Zhittenden and State of Vermont, persona aggrieved by the
decision entered by the ,Coning Board of Adjustment for the
'ity of South Burlington, on July 21, 1971, in an appeal
thereto filed by said Petitioners, and, under 24 V 3A,
Section 4471, appeal from said decision on the grounds that
it is wholly illegal and unreasonable.
As grounds for this petition, your Petitioners allege
as follows:
1. Petitioners are residents of the City of South
Burlington and the owners of property situated in the City
of Routh Harlington at 29 Tangiewood Drive.
2. The Petitioners appealed on July 12, 1971, to the
South Burlington 'Zoning Hoard of Adjustment from a rejection
of an application for a building permit to enlarge their
basement by thirty (30) by thirty-five (35) feet.

After due notice, a hearing was held on July 21, 1971, at j
the :3outh Burlington City Hall before the South Burlington
Zoning Board of Adjustment; the South Burlington Zoning BoarO
of Adjustment denied the appeal on July 21, 1971.
3. The South Burlington Zoning Ordinance was adopted on;

(7) soning districts:
Rosi-
dence A and B; Business A and at Industrial A and Bt and
Planned Districts.
4. The Petitioners herein, DONALD R. O'BRIM, JR and
ROSEMARY O'BRIEN, purchased a personal residence at 29 Tangl+s-
wood Drive, South Burlington, Vermont, in 1959. shortly
after making their purchase of this residence, the O'Biriens
�"Xcommenced the operations of dancing classes in their basement.
The classes are conducted in the afternoon hours and early
evening hours during the week and, occasionally, on Saturday
mornings. The classes consist of ten to twelve children per
class, and a total enrollment of approximately one hundred
and fifty (150) students.
��� 5. At the time of the commencement of th*kx dancing
R'� classes, the O'Brien: secured a written determination by the
then -Town Manager that the conduct of these classes, consti-
tuted a home occupation.

6. A home occupation is defined in the Zoning Ordinances
of the City of South Burlington, Vermont, in Subparagraph 1S,i
of Article II, Paragraph 3.10. 1
7. The conduct of dancing classes for children in the i
basement of the home of the Petitioners, DMALD R. O' BRIM, ^.
and ROSEMARY O'BRIEN, meet all the definitions set forth in
the zoning Ordinances as being classified a home occupation.
S. Under the provisions of the Zoning Urdinances for the
City of south Burlington, Vermont, adopted on February 28,

1964, the Petitioners' residence at 29 Tanglewood Drive, South
Burlington, Vermont, is in a classification of Reoidentai
District (8) .
9. Under the provisions of Article VI of the Zoning
Ordinances for the City of South Burlington, Vermont, adopted
d?N•bruary 28, 1964, in Paragraph 6.10, Subparagraph 12. it
provides that buildings in this Residential District (B)
classification may be utilised is home occupations.
10. The size of the classes and the number of total

substantially since the lessons were started in 1959.
11. On July 12, 1971, Petitioner, DONALD R. O'BRIEN,JR.,
requested a building permit for purposes of extending the six*
of his basement in his home by approximately thirty (30) by

thirty-five (35) feet. Petitioner explained that he presently
was conducting dancing classes in a studio area in nis base -
went of eighteen (18) by thirty (30) feet, which was too

congested for
ballet,
acrobatics and tumbling.
He
explained
further that
the new
addition would enable him
to
be more
efficient but that the size of classes or total enrollment
would not increase, Petitioner's application was denied;
whereupon .petitioner appealed to the Zoning Board of
Ad j u rs tment .
♦ 12. Attached hereto and marked as Exhibit A is a copy
of the Minutes of the Meeting of the South Burlington City
2::)ning Board of Adjustment Meeting held on July 21, 1971,
13. As a result of this hearing conducted on Petitioner's
appeal on July 21, 1971, the City of South Burlington Zoning
B,-)ard of Adjustment illegally and unreasonably held that the
home business was not incidental or secondary to the use of
the dwelling; that it would be detrimental to the surrounding
neighborhood; that strict compliance with the ordinance would
not deprive owner of reasonable use of the land.

14. The evidence submitted at the hearing clearly demon-
�- strated that the request for the building permit involved in
this case was not the request for a variance for enlargement
of a non -conforming use, but rather was a request for an

being utilized in conformity with the requirements of
Article VI of the South Burlington Zoning Ordinances relating
to Residential District (a)
15. The south Burlington Zoning Board of Adjustment in
l this entire proceeding has treated Petitioners' application
for a building permit as if it were an application for the
enlargement of a building being utilized for a non -conforming]
use. The decision of the Zoning Board of Adjustment in
denying the appeal of Petitioners is wholly illegal, unreason-
able, discriminatory and arbitrary.
16. The provisions of the South Burlington Zoning
Ordinances relating to the conduct of home occupations as
defined in the Ordinances in Residential District (B) are
reasonable, and Petitioners' use of the basement of their
home for the conduct of dancing Glasses is a home occupation'
within the meaning of these Ordinances, and the South
Burlington Zoning Board of Adjustment, in treating the conduct
of dancing glasses in the basement of the Petitioners' home
as constituting a non -conforming use under the Zoning Ordinanceo
was wholly illegal, unreasonable, discriminatory and arbitrary.
WREREIPORE, Petitioners pray:
1. THAT.the Court set aside the decision of the South
Burlington Zoning Board of Adjustment from which this decision

is taken and make a new Order, permitting Petitioners to
extend the size of their basement in accordance with their
application before the Zoning Board of Adjustment.
Z. THAT the Court adjudge and decree that the conduct of
dancing lessons in the basement of the Petitioners' residence
constitutes a home occupation within the definitions of
Paragraph 310, Subparagraph 15, of the South Burlington
Zoning Ordinances, and is a conforming use under Residential
District (B) of said Ordinances.
3. TMT the Court give and grant petitioners suoh other
and further relief as to the Court may seem just and proper.
4. THhT the Court award the Petitioners the costs and
disbursements of this appeal.
