Re: Findings of Fact, application of David Luce to amend a previously approved site
plan for a 275 seat church. The amendment consists of modifications to the parking
area, 400 Swift Street.
On the 11th day of March, 1997, the South Burlington Planning Commission approved
the request of David Luce for site plan review under Section 26.10 of the South
Burlington Zoning Regulations based on the following findings:
1. This project consists of amending a previously approved site plan for a 275 seat
church. The amendment consists of modifications to the parking area. The last
review of this property by the Commission was on 6 / 28 / 83 .
2. This property located at 400 Swift Street lies within the R2 and C.O. Districts.
It is bounded on the east by a church, on the north and west by the Ridgewood
residential development, and on the south by Swift Street.
3. Access/circulation: Access is provided by a 26 foot curb cut on Swift Street.
No changes proposed.
Access on the site is adequate.
4. Coverage/setbacks: Building coverage is 13% (maximum allowed is 20%) . Overall
coverage is 50% (maximum allowed is 40%). This is an existing situation which will
not be made worse by this application. Pavement will be removed along the northerly
boundary to compensate for the green island being removed in the parking lot so
there will be no increase in overall coverage. Front yard coverage is 8.5 % (maximum
allowed is 30%) .
Setback requirements are met.
5. Parking: A total of 92 spaces are required and 118 spaces including five (5)
handicapped spaces and a bike rack will be provided.
6. Landscaping: No additional landscaping, based on building costs, is required.
Plan shows existing landscaping in addition to landscaping that was required in the
6 / 28 / 83 approval which was never planted. The proposed landscaping has a value
of $3240.
7. Traffic: No additional traffic will be generated.
8. Dumpster: The existing dumpster storage area will be screened.
9. Lighting: Exterior lighting consists of:
--- eight (8) 250 watt high pressure sodium lamps with downcasting shielded
fixtures mounted on 20 foot poles.

--- six (6) building mounted flood lights will be replaced with 50 watt high
pressure sodium lamps.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission
approves the site plan application of David Luce to amend a previously approved site
plan for a 275 seat church. The amendment consists of modifications to the parking
area, 400 Swift Street, as depicted on a four (4) page set of plans, page one (1)
entitled "Existing Conditions and Demolition Plan," prepared by Engineering
Ventures Inc. , dated 1/10/97, last revised 3/10/97, with the following stipulations.
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. For the purpose of calculating road impact fees under the South Burlington
Impact Fee Ordinance, the Planning Commission estimates that the parking lot
modifications will generate zero (0) additional vehicle trip ends during the P.M. peak
hour.
3. The applicant shall post a $3240 landscape bond prior to issuance of a zoning
permit. The bond shall remain in effect for three (3) years to assure that the
landscaping takes root and has a good chance of surviving.
4. Any new exterior lighting shall consist of downcasting shielded fixtures so as not
to cast light beyond the property line. Any change in lighting shall be approved by
the City Planner prior to installation.
5. The applicant shall obtain a zoning permit within six (6) months pursuant to
Section 27.302 of the zoning regulations or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy/ Compliance from the
Administrative Officer prior to use of the modified parking area.
7. Any changes to the site plan shall require approval by the South Burlington
Planning Commission.
