As we discussed during the sketch plan review, the Austins propose to leave a buffer of trees between the building site and Swift Street. The enclosed plans show a line that runs generally parallel to Swift Street and is identified as "proposed limit of clearing from Swift Street". The Austins will agree, as a condition to subdivision approval, not to remove trees northerly of that line except to the extent necessary to install the driveway and connect the proposed dwelling to utilities, including sewer, water, electricity, cable and natural gas. Lot #1 is currently developed with a single family residence and lot #2 is undeveloped. This property located at 301 Swift Street is within the R2 District and within the interim zoning district for the western portion of the SEQ which will expire on April 17th. This property is also located within a restricted area under the proposed SEQ zoning. The City Attorney has advised staff that this sketch plan should be reviewed to determine its conformance with both the underlying R2 zoning and with the proposed new SEQ zoning. The current interim zoning need not be considered since it will be expiring shortly. The final plat application should be reviewed under the regulations in effect at the time proper application is made. If the City Council has by that time acted on the proposed new zoning, then final application should be examined for compliance with either the new zoning (if it has been adopted), or with the existing R2 zoning (if the new SEQ zoning is rejected). If the City Council has not yet acted to adopt or reject the new zoning, then the application must be considered for compliance with both the R2 zoning and with the proposed SEQ zoning. If the application fails to meet the R2 zoning, subdivision approval should be denied. If the application meets the R2 zoning but not the SEQ zoning requirements, then the application can only be approved if the Council grants a "variance" for not meeting the requirements of the SEQ zoning. This property is bounded on the east by two (2) single-family residences, on the south a single family residence, on the west by undeveloped land and on the north by Swift Street.. Access: Access to the existing residence on lot #1 is via a 30 foot r.o.w. which serves this lot and a single family residence to the south. The proposed new lot (lot #2) is proposed to have its own driveway from Swift Street along its easterly boundary. 14 iemorandum - Planning .pril 14, 1992 age7idz-:t Lpril 10, 1992 Page 10 items R2 Zoning: Both lots will meet the area and dimensional requirements for this district. The existing structures on lot #1 will meet all setback requirements. Proposed SEQ Zoning: The proposed subdivision lies entirely within the restricted area under the proposed SEQ zoning. In order for a new residential lot to be created within a restricted area, the applicant would have to apply as a Planned Residential Development under Section 26.602 of the proposed zoning regulations and meet the standards setforth under Section 19.15 regarding Planned Unit Developments. One of the goals of PUD's is to "encourage innovation in design and layout, and more efficient use of land". The applicant, among other things would have to show that this development furthers this goal. Utilities: Section 16.605 of the proposed zoning requires that this new lot be connected to municipal sewer and water services. The City Sewer Regulations will not allow this new lot to connect to the private sewer line serving the adjacent Austin and Skiff Properties (see Bill Szymanski's comments). The Final Plat should show the type of, location and approximate size of any existing or proposed utilities. 10 TOWN OF SOUTH BURLINGTON, `IERMONT SEWER INSTALLATION REGULATIONS The,following regulations supplement the State of Vermont Regulations for Plumbing in Private Dwellings" adopted April 1, 1960 and the "Town of South Burlington Sewer Ordinances" adopted August 2, 1966 which govern the installations of sewer lines in the Town of South Burlington, Vermont. GENERAL The location of house sewer connections will be designated by the Town Manager or his authorized representative. Each building in the area served by a public sewer, when connected, must be connected separately and independently. House sewer connections from the Town sewer to the property line shall not have an inside dimension of less than 6 inches. In- side of the property, the sewer -pipe shall not have an inside dimension of less than 4 ches. Where pipe is laid at a slope of Tess than 1 inch in four feet, pipe having an inside dimension of not less than 6 inches shall be used. Where basement fixtures are connected, a back trap shall be installed in a readily accessible location. A clean out, accessible without excavating, shall be installed at each change in direction of the sewer connection greater than 45 degrees and in lines so that the distance between cleanouts does not exceed 50 feet. 24 It shall be the property owners responsi- bility to assume all costs incurred in the maintenance of and repair of the sewer con- nection from the dwelling to the Town sewer. This includes that portion of the sewer con- nection within public rights -of -ways and easements. MATERIALS At locations subject to vehicular traffic such as driveways, roads, and parking lots, the following materials shall be used: 1. Cast Iron Soil Pipe 2. Vitrified Clay Pipe, Extra Strength 3. Asbestos Cement Pipe, Class 2400 At locations that will not be subject to vehicular traffic such as lawns and side- walks, materials specified above or the following shall be used. 1. Cast Iron Soil Pipe 2. Vitrified Clay Pipe, Standard Strength 3. Asbestos Cement Pipe, Class 1500 CAST IRON PIPE Cast iron pipe shall be of the bell - and -spigot `vpe conforming to ASA Specifica- tions No. A 40.1. Pipe and fittings shall be sound, cylindrical and smooth internally, free from cracks, sandholes or other defects. A coating of coal -tar pitch varnish shall be included on the exterior surface of all pipe and fittings. VITRIFIED CLAY PIPE Clay pipe shall be unglazed extra strength, or standard strength conforming to Clay Sewer Pipe Association Specifications, 25 Sec. 2. There shall be two (2) classes of building sewer permits: (a) for residen- tial and commercial service, and (b) for service to establishments producing industrial wastes. In either case, the owner or his agent shall make appli- cation on a special form furnished by the 'town. The permit application shall be supplemented by any plans, specifica- tions, or other information considered pertinent in the judgement of the Town Manager. A permit and inspection fee of twenty-five (25.00) dollars for a residential or commercial building sewer permit and twenty-five (25.00) dollars for an industrial building sewer permit shall be paid to the town: at the time the application is filed. This fee shall be reduced to five (5.00) dollars in such cases where an ad,quate build- ing sewer already exists from the trunk or collector sewer main to the property line. Sec. 3. All costs and expense incident to the installation, connection, mainten- ance and repair of the building sewer shall be borne by the owner. mhe owner shall indemnify the town from any loss or damage that may directly or indirectly be occasioned by the installation, connection, maintenance, and repair of the building sewer. Sec. 4. A separate and independent building sewer shall be provided for every build- ing; except where one building stands at the rear of another on an interior lot and no private sewer is available or can be constructed to the rear build- ing through an adjoining alley, court, yard, or driveway, the building sewer from the front building may be extended 8 tc the rear }gilding and the whole con- sidered as or-� building sewer. Sec. 5. Old building sewers may be used in connection with new buildings only when they are found, on examination and test by the Town Yanager, to meet all re- quirements of this ordinance. Sec. 6. The size, slope, location, alignment, materials of _,onstruction of a build- ing sewer, and the methods to be used in excavating, placing of the pipe, jointing, testing, and backfill.ing the trench, shal- all conform to the re- quirements of building and plumbing code or other ap;licable rules and regu- lations' of t:.e town and shall also conform to t}.3 miles and requirements of the Town Nana;er. In the absence of code p_•ovisic-ns or in amplification thereof, the :materials and, procedures set forth in appropriate specifications of the A. S. T. M. and W. P. C. F. Manual of Practice No. 9 shall apply. Sec. 7. `hThenever oossible, the building sewer shall brought to the building at a- elevatf .Dn below the basement floor. In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sanitary sewage carried by s,;ch building drain shall be lifted by an approved means and dis- charged to the building sewer. JUDGE DEVELOPMENT - REVISED RETAIL BUILDING - CORPORATE WAY --- paragraph #5 on the revised site plan description indicates that the canopy extension into Corporate Way is shown on the revised plan. Plan submitted to staff does not show this canopy. --- a restaurant is a separate use from retail so staff will review parking, traffic and sewer, etc.. for both these uses so we need the following additional information about the restaurant. --- indicate whether proposed restaurant will be fast food or sd.t. down. --- indicate whether restaurant will serve breakfast. --- indicate square footage of space in the building which will be occupied by the restaurant, also indicate the square footage of floor area provided for patron use but not containing fixed seats. --- access aisle north of the theater building scales to be only 18 feet in width, this must be widened to 22 feet. --- plan should show location of new fire hydrant as approved by the Fire Chief. --- staff has consulted with City Attorney regarding the canopy which will project 2 1/2 feet onto Corporate Way. Szymanski, City Engineer Re: Apri114, 1992 preliminary comments Date: March 12, 1992 PETER JUDGE PROJECT CORPORATE WAY Revised plan dated March 4, 1992 is acceptable. AUSTIN SUBDIVISION. SWIFT STREET 1. Entrance drive shall have at least a 10 foot grassed strip along the adjacent property line to serve as a snow storage area. 2. There exists a sewer easement along the southerly property line. This is with private easement and includes a sewer service serving the Skiff and Austin properties. They were allowed to tie into the Meadowood Drive sewer because their on site systems failed. This line can not be used for serving the new lot. The main along the north side of Swift Street has to be extended westerly to serve it. 3. The stopping sight distance to the west should be checked. It should be sufficient to accommodate a vehicle traveling at least 40 m.p.h. (approximately 440 feet). ERDMANN 2 LOT SUBDIVISION. SWIFT STREET 1. The City took profile elevations along Swift Street. The maximum stopping sight distance is obtained when a driveway serving the proposed lot is located 700 feet as measured along the north edge of Swift Street starting at the west edge of Spear Street pavement. This sight distance is approximately 485 feet which is equal to a speed of approximately 44 m.p.h. The legal speed limit in the area is 35 m.p.h. 2. The water service should be jacked or washed across Swift Street instead of opening the road. This service is approximately 350 feet in length. A 3/4 inch service for that length will result in a sharp drop in supply when two or more appliances are used simultaneously such as a dishwasher and shower. Members agreed to leave this to the Planner's discretion. 7. Final Plat application of Edward & Jane Austin for a 2-lot planned residential development involving 2.6 acres of land, 301 Swift Street: Mr. Austin stepped down during this application hearing. .l Mr. Austin noted this is a 2-lot subdivision in a restricted zone. They have relocated the driveway along the existing right of way. They have agreed not to cut any trees above an indicated line in order to maintain a rural look along the street. They will hook onto existing sewer line, and utilities will come in underground from the street. Regarding the sidewalk, Mr Austin noted that Mr. Audette feels there shouj-d be a sidewalk. There is already a bike path across the road. Other: Existing dumpsters will be screened with six (6) foot cedar enclosures. 7) EDWARD & JANET AUSTIN - 2 LOT SUBDIVISION - FINAL PLAT This project consist of subdividing a 2.6 acre lot into two (2) lots of 1.3 acre each. Lot #1 is currently developed with a single family residence and lot #2 is undeveloped. The sketch plan was reviewed on April 14, 1992 (minutes enclosed). This property located at 301 Swift Street is located within the Southeast Quadrant District. It is bounded on the east by two (2) single family residences, on the south by undeveloped land and on the north by Swift Street. The proposed subdivision lies entirely within the restricted area under the SEQ zoning. In order for a new residential lot to be created within a restricted area, it must be reviewed and approved as a Planned Residential Development under Section 26.602 of the zoning regulations. It must also meet the standards setforth under Section 19.15 of the zoning regulations regarding Planned Unit Developments. One of the goals of PUD's is to "encourage innovation in design and layout, and more efficient use of land". At sketch plan the applicant indicated that he would meet the goal by constructing the house in the rear portion of the lot and not i cutting any trees in the front portion of the lot. The plan shows a� hs, a line delineating the limits of clearing. This restriction would run with the land unless otherwise modified by the Commission. Access: Access to the new lot (lot #2) will be via a 30 foot �► r.o.w. from Swift Street to a new 20 foot r.o.w. across lot #1. Sight distance on Swift Street is acceptable. J(L. Memorandum - Planning November 10, 1992 agenda items November 6, 1992 Page 8 Area and Dimensions: Both lots meet the minimum lot size requirement of 12,000 square feet and the frontage requirement of 100 feet. Sidewalks: At the sketch plan review, the Commission instructed staff to look into the sidewalk contribution policy. The way that this unwritten policy has been applied is that property owners are required to construct a sidewalk along their frontage or pay a $15 per linear foot fee. This requirement has been applied only to those property owners along streets which are planned to have sidewalks constructed in the next 5 years (i.e., Street Department Capital Plan). This section of Swift Street is not designated for sidewalk construction in the current capital plan, however, the Public Works Superintendent has recommended that the applicant contribute the $15 per linear foot fee towards the construction of a sidewalk along the south side of Swift Street. Sewer: A sewer allocation of 450 gpd is required. The applicant should pay the per gallon fee prior to issuance of a g zoning/building permit. Recreation fee: The recreation fee should be paid prior to the issuance of a zoning/building permit. Sketch plan application of Edward & Janet Austin, Jr., for subdivision of a 2.6 acre parcel into two parcels of 1.3 acres each, 301 Swift Street: Mr. Austin stepped down during this discussion. Mr. Austin said that he would be acquiring the second lot. The biggest issue is that one lot is in the Southeast Quadrant's restricted area. He suggested handling this as a PRD and satisfying the goals of the PRD. He also noted the second lot has very thick trees. He said a house would be put well back into the trees. He would be willing to designate a building envelope. The entrance drive to the second lot is about 250 ft. Mr. Austin said he had no problem leaving space for snow storage. Mr. Weith suggested a note on the plat that trees won't be cut. Mrs. Maher asked about water and sewer. Mr Austin showed the water route which could come right up the drive. There is a private sewer line on the property which he is pursuing dedica- ting to the city. Mr. Weith said he had to check on the sight distance to the west. There should be enough room to accommodate a vehicle going 40 mph. Members had no problem considering a PRD with a provision to retain trees. They were also satisfied with the safety issue on the driveway. Mr. Weith will check to see if the sidewalk fund PLANNING COMMISSION 14 April 1992 page 3 applies along Swift Street. 4. Revised Site Plan application of Judge Development Corporation for construction of a 19,253 sq. ft. building for retail use, Corporate Way: Mr. Burgess noted receipt of a FAX from Mr. Judge requesting a waiver on parking. He noted that contrary to the FAX, no pre- vious waiver had been granted. Mr. Dunn reviewed the plan. There will be parking behind the building and 14 street spaces in front. The building footprint and parking lot have changed. A proposed boundary line adjust- ment with the Anchorage didn't go through so they have gone back to the original boundaries. This means the building will be smaller. There will be a walk-through to the parking lot to link it to 100 Dorset St. The plan also shows other parking lots in the area. The landscaping will be the same. The dumpster has been moved. There is also a pedestrian passageway on the west side of the building. Mrs. Maher asked about the canopy. Mr. Weith said the City Council will have to approve an encroachment into the right-of- way. The City Center Committee has recommended awnings and canopies be allowed to encroach 3 ft. into the right-of-way as long as no posts encroach. Mrs. Maher asked if the canopies can be lit up. Mr. Weith said he thought they could. Mr. Judge said he hadn't thought about doing that. Mr. Dunn noted there is no "as built" drawing of the road. They feel the building should be parallel to the road, and they may have to shift the building. There will be 166 spaces in the rear of the building and the 14 street spaces for a total of 180. The applicant felt only 105 were needed. Mr. Judge said there is a surplus of parking on that side of the street. They are hoping to shift some of the 100 Dorset St. parking to this lot. Mr. Judge said he felt the requirement of 5.5 spaces is wildly excessive. Ms. Peacock noted that University Mall which has less than 5.5 is woefully inad- equate. Mr. Judge said if there isn't enough, it's their own problem. Mr. Burgess said that's only partly true. It could be their neighbors' problem. Mr. Weith noted that in the previous applicatiion Judge asked for a waiver of 4 or 5 spaces. The Commission said they should be required to put in what is re- quired. The balance could be used for 100 Dorset St. It could then be reviewed when 100 Dorset St. comes in with a plan and a waiver could be considered. Maintenance of the common drive shall be defined in the easement. O'DELL PARKWAY, SHELBURNE ROAD 1. O'Dell Parkway should be designed as a public street and connected to Farrell Street. This street is on the official map. It was rough graded through years ago and would benefit these businesses. 2. Internal pedestrian traffic between these businesses would justify a sidewalk along both sides of the street.
