HomeMy WebLinkAboutSD-98-03 - Decision - 0301 0305 Swift StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application of David Austin to amend a subdivision plat for a planned residential development previously approved on 11/10/92 for a two (2) lot subdivision, 301 and 305 Swift Street. The amendment consists of a boundary line adjustment involving 0.2 acres of land thereby resulting in two (2) reconfigured parcels of 1.10 and 1.52 acres. On the V day of September, 1998, the South Burlington Planning Commission approved the request of David Austin for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a subdivision plat for a planned residential development previously approved on 11/10/92 for a two (2) lot subdivision. The amendment consists of a boundary line adjustment to reduce the size of lot #1 by 0.2 acres and increase the size of lot #2 by 0.2 acres. The sketch plan was reviewed on 6/23/98. 2. These properties located at 301 and 305 Swift Street are located in the SEQ District. They are bounded on the east by residences, on the south and west by undeveloped land, and on the north by Swift Street. 3. Access: Access to both lots is via a shared curb cut on Swift Street. No changes proposed. 4. Lot size/frontage: Both lots will still meet the minimum lot size requirement of 12,000 square feet and the frontage requirement of 100 feet. 5. Setbacks: The new property line will meet the setback requirements from any existing structures. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of David and Laura Austin to amend a subdivision plat for a planned residential development previously approved on 11/10/92 for a two (2) lot subdivision, 301 and 305 Swift Street. The amendment consists of a boundary line adjustment involving 0.2 acres of land thereby resulting in two (2) reconfigured parcels of 1.10 and 1.52 acres, as depicted on a plat entitled, 1 "Boundary Plat Showing Boundary Line Adjustment Between Lands of David T. & Laura L. Austin and Lands of Edward L. Austin, Jr. & Janet T. Austin 305 and 301 Swift Street South Burlington, Vermont," prepared by Donald L. Hamlin Consulting Engineers, Inc., dated 7/13/98, last revised on 8/14/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Any change to the final plat plan shall require approval by the South Burlington Planning Commission. 3. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the City Planner.
