a. Mr. Weith announced that Item 4r5 on the agenda would be post-
poned.
b.Mr. Weith also informed the Commission that at last night's
meeting the City Council had approved the zoning amendments the
Commission had sent them.
2. Public Hearing: Final Plat Application of Francis Von
Turkovich & Patrice Stratman to amend an approved subdivision of
a 9.5 acre parcel into three lots c= 4.1 acres, 4.0 acres and 1.4
acres, 300 swift- Street% "The'-�amenditient consists of correcting
several lot line distances that were incorrect on the originally
approved plat:
Mr. Von Turkovich showed where the error had been made by the
surveyor. It involved distances between 2 points of about 30 or
40 feet. Mr. Weith said the lot configurations don't change at
all.
No issues were raised.
Mr. O'Rourke moved the Planninq Commission approve the revised
final plat application of Francis Von Turkovich and Patrice
Stratmann to amend an approved subdivision of a 9.5 acre parcel
into three lots of 4.1 acres, 4.0 acres, and 1.4 acres, 300 Swift
Street. The amendment consists of correcting several lot line
distances that were incorrect on the originally approved plat, as
depicted on a plat entitled "Property Plan F. Von Turkovich & P.
Stratmann, 300 Swift Street South Burlington, Vermont," prepared
by William A. Robenstein, dated 5/9/98 with the followincr
stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. Anv change to the plat shall rec-aire approval by the South
Burlington Planning Commission.

3. Consider proccsed amendment to the Scut-: _.,,�riington Zoning
Regulations to establish a City Center Review Overlay
District:
Mr. Weith said that Section I adds the new cverlay district. He
has left in the height bonus provision.
Mr. Weith asked that the the revisions be checked by the City
Attorney before going to public hearing.
Mr. Dinklage moved to have the proposed amendment warned for
Public Hearing after review by the Citv Attorney. Ms. Barone
seconded. Motion passed unanimously.
Mr.,' Weith also gave members a resolution for the City Council to _
establish a Design Review Committee. The resolution outlines'``
qualifications for serving and terms of service (two 2-year and
three 3-year terms).
Mr. Weith said he also took a stab at changes to the Sign
Ordinance. The City Attorney recommended keeping this completely
out of the Zoning Ordinance and fully in the Sign Ordinance. The
criteria for Planning Commission review of signs would include:
materials, colors and textures.
Members felt additional guidelines were needed as well as the
opportunity to review the rest of the Sign Ordinance. Mr.
Dinklage felt the "character of the neighborhood" should be
considered in addition to other criteria.
Mr. Weith noted the boundaries on the map of the City Center Sign
District and said that the design review district is within that
larger district. He asked if members wanted design review for
the whole area. Members were OK with the present proposal.
4. Consider proposed amendment to South Burlington Zoning Reg-
ulations, Section 25.113(i)-four story residential structures:
Mr. Weith said this amendment applies only to single family and
duplex structures.

I move the South Burlington Planning Commission approve the revised final plat application of
Francis Von Turkovich and Patrice Stratmann to amend an approved subdivision of a 9.5 acre parcel
into three (3) lots of 4.1 acres, 4.0 and 1.4 acres, 300 Swift Street. The amendment consists of
correcting several lot line distances that were incorrect on the originally approved plat, as depicted
on a plat entitled "Property Plan F. Von Turkovich & P. Stratmann 300 Swift Street South
Burlington Vermont," prepared by William A. Robenstein, dated 5/9/98 with the following
stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. Any change to the plat shall require approval by the South Burlington Planning Commission
3. The final plat plan shall be recorded in the land records within 90 days or this approval is null and
void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording. Prior
to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format.
The format of the digital information shall require approval of the City Planner.

4. Sketch plan application of Antonio Pomerleau to amend a
planned unit development consisting of 3 buildings on a 6.8 acre
parcel, 1519 Shelburne Rd. The amendment consists of converting
3000 sq. ft. of a 12,000 sq. ft. building currently used for
retail to light manufacturing:
Mr. Marshall identified this as the Audio -Video Authority
building. Audio -Video occupies the front half of the building.
The proposal is to locate a machine shop in the rear. The new
business will employ 2 persons.
The applicant received conditional use approval from the Zoning
Board.
They have enough parking spaces to comply. Mr. Marshall showed
the traffic circulation pattern. Traffic is still below what
GE generated in the building. Mr. Burgess said that would not be
a factor, what does matter is that ITE data says the use will
generate less traffic than the current use.
There will be no change in lighting.
Mr. Dinklage noted that when the road is widened, there will be a
median in front of this building. The applicant said they are
aware of this.
No issues were raised.

into three lots of 4.1 acres, 4.0 acres, and 1.4 acres, 300 Swift
Street:
Mr. Von Turkovich said they made a few changes in response to

comments made by the Commission. These include: changing the
line that denotes the easement, showing the Gardner house, making
reference to the proposed recreation path, and having the
driveway that serves lots 2 and 3 connecting all the way to the
pavement on the street. The easement for the driveway will be 10
feet wide.
Mr. Von Turkovich noted they have also added frontage on lots 1
and 2. The right-of-way to lot #1 and 294 Swift St. is 30 feet
wide.
Regarding the UVM right-of-way, Mr. Von Turkovich said UVM has an
agreement to buy lot #1. He felt the issue of where the right-
of-way goes won't matter because all the lands will merge. They
are showing the right-of-way only to 294 Swift Street.
Members of the Commission were concerned with UVM's floating
easement. Mr. Crow felt the owner of lot #1 should agree not to
modify or alter the UVM easement.
Mr. O'Rourke asked what could go on lot #1. Mr. Weith said a
single family home or a duplex. Neither would have to come to
the Commission for approval.
Mr. Gardner said he had no problem with the easement. Mr.
Burgess noted that the right-of-way does not give Mr Gardner
the right to put in water or sewer lines. He would have to
negotiate that with Mr. Von Turkovich.
Mr. Crow moved the Planning Commission acprove the Final Plat
Application of Francis Von Turkovich and Patrice Stratmann for
subdivision of a 9.5 acre parcel into three lots of 4.1 acres,
4.0 acres and 1.4 acres, 300 Swift Street, as depicted on a plan,

1. All previous approvals. -and stimulations which are not _super-

2. The Planning Commission approves a sewer allocation of 840 g
for lots #2 and #3 (includes 20% reduction allowed by_State).

5. The Commission approves a 10 foot wide drive to serve lot #1
and the existin�_dwelling at 294 Swift Street. This drive shall
be widened to 20 feet if and when it serves three or more resi-
dential units. This drive shall be constructed prior to the
occupancy of an dwellin unit on lot #1. If and when this drive
is constructed, UVM shall be required to use the new drive to
access Swift Street.

Mr. Rabideau said they recognized that the primary concern of the
Commission is density. Mr. Burgess said it is more than that.
It is the combining of densities from two lots onto one. He
noted that the City Attorney had said the Commission can listen

2) PUBLIC HEARING - REAPPROVE 3-LOT SUBDIVISION, VONTURKOVICH
This application is to amend a recently approved three (3) lot subdivision located on Swift Street.
The final plat was approved on 1/27/98 (minutes enclosed). After the plat was recorded in the
land records, the applicant discovered that the distance notations along the front of lot #1 were
incorrect. Since the 90 day recording period had lapsed, the applicant was required to return to
the Commission for a new approval.
3) CITY CENTER DESIGN REVIEW OVERLAY DISTRICT
Enclosed is a proposed amendment to the zoning regulations to establish a City Center Design
Review Overlay District. The amendment includes adding a new Article XXIV (Exhibit A),
amending the Overlay Districts Map, and amending Section 14.403, Building Heights in the
Central District. I have added several illustrations to the design review ordinance - Section
24.401. Please review these before the meeting. In terms of Section 14.403, Building Heights, I
have revised this section to eliminate any provisions that deal with design review, since these
issues will now be addressed through the design review ordinance. I left in the height bonus
provisions as directed by the Commission. I will present proposed amendments to the sign
ordinance at Tuesday's meeting.
4) ZONING AMENDMENT - SECTION 25.1130). HEIGHT OF RESIDENTIAL
STRUCTURES
Enclosed is a proposed amendment to Section 25.113(i) which is the section that addresses fourth
story vertical extensions on residential structures. At the last meeting this issue was discussed,
the Commission decided to amend the provision so that it applies only to single family and duplex
residential structures.

I move the South Burlington Planning Commission approve the final plat application of Francis
Von Turkovich and Patrice Stratmann for subdivision of a 9.5 acre parcel into three (3) lots of 4
acres, 4.0 acres and 1.4 acres, 300 Swift Street, as depicted on a plan entitled "Property Plan F.
Von Turkovich & P. Stratmann 300 Swift Street South Burlington Vermont," prepared by
William A. Robenstein, dated 1/15/98, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain
in effect.
2. The Planning Commission approves a sewer allocation of 840 gpd for lots #2 and 3 (includes
20% reduction allowed by State). The applicant shall be required to pay the per gallon fee prior
to permit issuance.
3. The plat plan shall be revised to show the changes listed below and shall require approval of
the City Planner. Three (3) copies of the approved revised plat plan shall be submitted to the

lot #1. If and when this drive is constructed, UVM shall be required to use the new drive to
access Swift Street.
6. Any change to the final plat plan shall require approval by the South Burlington Planning
Commission.

and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording.

Lighting: Exterior lighting consists of the following:
— four (4) building mounted 175 watt mercury vapor lights with downcasting luminaries.

These lights should not cast light beyond the property line.
5) FRANCIS VON TURKOVICH & PATRICE STRATMANN - 3 LOT SUBDIVISION -
FINAL PLAT
This project consists of subdividing a 9.5 acre lot into three (3) lots of acres (lot #1), 1 .4 acres (lot
#2) and 4.1 acres (lot #3). Lot #3 is currently developed with a single family dwelling. A preliminary
plat approval for a three (3) lot subdivision on this property was granted on 8/12/97 . A new sketch
plan was reviewed on 12/16/97 (minutes enclosed) due to a substantial change in the configuration
of the lots from the previous plan. This application will be handled as a minor subdivision.
This property located at 300 Swift Street lies within the R2 District. It is bounded on the north by
a residence and undeveloped land, on the west by a church, on the east by a multi -family development
(Ridgewood), and on the south by Swift Street.
Access: Applicant's proposal for access to lot #1 is unclear. Staff recommends that access to lot
#1 be via the proposed 30 foot r.o.w. to serve the existing lot at 294 Swift Street. Lots #2 and #3
will be served by the existing driveway to the house on lot #3. The no.w. currently serving 294 Swift
Street will be discontinued in favor of the new 30 foot r.o.w.
Section 40 1. 1 (k) (2) of the subdivision regulations requires that all private roadways be a minimum
width of 30 feet with parking and 24 feet without parking. The width of the proposed private road
is 10 feet. The Commission at the sketch plan meeting approved a 10 foot wide drive. However,
this drive must be widened to 20 feet if more than 2 residential units use it.

At the sketch plan review, the Planning Commission required that a r.o.w. for UVM be provided that
extends all the way back to the property currently owned by UVM. The Commission also wants
written confirmation from UVM that they have reviewed the proposed r.o.w. Neither of these have
been addressed by the applicant.
The City Engineer reviewed the sight lines at the intersection of the new driveway with Swift Street
and feels that they are adequate.
Lot size/frontage: The minimum lot size requirement of 19,000 square feet (0.44 acres) will be met
by all three (3) lots.
The minimum frontage requirement of 100 feet will be met by all three (3) lots.
Density: The maximum density permitted on the 9.5 acre lot is 19 units (9.5 x 2). One (1) unit is
proposed for lot #2 in addition to the dwelling on lot #3. Lot #1 will be sold to UVM.
Sewer: The sewer allocation request is 840 gpd (includes 20% reduction allowed by State). The
applicant will be required to pay the per gallon fee prior to permit issuance.
Impact fees: The applicant should be aware that dwelling units on lot 1 and 3 will be subject to road,
school and recreation impact fees.

acres (lot 1), 1 acre (lot 2) and 4.7 acres (lot 3), 300 Swift
Street:
Ms. Stratmann said they have changed the plan and have a contract
with UVM to purchase lot #1. She showed the possible location of
a new driveway which would be put in if the neighbor moves. She
also showed the right-of-way for UVM access to lot #1 which is
now used. UVM is farming the land and the right-of-way is only
for farm equipment.
Mr. Weith suggested reserving a right-of-way for future access to
lot #1. Mr.. Burgess said the applicant will have to pick a time
when the new access will be used. Mr. Weith suggested it be
built prior to issuance of a zoning permit for lot #1. If it is
built before then, UVM equipment should also use it.
Mr. Burgess asked if the Gardners have a legal right-of-way to
access their lot. Ms. Stratmann did not know. Mr. Teeson felt
it might help to have the Gardner lot labelled so sale of it or
of lot 3 or development of lot #3 might trigger using the new
right-of-way. Mr. Teeson said he had no trouble with the right-
of-way as long as its use is brought about by a specific event.
Mr. Burgess noted that the 2 curb cuts will now be closer
together. Mr. Weith said that is offset by better visibility.
Ms. Stratmann questioned the size of the new right-of-way to
serve lots 1 & 4. Mr. Weith said the standard is 24 ft, but the
last time the Commission approved a preliminary plat they said a
20 ft. road was OK within a 40 foot right-of-way. He felt a 20
ft. road within a 30 ft. right-of-way would be OK. Ms. Stratmann
asked if it could be a 10 ft. road. Mr. Weith said 10 ft. was
OK until it serves more than 2 housing units.
Members raised no further issues but Mr. Burgess reminded the
applicant that they will have to have all details worked out when
they come in for approval.
5. Site plan application of Goldfield Construction Management to
amend a previously approved plan for a 26,000 sq. ft. building
for equipment rental/light manufacturing use. The amendment con-
sists of 1) increasing the size of the internal office space from
2605 sq. ft. to 4605 sq. ft., 2) reducing the width of a curb

drawn? We would really like this to be resolved, if possible, before our upcoming

4) FRANCIS VON TURKOVICH & PATRICE STRATMANN - 3 LOT SUBDIVISION -
SKETCH PLAN
This project consists of subdividing a 9.7 acre lot into three (3) lots of 4 acres (lot I), 1 acre (lot
II) and 4.7 acres (lot III). Lot III is currently developed with a single family dwelling. A
preliminary plat approval for a three (3) lot subdivision on this property was granted on 8/12/97
(minutes enclosed). A new sketch plan was submitted due to a substantial change in the
configuration of the lots from the previous plan. This application will be handled as a minor
subdivision.
This property located at 300 Swift Street lies within the R2 District. It is bounded on the north by
a residence and undeveloped land, on the west by a church, on the east by a multi -family
development (Ridgewood), and on the south by Swift Street.
Access: Applicant's proposal for access to lot I is unclear. Staff recommends that access to lot
I be via the proposed 20 foot r.o.w. to serve the existing lot at 294 Swift Street. Lots II and III
will will be served by the existing driveway to the house on lot III. The r.o.w. currently serving
294 Swift Street will be discontinued in favor of the new 20 foot r.o.w.
Section 401.1 (k) (2) of the subdivision regulations requires that all private roadways be a
minimum width of 30 feet with parking and 24 feet without parking. The width of the proposed
private road is 20 feet. The Commission at the preliminary plat meeting approved a 20 foot wide
drive.

The City Engineer reviewed the sight lines at the intersection of the new driveway with Swift
Street and feels that they are adequate.
Lot size/frontage: The minimum lot size requirement of 19,000 square feet (0.44 acres) will be
met by all three (3) lots.
The minimum frontage requirement of 100 feet will be met by all three (3) lots.
Density: The maximum density permitted on the 9.7 acre lot is 19 units (9.7 x 2). One (1) unit is
proposed for lot II in addition to the dwelling on lot III. Lot I will be sold to UVM.
Sewer: The final plat submittal should include the sewer allocation request.
Impact fees: The applicant should be aware that the dwelling on lot II will be subject to road,
school and recreation impact fees.
Bike path: A portion of the bike is located on lot III. The final plat should show the bike path
easement.
5) GOLDFIELD CONSTRUCTION MANAGEMENT - EXPAND PARKING & OFFICE -
SITE PLAN
This project consist of amending a plan previously approved on 1/10/95 (minutes enclosed) for a
23,600 square foot building for equipment rental/light manufacturing use. The amendment
consists of: 1) increasing the size of the internal office space from 2605 square feet to 4605
square feet, 2) reducing the width of a curb cut, 3) adding green area at building entrance, and 4)
constructing a 20 space parking lot.
This property located at 14 Berard Drive lies within the IC District. It is bounded on the east by a
fuel storage and distribution business, on the north and west by undeveloped land, and on the
north and west by undeveloped land, and on the south by Berard Drive.
Access/circulation: The property is currently served by six (6) curb cuts on Berard Drive ranging
in width from 60 feet to 12 feet. The 1/10/95 approval required that the 60 foot curb cut be

Mr. Von Turkovich explained that in construction of a pumping station on the far northwest
parcel, all septic tanks would gravity drain pump into that station and then pump down Swift

Street into the manhole across from Swift Estates. In long range planning with the city, an 8 inch
sewer line would be extended as far west as possible on Swift Street. More work would also be
done regarding topography, contours, etc. Only 4 houses would be using it at the moment as it is
not economically feasible to extend the line at this time.
Mr. Weith said that Mr. Szymanski requested a full topo before the final plat.
Mr. Dinklage asked if they had had sufficient discussion with Mr. Szymanski. With his recent
view, it is likely that the 8 inch line would be extended.
Mr. Von Turkovich did not agree that all the lots would be able to gravity drain into the 8 inch
line unless the line was extremely deep in the ground.
Mr. Dinklage asked if the city plans to show the sewer continuing on.
Mr. Weith said that long range plans showed the line continuing west of Spear Street and then
south on Spear Street for several hundred feet. It might be cheaper to go to Bartlett Bay. It
would be difficult to extend the line to Spear Street, however Mr. Szymanski did not rule out the
extension. There are no current plans to extend the line up Spear Street north and he requests full
topo of the property before the final plat.
Mr. Burgess wanted to know about the right of way to UVM property.
Mr. Dinklage asked if that had been resolved.
Mr. Weith suggested that it be shown on the plat the current location and the right of way.
Mr. Von Turkovich spoke with the Vice President of UVM. He has looked at the plans and is not
enthusiastic about them. Asked for a continuance of talks to determine feasibility and consider
alternatives, one of which may be another way to access the property. UVM will continue to use
it and the applicant will continue to ask them to use the driveway.
Mr. Weith said that at the last hearing they restricted further development on lots 2 and 3 and
wants to make sure that it is still a condition.

Mr. Burgess noted there is still outstanding information and
asked if the Commission should hear the application. Mr. Weith
felt it should but should continue it in order to get the infor-
mation before making a decision. Mr. Burgess noted about a dozen
items were asked for and were not provided.
Mr. Von Turkovich said they tried to address the easement
location. It has been shifted to the east across from the
property across the road. This addresses the sight line problem.
It will require getting permission to cut down a tree in the city
r.o.w. The applicant would pay for it and relandscape the area.
It will also require relocation of neighbor's mailboxes.
There is also the issue of the status of the UVM right-of-way.
The applicant is trying to get UVM to give up the current r.o.w
and relocate it. There is no deal on this yet, and they don't
know if it will ever happen.
Mr. Heald explained that UVM has haying and access rights. Their
property has another access.
Mr. Von Turkovich said they have no plans for on -site septic
system. Mr. Weith said the City Engineer recommends a gravity
sewer line on Swift Street to serve some of the lots. Mr. Von
Turkovich said the problem is there is a drainageway on Swift
Street and it will be hard to get under that. Mr. Weith said the
City Engineer looked at that and this was still his
recommendation. Regardless of where the sewer goes, the plans
will have to show the easements, etc.
Mr. Dinklage said he had no problem showing the UVM driveway as
it is now used (agricultural use only) with the option to come

back if something can be negotiatied. Mr. O'Rourke said that if
the agricultural use agreement is expired, he would have a
problem with the easement continuing forever. Members felt they
needed to have the ambiguity eliminated. Mr. Dinklage said he
had a problem with the proposed location of the access because
sight lines are very bad there. He would like to know how UVM
feels about it.
Mr. O'Rourke raised the question of reserving a 60 ft. r.o.w.
Mr. Weith said that from a long range planning point of view, it
makes sense to connect Swift and Spear Streets to inner roads
serving homes. Mr. Dinklage said that to reserve the 60 ft.
r.o.w. would make it unnecessary for the applicant to negotiate
with UVM. Mr. Von Turkovich said it would be a long time before
the market drove anyone to want to resubdivide the property. He
felt the 60 ft. r.o.w. would be a deal killer for them. People
don't want the potential for a major r.o.w He said it would make
marketing the lots impossible. Mr. Teeson asked if the applicant
would be willing to stipulate that there would be no further
subdivision and include this in the deeds. Mr. Von Turkovich
said he would do this on the two newly created lots. If UVM
didn't have any other access, there would be a problem but they
have plenty of land on Spear Street. Mr. O'Rourke said his
concerns would be addressed if there were no possibility of
further subdivision.
Mr. Von Turkovich said he would return with a complete plan if
the Commission continues the application.
Mr. Dinklage__moved to continue the application until 12 August
1997. Mr. Teeson seconded. Motion_passed__unanimous lv.�
9. Discussion on comments raised by the City Council on the
proposed amendment to the South Burlington Zoning Regulations to
add "valet parking, airport transient parking, and long term
parking" as a conditional use in the Mixed Industrial -Commercial
District:
Mr. Weith noted that Dennis Johnson had told the Council the use
shouldn't be allowed because of the dangerous intersection. The
Council also wanted to know if the Airport is aware of this
proposal.
Mr. O'Rourke noted it was made a conditional use because of the
traffic. Mr. Weith said plans are to improve the intersection in
1998.
Mr. Girard said the use he proposes would be only for 20-24 cars
a day and that wouldn't put a burden on the intersection. Mr.
Burgess reminded him that the zone change would allow the use in

FRANK VON TURKOVICH & PATRICE STRATMANN - 3 LOT SUBDIVISION -
PRELIMINARY PLAT
This application was continued from the July 15, 1997 meeting
(minutes enclosed) to provide the applicant additional time to
submit required information. This project consists of subdividing
a 9.5 acre lot into three (3) lots of 5.5 acres (lot #1), 1.8 acres
(lot #2) and 2.2 acres (lot #3). Lot #1 is currently developed
with a single family dwelling.
This property located at 300 Swift Street lies within the R2
District. It is bounded on the north by a residence and
undeveloped land, on the west by a church, on the east by a multi-
family development (Ridgewood), and on the south by Swift Street.
Access: Access to the two (2) new lots and an existing lot which is
not part of this subdivision is to be provided by a 40 foot r.o.w.
with a driveway of 20 feet in width. Access to the UVM property to
the north is shown to be provided by a 40 foot r.o.w. along the
easterly boundary of the property. The applicant has indicated
that they will leave the current UVM r.o.w. in its present
location. Therefore, the proposed U.V.M. r.o.w. along the easterly
boundary should be removed.
Section 401.1 (k) (2) of the subdivision regulations requires that
all private roadways be a minimum width of 30 feet with parking and
24 feet without parking. The width of the proposed private road is
20 feet. The Commission at the sketch plan meeting recommended a
20 foot wide drive.
The City Engineer has reviewed the sight lines at the intersection
of the new driveway with Swift Street and feels that they are
adequate.
Lot size/frontage: The minimum lot size requirement of 19,000
square feet (0.44 acres) will be met by all three (3) lots.
The minimum frontage requirement of 100 feet will be met by the two
(2) lots fronting Swift Street. The third lot has no road frontage
and will be served by an 40 foot r.o.w.

Density: The maximum density permitted on this 9.5 acre lot is 19
units (9.5 x 2). Three (3) dwelling units are proposed.
Sewer: The sewer allocation requested is 1440 gpd (includes 20%
reduction allowed by State). The applicant will be required to pay
the per gallon fee prior to permit issuance.
The applicant should prepare a complete contour map so that the
City Engineer can determine whether or not a gravity sewer can be vie
installed (see engineer's comments).
Impact fees: The applicant should be aware that the new residences
will be subject to road, school, and recreation impact fees.
Adjoining UVM Land: At the sketch plan hearing, the Commission
asked staff to look into the potential development of the UVM land
to the north, and whether it would be appropriate to reserve a
future 60 foot wide R.O.W. over the Von Turkovich land. Enclosed
is Exhibit A which shows the properties and roads in the vicinity.
The UVM land is 17 acres in size, has 635 feet of frontage on Spear
Street, and could potentially yield 34 housing units. From a long
range planning standpoint, it probably makes sense to connect these
two parcels with reserved 60 foot wide R.O.W.'s. This precedent
has been consistently applied to other subdivisions in the City.
If Von Turkovich was proposing more lots, staff would most likely
recommend establishing and reserving such a R.O.W. However,
because only three (3) lots are proposed, it is more difficult to
justify the need for such a R.O.W. especially since such a road is
not shown on the City's Official Map. It may be more appropriate
to require a R.O.W. if and when the property is further subdivided
into more lots. Also, if such a R.O.W. is required, it should be
appropriately located to take into account safe site distances.
Landscaping: A large street tree will be removed to accommodate
the proposed private street. Street trees should be planted along
the private street as required under Section 412.4 of the zoning
regulations and shown on the final plat plan.
Preliminary plat information: The following information required
for preliminary plat was requested and not submitted:

FINAL PLAT
This project consists of amending a previously approved planned
residential development consisting of 191 single family lots and 40
multi -family units, and an 18 hole golf course on approximately 452
acres of land. The amendment consists of: 1) resubdividing 12
lots (#118-129) into 10 lots, and 2) allowing 16 two (2) family
dwellings on lots previously approved for single family lots (#109-
117 and 137-143). The result is 14 more units than currently
approved. This is an amendment of Phase 1B approved on 6/18/96.
The sketch plan was reviewed on 5/27/97 (minutes enclosed). The
only issues involved with this amendment are: lot size/frontage,
coverage, and sewer.
Lot size/frontage: The minimum lot size requirement of 24,000
square feet is not being met by any of the duplex lots. These lots
are proposed to range in size from 11,594 to 19,640 square feet.
The Commission, pursuant to Section 6.607 of the zoning
regulations, may modify the minimum lot size requirement.
The minimum frontage requirement for a two (2) family lot is 100
feet. Lots #113-116 and 142 do not meet this requirement. The
Commission, pursuant to Section 6.607 of the zoning regulations,
may modify the minimum frontage requirement.
Coverage/setbacks: The maximum building coverage of 20% and the
maximum overall coverage of 40% will be exceeded on the duplex lots

I trust that you have received the revised plan for the proposed development from Bill
Robenstein. Please let me know if you need any additional copies.
Below, please find an explanation of some of the changes we made and our request for
you to reconsider some of the still outstanding requirements.
At Bill Szymanski's request, we added the location of the existing trees on Swift Street.
We have not shown the location of the street trees on the private way. We would like to
reserve judgment as to exactly where these trees should be located. Do you think it might
be possible to deal with this as a condition of approval to be determined later, in
consultation with staff?
Biil Szymanski met with me on site to review the following issues: (i) sight distance
from the proposed entrance of the new private road and, (ii) the design and of the private
septic system and its connection into the city sewer line. Bill felt that the proposed road
alignment across from the entrance to the roadway which serves the houses on the south
side of Swift Street was optimal. At this location, the sight distance is the best available
and appears to be adequate by engineering standards. Bill also felt that the idea of
collecting the effluent from the new and existing houses and pumping into the man hole
located on the north side of Swift Street (across from the entrance to Swift Estates) was
also acceptable. He no longer feels that we must extend the existing sewer main further
west. We talked specifically about the installation of the force main and came to the
conclusion that he did not see the need for the development of any grade profiles. I also
ask him about whether he would need profiles for the private road and his response was,
also, that this would not be necessary. Accordingly, I would like to ask you whether the

staff would be willing to waive its request for the submission of these profiles as they will
be costly to produce and of no material value to either us or the city engineer.
I have signed a letter to UVM asking them whether they would be willing to consider re
locating the existing easement. To date, I have not received a reply. My expectation is
that a formal decision could take some time. Accordingly, we are showing the location of
the easement that is actually being used by the university and will proceed as if though it
will remain in place in the future. If UVM agrees to make a change, we will contact the
commission for formal approval.
Please contact me if you find that any of our plans or documentation are not in order. We
will be happy to promptly make any further changes that you require.

The South Burlington Planning Commission will hold a public hearing
at the South Burlington City Hall, Conference Room, 575 Dorset
Street, South Burlington, Vermont on July 15, 1997 at 7:30 P.M. to
consider the following:
1) Final plat application of Wright & Morrissey/Vermont Gas for a
planned unit development consisting of the existing Vermont Gas
building and a new 39,728 square foot building for general office
use and a bank with drive -through service, 69 and 85 Swift Street.
2) Final plat application of Dan Morrissey and Marie and Albert

I move the South Burlington Planning Commission approve the
preliminary plat application of Francis J. Von Turkovich & Patrice
A. Stratmann for subdivision of a 9.5 acre parcel into three (3)
lots of approximately 1.8 acres, 2.2 acres, and 5.5 acres, 300
Swift Street, as depicted on a two (2) page set of plans, page one
(1) entitled, "Property Plan F. Von Turkovich & P. Stratmann 300

1. All previous approvals and stipulations which are not

8) FRANCIS VAN TURKOVICH & PATRICE STRATMANN - 3 LOT SUBDIVISION -
PRELIMINARY PLAT
This project consists of subdividing a 9.7 acre parcel into three
(3) lots, two (2) lots of approximately (2) acres and one (1) lot
of approximately 5.7 acres. The property is currently developed
with a single family dwelling. The sketch plan was reviewed on
6/10/97 (minutes enclosed).
This property located at 300 Swift Street lies within the R2
District. It is bounded on the north by a residence and
undeveloped land, on the west by a church, on the east by a multi-
family development (Ridgewood), and on the south by Swift Street.
Access: Access to the two (2) new lots and an existing lot which is
not part of this subdivision is to be provided by a 40 foot r.o.w.
with a driveway of unknown width. Access to the UVM property to
the north is to be provided by a 40 foot r.o.w. along the easterly '
boundary of the property. This r.o.w. should be shown as an
easement/r.o.w. not a separate parcel. Plat should show the
driveway to the existing house.
Section 401.1 (k) (2) of the subdivision regulations requires that
all private roadways be a minimum width of 30 feet with parking and
24 feet without parking. The width of the proposed private road is
unknown. The Commission at the sketch plan meeting recommended a
20 foot wide drive.
The applicant should address the sight line distances at the
intersection of the new driveway with Swift Street.
Lot size/frontage: The minimum lot size requirement of 19,000
square feet (0.44 acres) will be met by all three (3) lots.
The minimum frontage requirement of 100 feet will be met by the two
(2) lots fronting Swift Street. The third lot has no road frontage
and will be served by an 40 foot r.o.w.
Density: The maximum density permitted on this 9.7 acre lot is 19
units (9.7 x 2). Three (3) dwelling units are proposed.

Sewer: The sewer allocation request should be submitted.
Impact fees: The applicant should be aware that the new residences
will be subject to road, school, and recreation impact fees.
Adjoining UVM Land: At the sketch plan hearing, the Commission
asked staff to look into the potential development of the UVM land
to the north, and whether it would be appropriate to reserve a
future 60 foot wide R.O.W. over the Von Turkovich land. Enclosed
is Exhibit A which shows the properties and roads in the vicinity.
The UVM land is 17 acres in size, has 635 feet of frontage on Spear
Street, and could potentially yield 34 housing units. From a long
range planning standpoint, it probably makes sense to connect these
two parcels with reserved 60 foot wide R.O.W.'s. This precedent
has been consistently applied to other subdivisions in the City.
If Von Turkovich was proposing more lots, staff would most likely
recommend establishing and reserving such a R.O.W. However,
because only three (3) lots are proposed, it is more difficult to
justify the need for such a R.O.W. especially since such a road is
not shown on the City's Official Map. It may be more appropriate
to require a R.O.W. if and when the property is further subdivided
into more lots. Also, if such a R.O.W. is required, it should be
appropriately located to take into account safe site distances.
Landscaping: A large street tree will be removed to accommodate
the proposed private street. Street trees should be planted along
the private street as required under Section 412.4 of the zoning
regulations.
Preliminary plat information: The following information required -
for preliminary plat was requested and not submitted:

--" five (5) foot contour lines based on USGS datum for existing
and proposed grades.

9) ZONING AMENDMENT AIRPORT TRANSIENT PARKING IN I C DISTRICT
At last Monday's meeting the Council raised two questions relating
to the proposed zoning amendment to add "valet parking, airport
transient parking, and long term parking" to the I-C District.
They want the Planning Commission to consider the traffic problem
at the Airport Parkway/Shamrock Road/Ethen Allen Drive intersection
and provide an opinion as to whether this use should still be
added. The Council also wants staff to contact the Airport
Commission and get their comments regarding this proposed change.

Mr. Weith also requested some sort of site drainage.
The Martins said they plan to remove the existing overhead line and install a new pole.
Everything from the new pole will go underground.
The question of requiring a street light was raised. The Commission questioned whether a private
light is a good idea. They agreed to go with staff decision on this.
Mr. Dinklage said his main concern will be excess run-off of water
onto the neighboring properties.
4. Sketch plan application of Francis Von Turkovich & Patrice Stratmann to subdivide a 9.7 acre
parcel into 3 lots, 2 lots of approximately 2 acres and one lot of approximately 5.7 acres, 300
Swift Street:
Mr. Von Turkovich said they will construct a new private access drive to serve the new lots and
the house now occupied by the Gardner family. The Gardners have agreed to hook into this
drive.
Mr. Von Turkovich said they would like a road narrower than city standard to keep with the look
of other private drives in the area. Mr. Burgess noted the City engineer suggests 20 feet. Mr.
Von Turkovich said they could do that.
Mr. O'Rourke raised the issue of sight distances from the proposed new drive.
Mr. Weith said a major issue is the right-of-way to land now owned by UVM. The right-of-way
is not now defined and this will have to be done. Mr. Burgess stressed that this right-of-way is
for the benefit of the city if UVM ever decides to develop the parcel.
Mr. Von Turkovich said there will be covenant that the lots created in this subdivision will never
again be subdivided. This includes the lot with the existing house. Mr. O'Rourke said that makes
the right-of-way issue even more important.
Mr. Burgess reviewed the major issues:
Location/width of right-of-way to adjacent property (staff will be asked to come
back with a recommendation on this)
Access road width (members are comfortable with 20 ft.)
Sight distances.

- SKETCH PLAN
This project consists of subdividing a 9.7 acre parcel into three
(3) lots, two (2) lots of approximately (2) acres and one (1) lot
of approximately 5.7 acres. The property is currently developed
with a single family dwelling.
This property located at 300 Swift Street lies within the R2
District. It is bounded on the north by a residence and
undeveloped land, on the west by a church, on the east by a multi-
family development (Ridgewood), and on the south by Swift Street.
Access: Access is provided by a r.o.w. serving a residence to the
north which also provides access to the existing dwelling. Access
for the two (2) lots to be developed will be provided by a 18 foot
wide private roadway which will also provide access to the
undeveloped land to the north.
Section 401.1(k)(2) of the subdivision regulations requires that
all private roadways be a minimum width of 30 feet with parking and
24 feet without parking. The proposed private road is proposed to
be 18 feet in width. The Commission has approved 18 foot drives in
the past when serving only 2 or 3 lots.
The applicant should address the sight line distances at the
intersection of the new driveway with Swift Street.
Lot size/frontage: The minimum lot size requirement of 19,000
square feet (0.44 acres) will be met by all three (3) lots.

The minimum frontage requirement of 100 feet will be met by the two
(2) lots fronting Swift Street. The third lot has no road frontage
and will be served by an 18 foot r.o.w.
Density: The maximum density permitted on this 9.7 acre lot is 19
units (9.7 x 2). Three (3) dwelling units are proposed.
Sewer: The sewer allocation request should be submitted with the
preliminary plat submittal. If on -site septic is proposed,
applicant should provide the information required under Section
203.1(n) of the subdivision regulations with the preliminary plat
submittal.
Impact fees: The applicant should be aware that the new residences
will be subject to road, school, and recreation impact fees.
