This permit affects property identified as Town Tax Parcel ID # 170-000-214 and referenced in deeds
recorded in Book 329 Page 285 of the Land Records in South Burlington, Vermont.
This project. consisting of amending Permit #EC-4-1633 to reconstruct the on -site wastewater
disposal system to accommodate a four bedroom single family residence served by municipal water
located at 214 Swift Street in the City of South Burlington, Vermont, is hereby approved under the
requirements of the regulations named above subject to the following conditions.
GENERAL
1. This permit does not relieve the landowner from obtaining all other approvals and permits as
may be required from the Act 250 District Environmental Commission; the Department
Public Safety, Division of Fire Safety— telephone Williston Regional Office (802) 879-2300;
and local officials prior to proceeding with this project.
2. The project shall be completed as shown on the following plans that have been stamped
"approved" by the Wastewater Management Division:

prepared by Civil Engineering Associates, Inc.
The project shall not deviate from the approved plans in a manner that would change or affect
the exterior water supply or wastewater disposal system, building location or the approved use
of the building without prior written approval from the Wastewater Management Division.
3. The conditions of this pen -nit shall run with the land and will be binding upon and enforceable
against the landowner and all assigns and successors in interest. The landowner shall be
responsible for the recording of this permit in the South Burlington Land Records within
thirty, (30) days of issuance of this permit and prior to the conveyance of any lot subject to the
jurisdiction of this pennit.
4. Each prospective purchaser of the lot shall be shown copies of the Wastewater System And
Potable Water Supply Permit and the approved plans prior to conveyance of the lot.

5. This project has been reviewed and approved for the existing four bedroom single-family
residence on the lot. The landowner shall not construct any other type of structure requiring
plumbing, including public buildings, duplexes, condominium units, or commercial buildings,
without prior review and approval by the Wastewater Management Division. Such approvals
will not be granted unless the proposal conforms to the applicable laws and regulations.
6. All conditions set forth in Permit #EC-4-1633 shall remain in effect except as modified or
amended herein.
7. A copy of the approved plans and this permit shall remain on the project during all phases of
construction and, upon request, shall be made available for inspection by State or local
personnel.
WATER SUPPLY & WASTEWATER DISPOSAL
8. No permit issued by the Secretary shall remain valid after substantial completion of a
wastewater system until the Secretary receives a signed and dated certification from a
designer or an installer, as specified in the permit, that states:
"I hereby certify that in the exercise of my reasonable professional judgment the
installation -related information submitted is true and correct and that the wastewater
system: was installed in accordance with the permitted design and all permit
conditions or record drawings and such record drawings are in compliance with the
applicable rules, were filed with the Secretary, and are in accordance with all other
permit conditions; was inspected; was properly tested; and has successfully met those
performance tests."
9. The lot is approved for wastewater disposal by construction and utilization of the site -specific
wastewater disposal system depicted on the approved plans. The Wastewater Management
Division is to be notified if at any time this system fails to function properly and/or creates a
health hazard. The Wastewater Management Division shall allow no other method or location
of wastewater disposal without prior review and approval.
10. No buildings, roads, water lines, earthwork, re -grading, excavation or other construction that
might interfere with the installation or operation of the wastewater disposal systems are
allowed on or near the site -specific wastewater disposal system or replacement area depicted
on the approved plans. All isolation distances, which are set forth in the Wastewater System
and Potable Water Supply Rules will be incorporated into the construction and installation of
the wastewater disposal field. Compliance with these isolation distances is required.
11. The future wastewater disposal "replacement area" designated on the approved plans shall be
held in reserve for the eventual construction of a replacement wastewater disposal system in
the event of the failure of the primary wastewater disposal system. Prior to construction of
the replacement wastewater disposal system, the landowner shall submit an application, fee
and engineering plans for review and approval by the Wastewater Management Division.

12. The approved wastewater disposal system has been designed to serve a four -bedroom single-
family residence. Prior to any increase in bedrooms, the landowner shall submit an
application, fee, and engineering plans for review and approval by the Wastewater
Management Division.
13. The lot is authorized to obtain water from the municipal water supply system provided the
water service is located as shown on the approved plan. The Wastewater Management
Division shall allow no other method or location of obtaining potable water without prior
review and approval.

This project, consisting of a one lot subdivision, the lot being
6.9 acres in size located off Swift Street in the City of South
Burlington, Vermont -is hereby approved under the requirements of
the regulations named above, subject to the following conditions.
GENERAL
(1) The project shall be completed as shown on the plans Sheet 1
of 1 "Site Plan" dated February 10, 1992 prepared by Gunner
McCain, Site Technician B and which have been stamped
"approved" by the Division of Protection. The project
shall not deviate from the approved plans without prior
written approval from the Division of Protection.
(2) Each prospective purchaser of the lot shall be shown a copy
of the approved plot plan and this Subdivision Permit prior
to conveyance of the lot.
(3) This project has been reviewed and is approved for the
construction of one single family residence on the approved
lot. Construction of other type dwellings, including public
buildings, duplexes, and condominium units, is not allowed
without prior review and approval by the Division of
Protection, and such approval will not be granted unless the
proposal conforms to the applicable laws and regulations.
(4) The conditions of this permit shall run with the land and
will be binding upon and enforceable against the permittee
and all assigns and successors in interest. The permittee
shall be responsible for the recording of this permit and
the "Notice of Permit Recording' in the City of South
Burlington Land Records within 30 days of issuance of this
permit and prior to the conveyance of any lot subject to the
jurisdiction of this permit.
(5) In the event of a transfer of ownership (partial or whole)
of this project, the transferee shall become permittee and
be subject to compliance with the terms and conditions of
this permit.
(6) This permit shall in no way relieve you of the obligations
of Title 10, Chapter 48, Subchapter 4, for the protection of
groundwater.
WATER SUPPLY
( 7 ) The lot is approved for water supply by connection to the
municipal water system. No other means of obtaining potable
water shall be allowed without prior review and approval by
the Division of Protection.
SEWAGE DISPOSAL
(8) The lot is approved for wastewater disposal by construction
and utilization of the site -specific wastewater disposal
system depicted on the approved plans. No other method or
location of wastewater disposal shall be allowed without
prior review and approval by the Division of Protection.

(9) The wastewater collection, delivery, and treatment/disposal
systems herein approved shall be routinely and reliably
inspected during construction by a professional engineer,
registered in the State of Vermont, or Type A or Type B
certified site technician who shall, upon completion and
prior to occupancy of the subject establishment, report in
writing to the Division of Protection that the installation
was accomplished in accordance with the approved plans and
permit conditions.

The South Burlington Planning Commission held a regular meeting on Tuesday, 14 July 1998, at
T30 p.m., in the conference room, City Hall, 575 Dorset Street.

1. Other Business:
Mr. Weith noted that Peter Judge has appealed the condition that requires him to move the
transformer in the future.
2. Consent Agenda:
a. Continued site application of Jolley Associates to amend a previously approved plan to con-
struct a 262 sq. ft. addition to a convenience store with gas sales. The amendment consists of
altering the landscaping in the front yard, 977 Shelburne Rd.
No issues were raised.
Mr. O'Rourke moved to approve the site plan application of Jolley Associates subject to the
stipulations and conditions provided by the City Planner in his memo of 10 July 1998. Ms.
Barone seconded. Motion passed unanimously.
3. Sketch Plan application of Robert & Carol Erdmann to subdivide an 11 acre parcel into two
lots of approximately four acres and seven acres, 200 Swift Street:
Mr. Erdmann said the main consideration is access to the north side of Swift Street. UVM is the
neighbor to the north. The Erdmann's son owns the easterly parcel. The applicant wants to run a
line cutting out a triangular parcel for his other son to build a residence. He didn't see any traffic
hazard from the proposed access and felt there would be more of a hazard to have a shared drive.
Mr. Beaudin and Ms. Barone had no problem with the new cut. Mr. O'Rourke and Mr. Burgess
agreed with the City Planner and City Engineer that it was a bad idea.
Mr. Erdmann said felt having to share a drive would put more traffic higher on the hill and would
also depreciate the value of the property.

Mr Burgess advised the applicant that the members of the Commission present are split on the
issue, so he might have a problem at the hearings if he continues to show the new access.
Mr. Weith said that because there is no frontage for the new lot, there will have to be both a
preliminary and final plat hearing. A survey plat will be required before preliminary plat. Mr.
Erdmann said he would not want to go through the cost of a survey if the plan is not going to be
approved.
The Planning Commission was willing to treat both preliminary and final plat on the same night.
4. Public Hearing: Final plat application of JAM Golf Course LLC to amend a planned residential
development consisting of 162 single family lots, 20 duplex lots and 40 multi -family units (242
units total) and an 18-hole golf course, Dorset Street. The amendment consists of 1) altering the
alignment of Nowland Farm Road and 2) reducing the number of single family lots by 2 and
adding one duplex building (242 units total):
Mr. Marshall showed the location of Nowland Farm Road. The area under consideration is the
approach to Pinnacle at Spear. He showed the area where 6 units were originally proposed and
where there will be only 4.
Mr. Marshall said the applicant has worked with staff on curb cut issues. There are two options.
The City Engineer likes Option A and planning staff likes Option B which reduces the number of
curb cuts.
Mr. Marshall also said the applicant is willing to offer a stipulation that there would be no more
than a 10% total increase over the number of units originally approved. That would be about 24
units of which 14 are already approved. They would also agree that when there are more than 35
units off Three Sisters Road, they would provide a second access. Mr. O'Rourke asked what
"provide an access" means. Mr. Marshall said they would build the road.
After a brief discussion, members agreed they preferred Option B.
Mr. O'Rourke moved the Planning Commission approve the final plat application of JAM Golf
LLC to amend a planned residential development consisting of 164 single family lots, 20 duplex
lots and 40 multi -family units 244 units total) and an 18 hole golf course, Dorset Street. The
amendment consists of: 1) altering the alignment of Nowland Farm Road, and 2) reducing the
number of single family lots by two and adding one duplex building (244 units total), as depicted
on a ten page set of plans, page one entitled "Economou Farms Golf Course Plat Phase H - Four
Sisters Road Property of J.A. McDonald, Inc, South Burlington Vermont," prepared by Civil
Engneeriniz Associates, Inc, dated February, 1997, last revised on 7/7/98, with the following
stipulations:

3) ROBERT & CAROL ERDMANN - 2 LOT SUBDIVISION - SKETCH PLAN
This project consists of subdividing an 1 I acre parcel into two (2) lots of approximately
four (4) acres and seven (7) acres. The seven (7) acre parcel is developed with a single
family dwelling. The four (4) acre parcel will have no frontage so this application must be
reviewed as a major subdivision.
This property located at 200 Swift Street lies within the R1 and C.O. Districts. It is
bounded on the north by UVM land, on the east and west by single family dwellings and
on the south by Swift St.
Access: Access to the developed lot is by an existing curb cut. Access to the new lot will
be by a new curb -cut with a right-of-way across the developed lot. Staff recommends that
the new lot share the existing curb -cut.
Lot size/frontage: The minimum lot size requirement of one (1) acre is met by both lots.
The frontage requirement of 170 ft. will be met by the developed lot. The undeveloped lot
has no frontage and is served by a r.o.w.
Density: The maximum density allowed is 11 units and two (2) units are proposed (i.e.,
one existing and one new)
PreliminM Plat: The preliminary plat plan should include all the information requirements
listed under Section 203 of the subdivision regulations.
Impact fees: The dwelling proposed for the undeveloped lot will be subject to the road,
school and recreation impact fees.
Sewer: The preliminary plat submittal should include the sewer allocation request unless a
septic system is proposed. If a septic system is proposed, all applicable information that is
required by the subdivision regulations shall be submitted.

Mr. Weith noted that Item #4 had been withdrawn.
Mr. Burgess noted that on next week's agenda the I-Ag District
will be discussed. He said he had invited the City Council to
discuss this with the Commission and would like to have the
discussion center on which of the options the city wants to
pursue.
The city will be putting out a flier on the upcoming ballot item
on the Southeast Quadrant. Mr. Burgess said he would write the
Commission's point of view, and there would be equal opportunity
for those opposed to present their views.
2. Final Plat applicaltion of Robert Erdmann for subdivision of a
17.9 acre parcel into two parcels of 11 acres and 6.9 acres, 200
Swift St:
Mr. Erdmann said there is a question of site distance at the
access of the parcel to be created. This has been staked.
Mr. Burgess noted a note from the City Engineer that site
distance allows for speeds up to 44 mph. The legal minimum is 35
mph.
Mr. Weith said he didn't think the Rec Path people have walked
the site. The Comprehensive Plan doesn't i:zclude the area for
the Rec Path and Mr. Weith recommended it not be included this
late in time.
Mr. Austin moved the Commission approve the final plat applica-
tion of Robert Erdmann for subdivision of a 17.9 acre parcel into
two (2) parcels of 11 acres and 6.9 acres as depicted on a plan
entitled "Plat Showin Proposed Subdivision, Robert H. and Carol
B. Erdmann Property, Swift Street, South Burlin ton, Vermont,"

1. In order to promote adequate sight distance, the driveway for
Parcel #2 shall be so located to be 700 feet from the west edge
of the Spear Street pavement at the Spear Street/Swift Street in-
tersection. The survey plat shall be revised prior to recordin
to show the proposed location of the driveway for Parcel #2 as
recommended above. The revised plan shall be approved by the
City Engineer.
2. Prior to issuance of a zoningZbuilding permit for Parcel #2,
the, applicant shall pay the required_.perunit recreation fee for
this parcel.
3. The final plat shall be recorded in the South Burlington Land
records prior to issuance of a zonin building_permit and within
90 days or this approval is null and void. The plat shall be
signed by the Planning Commission Chair or_Clerk prior_ to
recording.
Mrs. Maher seconded. The motion passed unanimously.
3. Sketch plan application of Edward & Janet Austin, Jr., for
subdivision of a 2.6 acre parcel into two parcels of 1.3 acres
each, 301 Swift Street:
Mr. Austin stepped down during this discussion.
Mr. Austin said that he would be acquiring the second lot. The
biggest issue is that one lot is in the Southeast Quadrant's
restricted area. He suggested handling this as a PRD and
satisfying the goals of the PRD. He also noted the second lot
has very thick trees. He said a house would be put well back
into the trees. He would be willing to designate a building
envelope. The entrance drive to the second lot is about 250 ft.
Mr. Austin said he had no problem leaving space for snow storage.
Mr. Weith suggested a note on the plat that trees won't be cut.
Mrs. Maher asked about water and sewer. Mr Austin showed the

Members had no problem considering a PRD with a provision to

CHAMPLAIN WATER DISTRICT - PLANT EXPANSION - QUEEN CITY PARK ROAD
1. The sewage pumping station valve vault should have a connection for an emergency pump.
2. The sidewalk shall be continuous across the new driveway and 8 inches thick to accommodate
heavy trucks.
3. Pipe that will receive concrete thrust blocks should be wrapped with plastic to prevent the
concrete from bonding to them.
4. Queen City Park Road in this area is in the City of Burlington. Access to the sewer, as shown
on the plans, will require a road opening permit from Burlington. This is quite expensive. If the
sewage pumping station could be relocated say north of the garage and near the raw water tank
and from there the force main cross the existing parking lot and tie into the existing 6 inch service
in front of the existing building, it may be a little longer run, but save the cost of the road opening
permit.
5. Garage shall be equipped with a grease and grit trap prior to discharge to the sanitary sewer.
6. Force main should include clean outs at the sharp bends.

2) ROBERT ERDMANN - 2 LOT SUBDIVISION - SWIFT STREET
This project consists of the subdivision of a 17.95 acre lot into
an 11.02 acre lot (lot #1) and a 6.92 acre lot (lot #2). Lot #1
is currently developed with a single family residence. The
sketch plan was reviewed on 2/4/92 (minutes enclosed).
This project located at 200 Swift Street is within the R1
District. It is bounded on the north by a natural area owned by
UVM, on the east by a single family residence, on the south by
Swift Street and on the west by a single family residence.
Access: There is currently an access to the residence on lot #1.
Due to sight distance limitations, City Engineer Bill Szymanski
has recommended that the driveway to lot #2 be located 700 feet
west of the edge of the Spear Street pavement. Applicant's
representative has indicated to staff that the location of the
proposed driveway as shown on the plat was not determined by this
measurement. It appears that the proposed driveway location
needs to be moved approximately 22 feet to the east to meet Bill
Szymanski's recommendation. The Planning Commission should be
assured that the location of the driveway will be determined as
recommended by the City Engineer.
Setbacks: Existing structures meet setback requirements from new
property line.
Area and Dimensions: Both lots meet area and dimension
requirements for the R1 District.
Sewer: Sewage disposal will be on -site. Applicant has obtained
a State permit for the on -site system.
Recreation Fee: The required recreation fee for the new lot
should be paid prior to issuance of a building/zoning permit for
a structure on this lot.

Other: A member of the Recreation Path Committee has suggested
that a recreation path easement be shown to provide a connection
from Swift Street to the UVM property and eventually to Spear
Street. This link is not shown in the Comprehensive Plan and has
not been walked by either staff or the Recreation Path Committee.
3) JUDGE DEVELOPMENT - REVISEDRETAIL BUILDING - CORPORATE WAY
This project consists of the reduction in size of a 21,655 square
foot retail building approved on 9/24/91 (minutes enclosed) to a
19,253 square foot retail building. The applicant no longer
proposes a boundary line adjustment with the adjacent Anchorage
Inn property.
This property is located on Corporate Way. Most of this property
is in the Central District 1 zone with a small portion in the
Commercial 1 zone. This property is bounded on the north by the
Ramada Inn and a single-family dwelling on Mary Street, on the
east by undeveloped land along Corporate Way, on the south by
Corporate Way and on the west by the Anchorage Motor Inn and 100
Dorset Street.
This 2.6 acre parcel was subdivided from the Ramada Inn property
and approved by the Planning Commission on July 10, 1990.
Access/circulation: Primary access to the property will be via a
25 foot two-way curb cut on Corporate Way. Additional access
will be provided by a 24 foot parking aisle to 100 Dorset Street,
and a 24 foot "floating right-of-way" between this property and
the Ramada property, the permanent location of which is to be
determined at the time of site plan approval of this lot. This
plan shows the permanent location of the right-of-way to the
Ramada rroperty.
The July 10, 1990 subdivision approval stipulated that an access
agreement allowing vehicle access via a 24 foot wide easement
between this parcel and 100 Dorset Street be recorded. The legal
documents were drafted and approved by the City Attorney. The
documents are still with the original applicant's attorney and
therefore have not been recorded. Applicant has indicated that
this document will be recorded prior to obtaining the
zoning/building permit.

The South Burlington Planning Commission held a meeting on
Tuesday, 4 February 1992, at 7:30 pm, in the Conference Room,
City Hall, 575 Dorset St.

Mr. Sheahan moved to approve the Minutes of 3 December as
written. Mr. Austin seconded. Motion passed unanimously.
3. Public Hearing: Consider request of S. Burlington Realty to
continue revised final plat application for construction of a
49,000 sq. ft. building for general office use (38,000 sq. ft.),
retail use (9400 sq. ft.), and mechanical space (1600 sq. ft.) on
39 acres of land along Corporate Way to the 3 March 1991 meeting:
Mr. Craig moved to grant the applicant's request. Ms. Peacock
seconded. Motion passed unanimously.
4. Sketch Plan application of Robert Erdmann for subdivision of
18.7 acres of land containing a single family dwelling into two
lots of 11.2 acres (single family dwelling) and 7.5 acres, Swift
Street:
Mr. Erdmann showed the proposed plan. Mrs. Maher noted the City
Engineer has made a strong case for one access for both lots.
Mr. Erdmann agreed there might be a question on this but he said
Swift St. becomes steep at their dirve then levels off. It is
almost dead level at the proposed curb cut for the new lot. He
said he had timed the visibility factor at 35 mph and there are
10 seconds from the time you see a car till you are at the drive-
way. He felt this was plenty of time to see a car approaching
the driveway. Mr. Weith suggested he and the City Engineer meet
with the applicant to discuss this further. Mr. Burgess noted
the City Engineer had also raised the question of left turns at
the proposed driveway.
The applicant agreed to donate land for to extend the Swift St.

right-of-way, if all the others on the street do.
4. Public Hearing: Revised final plat application of John Larkin
and Gerald Milot for construction of a planned commercial devel-
opment consisting of 150 multi -family residence units, a 60-room
hotel, 20,000 sq. ft. movie theatre (1000 seats), a 25,000 sq.
ft. fast food restaurant with drive-thru window on a 33 acre
parcel located on Shelburne Rd.:
Mr. Rabideau reviewed the previous proposal and noted that the
Commission had felt the plan and use were not popular. He felt
that their previous experience with fast food restaurants would
enable them to do a good job with such a use. He then oulined
several new elements in their plan. The have moved the res-
taurant to the front of the lot to hide parking behind it.
Circulation would be entirely behind the restaurant. There would
also be a 50 ft. landscaped buffer in front. Mr. Rabideau felt
this was a generous concession by McDonalds as was their offer to
construct a non-standard building with a more creative approach
to the architecture that would be more fitting for a family use
image. Other changes include the reconfiguring of the retail
space which, he felt, would make the shared parking work out
better. There will be some parking under the retail buildings
and they have agreed to extend parking all the way out to the
retail wing to make up the parking deficit. The landscaped
buffer along the parking lot has also been widened.
Mr. Craig noted that on the plan there was a difference between
delineations of two areas of parking. Mr. Rabideau explained
that one delineation defines an area where deliveries would be
accepted. Mr. Burgess said either you have parking spaces or
driveways for trucks. One space can't be for both.
Mr. Craig noted the pedestrian door exits right to the drive-thru
lane. He said this was not safe. A McDonald's representative
said theytried to keep the drive-thru on the back side to hide it
from Shelburne Rd. Mr. Criag said they could eliminate the
drive-thru altogether. The McDonalds people said this is not
conducive to the current market. Mr. Craig said the present set
up is totally unacceptable to him. McDonalds people said they
do this in many places and have never had an accident. They
said they had no problem adding a railing.
Mrs. Maher asked the Planner if he was satisfied with the parking
location in relation to peak demands. Mr. Weith said the number
of spaces was OK but he wasn't sure about the location. He noted
that people who live in the motel/apartments are now parking on
Fayette Rd. instead of behind the buildings.
Mrs. Maher asked when the traffic light will be in. Mr. Milot

5) ROBERT ERDMANN - 2 LOT SUBDIVISION - SWIFT STREET
This project consists of the subdivision of an 18.7 acre lot into
a 7.5 acre lot and an 11.2 acre lot. The 11.2 acre lot is cur-
rently developed with a single family residence.
This property is located at 200 Swift Street and is within the
R1 District. It is bounded on the north by a natural area owned
by UVM, on the east by a single-family residence, on the south by
Swift Street and on the west by a single-family residence.
Access: There is currently an access to the residence on the
11.2 acre lot. A separate access is proposed for the 7.5 acre
lot which is located easterly of the current access. Due to
limited sight distance for the proposed access and relatively
high traffic volumes on Swift Street, staff recommends that the
existing access be used to serve both lots.
Area and Dimensions: Both lots are proposed to meet the area and
dimension requirements for the R1 District.
Sewer: Sewage disposal will be on -site. Applicant will be
required to obtain both local and State permits for sewage dis-
posal.

--- the final plat must include existing structures in order
that compliance with setback requirements can be checked.
6) TAP. INC. - TEMPORARY DRIVE - CORPORATE WAY
This project consists of the construction of a 24 foot wide
temporary gravel drive connecting Corporate Way with both the 100
Dorset Street and Ramada Inn properties. This gravel drive was
constructed in November 1991 without authorization (see enclosed
letter from Peter Judge).
This gravel drive crosses the property at 2 Corporate Way on
which a 21,655 square foot retail building was approved on Sep-
tember 24, 1991. This temporary drive was instigated by a joint
effort of both the applicant and Ramada Inn. They felt that this
was a good opportunity for them to experiment with the traffic
patterns for both of the properties involved.

lighting.
--- staff has calculated overall coverage to be 69.4% (maximum
allowed is 70%) and the site plan application states that it
is 54%. Increasing the width of the parking aisle as noted
above will bring overall coverage to 70%.
--- this property is in Traffic Overlay Zone 1 which would allow
lot to generate a maximum of 3.3 vehicle trip ends
during the P.M. peak hour. The proposed use would exceed
this limit. Since the main access to the site will be via
the Farrell property, the applicant must be prepared to
make a case for allowing this use to exceed the traffic
generation limit given the unique circumstances in this
case, otherwise the Planning Commission would have to deny
the application.

AUSTIN SUBDIVISION SWIFT STREET
1. Entrance drive shall have at least a 10 foot grassed strip
along the adjacent property line to serve as a snow storage area.
2. There exists a sewer easement along the southerly property
line. This is with private easement and includes a sewer service
serving the Skiff and Austin properties. They were allowed to
tie into the Meadowood Drive sewer because their on site systems
failed. This line can not be used for serving the new lot. The
main along the north side of Swift Street has to be extended
westerly to serve it.
3. The stopping sight distance to the west should be checked.
It should be sufficient to accommodate a vehicle traveling at
least 40 m.p.h. (approximately 440 feet).
ERDMANN 2 LOT SUBDIVISION SWIFT STREET
1. The City took profile elevations along Swift Street. The
maximum stopping sight distance is obtained when a driveway
serving the proposed lot is located 700 feet as measured along
the north edge of Swift Street starting at the west edge of Spear
Street pavement. This sight distance is approximately 485 feet
which is equal to a speed of approximately 44 m.p.h. The legal
speed limit in the area is 35 m.p.h.
2. The water service should be jacked or washed across Swift
Street instead of opening the road. This service is
approximately 350 feet in length. A 3/4 inch service for that
length will result in a sharp drop in supply when two or more
appliances are used simultaneously such as a dishwasher and
shower. A 1 inch service will eliminate this problem.

My preliminary comments are as follows: I find that, although the sight
distance for access to the easterly lot is not unlimited, the limitation
is certainly not unsafe since one looking easterly from the proposed
curb cut can easily see oncoming traffic westbound, with plenty of time
for each driver as he or she approaches the other.
Since I need to know more about the planned increase in the right-of-way
width for Swift Street, I am unable to make a commitment as noted in the
memorandum from Mr. William J. Szymanski to the Planning Commission.
I shall be pleased to meet with the Commission on February 4, 1992.

1. The width of Swift rights -of -way is 49.5 feet. The planned
r.o.w. for this street .is 66 feet. A commitment for the addi-
tional 8.25 feet should be obtained from this subdivider.
2. The proposed curb cut is in an area where sight distance and
visibility especially to the east is poor. It is on a Swift
Street steep grade which will create problems for making left
turns when street conditions are less than perfect. Access to
the proposed lot should be through the existing lot curb cut.
INVESTORS MANAGEMENT CORPORATION, TEMPORARY DRIVE CORPORATE WAY
Plan dated 6/22/90 prepared by Butler association is acceptable.

1. The under cover parking will be attractive to shoppers. Most
traffic will have to make a 180 degree turn to get to this park-
