HomeMy WebLinkAboutSD-92-0000 - Decision - 0200 Swift StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Robert Erdmann for subdivision of a 17.9 acre parcel into two (2) parcels of 11 acres and 6.9 acres, 200 Swift Street. On the 14th of April, 1992 the South Burlington Planning Commission approved the request of Robert Erdmann for final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of the subdivision of a 17.95 acre lot into an 11.02 acre lot (lot #1) and a 6.92 acre lot (lot #2). Lot #1 is currently developed with a single family residence. The sketch plan was reviewed on 2/4/92. 2. This project located at 200 Swift Street is within the R1 District. It is bounded on the north by a natural area owned by UVM, on the east by a single family residence, on the south by Swift Street and on the west by a single family residence. 3. Access: There is currently an access to the residence on lot #1. Due to sight distance limitations, City Engineer has recommended that the driveway to lot #2 be located 700 feet west of the edge of the Spear Street pavement. It appears that the proposed driveway location needs to be moved approximately 22 feet to the east to meet the City Engineer's recommendation. 4. Setbacks: Existing structures meet setback requirements from new property line. 5. Area and Dimensions: Both lots meet area and dimension requirements for the R1 District. 6. Sewer: Sewage disposal will be on -site. Applicant has obtained a State permit for the on -site system. 7. Recreation Fee: The required recreation fee for the new lot should be paid prior to issuance of a building/zoning permit for a structure on this lot. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of Robert Erdmann for subdivision of a 17.9 acre parcel into two (2) parcels of 11 acres and 6.9 acres as depicted on a plan entitled, "Plat Showing Proposed Subdivision, Robert H. & Carol B. Erdmann Property, Swift Street, South Burlington, Vermont", prepared by Warren Robenstein, and dated February, 1992, with the following stipulations: 1. In order to promote adequate sight distance, the driveway for Parcel No. 2 shall be so located to be 700 feet from the west edge of the Spear Street pavement at the Spear Street/Swift Street intersection. The survey plat shall be revised prior to recording to show the proposed location of the driveway for Parcel No. 2 as recommended above. The revised plan shall be approved by the City Engineer. 2. Prior to issuance of a zoning/building permit for Parcel No. 2, the applicant shall pay the required per unit recreation fee for this parcel. 3. The final plat shall be recorded in the South Burlington Land records prior to issuance of a zoning/building permit and within 90 days or this approval is null and void.
