Chapter 64, Potable Water Supply and Wastewater System Permit Wastewater System and Potable Water Supply Rules, Effective September 29, 2007 Chapter 21, Water Supply Rules, Effective April 25, 2005 Permit Number: WW-4-3559 PIN: EJ10-0374 Landowner: Geri Reilly & Michael Simoneau 33 Iris Lane South Burlington VT 05403 This permit affects property identified as Town Tax Parcel ID # South Burlington: 1700-00119 and referenced in deeds recorded in 219 Page(s) 39-40 of the Land Records in South Burlington, Vermont. This project, to construct a replacement wastewater system for an existing duplex with one — one bedroom unit and one — three bedroom unit on a 2.4 acres +/- lot, served by onsite well and wastewater disposal system, located on Swift Street in South Burlington, Vermont, is hereby approved under the requirements of the regulations named above subject to the following conditions. i.GENERAL 1.1 The project shall be completed as shown on the application, plans and/or documents prepared by Earthbound Services, with the stamped plan listed as follows: Sheet Number Title Plan Date Plan Revision Date 1 of i Wastewater Plan 8/11/2010 9/29/2010 1.2 The project shall not deviate from the stamped plan in a manner that would change or affect the exterior water supply or wastewater disposal systems, building location, or, the approved use of the building, without prior review and written approval from the Wastewater Management Division. 1.3 This permit does not relieve the landowner from obtaining all other approvals and permits as may be required from the Act 25o District Environmental Commission, the Department of Environmental Conservation, Water Supply Division — telephone (802) 241-8400, Water Quality Division — telephone (802) 241-3770, the Department Public Safety, Division of Fire Safety— telephone (802) 879-2300, the Department of Health — telephone (802) 863-7221, and local officials prsor to proceeding with this project. 1.4 The conditions of this permit shall run with the land and will be binding upon and enforceable against the landowner and all assigns and successors in interest. The landowner shall be responsible for the recording of this permit in the South Burlington Land Records within thirty, (3o) days of issuance of this permit and prior to the conveyance of any lot subject to the jurisdiction of this permit. 1.5 Each prospective purchaser of the lot shall be shown copies of the Wastewater System And Potable Water Supply Permit and the stamped plan prior to conveyance of the lot. 1.6 By acceptance of this permit, the landowner agrees to allow representatives of the State of Vermont access to the property subject to this permit, at reasonable times, for the purpose of ascertaining compliance with Vermont environmental/health statutes, regulations, and permit conditions, including performing an inspection of the wastewater disposal system serving the structure. Regional Offices — Barre/Essex Jct./Rutland/Springfield/St. Johnsbury Wastewater System and Potable Water Supply Permit WW-4-3559 Page 2 of 2 1.7 In issuing this permit, the Division has relied upon the licensed designer's certification that the design - related information submitted was true and correct, and complies with the Vermont Wastewater System and Potable Water Supply Rules and the Vermont Water Supply Rules. This permit may be revoked if it is determined that the project does not comply with these Rules. 1.8 Any person aggrieved by this permit may appeal to the Environmental Court within 3o days of the date of issuance of this permit in accordance with 10 V.S.A. Chapter 22o and the Vermont Rules of Environmental Court Proceedings. 2.WATER SUPPLY 2.1 The project is authorized to utilize the existing onsite water supply system provided the water supply is located as shown on the stamped plan and the water quality meets or exceeds potable water standards set forth by the Chapter 21, Water Supply Rules. No other means of obtaining potable water shall be allowed without prior review and approval by the Wastewater Management Division. If the water supply system fails to function properly and becomes a "failed supply" the landowner shall immediately notify the Division. g.WASTEWATER DISPOSAL 3.1 No permit issued by the Secretary shall remain valid after substantial completion of a wastewater system until the Secretary receives a signed and dated certification from a designer or an installer, as specified in the permit, that states: "I hereby certify that in the exercise of my reasonable professional judgment the installation - related information submitted is true and correct and the wastewater system was installed in accordance with: the permitted design and all permit conditions; or record drawings and such record drawings are in compliance with the applicable rules, were filed with the Secretary, and are in accordance with all other permit conditions; was inspected; was properly tested; and has successfully met those performance tests." This certification shall include the wastewater system and wastewater service line to the structure. 3.2 The project is approved for wastewater disposal by construction and utilization of the site -specific wastewater disposal system depicted on the stamped plan. The Wastewater Management Division is to be notified, if at any time this system fails to function properly and/or creates a health hazard. The Wastewater Management Division shall allow no other method, or location of wastewater disposal without prior review and approval. 3.3 The soil -based, wastewater treatment and disposal system approved for this project shall be routinely and reliably inspected during construction by a qualified consultant who has been determined acceptable by the Wastewater Management Division, who shall, upon completion, report in writing to the Division that the installation was accomplished in accordance with the stamped plan and permit conditions. 3.4 No buildings, roads, water lines, earthwork, re -grading, excavation or other construction that might interfere with the installation or operation of the wastewater disposal system are allowed on or near the site -specific wastewater disposal system depicted on the stamped plan. All isolation distances that are set forth in the Wastewater System and Potable Water Supply Rules will be incorporated into the construction and installation of the wastewater disposal field. Compliance with these isolation distances is required, except as permitted under the approved variances. 3.5 The approved wastewater disposal system has been designed (with variances) to serve a four bedroom duplex. Prior to any increase in design flow, the landowner shall submit an application, fee, and engineering plans for review and approval by the Wastewater Management Division. Justin G.
