HomeMy WebLinkAboutMinutes - Board of Civil Authority - 09/17/2021 - Morning sessionBOARD OF CIVIL AUTHORITY AM 17 SEPTEMBER 2021 The South Burlington Board of Civil Authority held a meeting on Friday, 17 September 2021, at 9 a.m., in the Auditorium, City Hall, 180 Market Street. Members Present: C. Shaw, Chair; D. Kinville, H. Riehle, M. Emery, C. Santorello Also Present: M. Lyons, M. Tomkowicz 1. Review evacuation plans in case of an emergency. Ms. Kinville reviewed emergency plans. Mr. Shaw noted that the wearing of masks is encouraged in City Hall. 2. Comments and questions from the public not related to the agenda: No comments or questions were presented. 3. Any change to the order of the agenda: No changes were made to the agenda. 4. BCA oath administered: Ms. Kinville administered the oath to Board members. 5. Hear Appeal from: a. Pizzagalli Properties 118 Tilley Drive Mr. Shaw explained the appeal process. Mr. Tomkowicz said Pizzagalli Properties is the developer for the business park and built this building. It has 4 tenants at present, 3 of whom are in the medical/dental field. The building is fully occupied, but 85,000 sq. ft. will be vacant in June. Mr. Tomkowicz also noted that 193 Tilley Drive is also one of their buildings. It is 80% occupied with strictly office use. In the recent appraisal, the square foot value of #118 is $210.43 while the square foot value for #193 is $132.67. Mr. Tomkowicz said he did speak with John Valente about 188 Tilley Drive, and Mr. Valente said that medical use sometimes has a premium rate. Mr. Tomkowicz said that their experience has been that improvements made for one medical use have a limited life; a new doctor just can’t walk into a space that has been used by another doctor. As a consequence, they have to charge a premium rent for medical use. The assessed value of the property prior to the reappraisal was $2,928,900. The initial new appraisal was $5,635,000. Following the discussion with Mr. Valente, the new appraisal was BOARD OF CIVIL AUTHORITY 17 SEPTEMBER 2021 PAGE 2 reduced to $5,232,000. Mr. Tomkowicz said the adjusted net operating income from the building is $461,810. He did not know why Mr. Valente did not use this figure. It would have reduced the assessment to $4,391,614, which he feels would be a fair assessment. Mr. Tomkowicz explained how they negotiate with a prospective tenant, comparing it how a banker would operate when making a loan. He said you are essentially making a loan over the period of the lease. But that value does not stick with the building. Ms. Lyons provided the reappraisal value from Mr. Valente. She had assumed that he did this based on the adjusted income/fit up costs. She stressed that she will not publicize an applicant’s income information as it could put the applicant at a disadvantage. Testimony was then closed, and an inspection team of Ms. Riehle, Ms. Emery and Mr. Santorello was assigned. They will view the property on 20 September at 9 a.m. The appeal was then continued to 7 October, 6 p.m. b. Technology Park Partners 5508C Community Drive Mr. Keenan said this property is unbuilt land, It is mostly wetland and deemed undevelopable. Their appraisal went from $200,000 to $819,400. He stressed that they cannot sell this land. Mr. Keenan showed a photo of the land and a photo of a document that was filed indicating the limitation of the land to be sold or developed. It is their feeling that the land should be valued at $200,000 or at zero. Ms. Emery asked whether they had had the land evaluated regarding stormwater retention. This might give some value to the land as it could eliminate the need for a stormwater pond. Mr. Keenan said they could do that. Ms. Lyons said there are no notes indicating that lot 8C is a wetland. That was why the value increased to $819,400. If it is a wetland, that assessment is not reasonable. She did suggested that the value not go below $200,000. Testimony was them closed, and an inspection team of Ms. Riehle, Ms. Emery, and Mr. Santorello was assigned to inspect the property on 20 September, 9:45 a.m. The hearing was then continued to 7 October, 6 p.m. BOARD OF CIVIL AUTHORITY 17 SEPTEMBER 2021 PAGE 3 c.
