HomeMy WebLinkAboutMinutes - City Council - 06/16/1969BOARD OF SELECTMEN MEETING JUNE 16, 1969 The South Burlington Board of Selectmen held a regular meeting at the Town Office Building, 555 Dorset Street, South Burlington, on Monday, June 16, 1969, at 7:00 P.M. Mr. Charles H. Behney, Chairman, called the meeting to order. MEMBERS PRESENT Charles H. Behney, Chairman; Vincent J. D'Acuti, Walter Nardelli, Gregory L. Premo and Raymond E. Stearns. MEMBERS ABSENT None OTHERS PRESENT George Silver, Town Assessor; Henry LeClair, Town Manager; Ray Unsworth, George E. Bosworth, Roger LeCours, Free Press Reporter; Jane Brennan from the League of Women Voters and Charlotte Marsh. READING OF THE MINUTES OF THE JUNE 2, 1969 MEETING On a motion made by Mr. D'Acuti and seconded by Raymond Stearns, the Board unanimously accepted the minutes of the June 2, 1969 meeting as read. SECOND READING OF FRONT-YARD SET-BACK ORDINANCE Mr. Behney, Chairman, read the ordinance and the Planning Commission's recommendation of approval as voted at the Commission meeting of May 27, 1969. In discussing the advantages of adopting the ordinance Mr. LeClair pointed out one reason was to have cars parked 15 feet from the front lot lines for safety purposes as well as beautification purposes. Mr. D'Acuti motioned to adopt this final reading. The motion was seconded by Mr. Premo and so voted. The ordinance reads as follows: SECOND READING OF FRONT YARD SET-BACK ORDINANCE, CONTINUED QUESTION FROM JOHN T. GLEASON, PROPERTY OWNER In answer to a question from Mr. John Gleason, owner of a music store in town as to whether he has to landscape fifteen feet from his lot line, Mr. Behney said no, that the ordinance would take effect from this date. SECOND READING OF ZONE CHANGE ORDINANCE - RESIDENDIAL B TO C ON HINESBURG ROAD Chairman Behney read the ordinance and the Planning Commission's recommendation of approval as voted at the Commission meeting of May 27, 1969. Mr. D'Acuti moved to accept the final reading. The motion was seconded by Mr. Stearns and Mr. Behney, Chairman, called for discussion. George E. Bosworth of 15 Wright Court voiced his disapproval of adoption of the zone change citing the fact that Hinesburg Road already has several apartment complexes and allowing more apartments in the area would change the whole picture of Hinesburg Road. There was a discussion relating to the planned apartments, lot size, entrances, amount of rent to be charged, cost to the town in services, etc., and at this point Mr. D'Acuti noted that the Selectmen's function was not concerned with the planning, etc., but only with changing the zone. Chairman Behney told those present that the Advisory Committee to the Planning Commission had also approved adoption of the zone change saying the plan made sense for the orderly development of our town. Mr. Behney called for a vote on the motion. The vote was four in favor and one against, with Mr. Nardelli casting the negative vote. The ordinance reads as follows: AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE" BY CREATION OF AN ADDITIONAL AREA OF RESIDENTIAL DISTRICT C. The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Residential District B to Residential District C. Commencing at a point on the west side of Hinesburg Road and being in common with the north east corner of the Edmund Chastenay lot, thence in a westerly direction seven hundred seventy-one and eighty-two one hundredths (771.82) feet, thence in a northerly direction one hundred sixty­four and fifty­six one hundredths (164.56) feet to a point, thence at an interior angle of 119º49' two hundred twenty­six and thirteen one hundredths (226.13) feet to a point, thence at an interior angle of 149º34' in an easterly direction four hundred eight and sixty­eight one hundredths (408.68) feet to a point, thence southerly at an interior angle of 90º36' sixty (60) feet to a point, thence in an easterly direction and at an interior angle of 269º24' fifty (50) feet to a point, thence at an interior angle of 90º36' in a southerly direction sixty one and sixty­five one hundredths (61.65) feet to a point, thence in an easterly direction and at an interior angle of 269º24' one hundred seventeen (117) feet to a point on the west side line of Hinesburg Road, thence in a southerly direction and along the west side line of Hinesburg Road one hundred forty-nine and forty-two one hundredths (149.42) feet to the point of beginning. Stearns Not Signed by - Walter Nardelli SOUTH BURLINGTON BOARD OF SELECTMEN SECOND READING AIR POLLUTION ORDINANCE The Selectmen unanimously voted to have the Chairman dispense with the reading of the complete ordinance, whereupon Mr. Behney read the heading. Mr. Stearns expressed his opinion that any ordinance that isn't enforced shouldn't be on the books, that the public should be advised of the ordinances and the penalties for violations and that we should go out of our way to notify people of ordinances that affect them and then enforce them. Mr. Premo made a motion to adopt the ordinance. The motion was seconded by Mr. Nardelli and so passed, unanimously. The ordinance follows: LAUREL HILL DRIVE REQUEST FOR A FIREWORKS DISPLAY Chairman Behney read a letter received from Mr. Norbert J. Crouchley in which Mr. Crouchley requested permission from the Board, on behalf of residents of Laurel Hill Drive, to hold a fireworks display on the street on July 4, 1969. After ascertaining that there would be one day general liability insurance to cover all residents of the area, as well as fireworks insurance, Mr. D'Acuti made a motion to grant permission for the display. Mr. Stearns seconded the motion and it was so voted unanimously. CONSIDER STREET PAVING BIDS Chairman Behney read the bids received for paving portions of Spear Street and Circle Drive. The bids were as follows: L. M. Pike and Son $10.20 per ton Vermont Paving Corporation 9.90 per ton Mr. Stearns made a motion to accept the Town Engineer's recommendation and award the bid to the low bidder, Vermont Paving Corporation. Mr. Premo seconded the motion and it was passed unanimously. BIDS FOR RESURFACING TENNIS COURTS AT ORCHARD AND CENTRAL SCHOOLS Chairman Behney read the bids received for the resurfacing of the tennis courts at the Orchard and Central Schools as follows: L. M. Pike and Son $7750.00 Vermont Paving Corporation $5505.00 Selectman Stearns expressed his opinion that a paved portion of the high school parking lot could be used as a tennis court, and he further said that it was children of high school age who would get the most use out of such a facility. Mr. Nardelli and Mr. Premo said they felt the court at Orchard school would get a lot of use and should be put in shape. TENNIS COURTS, CONTINUED Mr. D'Acuti made a motion to table any action on acceptance of the bids until the Board met with Chairman Ray and Director Burnell of the Recreation Committee for their views on the matter. Mr. Stearns seconded the motion and it passed unanimously. REVIEW FIRE MARSHALL'S REPORT ON TOWN HALL BUILDING The Board went over the State Fire Marshall's report on conditions in the Town Office Building. Mr. D'Acuti suggested that the Town Manager check over the items as to what could be corrected easily without too much expense and list the cost of the other items. In discussing the inconvenience and hazard of having employees working in the basement area, both Mr. D'Acuti and Mr. Stearns said they should be moved to the main floor right away because of a lack of a second exit. Chairman Behney said that as an alternative possibly part of the old section of the Central school could be used for office space. The Selectmen were agreed that Mr. LeClair should arrange to have the offices in the basement moved to the main floor utilizing all of the space in the building. The Board discussed locations for holding the Board and other meetings in another location such as the school buildings. REVIEW OF PAY SCALE The Board unanimously agreed to review the employee's pay plan at the June 23, 1969 meeting. UNLICENSED DOGS Chairman Behney accepted a list of the names of owners of unlicensed dogs as prepared by Helen D. Paquin, Town Clerk. Mr. D'Acuti made a motion to instruct the Police Chief to pick up the dogs whose owners had not licensed them. Mr. Nardelli seconded the motion and the vote was unanimous. VOLUNTEER FIRE DEPARTMENT As the men who are organizing the Volunteer Fire Department do not expect to meet with a representative from the Fire Underwriters Rating Association until the last of June or first of July the meeting with them has been postponed until the July 7, 1969 meeting. SET 1969-70 TAX RATE The Board voted unanimously to set the date of Monday, June 23, 1969 at 7:00 P.M. at the Town Office Building, for setting the new tax rate. DISBURSEMENT REPORT The Selectmen reviewed the May 30, 1969, disbursement report and noted several items for Mr. LeClair to check into, such as the rental charge for the Police Department building, the Old Age Assistance Tax account, the amount budgeted for social security, insurance, etc. SWIMMING AT BOYER QUARRY The Selectmen decided that Mr. Ralph Goodrich should be advised that quite a number of people are making a habit of swimming on his property known as the Boyer quarry, to be sure he is aware of it. HIGHWAY DEPARTMENT TOOLS Mr. LeClair was instructed to look into the matter of the ownership of mechanic's tools that were purchased in 1961 or 1962. Mr. Behney remarked that in the future someone should be accountable for the town tools. TOWN SIGNS IN BAD CONDITION Mr. Nardelli noted that the "Town of South Burlington" sign on Williston Road in the area of Spear Street was in need of paint and general repair. Mr. LeClair said that both of the town signs on Williston Road were scheduled to be put in shape. DRAINAGE PROBLEM IN REAR OF ORCHARD SCHOOL Mr. Stearns requested that the water problem that exists in the rear of the Orchard School be investigated, and said he would like to know the history of the problem. Mr. LeClair said he would have the Town Engineer look into it. NEW COMPREHENSIVE PLAN Chairman Behney asked for copies of the new comprehensive plan map for each of the Board members. Mr. LeClair said Mr. Sargent had not left any in the office for distribution as yet but he would check on it and have them available for the next meeting. Mr. Nardelli made a motion to adjourn the meeting at 10:20 P.M. Mr. Premo seconded the motion and it was so voted unanimously. APPROVED Gregory L.
