HomeMy WebLinkAboutMinutes - City Council - 01/20/1969BOARD OF SELECTMEN MEETING JANUARY 20, 1969 The South Burlington Board of Selectmen held a regular meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Monday, January 20, 1969 at 7:30 P.M. Mr. D'Acuti, Chairman, called the meeting to order. MEMBERS PRESENT Vincent J. D'Acuti, Chairman; Robert K. Ashley, Charles H. Behney, and Augustus T. Stannard. MEMBERS ABSENT Walter Nardelli OTHERS PRESENT Henry LeClair, Town Manager; Richard G. Carter, Chief of Police; Mr. Ray Unsworth, Attorney William E. Mikell, James Cressey, State's Attorney Leahy, Jere Meserole, Robert Sprano and Mrs. Richard Carter. READING OF THE MINUTES OF THE MEETING OF JANUARY 13, 1969 The minutes of the January 13, 1969 meeting were approved as read. JAMES CRESSEY REQUEST Mr. Mikell, Attorney, told the Board that James Cressey had consulted him as a lawyer with reference to the matter of the pay that had been withheld from him since last July in the amount of $10 a week. He said Mr. Cressey had been advised there would be an across-the-board raise of $10 a week for employees of the Police Department, and the raise did go into effect in July, 1968 except for one person who received a $3 a week increase. Mr. Cressey was told by the Chief that the increase was being withheld pending completion of back-due reports and daily reports. JAMES CRESSEY REQUEST, CONTINUED Mr. Mikell quoted from the South Burlington Town Charter the procedures to be followed in cases of appointments, layoffs, suspensions, promotions, demotions and removals of employees, and said he felt legal procedures had not been adhered to in this case. The Board unanimously agreed to check with the Town Attorney for his legal opinion, and told Mr. Mikell they would meet with him again in one or two weeks after they received the information. Mr. D'Acuti read a letter from Mr. H. Fienberg expressing his opinion of Mr. Cressey's resignation. The letter is filed with these minutes. FIRST READING OF ZONE CHANGE REQUEST - RAY UNSWORTH Mr. D'Acuti read a proposed ordinance requested by Mr. Unsworth for a zone change on property located on the lake shore on the west side of Shelburne Road from Residential District B and Industrial District A to District C. Mr. Unsworth and Mr. Meserole pointed out the exact location of the property on the map and showed architect's plans of the types of buildings they would like to erect. The Board voted unanimously to pass the first reading, saying the ordinance would be forwarded to the Planning Commission for a recommendation, and advertised for a public second hearing on February 17, 1969. DISCUSSION WITH STATE'S ATTORNEY LEAHY The Board had a general discussion with State's Attorney Leahy who said South Burlington needed the services of a detective, and in fact with the rapid growth in the community in population, shopping centers and commercial establishments, could probably use two detectives on the squad. He also spoke on the advantages of regional police protection, felony squads, and related matters. Robert Sprano, Security Guard at the Grand-Way, also stressed the importance of having a detective on the South Burlington squad. ANGELO PIZZAGALLI RESIGNATION Mr. D'Acuti read a letter of resignation from Angelo Pizzagalli as Acting-Chairman of the Industrial Committee, effective January 14, 1969. The resignation was accepted with regret. LETTER FROM MR. ROCK OF MODERN SEPTIC TANK SERVICE Mr. D'Acuti, Chairman, read a letter from Mr. Rock in which Mr. Rock stated that he had not received payment from the Munson Earthmoving Company for sewer work done in South Burlington. Mr. LeClair was instructed to invite Mr. Rock to the Selectmen's meeting of January 27, 1969, in an effort to resolve the matter. VERMONT GAS SYSTEMS, INC. REQUEST The Vermont Gas Systems, Inc., request to install an underground Cathodic Protection System in the entrance to Farrell Park was tabled till the January 27, 1969 meeting. LETTER FROM JOHN EWING RE: DATE FOR POSTING WARNING FOR TOWN MEETING Mr. D'Acuti, Chairman, read a letter from the Town Attorney, in which Mr. Ewing advised the Board that the State law has been changed, requiring that the warning for the Town Meeting be posted at least thirty days before Town Meeting Day, which would be February 1, 1969. s The Board went into Executive Session at 9:00 P.M. CLASSIFICATION AND COMPENSATION PLAN The Board came out of Executive Session at 11:20 P.M. and it was moved by Mr. Behney and seconded by Mr. Ashley to adopt the proposed Classification and Compensation Plan as amended, with merit implementation on July 1, 1969. The amendment drops all classifications two grades from the proposal, with the exception of clerk and typist which remain as proposed, and police officers, which are 1 grade below proposal, or grade 11.
