HomeMy WebLinkAboutMinutes - City Council - 01/23/1968 (2)BOARD OF SELECTMEN MEETING JANUARY 23, 1968 The South Burlington Board of Selectmen resumed their adjourned meeting of January 16, 1968 at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, January 23, 1968 at 7:30 P.M. Mr. D'Acuti, Chairman, called the meeting to order. MEMBERS PRESENT Mr. Vincent J. D'Acuti, Chairman; Mr. Robert K. Ashley, Mr. Augustus T. Stannard and Stephen M. Whittlesey. Mr. Frederick G. Blais came in after the Board went into Executive Session. MEMBERS ABSENT None OTHERS PRESENT Henry LeClair, Town Manager; Edgar Myers, Free Press Reporter; Mr. George Brady, Mrs. Jane Martin, Mrs. Marjorie Hill and Mrs. Ann Yawney. READING OF THE MINUTES OF JANUARY 16, 1968 The minutes of the meeting of January 16, 1968 were approved as read. SECOND READING OF PROPOSED SEWER CHARGE ORDINANCE Mr. D'Acuti, Chairman, read the proposed sewer charge ordinance and explained the change made in due date of payments and penalty for non-payment. Mrs. Hill asked when the sewer assessment charge would be put into effect and was told the charges would start July 1, 1968. The Selectmen then unanimously approved passage of the Sewer Charge Ordinance, a copy of which is filed with these minutes. SECOND READING OF PROPOSED EXISTING LOT ORDINANCE Mr. D'Acuti, Chairman, read the proposed ordinance, and the Board unanimously voted to approve passage of the Existing Lot Ordinance. The new ordinance reads as follows: AN ORDINANCE TO AMEND THE SOUTH BURLINGTON ZONING ORDINANCE The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964 is hereby amended by adding the following to Article 1, Purpose. Section 1.11 Existing Use of Residential Lots. Exception: Existing Residential Lots On any residential lots set-off and duly recorded as such in the office of the Town Clerk prior to February 28, 1964, it shall be permitted to construct garages and other accessory structures no closer than ten (10) feet from the existing side lot line. Section 2. This ordinance shall take effect from its passage. SECOND READING OF PROPOSED USABLE FLOOR AREA ORDINANCE Mr. D'Acuti, Chairman, read the proposed ordinance, and the Board unanimously voted to approve passage of the Usable Floor Area Ordinance. The new ordinance reads as follows: AN ORDINANCE TO AMEND THE SOUTH BURLINGTON ZONING ORDINANCE The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, is hereby amended by adding the following to Section 3.10, Definitions. (44) Usable Floor Area - The area of an enclosure in square feet, computed by measuring the outside dimensions of a dwelling or building. Section 2. This ordinance shall take effect from its passage. CONSIDER ACCEPTANCE OF COUNTRY CLUB ESTATES' STREETS The Chairman read a letter from the Town Attorney which approved the acceptance of the streets, the location of which was pointed out by Mr. LeClair. The Board then voted unanimously to accept four streets in Country Club Estates. FENCING OF PUBLIC OVERNIGHT PARKING AREAS IN AUTO SALES ESTABLISHMENTS Mr. LeClair read a report on the number of stolen cars reported in South Burlington. There was a general discussion of the problem and the advisability of enacting an ordinance requiring the fencing of public Automobile Sales Lots. The Board unanimously agreed not to act on the matter at this time and instructed Mr. LeClair to write to Mr. Albert Trepanier, Manager of Val Preda's Oldsmobile-Cadillac Company asking if Mr. D'Acuti or Mr. LeClair could attend the next Automobile Dealer's Association meeting for the purpose of seeking solutions to the problem. TAXI REGULATIONS The Town Manager told the Board members that many complaints are being received from residents about prices being charged by taxi drivers, and gave each Selectman a copy of the City of Burlington's ordinance covering Taxi Regulations and Taxi Drivers' Regulations to review. The Board felt there would have to be quite a few revisions as to zones, prices, etc., to make it applicable to the Town. Mr. D'Acuti suggested that the Board study the Ordinance as presented, and the Town Manager was instructed to refer it to the Town Attorney to study for possible adoption by the Town with the proper revisions to make it applicable, setting up zones, fares, etc. and also to investigate the possibility of overlapping of zones between Burlington and South Burlington. PARKING ON ONE SIDE OF BARTLETT BAY ROAD Mr. Stannard told those present that driving conditions on Bartlett Bay Road were intolerable because cars constantly parked on both sides of the road, and also said he was positive that No Parking signs, properly placed, would resolve the problem. Mr. D'Acuti said he had received complaints about the problem from several residents of the area and instructed Mr. LeClair to obtain portable No Parking signs for the present and see that they were erected in such a manner that they would be effective. NOTIFICATION OF ZONE CHANGES AND VARIANCES REQUEST FOR WRITTEN NOTIFICATION TO ADJACENT PROPERTY OWNERS Mr. George J. Brady of 1785 Airport Drive, South Burlington told the Board he felt that adjacent property owners to property being rezoned or petitioning for variances should be notified of the date, time, and place of the hearing in order to voice their approval or disapproval. The Board members agreed that it was a good idea and recommended to the manager that letters be sent out in the future. PURCHASE OF SKI LIFT TICKETS FOR TOWN RESIDENTS Mr. Edgar Myers expressed his approval of the Recreation Department's program of skiing for the school children and recommended that Mr. Burnell, the Recreation Director, be asked to look into the matter of purchasing a block of ski tickets from ski areas for sale to residents at a reduced price thus enabling adults to benefit. The Board generally agreed that it was well worth looking into, and as the Park and Recreation Department had its own committee and budget, instructed Mr. LeClair to have Mr. Burnell present the recommendation to the Recreation Committee for action. MISCELLANEOUS PARKING AT AIRPORT Mr. D'Acuti said he was going to attend the next Airport Commissioners' meeting and present recommendations on parking, etc. at the Airport that were given to him by Chief Carter. WILLISTON ROAD CURB CUTS Mr. D'Acuti requested a study and recommendations from Police Chief Carter relative to curb entrances in the commercial end of Williston Road. MEETINGS. The Chairman announced that the Natural Resources Meeting was being held at the High School on Wednesday, January 24, 1968 at 7:30 P.M. and that all who were interested could attend. He also announced that the next meeting on Tuesday, January 30, 1968 would be an Executive Session to go over budget matters and that the next regular Selectmen's meeting would be on Tuesday, February 6, 1968. The Board went into Executive Session at 8:30 P.M. The Board came out of Executive Session and adjourned at 10:30 P.M.
