HomeMy WebLinkAboutMinutes - City Council - 12/09/1968BOARD OF SELECTMEN MEETING DECEMBER 9, 1968 The South Burlington Board of Selectmen held a meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Monday, December 9, 1968 at 7:30 P.M. Mr. D'Acuti, Chairman, called the meeting to order. MEMBERS PRESENT Vincent J. D'Acuti, Chairman; Robert K. Ashley, Charles H. Behney, Walter Nardelli and Augustus T. Stannard. MEMBERS ABSENT None OTHERS PRESENT Henry LeClair, Town Manager; Charlotte C. Marsh, Gordon Wright, Arthur R. Hill, Jr., Sherman A. Stebbins, Allen C. Smith, Jr., Mac D. Valiquette and James Young. READING OF THE MINUTES OF THE NOVEMBER 25 and DECEMBER 2, 1968 MEETINGS The minutes of the meetings of November 25 and December 2, 1968 were approved as read. PROBLEM WITH ARTHUR GOYETTE SEWER LINE MAINTENANCE - SHELBURNE ROAD Mr. LeClair explained the difficulty encountered in attempting to maintain the Goyette sewer line, due to the failure of the Fire District to secure an easement across what is now the Cobb property. The Goyettes have indicated legal action against the town for not maintaining the system and Cobb's have indicated likewise if the town does attempt to maintain it. The Board decided to let the problem take its own course. OBJECTIONS TO THE NO PARKING SIGNS ON IMPERIAL DRIVE Mr. Valiquette and Mr. Smith, Jr. of Imperial Drive voiced their objections to the installation of the no parking signs on both sides of Imperial Drive. Mr. Smith said he felt it was necessary to have the signs on the lower end of the street because of the motel parking, and asked the Selectmen to consider removing them from the upper portion. During the discussion that followed Mr. Behney read from the minutes of the April 1, 1968 meeting noting that the motion on the item was for drafting a resolution prohibiting the parking of trucks on lower Imperial Drive. The Selectmen agreed that the complaint was a legitimate one, saying they would have the Police Chief check the area and recommend where he feels the signs should be cut-off. COMPLAINT ABOUT SEWER INSTALLATION ON MILLS AVENUE Mr. James Young of 15 Mills Avenue told the Board that the sewer contracter went over sections of his property without permission, removed trees, took down a fence and did not replace it satisfactorily, and that construction was done in such a way as to cause cracks in the foundation and walls of his home. Because such damage should be covered by the contractor's insurance company the Board advised Mr. Young to write to the Town Manager in detail about the issue making sure to forward a copy of the letter to the contractor, Mr. Munson, the Glens Falls Insurance Company, Webster-Martin, Inc., and to his lawyer if he had retained one. The Board felt that it should not interfere with the insurance company, but assured Mr. Young that final settlement with Mr. Munson would be held up till repairs for which he was obligated were completed. RECREATION DIRECTOR - SWIMMING POOL Mr. Burnell was instructed to notify Mr. Ray, the president of the Park and Recreation Committee, to investigate thoroughly all aspects of the financial picture relating to the proposed swimming pool in particular to ascertain if there were State or Federal funds available. DEED TO LAUREL HILL SOUTH STREETS After Mr. D'Acuti read a letter from the Town Attorney in which Mr. Ewing advised the Board to accept the deed to the streets at this time, the Board voted unanimously to accept the deed to the streets in Laurel Hill South, on a motion made by Mr. Stannard and seconded by Mr. Nardelli. PURCHASE OF LOADER FOR LAND-FILL AREA Mr. D'Acuti read a recommendation from the Town Engineer that the Catepillar machine be purchased, and the Selectmen heard a short presentation from Mr. Hill, Jr., salesman for the Allis-Chalmers machine and Mr. Stebbins, salesman for the Caterpillar machine. After a general discussion the Board tabled any decision on the matter till Mr. Szymanski and Mr. Norton had a chance to try out the Allis-Chalmers machine and until Mr. Szymanski prepared a written justification as to why the town should keep the Hough loader instead of using it as a trade-in. RESOLUTION - LOAN IN ANTICIPATION OF SEWER BOND ISSUE The Board signed the following resolution: RESOLUTION - LOAN IN ANTICIPATION OF SEWER BOND ISSUE R E S O L U T I O N Be it Resolved, that the Town of South Burlington will borrow $20,000 in anticipation of the bond issue for Phase IV of the sewage system for the purpose of the acquisition of the Collins property and other necessary easements and rights-of-way, and the Town Manager is authorized to complete said purchase on behalf of the town. ADVANCED MANAGER'S TRAINING PROGRAM The Selectmen unanimously agreed to authorize the Town Manager to attend the Advanced Management Training Program being held in Athens, Ga. from January 5, to 11, 1969, saying it would be advantageous to the Town. OPERATION OF JOE BARRY'S RESTAURANT Mr. Barry was not present to report on the operation of his business. The Manager stated he had forwarded an invitation to Mr. Barry to attend this meeting. The Board instructed the Manager to forward another invitation by registered mail asking Mr. Barry to attend the December 16, 1968 meeting. COMPLAINTS FROM ARTHUR ROCK ON SEWER INSTALLATION MATTERS Mr. D'Acuti read two letters from Arthur Rock in which Mr. Rock enumerated problems he encountered while installing house connections to our sewer system. The Board discussed the whole area of sewer inspection by Town personnel. Mr. Rock's letters are filed with these minutes. The Board went into Executive Session at 9:00 P.M. MUNICIPAL BUILDINGS When the Selectmen came out of Executive Session they instructed the Manager to get the Town Attorney's legal opinion on the best method to persue, under existing laws, a lease-purchase agreement with private individuals concerning municipal buildings. VIET NAM SERVICEMEN The Board unanimously resolved to have letters of appreciation sent from the town to all South Burlington servicemen serving in Viet Nam. NATIONAL FIRE PROTECTION ASSOCIATION'S PUBLICATION After a general discussion the Board unanimously agreed to order 25 copies of "Operation of Small Community Fire Departments" from the above Association.
