HomeMy WebLinkAboutMinutes - City Council - 09/05/1967BOARD OF SELECTMEN MEETING SEPTEMBER 5, 1967 The South Burlington Board of Selectmen held a public meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, September 5, 1967 at 7:30 P.M. Mr. Vincent J. D'Acuti, Chairman, called the meeting to order. MEMBERS PRESENT Mr. Vincent J. D'Acuti, Chairman; Mr. Frederick G. Blais, Mr. Augustus T. Stannard and Mr. Stephen M. Whittlesey. MEMBERS ABSENT Robert K. Ashley. OTHERS PRESENT Henry N. LeClair, Town Manager; William J. Szymanski, Town Engineer; Edgar Myers, Free Press Reporter; Mayone Hill, Mary Graham, Dorothy Guilford, League of Women Voters; Charlotte Marsh, Robert Cromer, Rollin Sutton, Mrs. Charles Bosley, Marion Lines, Francis Whitney, Albert Whitney, Joseph Boucher, Charles Bosley, Ann Yawney, Lynda Christiansen and Barbara Bull, Stanley and Lena Guczek. READING OF THE MINUTES The minutes of the previous meeting were approved as read. SECOND READINGS OF FIVE PROPOSED ORDINANCES (1) Zone Change Shelburne Road, Business B To Business A There was a general discussion on the zone change. Mr. D'Acuti read a letter from the League of Women Voters stating that they support passage of the ordinance. Mr. D'Acuti also stated that the Planning Commission recommended passage of the ordinance. The Board unanimously approved the ordinance. The ordinance reads as follows: O R D I N A N C E AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF BUSINESS A". The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Business District B to Business District A. All the land as described in the South Burlington Zoning Ordinance, Appendix A (Business District B), paragraphs 11 and 12, with the exclusion of that portion of land recently rezoned Residential B on Brewer Parkway. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN (2) Residential District C Zone There was a general discussion on the ordinance. The League of Women Voters supported the ordinance but felt that high-rise apartments should not be permitted because they would detract from the appearance of the town. Mr. D'Acuti said he felt that a high-rise apartment in the right place could be attractive. Mr. Blais asked that recommendations be made to the Planning Commission as to height requirements etc. and he also suggested that the League of Women Voters' letter be sent along with the recommendation. The Board unanimously approved the ordinance. The ordinance reads as follows: O R D I N A N C E AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE." The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964 is hereby amended by the following deletions, additions and revisions. Section 4.10 Establishment of districts In first sentence delete the word 'seven' and substitute the word 'eight'. List Residence District C after Residence District B. Section 6.10 Use regulations Delete sub-paragraphs (3) and (4). Section 6.20 Lot area requirements In paragraph (A) delete the words 'multi-family dwelling', and substitute the words 'two-family dwelling'. In paragraph (B) delete the words 'multi-family dwelling', and substitute the words 'two-family dwelling'. Section 6.51 Dwelling standards In the second paragraph delete the words 'multi-family dwelling', and substitute the words 'two-family dwelling'. In the third paragraph delete the words 'multi-family dwelling', and substitute the words 'two-family dwelling'. Section 6.60 Off-street parking requirements In sub-paragraph (1) delete the words 'multi-family dwelling', and substitute the words 'two-family dwelling'. Delete sub-paragraphs (3) and (4). Section 2. The South Burlington Zoning Ordinance adopted February 28, 1964 is hereby amended by the addition of Article XIV, RESIDENCE DISTRICT (C) Section 14.10 Use regulations. 14.20 Lot area requirements. 14.40 Yard requirements. 14.50 Height requirements. 14.60 Off-street parking. 14.61 Location of parking. 14.62 Surface and screening of parking area. 14.70 Accessory building requirements. 14.80 Sign requirements. Section 14.10 Use regulations No building, structure or portion thereof shall be erected, altered or moved and no land or building or part thereof shall be used for other than one of the following uses. Any use not expressly permitted is prohibited. (1) Multi-family dwelling. (2) Row house. (3) Boarding house. (4) Nursing, rest home or convalescent home. (5) Accessory buildings including garages, recreation facilities and swimming pools. Section 14.20 Lot requirements Minimum lot requirements for 20 family units or less: 7500 square feet per family unit; 20 family units or more: 6000 square feet per family unit. All multi-family dwellings must be connected to a sanitary sewer approved by the Planning Commission. Section 14.40 Yard Requirements Yards shall have minimum depths as follows: Front Yard 30 feet Rear Yard 30 feet Side Yard 30 feet 14.50 Height requirements No building shall be erected, altered, or moved so as to exceed thirty-five (35) feet or two and one-half stories in height unless for every story or twelve (12) feet in height (whichever is less) over the maximum height permitted there shall be added ten (10) feet to the depth of each required yard. 14.51 Dwelling standards Every family dwelling unit in a one-story multi-family dwelling shall contain not less than 750 square feet of usable ground floor area exclusive of basements, unfinished attics, porches, garages and other spaces not customarily used for living purposes. Every family dwelling unit in a multi-family dwelling of more than one story shall contain not less than 850 square feet of usable floor area, exclusive of unfinished attics, basements, porches, garages and other spaces not customarily used for living purposes. Section 14.60 Every dwelling unit shall be provided with not less than one and one­half (1½) parking spaces. Section 14.61 Location of parking No parking area for a multi-family dwelling shall be closer than fifteen (15) feet to any lot line nor closer than fifteen (15) feet to any building wall containing windows located on the same property. Section 14.62 Surface and screening of parking area. All parking areas in a residence district (C) shall be hard surfaced and graded so as to drain off all surface water. Any parking area serving a multi-family dwelling which is located in a required yard shall be provided with a wall or solid screen planting of appropriate shrubs to a height of not less than six (6) feet. Section 14.70 Accessory building requirements A. No accessory building shall be located within fifteen (15) feet of any lot line. B. No swimming pool shall be located in any required front yard. 14.80 Sign requirements No sign in residence district (C) shall: (1) Exceed twelve (12) square feet in area; (2) Be nearer than fifteen (15) feet to the street line: (3) Be illuminated by other than a white, non-flashing incandescent light of one-hundred (100) watts per side, or less: (4) Have any moving parts. Whittlesey South Burlington Board of Selectmen (3) Residential District C Zone Area The Board unanimously approved the residential district C zone area. The ordinance reads as follows: O R D I N A N C E AN ORDINANCE TO AMEND THE SOUTH BURLINGTON ZONING ORDINANCE. The Selectmen of the Town of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964 is hereby amended as follows: There Shall be added to Appendix A the following: RESIDENTIAL DISTRICT C 1. An area lying on the southeasterly side of Kennedy Drive. Said area is bounded on the southeasterly side by a line running parallel to and 500 feet southeasterly of Kennedy Drive, and is bounded on the east by the west boundary of Residential District A on Old Farm Road, and is bounded on the southwest by the northeast line of Hinesburg Road. 2. An area located on the southerly side of Kennedy Drive, said area being bounded by a line running parallel to and 500 feet southerly of Kennedy Drive, and is bounded on the east by the west boundary of land owned by Daniel J. and Leo D'Brien, Jr. (in Planned District) and is bounded on the west by the east line of Dorset Street. Section 2. The official zoning map is hereby amended to show Residential District C as above described. Section 3. This ordinance shall take effect from its passage. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN (4) Junk Ordinance There was a general discussion concerning the junk ordinance. Charlotte Marsh opposed the ordinance stating that she felt it was too autocratic. Miss Marsh stated that people who own property should be able to store whatever they wish on their own property. Miss Marsh questioned who would decide what is to be considered junk. Mr. D'Acuti pointed out that the ordinance was to protect the people of the town especially in cases where junk is deposited on somebody's property and left there. On a motion made by Mr. Whittlesey and seconded by Mr. Blais the Board unanimously approved the ordinance. The ordinance reads as follows: O R D I N A N C E The Selectmen of the Town of South Burlington hereby ordain: Section 1: No person, firm or corporation shall at any time deposit on any land within the Town, other than the public dumping ground maintained by the Town, any waste or discarded materials or matter of any kind, including motor vehicles which are no longer intended or in condition for legal use on the public highway. Section 2: A person, firm or corporation who violates a provision of this ordinance shall be fined not less than $20.00 nor more than $100.00. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN (5) Junk Ordinance - Public And Private, Junk Yard The Board unanimously approved the ordinance. The ordinance reads as follows: O R D I N A N C E AN ORDINANCE TO AMEND THE SOUTH BURLINGTON ZONING ORDINANCE: The Selectmen of South Burlington hereby ordain: Section 1: The South Burlington Zoning Ordinance adopted February 28, 1964 is hereby amended by adding the following section to Article XII: Section 12.85. In any district, the use of any property for the storage, collection, or depositing of junk shall be prohibited. "Junk" shall include any worn out, cast off, or discarded article or material, which is ready for destruction or has been collected or stored for salvage or conversion to some use. "Junk" shall also include a motor vehicle which is no longer intended or in condition for legal use on the public highway. Section 2: Section 3.10 (18) is hereby amended to read as follows: JUNK YARD. A lot, land or structure, or part thereof, used for the collection, storage or sale of waste paper, rags, scrap metal, bottles, or discarded material or for the collecting, wrecking, dismantling, storage, scavenging, salvaging or sale of machinery or vehicles not in running condition or parts thereof, including any place where one or more vehicles not in running condition or parts thereof are stored and are not being restored to operation. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN GIROUX TRUCK PURCHASE AGREEMENT The Selectmen signed Giroux's septic tank pump truck purchase agreement. DOG PETITION Mr. D'Acuti read a petition concerning a dog belonging to Theodore Jones of Helen Avenue. The petition stated the dog was a vicious killer and a nuisance. Mr. D'Acuti read a report compiled by the Police Department which consisted of complaints made about the Jones dog dating back to 1964. Mr. D'Acuti stated that according to the Vermont Statutes the Selectmen had to investigate the matter and make a decision to chain, muzzle, or destroy the dog and they have to act in three days. Mr. D'Acuti assigned Mr. Whittlesey and Mr. Blais to investigate the matter and tabled further action until Thursday, September 7, 1967 at 5:00 P.M. FIRST READING MARTIN-ALLARD ZONE CHANGE REQUEST After a general discussion the Board approved the First Reading of the zone change request with a recommendation to the Planning Commission that they consider the entire block of property in question rather than 300'. CONSIDER GOODRICH PAVING SUGGESTION Mr. D'Acuti read a letter from the Goodrich Construction Company engineer, Mr. Stanley, concerning paving after sewer construction. Mr. Stanley suggested paving with a tack-coat as a temporary measure and resurfacing in the Spring. CONSIDER GOODRICH PAVING SUGGESTION continued Mr. Szymanski, Town Engineer, suggested having Goodrich continue with the sewer specifications as in the contracts and maintain it for one year. He said if the road settles after this the Town could put in bituminous for the same price it would cost to have Goodrich put in the tack-coat. Mr. Szymanski felt the Town could save money when the roads don't settle enough to require more surfacing. The Board agreed to follow the Town Engineer's recommendation. CONSIDER THIRD SNOW-PLOW TRUCK Mr. LeClair pointed out the need for a third snow-plow truck. He said the town is growing rapidly and it is almost impossible to keep up the snow-plowing with only two trucks. Mr. LeClair said the Town already has a wing to put on the truck that was bought previously but doesn't fit the 185 truck. The matter was tabled until Thursday, September 7, 1967 at 5:00 P.M. AMORY SMITH – EASEMENT After general discussion by the Board, the matter was tabled. REPORT ON POLICE DISPATCHING – SHELBURNE The Selectmen discussed the report on Shelburne calls. Mr. LeClair explained that as Shelburne people become aware of the service, the calls will be on the increase. Mr. D'Acuti suggested letting the dispatching go for another quarter at the same price and then make a definite decision on the matter. The Selectmen felt that Shelburne should pay ¼ of the cost or $5,000. The Board agreed to continue the next quarter at the same price and bring the cost up to $5,000 at the beginning of Shelburne's fiscal year. The $5,000 would be ¼ of the total cost which the Board felt was very fair. BOND – CRANWELL There was a general discussion of the Laurel Hill South development bond. The Board agreed that the Town would consider extending the completion date providing that work commenced immediately and they instructed the Town Manager and the Town Engineer to meet with Mr. Cranwell and Mr. Butterfield for the purpose of instituting final street construction. SPECIAL MEETING There will be a meeting on Thursday, September 7, 1967 at 5:00 P.M. The Selectmen will act on the dog petition and the purchase of the 190 snow-plow truck.
