HomeMy WebLinkAboutMinutes - City Council - 11/07/1967BOARD OF SELECTMEN MEETING NOVEMBER 7, 1967 The South Burlington Board of Selectmen held a regular meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, November 7, 1967. Mr. D'Acuti, Chairman, called the meeting to order at 7:30 P.M. MEMBERS PRESENT Vincent J. D'Acuti, Chairman; Robert K. Ashley, Frederick G. Blais, Augustus T. Stannard and Stephen M. Whittlesey. MEMBERS ABSENT None OTHERS PRESENT Henry LeClair, Town Manager; Richard G. Carter; Chief of Police; Leopold Yandow, George DeForge, Gus Calkins, Charlotte Marsh, Mrs. Leonard Zubko, Mr. Earl Greer, Mr. and Mrs. William Guilford, a representative from the League of Women Voters and several other residents of the town. READING OF THE MINUTES The minutes of the previous meeting were approved as read. GUS CALKINS - COMPLAINT - TOWN SIGN ON HIS PROPERTY Mr. Calkins reported that a town sign was on his property and he wanted it removed. Mr. D'Acuti instructed the Town Manager and Chief Carter to investigate the complaint and have the sign removed if it was on private property. SECOND READING ­ ZONE CHANGE ON SHUNPIKE ROAD – ZAJCHOWSKI The Selectmen unanimously passed the second reading for a zone change on Shunpike Road. Mr. D'Acuti read the recommendation from the Planning Commission recommending that the Selectmen approve the request. The Ordinance reads as follows: AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF RESIDENTIAL DISTRICT B". The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Planned District to Residential District B. A strip of land located on the westerly side of Shunpike Road, starting at a point five hundred (500) feet southerly of Williston Road and continuing southerly to a point where Shunpike Road makes a sharp bend easterly. Said strip of land being one hundred and fifty (150) feet in depth from the west side line of Shunpike Road. Also a strip of land on the easterly side of Shunpike Road a depth of one hundred and fifty (150) feet. Said strip being directly opposite the aforementioned parcel. Section 2. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN SECOND READING - ZONE CHANGE ON DORSET STREET - ALLARD The Selectmen unanimously passed the second reading for a zoning change on Dorset Street. Mr. D'Acuti read the recommendation from the Planning Commission recommending that the Selectmen approve the request. The Ordinance reads as follows: SECOND READING - ALLARD ZONE CHANGE REQUEST, continued AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF RESIDENTIAL DISTRICT C". The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Residence District B to Residential District C. A lot of land having a frontage of three hundred (300) feet on the westerly side of Dorset Street, with a depth of eight hundred and ten (810) feet next to and south of the Green Mountain Power Company. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN SECOND READING - GREER ZONE CHANGE REQUEST - DORSET STREET The Selectmen unanimously passed the second reading for a zone change request on Dorset Street. Mr. D'Acuti read the recommendation from the Planning Commission recommending that the Selectmen approve the request. The Ordinance reads as follows: AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF BUSINESS DISTRICT A." The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 20, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Residential B to Business District A. SECOND READING - GREER ZONE CHANGE REQUEST - continued A strip of land located on the easterly side of Dorset Street starting at a poknt one hundred and fifty (150) feet southerly of the intersection of Dorset Street and Williston Road, thence, perpendicular to said Dorset Street in an easterly direction one hundred and eighty-five (185) feet, thence, in a southerly direction and parallel with a Dorset Street line one hundred and seventy-eight (178) feet, thence in a southerly direction one hundred and eighty-five (185) feet to the easterly side line of Dorset Street, thence along Dorset Street in a northerly direction one hundred and seventy-eight (178) feet to the point of beginning. Whittlesey SECOND READING - YANDOW ZONE CHANGE REQUEST - EAST OF LAUREL HILL SO. The Selectmen unanimously passed the second reading for a zone change request on Leopold Yandow property east of Laurel Hill South. Mr. D'Acuti read the recommendation from the Planning Commission recommending that the Selectmen approve the request. The Ordinance reads as follows: AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF RESIDENTIAL DISTRICT B." The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described property from Planned District to Residential District B. A rectangle of land approximately three hundred (300) feet by fourteen hundred (1400) feet, being the southerly portion of the former Reid property now owned by Leopold Yandow, located east of Laurel Hill South, north of the University of Vermont Horticultural Research Center, and about eight hundred (800) feet west of Spear Street. Said rectangle is the remainder of the Yandow parcel not included in the Residential District B. Zone. SECTION 2. This ordinance shall take effect from its passage. Approved November 7, 1967 and signed by all members of the Board of Selectmen. DESLAURIERS REZONING REQUEST - FIRST READING The Selectmen unanimously approved the first reading of a zone change request to change the land use of property from Residential District B to Residential District C. The Town Manager was instructed to forward the proposed ordinance to the Planning Commission for their recommendation and to advertise the ordinance for a second reading. BERARD REZONING REQUEST - FIRST READING The Selectmen unanimously approved the first reading of a zone change request to change the land use of two parcels of property from Residential District B to Industrial District A. The Town Manager was instructed to forward the proposed ordinance to the Planning Commission for their recommendation and to advertise the ordinance for a second reading. The Manager was also instructed to ask the Planning Commission to consider each parcel of property in this request separately. POLICE DEPARTMENT REPORT - CHIEF CARTER - BICYCLE ORDINANCE, ETC. Chief Carter gave each of the Board members a copy of a proposed bicycle ordinance that he had prepared. The members read the ordinance and discussed the following: method of administrating the ordinance, method of enforcing, cost to the police department, cost to registrants, and other related matters. Mr. D'Acuti instructed that the ordinance be sent to the Town Attorney for review. The Board then unanimously passed the first reading subject to the approval of the ordinance by the Town Attorney. POLICE DEPARTMENT REPORT - CHIEF CARTER - continued The Board questioned the Chief about the strength of our present ordinance for the control of dogs. After some discussion it was agreed that the Chief should present his recommendations on the matter after investigating the State's proposed law for control of dogs, whether we should have a leash law and other pertinent factors. The Board and those present had a general discussion on the patrolling of streets, vandalism, complaints, etc. Mr. Carter read from his monthly report, enumerating the percentage of increase in the different phases of police work and stating that he did not have enough help in the department to release men and cruisers for patrolling of residential areas. Mr. and Mrs. Guilford, Miss Marsh and Mrs. Zubko all stated that they felt that the Police Department should be strengthened by increasing the number of men on the force and the number of cruisers. Mr. D'Acuti instructed Chief Carter to look into the dog ordinance, vandalism and patrolling and report at the first meeting in December. The Chief was also advised by the Board to bring in a request for what he felt would be necessary to bring the department up to sufficient strength as the Board was going to begin working on the budget for the coming year. REPORT OF CEMETARY COMMITTEE - CHARLOTTE MARSH Charlotte Marsh read a report from the Cemetary Committee, asking for about $225 for repair of monuments in the two town cemetaries. The Committee also requested that the Selectmen put in the coming budget an amount sufficient to erect a new fence around the Shelburne Road cemetery. They had received a price of about $4,488 from one contractor, and Mr. D'Acuti stated that the town usually put such projects out for bid. The Board appointed a committee of two to inspect the cemeteries and report at the next meeting, naming Mr. Stannard and Mr. D'Acuti to the committee. The Cemetery Committee's Report is filed with the minutes of this meeting. VERMONT RETIREMENT SYSTEM FOR TOWN EMPLOYEES Mr. Blais made a motion, seconded by Mr. D'Acuti, that the Vermont Retirement system be approved for participation by town employees and the motion passed unanimously. The Selectmen then signed a resolution to that effect and the resolution is filed with the minutes of this meeting. PARKS - GREEN BELT AREAS IN DEVELOPMENTS Mrs. Leonard Zubko of Laurel Hill Drive told the Board that when she moved into the neighborhood seven years ago she was told that there would be an area set aside for recreational purposes in the development. Mr. D'Acuti told her that the town did not have the money to provide recreation facilities. She and others present then stated that all that was wanted was a woodsy area where the children could play, and it would not have to have maintenance. The Board explained to those present that the Selectmen had the power to zone areas, but plot plans for developments had to be approved by the Planning Commission who had the power to waive some of the requirements such as recreation areas. The Board of Selectmen then unanimously agreed that they would write to the Planning Commission suggesting that they do not waive some of the requirements of subdivisions such as recreation areas, 60 foot right of ways, sidewalks, etc. The Selectmen signed a liquor license request for the Rooster Tail Restaurant and a form for State Aid for Highway work.
