BOARD OF SELECTMEN MEETING JULY 11, 1967 The South Burlington Board of Selectmen held a regular meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, June 20, 1967 at 7:00 P.M. Mr. Vincent J. D'Acuti, Chairman, called the meeting to order. MEMBERS PRESENT Vincent J. D'Acuti, Chairman; Frederick G. Blais, Robert K. Ashley and Augustus T. Stannard. MEMBERS ABSENT Stephen M. Whittlesey. OTHERS PRESENT Henry LeClair, Town Manager; Mr. Andrews, Free Press Reporter; Mr. Brunini and two residents of Brewer Parkway. READING OF THE MINUTES The minutes of the June 6, 1967 and June 20, 1967 meetings were accepted as read. SECOND READING OF BREWER PARKWAY ZONE CHANGE REQUEST Mr. D'Acuti said he received a recommendation for the zone change from the Zoning Board. After a general discussion the Board unanimously approved a zone change for five lots on Brewer Parkway from Business B to Residential B. The ordinance reads as follows: P R O P O S E D O R D I N A N C E AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF RESIDENCE DISTRICT B". The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Business District B to Residence B. Five parcels of land, fronting on Brewer Parkway, owned by the following persons and recorded in the South Burlington Land records as follows: Parcel #1, Edwin Farnham, Volume 44, page 125 Parcel #2, Julian Goodrich, Volume 85, page 139 Parcel #3, Alfred Brunini, Volume 78, page 84 Parcel #4, Harold Ray, Volume 20, page 283 Parcel #5, Rufus E. Whittlesey South Burlington Board of Selectmen SECOND READING OF PIZZAGALLI ZONE CHANGE REQUEST After a general discussion the Board unanimously approved a zone change from Business District B to Planned District on land located on Kennedy Drive and Hinesburg Road owned by Pizzagalli. The ordinance reads as follows: P R O P O S E D O R D I N A N C E AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF PLANNED DISTRICT". The Selectmen of South Burlington hereby ordain: SECTION 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Business District B to Planned District. A parcel of land located on the south side of Kennedy Drive and on the easterly side of Hinesburg Road, as described in Volume 8, page 402 of the South Burlington Land Records. SECTION 2. Whittlesay SOUTH BURLINGTON BOARD OF SELECTMEN DISCUSSION ON PLANNING COMMISSION ACTION REGARDING CHRISTIAN HOSKAM REQUEST After discussion of the Planning Commission recommendation with regards to Mr. Hoskara's request, the Board asked the Town Manager to set up Mr. Hoskam's request for second reading on August 1, 1967. FIRST READING ON JUNK AUTO AND JUNK YARD ORDINANCE Mr. D'Acuti read an ordinance prepared by the Town Attorney concerning junk autos and junk yards. Members of the Board expressed disappointment in the ordinance and said they felt it didn't have enough "teeth" in it. They felt the ordinance should have specific penalties for each offense. Mr. LeClair pointed out the legislature has passed a law to control the land owner who has junk autos or a junk yard. He said the Towns did not have this law to work with before. He also said the law includes up to $100 for a fine. The Board approved the first reading of the junk auto and junk yard ordinance and instructed the Town Manager to instruct the Town Attorney to put more specifics in the ordinance regarding penalties etc. FIRST READING OF THE SWIMMING POOL ORDINANCE After a general discussion the Board approved the first reading of the swimming pool ordinance. CONSIDER APPROVAL OF A USE VARIANCE - EDMUND J. BENOIT Mr. D'Acuti read the proposal for a use variance for a three-family dwelling on Cottage Grove Avenue. Mr. D'Acuti said it was approved by the Zoning Board of Adjustment at a meeting on June 21, 1967. Mr. W. H. Davis of 20 Cottage Grove Avenue spoke against the proposal. Mr. Davis said the apartment house would depreciate the value of the other houses in the area, it would increase traffic on a street that is already too narrow and he thinks apartment houses should be in another area of town. Mr. Davis stated he felt when ordinances of this kind ware proposed that all residents of the area should be notified by mail. He said there is an apartment house in the area and many of the residents didn't know it was going up until they started building. After a general discussion the Board unanimously approved the use variance for a three-family dwelling on Cottage Grove Avenue. OTHER DISCUSSION ON SEWER CONSTRUCTION There was a general discussion regarding road construction after the sewer lines have been put in. Mr. D'Acuti said he noticed Dorset Street and other roads have settled causing holes, deep dips and ridges in the road. He asked if temporary roads could be built in the future and after they have settled put in good roads. Mr. LeClair said the company is responsible for the roads and patching them is cheaper. Mr. Stannard suggested talking with Goodrich and try to have a good road put in. He also suggested finding the cost of patching and the cost of a good road and have the town pay the difference. The Board agreed to talk with Goodrich and see what could be done. PROCTOR AVENUE DRAINAGE Mr. LeClair told the Selectmen that he and Mr. Szymanski attended a Board meeting of Rice Memorial High School. He said they explained the drainage problem on Proctor Avenue to the School Officials. The School Officials said if it was the architects mistake the architects will have to answer to it. Mr. LeClair said he and Mr. Szymanski went to Freeman French and Freeman who stated the Town constructed the Proctor Avenue drainage to intercept the school drainage. The Board instructed the Manager to pursue the situation further with Rice Officials. REST HAVEN MOTEL COMPLAINT There being no other business the meeting adjourned at 10:30 P.M.
