HomeMy WebLinkAboutMinutes - City Council - 02/21/1967BOARD OF SELECTMEN MEETING FEBRUARY 21, 1967 The South Burlington Board of Selectmen held a regular meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, February 21, 1967. The meeting called to order by Stephen M. Whittlesey started at 7:30 P.M. and immediately recessed for the purpose of holding the public meeting on the charter amendment. The Selectmen reconvened at 7:45 P.M. following the hearing on the charter amendment. MEMBERS PRESENT Stephen M. Whittlesey, Augustus T. Stannard, Robert K. Ashley, and Frederick G. Blais. MEMBERS ABSENT Vincent J. D'Acuti, Chairman. OTHERS PRESENT Henry N. LeClair, Town Manager; Irving L. Douglas, Director of the New Sewer System; John T. Ewing, Town Attorney; Ed Myers, Free Press Reporter; Laforrest Thompson, CPA; Frederick Fayette, School Attorney; and a representative from the League of Women Voters. READING OF THE MINUTES The minutes of the previous meeting were accepted as read. JAZINSKI SESSION ON MUNICIPAL MALL The Jazinski session on the Municipal Mall was cancelled but Mr. Jazinski will meet with the Board on March 21, 1967. SEWER REAL ESTATE TAX RATE REVISIONS There was a general discussion on sewer real estate tax rate revisions. Mr. Ewing stated that he felt the Town had the right to have a front foot charge but he felt an annual bill should be made of fifty cents per front foot, which would come out the same as having a frontage charge. Mr. Thompson, auditor, felt the town should be able to come up with a frontage figure after final construction cost is determined and the total front footage figure is compiled. He said the early payments on the bond issue and interest then determine the number of dollars to be raised and divide it by the number of feet, therefore, we can't come up with a figure until 1968. Determine the percent the three factors are going to be, and with this figure determine the front foot charge. Mr. Ewing felt we should not rely on the contingency fund. He said the legal point cannot be decided until policy is known. A member of the Board stated that if too much money was collected it would be a surplus and could go towards lowering the next year's tax. However, Mr. Thompson pointed out that if the Town showed a surplus, it would show up in the books as a surplus rather than the Town getting money for paying too much. On a motion made by Mr. Blais and seconded by Mr. Ashley the Board voted in favor of adopting a 22¢ tax rate. The first step is to have Mr. Ewing prepare a legal check to see what can and cannot be done with respect to frontage charges. CONSIDERATION OF TAX PENALTIES Mr. Ewing stated that the Board of Civil Authority cannot decide anything about penalties. Mr. Blais said he felt the Board should waive the penalties. The Board authorized forgiveness of penalties on the list that was presented. A copy of the list is filed with the minutes of this meeting. RESOLUTION ON JUNK AUTOS Mr. Ewing prepared a resolution to cover junk autos. Mr. Stannard moved that the resolution be adopted and the motion was seconded by Mr. Ashley. The Board voted to accept the resolution. The resolution reads as follows: RESOLUTION BE IT RESOLVED by the Board of Selectmen, that no motor vehicles, or portions thereof, be deposited in the Town dump unless the prior consent of the attendant at said dump is first obtained, and that the motor vehicle be cut up in a manner satisfactory to said attendant. Resolution adopted by Board of Selectmen at regular meeting of February 21, 1967. FIRE DISTRICT #6 DEED The Deed for Fire District #6 was signed. DATE FOR TONE CHANGE REQUEST March 21, 1967 was the date set for the second reading of a change for Shelburne Road property requested by Dr. E.B. Crane. SPECIAL MEETING The Board set March 8, 1967 at 5:30 P.M. for a special organizational meeting. REQUEST BY PLANNING COMMISSION The Planning Commission chairman requested a revision of residential district B so that any residential buildings would be limited to single family or duplex buildings. The Board tabled the request until a complete resolution was submitted by the Planning Commission. SIGN TOWN WARNING The Board of Selectmen signed the Town Warning school District warning and charter amendment warnings. DISCUSSION ON SEWER EQUIPMENT NEEDS There was a general discussion on sewer equipment needs. There being no other business the meeting adjourned at 11:00 P.M.
