HomeMy WebLinkAboutMinutes - City Council - 02/07/1967BOARD OF SELECTMEN MEETING FEBRUARY 7, 1967 The South Burlington Board of Selectmen held a regular meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont, on Tuesday, February 7, 1967 at 7:30 P.M. Mr. D'Acuti, Chairman, called the meeting to order. MEMBERS PRESENT Vincent J. D'Acuti, Chairman; Frederick G. Blais, Augustus T. Stannard, Robert K. Ashley and Stephen M. Whittlesey. MEMBERS ABSENT None OTHERS PRESENT Henry LeClair, Town Manager; Robert Ladd, Highway Superintendent; Ed Myers, Free Press Reporter; and William Kellner, Chairman of the Planning Commission. READING OF THE MINUTES The minutes of the previous meeting were approved subject to three corrections on page two. SECOND READING OF PROPOSED ORDINANCE Mr. D'Acuti read the proposed ordinance for a zone change from Planned District to Business A. Mr. Kellner was asked how the Planning Commission felt about the ordinance. He stated that the Commission was in agreement with the ordinance if it would be used for Business A, although they had not met officially to discuss it. SECOND READING OF PROPOSED ORDINANCE, continued The Selectmen unanimously approved the second reading of the ordinance, which reads as follows: O R D I N A N C E AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE" BY CREATION OF AN ADDITIONAL AREA OF BUSINESS DISTRICT A. The Selectmen of the Town of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Planned District to Business District A. A parcel of land bounded on the south by Interstate Route 189, on the north and east by land of Rice Memorial High School, and on the west by land owned by Thomas Farrell. Section 2. This ordinance shall take effect from its passage. Approved February 7, 1967 Signed by all members of the SOUTH BURLINGTON BOARD OF SELECTMEN SET BUDGET HEARING DATE The Board set the Public Budget Hearing for Tuesday, February 14, 1967, at 7:30 P.M. in the South Burlington High School auditorium. CONSIDERATION OF TAX PENALTIES The Town Manager requested the Board to consider the matter of the tax penalties. He explained that the list of unpaid penalties was turned over to the Board of Civil Authority for their action, but since no provision exists for their handling the matter, they suggested it be submitted to the Board of Selectmen. CONSIDERATION OF TAX PENALTIES, continued Following a brief discussion Mr. Blais suggested that the manager secure an opinion with respect to the matter from the Town Attorney and it be resubmitted to the Board at the next meeting on February 21, 1967. LAND FILL AREA Mr. LeClair requested that the Board consider establishing a fee for receiving junk cars at the land fill area. Mr. Whittlesey made a motion that intact bodies of cars not be accepted in the land fill area. There was some question as to the definition of intact cars and junk cars. Mr. Whittlesey withdrew his motion and Mr. Blais suggested that the Town Attorney draw up a resolution covering the matter for consideration at the next meeting, the intent to be to allow only dismantled automobiles or parts thereof disposed of in our Land Fill Area and to prohibit whole automobile carcasses. HIGHWAY SUPERINTENDENT REPLACEMENT In discussing the hiring of a highway superintendent Mr. D'Acuti suggested employing a working foreman for the highway department, and hiring an engineer for the highway department and water department combined. The Board gave Mr. D'Acuti permission to talk this over with the Water Department Commissioners and get their views on the matter. MUNICIPAL MALL There was a general discussion about plans for the municipal mall site. The Board agreed that they did not want to be morally or legally obligated to any architect at this time, therefore felt that Mr. LeClair should write a letter to Mr. Jazinski explaining their position. AMENDMENT TO TOWN CHARTER - POLLING PLACES FOR ANNUAL AND SPECIAL TOWN MEETINGS. The Board discussed the Town Government Committee's proposed amendment to the Town Charter, and decided to place it to a vote at the Annual Town Meeting, set the date of February 21, 1967, at a regular selectmen's meeting, for the required Public Hearing. The proposed charter amendment is as follows: SECTION 502A - POLLING PLACES FOR ANNUAL AND SPECIAL TOWN MEETINGS. In any annual or special town meeting, for the purpose of the election of officers and the voting on all questions to be decided by Australian ballot, there shall be additional polling places which shall be the polling places designated for the election of representatives to the General Assembly in each representative district. The check list for each polling place shall be composed of those voters residing in that representative district. The votes cast shall be separately counted in the manner provided in the election of representatives to the General Assembly. Except as provided in this section, the conduct of such meeting shall conform to the requirements where applicable, set forth in Chapter 19, subchapter 2 of Title 17, VSA.
