HomeMy WebLinkAboutMinutes - City Council - 12/19/1967BOARD OF SELECTMEN MEETING DECEMBER 19, 1967 The South Burlington Board of Selectmen held a public meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, December 19, 1967 at 7:30 P.M. Mr. D'Acuti, Chairman, called the meeting to order. MEMBERS PRESENT Vincent J. D'Acuti, Chairman; Robert K. Ashley, Frederick G. Blais and Stephen M. Whittlesey. MEMBERS ABSENT Augustus T. Stannard OTHERS PRESENT Henry LeClair, Town Manager, Mr. Angelo Pizzagalli, Mr. Rene Berard, Mr. Randall Munson, Mrs. Fastiggi and Mrs. Marjory Hill. READING OF THE MINUTES OF DECEMBER 5, 1967 and December 12, 1967 The minutes of December 5, 1967 were approved after a correction was made on page 3. The minutes of December 12, 1967 were approved as read. HINESBURG ROAD - KENNEDY DRIVE SEWER CROSSING CONSTRUCTION Mr. Angelo Pizzagalli, Contractor, told the Board he was anxious to have the sewer crossing at Hinesburg Road and Kennedy Drive constructed as soon as possible and he would be willing to do the work at the original open-ditch price of $15,210, and also that he would be able to start immediately. He said he had the impression that the prime contractor, Mr. Munson, was not interested in doing the work since the specifications had been changed to conform to State requirements which increased the cost. After a general discussion the Board agreed to allow Mr. Pizzagalli to do the construction at the original cost, if all of the legal aspects of the matter were cleared, and with Mr. Munson's concurrance. Mr. Munson, who arrived later in the evening, informed the Board that he did want to do the work and although the cost was increased he was prepared to start immediately and would also complete the job for the original price of $15,210. Mr. Parkes', of Webster-Martin, Inc., estimated cost of $19,738 was based on the State's requirements for relocation outside of the roadbed and for boring under the intersection with an 18" steel casing for approximately 125 feet and also for boring and laying a steel casing for approximately 25 feet across Hinesburg Road to the Shell Station. After discussing the matter the Board agreed that as long as both contractors would complete the work at the original bid price, they felt that Mr. Munson, as prime contractor, should be allowed to do the job. SCHOOL BUS GARAGE Mr. D'Acuti, Chairman, read a letter from School Superintendent Lull in which he indicated the School Directors' desire to have the Selectmen add the construction of a School Bus Garage to the Town Garage contract. He also read a letter from Mr. Berard, Contractor, to the School Superintendent outlining basic specifications and method of payment. Mr. D'Acuti said he could see no objection to the town acting as agent in this matter. Mr. Blais pointed out that we should be sure the Town was not committed financially, and was assured that we would not be. Mr. Whittlesey agreed that we could add an addendum to our contract for the Town Garage and include construction of the School Bus Garage. The Selectmen voted unanimously to act as agent for the School Board and include the South Burlington School Bus Garage in our contract for the Town Garage. TOWN GARAGE CONTRACT There was a general discussion as to just what items were to be included in the specifications of the Town Garage when the contract was negotiated. Mr. Berard stated that there was some misunderstanding and that he would call and make an appointment with the Town Manager, the Town Engineer and his foreman, John McKenzie, to meet with him during the morning of December 20, 1967 in an effort to straighten out the matter. ROLAND DESLAURIERS - OFFER TO DEED LAND TO TOWN FOR FUTURE BUILDINGS Mr. D'Acuti said he had talked with Mr. DesLauriers about his deeding more land to the town for the town buildings. Mr. DesLauriers pointed out that he would be willing to do this if the town would construct their road so that it could serve his property also. The Board agreed that they would appreciate having more land and instructed the Town Manager to confer with Mr. DesLauriers and the Town Engineer to outline the location of the property. Mr. DesLauriers felt he should have a letter of intent from the Town concerning the construction of the road, and this was agreed on. Mr. D'Acuti impressed upon the Board and Mr. LeClair that the matter should be acted upon immediately so the Board would have all the facts available in order to place the item of building a new Town Hall on the ballot at the March Meeting. RESOLUTION - ENFORCEMENT OF BICYCLE ORDINANCE The Selectmen signed a resolution governing the enforcement of the new Bicycle Ordinance. The resolution is filed with these minutes. CONSIDERATION OF TOWN ATTORNEY'S OPINION WITH REGARD TO ACCEPTING INCOMPLETE STREETS. Mr. D'Acuti read a letter from John Ewing, Town Attorney, outlining the correct procedure for accepting incomplete streets. ACCEPTANCE OF CLOVER STREET - CHARLES ANGOLANO The Selectmen unanimously agreed to accept Clover Street and signed the deed. FIRST READING OF "ORDINANCE FOR SEWER CHARGES". The Selectmen unanimously approved the first reading of an ordinance establishing sewer disposal charges subject to concurrance of Water Department with rates of charges and cost of penalties. FIRST READING OF ZONING DEFINITION AMENDMENT The Selectmen unanimously approved the first reading of an ordinance to add the definition "Usable Floor Area" to the Zoning Ordinance. FIRST READING OF ZONING ORDINANCE - EXISTING USE OF RESIDENTIAL LOTS The Selectmen unanimously approved the first reading of an ordinance governing existing use of residential lots after making a change in the wording. POLICE CRUISER BID The Selectmen voted unanimously to accept a bid for a police cruiser from Brewer Moters, Burlington, who are furnishing a cruiser at the same price the car could be obtained through the Vermont State Purchasing Department. Price $2396.40. SCHOOL BOARD MEETING Mr. D'Acuti stated that he intended to attend the School Board Meeting being held on December 20, 1967 at 4 P.M. WASTE MATERIAL FROM SEWER CONSTRUCTION Mr. Whittlesey told the Board that waste material from the trenches was not reaching its destination, the land fill area. Mr. LeClair explained that under the contract the waste material generated by the sewer construction was the property of the town. Mr. D'Acuti said he would investigate the matter. Miscellaneous: The secretary was instructed to correct page three of the December 5, 1967 minutes as there was an omission.
