BOARD OF SELECTMEN MEETING DECEMBER 5, 1967 The South Burlington Board of Selectmen held a regular meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, December 5, 1967 at 7:30 P.M. Mr. Vincent J. D'Acuti, Chairman, called the meeting to order. MEMBERS PRESENT Vincent J. D'Acuti, Chairman; Robert K. Ashley, Frederick G. Blais, Augustus T. Stannard and Stephen M. Whittlesey. READING OF THE MINUTES The minutes of the previous meeting were approved as read. SECOND READING OF BERARD ZONE CHANGE REQUEST Mr. D'Acuti read the Berard zone change request and the Planning Commission's recommendation. The Planning Commission did not recommend approval of Parcel No. 1 and recommended approval of Parcel No. 2 with the stipulation that the line of trees at the east border of the parcel be retained as a screen for the adjacent residential area. Mr. Bernard Ward spoke in opposition to approval of the change if adequate screening was not provided. Mr. George Brady and Mr. Gregory Friedman also spoke saying to be sure a buffer zone was maintained so that their property would not lose its residential environment. The Selectmen then unanimously voted to deny the zone change request for parcel No. 1, and to approve the zone change request for Parcel No. 2 with the stipulation that a fifty foot buffer zone with screening is maintained adjacent to the Residential B area. The ordinance, as approved with stipulation, reads as follows: AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF INDUSTRIAL DISTRICT A". The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Residential District B to Industrial District A. Parcel number 2, bounded on the east by Deuso, Friedman, Brady, Barrett, and Ward, on the north by Ward, on the northwest by Airport Parkway, on the southwest by Airport property, and on the south by Bruner. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN SECOND READING OF DESLAURIERS ZONE CHANGE REQUEST Mr. D'Acuti read the proposed ordinance for a zone change request by Mr. Ralph DesLauriers, also a letter from the Planning Commission with a recommendation that the Selectmen approve the request. Mr. DesLauriers spoke in his behalf, stating the exact location of the property and what he wanted to use it for. In opposition to approval of the change the Board was presented with a petition signed by 94 residents of the area. Mr. William Walton and Mr. George Drabble of East Terrace spoke in opposition, also Mr. James Ewing, Mrs. Barbara Bull and Mrs. Marjory Hill. They voiced objections based on distruction of the view from their homes, increase in traffic, cost of additional services for apartment buildings to the town, and their concern over the height of the buildings. Mrs. Bull read a letter of opposition to approval from the L. of W. V., which stressed their objection to spot zoning. The Chairman brought to the attention of those present that this was not spot zoning as it referred to a piece of property containing 39 acres. Mr. Winston Way spoke in favor of granting the request saying that although he was a resident of the area, he felt the apartment buildings would be an appropriate use of the property. Mr. Edgar Myers also was in favor of granting the request saying he had not heard a legimitate reason for not granting it. The letter from the L.W.V. and petition are filed with these minutes. On a motion made by Mr. Blais, seconded by Mr. Stannard, the Selectmen unanimously approved the proposed ordinance, which reads as follows: AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF RESIDENTIAL DISTRICT C." The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Residential District B to Residential District C: Starting at a point that intersects Interstate 89, UVM property, and Cupola Golf Course Incorporated property, thence, westerly along the UVM north boundary ten hundred ninety point ninety-five (1090.95) feet to a point that is one hundred twenty-five (125) feet short of the easterly side line of Spear Street, thence north-westerly and parallel to Spear Street two hundred (200) feet, thence, north-easterly to a point that intersects at the right angle the extension of a line one hundred fifty (150) feet east of the east street line of East Terrace, thence, northwesterly along said line to southwest corner of land presently zoned Business District A, thence, northeast along land zoned Business District A to Interstate 89, thence, southeast along Interstate 89 to the point of beginning. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN SECOND READING OF BICYCLE ORDINANCE On a motion made by Mr. Whittlesey and seconded by Mr. Stannard the Selectmen unanimously approved the second reading of a Bicycle Ordinance. Mr. LeClair was instructed to prepare a resolution naming a date for enforcement of this ordinance for presentation to the Selectmen at their meeting of December 19, 1967. An "as advertised" copy of this ordinance is filed with the minutes of this meeting. FIRST READING OF DOG ORDINANCE AND AMENDMENTS The Selectmen heard the first reading of the current dog ordinance and proposed amendments to Section 2 and Section 7. After some discussion the Board agreed that there should be changes either in the amendment to Section 2 or in Section 2 of the original ordinance. The Chairman suggested that the ordinance and amendments be returned to Chief Carter for revisions, and tabled any decision until the meeting of December 19, 1967. INSURANCE COMMITTEE RECOMMENDATION Mr. D'Acuti read a recommendation from the Insurance Committee that the Town join with the School and Water Departments to acquire excess public liability insurance at a cost of $325.00. The Selectmen unanimously agreed to accept the recommendation of the Committee. DISCUSSION AND POSSIBLE FIRST READING OF SEWER USER CHARGE PENALTY AND INTEREST ORDINANCE. The Selectmen tabled discussion of a first reading of a sewer user charge, penalty and interest ordinance, as well as discussion on methods of billing water and sewer user charges. Mr. D'Acuti instructed the Town Manager to invite the Water Commissioners to meet with the Board at an Executive Session to be held at the Town Office Building on December 12, 1967, Tuesday, at 7:30 P.M. to consider items of mutual interest. CHIEF CARTER'S REPORT ON POLICE NEEDS Chief Carter presented the Selectmen with a report of the Police Department's needs. The Selectmen decided to table study and discussion of the report until the Executive Session to be held December 12, 1967. FINANCIAL STATEMENTS The Board went over the current financial statements. DISCUSSION ON PROPOSED 1967-1968 SEWER CONSTRUCTION PAYMENTS The Town Manager presented the Board with a proposed Sewer Department 1967-1968 Budget. There was some discussion of the figures and the Board decided to continue study on the matter along with other budget figures at the Executive Session of December 12, 1967. ACCEPTANCE OF DEED TO BERARD'S COUNTRY CLUB ESTATES The Board tabled the matter of acceptance of the streets in Country Club Estates as there are still ten lots that require revisions. MISCELLANEOUS ITEMS HOWARD CRANWELL - BOND RELEASE - Mr. D'Acuti read a letter from John T. Ewing, Town Attorney, stating he and Mr. Piche, Attorney for Cranwell had been working on the deeds and there were several deeds yet to be corrected. LAND FILL AREA - The Chairman asked Mr. Whittlesey, as a committee of one, to investigate future landfill areas. METROPOLITAN POLICE - Mr. D'Acuti, Chairman, is to look into the Metropolitan Police Proposal and invite Mr. Leahy to attend the Executive Session of December 12, 1967 and discuss it. HINESBURG ROAD - KENNEDY DRIVE SEWER CROSSING The Board decided to allow Pizzagalli to construct the Hinesburg Road - Kennedy Drive sewer crossing, at open ditch unit cost, Munson permitting. ZONING BOARD - SIGN ORDINANCE The Town Manager was instructed to send a letter to the Zoning Board of Adjustment requesting them to revamp the sign ordinance if they do not agree with it. If possible the Board will have the first reading of such a proposed sign ordinance, as well as a "grandfather clause" for older Residential B properties, at the next regular meeting to be held December 19, 1967. HUGH MARVIN REQUEST Mr. Marvin was granted permission to sell coffee, etc. at the Annual Town Meeting, subject to School Department sanction.
