BOARD OF SELECTMEN MEETING AUGUST 15, 1967 The South Burlington Board of Selectmen held a public meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, August 15, 1967 at 7:00 P.M. MEMBERS PRESENT Mr. Vincent J. D'Acuti, Chairman; Mr. Robert K. Ashley, Mr. Frederick G. Blais, Mr. Augustus Stannard and Mr. Stephen M. Whittlesey. MEMBERS ABSENT None OTHERS PRESENT Mr. Robert Rosenberg, Jr., Attorney; Ed Myers, Free Press Reporter; Mr. William D. Kellner, Chairman of South Burlington Planning Commission; Mr. William J. Szymanski, Town Engineer and Mr. Richard A. Myette of 7 Richard Terrace. SIGNING OF DISBURSEMENT ORDERS The Selectmen signed the disbursement orders as presented. READING OF THE MINUTES OF THE PREVIOUS MEETING The minutes of the previous meeting were approved as read. CONSIDER PURCHASE OF GIROUX SEPTIC TANK PUMP TRUCK Mr. Blais read the agenda item in regard to the town purchasing a 1 and ½ ton Chevrolet truck, 1958 model, with a thousand gallon capacity having a separate pump engine with reversible valve from Mr. Maurice Giroux at a purchase price of $1450.00. PURCHASE OF SEPTIC TANK TRUCK - CONTINUED Mr. William J. Szymanski, Town Engineer, explained that there was a definite need for this type of equipment, stating that the price was a fair one and that upkeep and maintenance cost should be minimum. Mr. Blais then read Mr. Giroux's Agreement with Mr. Giroux's restrictions spelled out and the Bill of Sale. The Board was in agreement that the documents were satisfactory. The Selectmen voted unanimously to buy the truck and agreed to sign the Agreement and Bill of Sale after Mr. Giroux signed them. APPOINTMENT OF WILLIAM J. SZYMANSKI TO AUTHORIZE ADDITIONS TO SEWER CONTRACTS The Board of Selectmen voted unanimously to allow William Szymanski, Town Engineer, to authorize work additions to sewer contracts with the stipulation that any work order costing $250 or more should be brought to the attention of a member of the Board of Selectmen for approval. EASEMENTS - AMORY SMITH - REPORT BY I.L.DOUGLAS Mr. Douglas explained the difficulty he is having in obtaining a sewer easement from Mr. Amory Smith. Mr. Smith wants the Town to pay his lawyer's fee of approximately $100 plus the $10 easement fee. The Board questioned the Town Engineer who said that there was no other method of constructing the sewer to eliminate the necessity of obtaining the Smith easement. He also stated that the contractor could do parts of East Terrace and Spear Street, leaving the spur to be constructed on the Smith property till later. SEWER EASEMENTS - AMORY SMITH - REPORT BY I.L.DOUGLAS, continued Mr. Douglas suggested the Town start condemnation proceedings on the property. Mr. D'Acuti asked the Board to table decision on this matter till the September 5th, 1967 meeting. The Selectmen unanimously agreed to the postponement. Mr. Douglas concluded his report stating he hoped to have all the sewer easements completed by next Monday or Tuesday. SEWER CONSTRUCTION - LAST TWO CONTRACTS The Town Engineer told the Board that Webster-Martin, Inc., had indicated that plans for the last two sewer contracts would be ready to advertise for bid in about two weeks. The work priorities are the line on White Street that services the new Post Office and the Restaurant, the line to the proposed Dumont development at Iby and Barrett Streets, and the line on Cottage Grove Avenue. PROCTOR AVENUE DRAINAGE Mr. Szymanski explained that the Proctor Avenue drainage problem is acute and should be remedied as soon as possible, as the drainage system cannot handle all the water coming from the Rice High School property. He said the best way to alleviate the situation would be to divert the flow over the school property, using some underground piping, at a cost of approximately $5000. He also stated that the town would have to have a perpetual easement and right-of-way over the school property in order to construct the drainage system. PROCTOR AVENUE DRAINAGE - continued In discussing how to pay for this project the Board considered giving the drainage work priority over the Baldwin Avenue sidewalk construction that had been scheduled for this year at a cost of about $3000. The Board then voted four to one to approve giving the Proctor Avenue drainage construction priority over the Baldwin Avenue sidewalk construction. Voting their approval were Mr. D'Acuti, Mr. Blais, Mr. Ashley and Mr. Whittlesey - against the priority, Mr. Stannard. PLANT OPERATOR - REPORT As Mr. Robert Lincoln, Plant Operator, was not present the discussion on his written report was tabled until the September 5, 1967 meeting which he will be asked to attend. POLICE DISPATCHING FOR SHELBURNE Mr. D'Acuti read the Police Dispatching Agreement with Shelburne for our police dispatching service from July 1, 1967 to September 30, 1967. The Board unanimously voted to approve and sign the agreement. The Chairman requested that a breakdown of the number of police calls handled for the town of Shelburne be prepared and presented at the next meeting. FIRST READING OF RESIDENTIAL C AREA ORDINANCE Mr. D'Acuti read the proposed ordinance outlining sections of town to be used for Residential C District (apartment buildings), as recommended by the Planning Commission. Mr. William Kellner, Chairman of the Planning Commission explained the reasons for selecting the locations. One of the areas recommended was all of the Boyd Hatch Estate property known as Red Rocks. Mr. Robert Rosenberg, Jr., Attorney for the Hatch Estate, voiced his objections at the inclusion of this area, stating that the owners were not notified of the proposed change in zoning, that the property was not suitable for residential development because of the ledges which would make the cost of sewer installations prohibitive, and also because the property was in an area of G.B.I.C. industrial development. He said that the owners were seriously considering selling the property for industrial development and felt that it should remain in Planned Area. The Board agreed to omit the Red Rocks area and voted unanimously to approve the first reading of the Residential C Area ordinance as then read. FIRST READING PROPOSED ORDINANCE ADDITIONAL AREA OF BUSINESS A - SHELBURNE ROAD The Selectmen unanimously approved the first reading of a proposed ordinance to create an additional area of Business A area as described in paragraphs 11 and 12 of Appendix A of the South Burlington Zoning Ordinance. RICHARD TERRACE COMPLAINT Mr. Richard Myette, a resident of Richard Terrace and a member of our Zoning Board of Adjustment discussed the waste of effort and money used to gravel the driveways on Richard Terrace that were disrupted during sewer construction last year as the plows would throw the gravel on the lawns, etc. during winter plowing. It was explained to him that the problem would always exist until curbs were constructed. MISCELLANEOUS Mr. D'Acuti, Chairman, requested the Town Engineer to make a study of and report on the drainage problem on Richard Terrace. Mr. Szymanski presented a Highway State Aid payment form for reimbursement for work done on Town Highway roads to the Selectmen for their signature. The Selectmen had heard that Mr. Alex Graham was not going to work as part-time inspector of sewer construction, and questioned the Town Engineer about it. Mr. Szymanski said he also had heard this and that it is up to Webster-Martin, Inc. to supply an inspector. A resident of Iby Street, Mr. Gordon A. Riddell, had complained that Iby Street is being used as a throughway and the road is in terrible condition. The Town Engineer was requested to investigate the matter. A letter from Pizzagalli Construction Company, requesting permission to install a small trailer on the South Burlington Middle School job site in order to allow one of their men to be there at night for security reasons, was read by Mr. D'Acuti. Because of the danger of serious accidents involving the equipment and vandalism the Board unanimously agreed to grant the request.
