HomeMy WebLinkAboutMinutes - City Council - 05/03/1966BOARD OF SELECTMEN MEETING MAY 3, 1966 The South Burlington Board of Selectmen held a regular meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, May 3, 1966 at 7:30 P.M. Mr. Whittlesey, Vice-Chairman, called the meeting to order. MEMBERS PRESENT Stephen M. Whittlesey, Vice-Chairman; Mr. Robert K. Ashley, Frederick G. Blais and Augustus T. Stannard. MEMBERS ABSENT Vincent J. D'Acuti, Chairman OTHERS PRESENT Henry LeClair, Town Manager; John T. Ewing, Town Attorney; Professor Samuel N. Bogorad, Mr. Roland M. Whittier, Bernard J. Rocheleau, Mrs. Sally Caswell and Mrs. Robin Milne. MINUTES A motion made by Robert K. Ashley, seconded by Mr. Stannard, to accept the minutes of the previous meeting as read, was unanimously passed by the Board. ACCEPTANCE OF FIRE DISTRICT 3. Mr. Stannard made a motion, seconded by Mr. Ashley, that the Board of Selectmen accept the transfer of Fire District 3 to the Town of South Burlington. As there was no objection the Board unanimously agreed to accept the transfer of Fire District 3 to the Town, and then signed the necessary papers as presented by Mr. Ewing, Town Attorney. COUNTY TAX Mr. LeClair, Town Manager, explained to the Board of Selectmen that the cost of our County Tax had increased from $3672.23 in 1965 to $6478.35 in 1966, because of the change from a 30% ratio to a 50% ratio. He felt that this was an unfair assessment. The Board suggested that the Town Manager and Town Attorney check into the matter thoroughly, bring it to the attention of the Vermont Tax Commissioner, the County Commissioners, and also discuss it with the Representatives from our District, in an endeavor to get the tax reduced. SECOND READING OF THREE AMENDMENTS TO THE ZONING ORDINANCE Mr. Whittlesey read the following three ordinances. As there was no objection to these ordinances, the Board of Selectmen voted unanimously to accept the second reading. AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE". The Selectmen of the Town of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964 is hereby amended by adding the following to Article XI, Planned Districts. Section 11:21 Use regulations for existing lots of less than five (5) acres. No building, structure or portion thereof shall be erected, altered or moved and no land or building or part thereof shall be used, arranged or designed to be used on a lot of less than five (5) acres existing at the time of enactment of this Ordinance, for a purpose other than a dwelling occupied by one family or a building accessory thereto. Any such use shall conform to: Section 5.20 Section 5.50 Section 5.21 Section 5.51 Section 5.40 Section 5.80 Section 2. This ordinance shall take effect from its passage. APPROVED May 3, 1966 SOUTH BURLINGTON BOARD OF SELECTMEN AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE". The Selectmen of the Town of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964 is hereby amended by adding the following to Article V, RESIDENCE DISTRICT A. Section 5.11 Use regulations. Churches in Residence A may be permitted only when authorized as a special exception by the Zoning Board of Adjustment. Section 2. This ordinance shall take effect from its passage. APPROVED May 3, 1966 SOUTH BURLINGTON BOARD OF SELECTMEN AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE". The Selectmen of the Town of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964 is hereby amended by substituting the following in Article V1, Residence District B. Section 6.20 Lot area requirements. (A) Where lots are connected to a sanitary sewer approved by the Town Planning Commission, no dwelling shall be erected, altered or moved so as to provide less lot area per family than as follows: Single-family Dwelling 10,000 sq. ft. per family Multi-family Dwelling 7,500 sq. ft. per family Section 6.21 Lot frontage requirements. One hundred (100) feet. Section 2. This ordinance shall take effect from its passage. APPROVED May 3, 1966 SOUTH BURLINGTON BOARD OF SELECTMEN FIRST READING OF TWO PROPOSED ORDINANCES The Board of Selectmen unanimously passed the first reading of two proposed ordinances. Mr. LeClair, Town Manager, was instructed to advertise them for a second reading, and to refer them to the Planning Commission for their recommendation, with comments about restrictions on the Whittier Ordinance. SIGNING AGREEMENT WITH SHELBURNE - LAND FILL AREA The Board of Selectmen signed the Shelburne Land Fill Area agreement. The agreement with Williston was also signed at this time. Mr. LeClair was instructed to draw up new agreements on a month to month basis, with option to terminate in 30 days, if either or both towns wanted to continue to use the Land Fill Area temporarily. SEWER PROBLEM - STATEMENT OF POLICY Mr. Whittlesey, Vice-Chairman, read a letter from Mr. Mikell, Attorney, in behalf of a resident of Laurel Hill Drive who had trouble with the sewer system in Laurel Hill. Mr. Ewing, Town Attorney, was instructed to check his opinion of who has the responsibility of the cost of cleaning sewer lines in District 3 and 4. HENRY COLLIN - CIVIL DEFENSE DIRECTOR The Board of Selectmen accepted the resignation of Mr. Henry Collin as South Burlington Civil Defense Director with regret. PURCHASE OF TRUCKS A motion made by Mr. Whittlesey, seconded by Robert Ashley, to purchase a large International truck was unanimously passed by the Board. The price submitted by International Harvester Company is $6385.54. PURCHASE OF TRUCKS, continued After discussion concerning the difficulty involved in getting a delivery date on the small GMC truck, the Board decided to purchase the small International if they did not receive an eight week delivery date on the GMC. PURCHASE OF SEWER MAINTENANCE EQUIPMENT The selectmen unanimously agreed to purchase the sewer maintenance equipment from the J. F. McDermott Company, Inc. for a price of $1365.00. The other price quotation received was from the C. A. Turner Company for $1373.43. Taken into consideration was the fact that McDermott Company has equipment in the surrounding communities, and since the parts are interchangeable, we would be able to get them easily in an emergency. MISCELLANEOUS BUSINESS The Selectmen signed the Berard Zone change for recording, relative to land at intersection of National Guard Avenue and Airport Parkway. The Selectmen discussed the Water Department merger generally, and resolved that the Water Department should be given a letter subject to the approval of the Board, outlining the present status of the Department. The Selectmen discussed a mobile home ordinance and requested the Town Manager to draw up an ordinance relative to the same. The Selectmen also signed the orders.
