BOARD OF SELECTMEN MEETING JUNE 7, 1966 The South Burlington Board of Selectmen held a regular meeting at the Town Office Building, 555 Dorset Street, South Burlington, Vermont on Tuesday, June 7, 1966 at 7:30 P.M. Mr. Whittlesey, Vice-Chairman, called the meeting to order. MEMBERS PRESENT Vincent J. D'Acuti, Chairman; Stephen M. Whittlesey, Robert K. Ashley, Frederick G. Blais and Augustus T. Stannard. OTHERS PRESENT Henry LeClair, Town Manager, Robert Rosenberg, Attorney; Mr. Bernard Rocheleau, Mr. Emery Victory, Edward A. Hill, Mr. Norman Slameka, Professor Robert O. Sinclair, Mr. Stanley Guczek, Mr. Robert Ubele, Mr. Christian B. Hoskam, Mr. Russell Tilley, and many other interested residents of the town. READING OF THE MINUTES OF THE PREVIOUS MEETING The minutes of the previous meeting were approved as read. SECOND READING OF VICTORY CHANGE OF ZONE REQUEST Mr. LeClair read the proposed ordinance for a zone change from Residence District B to Business District A. He also read the recommendation of the Planning Commission, that the petition be denied till the completion of the updating of the Master Plan. Mr. Emery Victory told those present that the request was made so the property could be sold for commercial use, and he did not have any specific type of business in mind. Attorney Rosenberg, representing the residents of the area, spoke in opposition to the change and presented a petition with about 300 legal signatures of residents supporting the opposition. Professor Sinclair, Mr. Norman Slameka, Mr. Stanley Guczek, and Mr. Robert Ubele voiced their objections as well as a representative of the League of Women Voters who read a letter expressing their views. On a motion made by Mr. D'Acuti and seconded by Mr. Stannard the Selectmen unanimously denied the Victory petition. SECOND READING OF ROCHELEAU CHANGE OF ZONE REQUEST Mr. D'Acuti, Chairman, took the chair and read the proposed ordinance. Mr. LeClair read the recommendation of the Planning Commission that the petition be denied till the completion of the updating of the Master Plan. Mr. Rocheleau told those present that he intended to put up a good looking office building on the site. Several residents of the area spoke in opposition to the change. On a motion made by Mr. Whittlesey, seconded by Mr. Blais, the Selectmen unanimously voted to deny the Rocheleau petition. SECOND READING OF WHITTIER CHANGE OF ZONE REQUEST Mr. D'Acuti, Chairman, read the proposed ordinance. Professor Sinclair voiced objection to spot zoning. Mr. Hoskam spoke in favor of some commercial growth in town. After discussion Mr. Blais made a motion, seconded by Mr. D'Acuti, to accept the petition as read. As the Selectmen's vote was against acceptance the Whittier petition was denied. TRAILER AND MOBILE HOME AMENDMENT Mr. D'Acuti, Chairman, read the proposed amendment to the Zoning Ordinance in regard to Trailers and Mobile homes. Mr. D'Acuti made a motion, seconded by Mr. Whittlesey, that the amendment be accepted as read and the Selectmen unanimously approved the trailer and mobile home amendment to the Zoning Ordinance. FIRST READING OF SHEARER REALTY CORP. ZONE CHANGE REQUEST Mr. D'Acuti read a proposed ordinance for a zone change from Business A to Business B requested by Shearer Realty Corporation. On a motion made by Mr. Blais and seconded by Mr. Stannard the Selectmen unanimously approved the first reading. The Town Manager was instructed to present it to the Planning Commission for their recommendation. FIRST READING OF HOMER DUBOIS ZONE CHANGE REQUEST Mr. D'Acuti read a proposed ordinance for a zone change from Planned District to Residence District A. On a motion made by Mr. Stannard and seconded by Mr. Blais, the Selectmen unanimously approved the first reading. The Town Manager was instructed to present it to the Planning Commission for their recommendation. FIRST READING OF HILL ZONE CHANGE REQUEST Mr. D'Acuti read a proposed ordinance for a zone change from Planned District to Residence District B. FIRST READING OF HILL ZONE CHANGE REQUEST, continued On a motion made by Mr. D'Acuti and seconded by Mr. Blais, the Selectmen approved the first reading and requested the Town Manager to present it to the Planning Commission for their recommendation. FIRST READING OF PARE ZONE CHANGE REQUEST Mr. D'Acuti, Chairman, read a proposed ordinance for a change from Planned District to Business District B as requested by Mr. Henry Pare. On a motion made by Mr. Whittlesey and seconded by Mr. Stannard the Selectmen unanimously voted to deny the petition. MOTOR VEHICLE AND TRAFFIC REGULATION ORDINANCE AMENDMENT Mr. D'Acuti, Chairman, read a proposed amendment to the Motor Vehicle and Traffic Regulation Ordinance, which would amend Section 40 by limiting speeds to 25 and 35 miles per hour on designated streets. After a general discussion the selectmen agreed to omit Kennedy Drive from the list of streets to be posted at 35 miles per hour. The Selectmen then voted four to one to accept the first reading of the amendment. TAX RATE The Board of Selectmen unanimously voted a tax rate of $6.15 for the 1966-1967 fiscal year. The breakdown is as follows: School $4.73 General Fund .98 Highway Dept. .44 $6.15 SPECIAL TOWN MEETING The Town Manager stated that the School Board had elected to hold a special town meeting on July 19, 1966, that the first notice would have to appear on June 28, 1966. The Water question was then discussed generally and it was agreed that Mr. Whittlesey would write a letter to the Water Commission giving them a general re-cap of the reasons for the wording of the article as it is to appear. Purchase of the Legion property was also discussed and it was decided to table the preparation of the warning of the article till the June 21, 1966 meeting. The Manager reported that the Planning Commission had approved the purchase of the land, and also pointed out that the total cost would be $10,000 for land and nearly $4,000 in loss of sewer frontage assessment. Mr. D'Acuti, Chairman, stated that he would be interested in contacting Mr. Burnett for purposes of re-neogiating the figure, if possible, and would report at the June 21, 1966 meeting. FIRE CONTRACT The Board discussed the Fire Contract. The Manager reported his most recent findings relative to same, and stated that the New England Fire Association's recommendations should be finalized by the meeting of the 21st. The Board authorized the manager to write to Doctor John D. Boardman, Chairman of the Burlington Fire Commissioners, stating that South Burlington refuses to accept the $50,000 offer for services. UNLICENSED DOGS The Board voted to take the necessary legal steps to procure uncollected license fees or to dispose of the unlicensed dogs. AIR NATIONAL GUARD ROAD Chairman D'Acuti read a letter from General Richard B. Spear, Base Detachment Commander of the Vermont Air National Guard, relative to the status of the road over Guard property used by the general public. General Spear suggested the possibility of accepting an easement, or accepting the road as a public way. Mr. D'Acuti suggested that a preliminary meeting be set up for further discussion. HIGHWAY DEPARTMENT SALARY CONSIDERATION The Board discussed briefly Highway Department salaries, and decided to put into effect the salary changes as of June 6, 1966 rather than July 1, 1966. TRAFFIC LIGHTS The Town Manager reported that he had contacted Mr. Richard Kostka (person supplying our radar set) relative to installation of the traffic control equipment in front of Gaynes. Mr. Kostka will arrive this coming Saturday or Sunday and attempt to resolve the problem of getting the lights in operation. TRAILER AND MOBILE HOME ORDINANCE O R D I N A N C E AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE". The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964 is hereby amended by adding the following to Article XII, General Provisions. Section 12.51 Trailers or mobile homes. The use of trailers or mobile homes for living purposes shall be prohibited within the territorial limit of the Town. Trailer or mobile homes for non-living purposes may be permitted only when authorized as a special exception by the Zoning Board of Adjustment for temporary emergency facilities. Section 2. This ordinance shall take effect from its passage. APPROVED June 7, 1966 SOUTH BURLINGTON BOARD OF SELECTMEN The meeting adjourned at approximately 11:30 P.M.
