Mr. D'Acuti, Chairman called the meeting to order. MEMBERS PRESENT Vincent J. D'Acuti, Chairman; Robert K. Ashley, Frederick G. Blais and Stephen M. Whittlesey. MEMBERS ABSENT Augustus T. Goss, Jr. READING OF THE MINUTES OF THE PREVIOUS MEETING The minutes of the meeting of June 21, 1966 were approved as read. SHEARER REALTY CORP. - ZONE CHANGE REQUEST - SECOND READING The Board of Selectmen unanimously approved the request of Shearer Realty Corporation for a change in zoning as follows: O R D I N A N C E AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF BUSINESS DISTRICT B". The Selectmen of South Burlington hereby ordain: ORDINANCE continued Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Business District A and Industrial District A to Business District B. A parcel of land owned by Shearer Realty Corporation situated on the southerly side of Bartletts Bay Road and the westerly side of U. S. Route 7, having a frontage on Shelburne Road of approximately seven hundred and fifty (750) feet and a frontage on Bartletts Bay Road of approximately seven hundred and eight (708) feet, of record in Vol. 78 at page 12 of the Town of South Burlington Land Records. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN HILL FARM PROPERTY ZONE CHANGE REQUEST SECOND READING The Board of Selectmen unanimously approved the second reading of Mr. Hill's request for a zone change, with the stipulation that he submit and have recorded a five acre plot plan showing the location of the proposed building. The ordinance reads as follows: O R D I N A N C E AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF RESIDENCE DISTRICT B". The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Planned District to Residence District B. ORDINANCE continued A parcel of land located on the westerly side of Hinesburg Road, south of Interstate 89, containing a frontage of one hundred twenty five (125) feet on Hinesburg Road and a depth of one hundred seventy five (175) feet, with a south boundary bordering the Donald Brisson property. Whittlesey SOUTH BURLINGTON BOARD OF SELECTMEN DUBOIS PROPERTY ZONE CHANGE REQUEST SECOND READING The Board of Selectmen unanimously approved the second reading of Mr. Homer Dubois' request for a zone change, with the stiuplation that he submit and have recorded a five acre plot plan showing the location of the proposed building. The ordinance reads as follows: O R D I N A N C E AN ORDINANCE TO AMEND "THE SOUTH BURLINGTON ZONING ORDINANCE BY CREATION OF AN ADDITIONAL AREA OF RESIDENCE DISTRICT A" The Selectmen of South Burlington hereby ordain: Section 1. The South Burlington Zoning Ordinance adopted February 28, 1964, and the official zoning map adopted in connection therewith is hereby amended by changing the land use of the following described land from Planned District to Residence District A. ORDINANCE continued A parcel of land located on the westerly side of Hinesburg Road, having a common boundary of Bogorad and Dubois with a frontage of two hundred sixty (260) feet and a depth of three hundred (300) feet, owned by Homer L. and Marion A. Whittlesey BOARD OF SELECTMEN TRAFFIC ORDINANCE - SECOND READING The Board of Selectmen approved the second reading of an amendment to the Motor Vehicle and Traffic Regulation Ordinance of the Town of South Burlington, revision of April 28, 1958 with Mr. D'Acuti, Mr. Ashley and Mr. Blais voting yes, and Mr. Whittlesey abstaining. The ordinance is as follows: O R D I N A N C E AN ORDINANCE TO AMEND THE SOUTH BURLINGTON MOTOR VEHICLE AND TRAFFIC REGULATION ORDINANCE. The Selectmen of the Town of South Burlington hereby ordain: Section 1. The Motor Vehicle and Traffic Regulation Ordinance of the Town of South Burlington, revision of April 28, 1958, is hereby amended so that Section 40 relating to speed limits shall read as follows: Section 40. No motor vehicle shall be operated upon any of the streets of the Town at any time at a rate of speed greater than 25 miles per hour, unless otherwise herein provided. On the following streets of the Town, no motor vehicle shall be operated at any time at a rate of speed greater than 35 miles per hour: Spear Street Airport Parkway from the Colchester- Swift Street South Burlington Town line to its Allen Road intersection with Kirby Road Dorset Street Williston Road Old Farm Road Cheesefactory Road ORDINANCE continued Section 2. This ordinance shall take effect from its passage. Approved July 5, 1966 s/ Vincent J. D'Acuti s/ Robert K. Ashley s/ Frederick G. Blais Mr. Harold B. Bensen and Mr. Roger E. Curtis, residents of Spear Street went on record as opposing some sections of the above ordinance. COMPLAINT Mr. Roy J. Cole, 95 Logwood Street made a complaint about noise made by a construction firm working near his residence at 5 A. M. The Town Manager was instructed to look into the legal aspects of the matter. REPORT ON SEWER CONSTRUCTION Mr. Irving L. Douglas, Director of New Sewer System, gave a report on construction progress. Mr. Douglass asked the Board for their approval to hire the Pizzagalli Construction Company to do drainage work on Mills Avenue and Logwood Extension. Permission was given but the Board asked him to attempt to get the work done at a price equal to or below the engineers' figures. The Town Manager was instructed to look into the drainage problem on the Charles Angolano property as the matter was delaying the obtaining of the Angolano easement. Mr. D'Acuti asked Mr. Douglas to present similar reports at the first meeting each month and also to keep in close touch with inspection so that construction material would not be put on private property, or any other infraction take place that could cause complaints. INSURANCE PROPOSAL An insurance proposal submitted by Hickok Boardman Insurance Company was tabled for further details. SEWER ORDINANCE On a motion made by Mr. Whittlesey and seconded by Mr. Blais the Board voted to accept the first reading of a sewer ordinance. SIGNING OF ORDERS The Board signed the orders as presented. OTHER BUSINESS Mr. Whittlesey read a proposed amendment to the Zoning Ordinance relating to variances and non-conforming use. Mr. D'Acuti instructed the Town Manager to send copies to the members of the Zoning Board of Adjustment and the Planning Commission as well as the Board of Selectmen. Mr. D'Acuti reminded the Board that the Board of Civil Authority is meeting on July 9, 1966 and July 16, 1966, both meetings to start at 1:30 P.M.
