HomeMy WebLinkAboutSP-01-08 - Decision - 0095 Swift Street#SP-01-08 FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of South Burlington Youth Baseball to install two 336 square foot dugouts on City -owned land at Farrell Park, 95 Swift Street, South Burlington, VT 05403. On the 23rd day of February 2001, the Director of Planning and Zoning approved the request of South Burlington Youth Baseball for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of installing two 336 square foot dugouts, each nine (9) feet high, on existing concrete footprints at Farrell Park. 2. The record owner of the property is the City of South Burlington. This property located at 95 Swift Street and is within the Park and Recreation District. 3. Access/circulation: Access and circulation will not be changing as a result of this approval. Circulation on the site is adequate. 4. Coverage/setbacks: Building coverage will be less than the maximum of 15%. Total coverage will be less than the 25% maximum. All required setbacks are met. 5. Landscaping No landscaping changes are proposed. 6. Traffic: These will not create additional traffic or parking needs. 7. Sewer: No additional sewer allocation is needed. 8. Lim: No additional lighting is proposed. 9. Dumpster: No new dumpsters are proposed. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Director of Planning and Zoning approves the site plan application of South Burlington Youth Baseball to install two 336 square foot dugouts on City -owned land at Farrell Park, 95 Swift Street, South Burlington, VT 05403, as depicted on a plan entitled "Farrell Park" and dated April 27, 2000, with the following stipulations: 1) All previous approvals and stipulations, which are not superseded by this approval, shall remain in effect. 2) Any change to the site plan shall require approval by the South Burlington Development Review Board. 3) No changes to lighting, parking, landscaping or access shall be permitted without prior approval. The fee is $150.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality).
