HomeMy WebLinkAboutSP-95-0000 - Decision - 0069 Swift StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Vermont Gas Systems to construct a 3-story 32,124 square foot general office building and raze an existing office building and accessory structure, 63 and 69 Swift Street. On the 25th of April, 1995, the South Burlington Planning Commission approved the request of Vermont Gas Systems for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the construction of a 3-story 32,124 square foot general office building and razing an existing office building and accessory structure. 2. This property located at 63 and 69 Swift Street lies within the Cl District. It is bounded on the east by the Vermont Gas Systems pipe yard and an auto body shop, on the south by residences, on the west by a mini -storage facility and on the north by Swift Street. 3. Access/circulation: Access will be via a 24 foot curb cut on Swift Street. Access to the adjoining Vermont Gas Systems property to the east will be made available via an access at the southeast corner of the property. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 13.3% (maximum allowed is 305). Overall coverage is 68.7% (maximum allowed is 70%). Front yard coverage is 15% (maximum allowed is 30%). Setback requirements are met. 5. Landscaping: The minimum landscaping requirement, based on building costs, is $24,500 which is being met. Plantings include Chinese Elm, Black Pine, Spruce, Cedar, Lilac, Rhododendron, Juniper and Perwinkle. 6. Parking: This project requires a total of 128 parking spaces and 128 spaces are being provided including six (6) handicapped spaces. A bike rack is also being provided as required under Section 26.253(b) of the zoning regulations. 7. Traffic: ITE estimates that this project will generate 68.7 additional vehicle trip ends (vte's) during the P.M.peak hour. The applicant was made aware that the road impact fee for this project will be approximately $13,000. 1 8. Sewer: The sewer allocation needed for this project is 1170 gpd. The applicant will be required to pay the per gallon fee prior to permit issuance. 9. Sidewalk: A sidewalk is proposed along the property's frontage. This sidewalk should be constructed prior to the issuance of the Certificate of Occupancy/Compliance. 10. Lot merger: This development is taking place on two(2) separate lots. The use of both lots to accommodate the development merges the two (2) lots into one (1) lot. The plan should be revised to remove the lot line separating the two (2) parcels. 11. Lighting: Exterior lighting consists of the following: --- eight (8) 250 watt metal halide downcasting and shielded fixtures on three (3) 18 foot poles. --- two (2) bollard fixtures with 150 watt incandescent lamps. Details of the building mounted lights should be approved by the City Planner prior to permit issuance. 12. Dumpster: A screened dumpster area is shown on the plan. 13. Building height: Applicant indicated that the proposed building will meet the height requirements for a flat roofed structure and a pitched roof structure. 14. Street widening: Staff suggests that the applicant dedicate to the City an eight (8) foot strip of land along the property's frontage for future street widening. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Vermont Gas Systems to construct a 3-story 32,124 square foot general office building and raze an existing office building and accessory structure, 63 and 69 Swift Street, as depicted on a two (2) page set of plans, page one (1) entitled "Layout & Utilities, Vermont Gas Systems Inc. 69 Swift Street South Burlington, Vermont", prepared by Wiemann-Lamphere, Architects, Inc., dated 3/28/95, with the following stipulations. 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall construct the sidewalk along the property's frontage in a location approved by the City Engineer. This sidewalk shall be constructed prior to occupancy of the building. Prior to issuance of a zoning permit, the applicant shall post a `a bond for the sidewalk in an amount approved by the City Engineer. This sidewalk shall be constructed to the specifications approved by the Public Works Director. 3. The applicant shall post a $24,500 landscape bond prior to issuance of a zoning permit. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 4. For the purpose of calculating required road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the proposed office building will generate 68.7 additional vehicle trip ends during the P.M. peak hour. 5. A sewer allocation of 1170 gpd is approved. The applicant shall pay the per gallon fee prior to issuance of a zoning permit. 6. All new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. Details pf the building mounted lights shall be submitted to the City Planner for approval prior to permit issuance. 7. As expressly represented by the applicant, the applicant shall dedicate to the City an eight (8) foot strip of land along the property 's frontage for future street widening. The legal documents (i.e. irrevocable offer of dedication) shall be approved by the City Attorney and recorded in the land records prior to issuance of the zoning permit. 8. The plan shall be revised prior to issuance of a zoning permit to show a drainage easement along the proposed drainage pipe on 85 Swift Street (existing Vermont Gas property). 9. The applicant shall obtain a zoning permit for the building within six (6) months or this approval is null and void. 10. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the building. 11.
