The applicant wants to transfer some of that capacity to Swift Street in accordance with the recently adopted policy change. Members voiced no concerns. Mr. O'Rourke moved the Planning_ Commission approve the req_uest__o_f National Gardening_Association to transfer 840 q d of sewer allocation from the 60 Farrell Street project to the Wright & Morrissey VT Gas PUD ro'ect at 69 Swift Street. This results in a remaining allocation of 3010 gpd for the 60 _Farrell Street project and a total allocation on 20_40yopd (inc_ludes a 1209gpd credit for buildinns_to be removed) for the 69 Swift Street pro l ec t-. Mr. Dinklage raised the question of the two trailers which are on the site now and are not approved. Mr. Weith noted they were never shown on the previously approved plan, and staff recommends removal. Ms. St. Amand said they have always been there. The Planning Commission agreed that the trailers are not approved as part of this plan. Public Hearing: Final Plat Application of Wright & Morrissey/ Vermont Gas for a planned unit development consisting of the existing Vermont Gas building and a new 38,428 sq. ft. building for general office use and a bank with drive -through service, 69 and 85 Swift Street: Mr. Vock outlined changes to the plan since preliminary approval. The drive -up situation has been improved. There is now a complete drive -through. They have also moved the entrance and have more green space near it. These changes resulted in the loss of 5 parking spaces, so the size of the building has been reduced. There will be more plantings in several areas. Regarding the bike path/sidewalk, Mr. Vock said they have met with the Couillards and City Manager. The Couillards are willing to allow the path to be shown on the overall site plan. They are asking for some language regarding liability. Mr. Vock felt the situation looks very promising. Mr. Dinklage asked whether the moving of the entrance satisfies the concern about sight lines. Mr. Weith said the City Engineer voiced no further concerns. Mr. O'Rourke asked if anything can be done to prevent 4-foot high lighted letters on top of the building. Mr. Burgess said the Planning Commission doesn't control that. Mr. O'Rourke noted one very unattractive building that has done this and said it would be something to be looked at in the future. Mr. Dome asked whether there can be a mix of evergreen and deciduous trees on the southern boundary. The applicant had no problem with this. The format of the digital information shall be approved by the City Planner. Memorandum - Planning July 15, 1997 agenda items July 11, 1997 page 3 Traffic: The proposed change in use will increase the estimated vehicle trip ends (vte's) from 115 to 119 vte's. The applicant should be aware that the road impact fee is zero (0). Sewer: No additional sewer allocation needed. 5) NATIONAL GARDENING ASSOCIATION - SEWER TRANSER REQUEST This is a request to transer 840 gpd of unused sewer allocation from the Wright & Morrissey building at 60 Farrell Street on land owned by National Gardening Association to the proposed office building at 69 Swift Street to be owned by Wright & Morrissey. A total excess allocation of 1143 gpd at the 60 Farrell Street property resulted from the applicant eliminating the medical office component previously proposed for this building. The transfer of 840 gpd results in a remaining excess capacity of 303 gpd. The applicant has already paid for the 1143 gpd of excess allocation. 6) ALBERT AND MARIE ST AMAND & DAN MORRISSEY - BOUNDARY LINE ADJUSTMENT - REVISED FINAL PLAT This project consists of a boundary line adjustment between two (2) adjoining property owners involving 7500 square feet and amending the site plan. This boundary adjustment will result in no change in size or frontage to either property. The purpose of the boundary line adjustment is to make the lot at 57 Swift Street owned by Morrissey contiguous with other lands owned by Morrissey at 63 and 69 Swift Street. The 57 Swift Street property is developed with a single family dwelling and accessory structures. The sketch plan was reviewed on 5/13/97 (minutes enclosed). These properties located at 57 and 59 Swift Street lie within the C1 District. They are bounded on the west by a commercial building and undeveloped land, on the south by two (2) single family residences, on the east by two (2) commercial buildings, and on the north by Swift Street. Access: The boundary line adjustment will result in the access to 59 Swift Street being relocated approximately 100 feet to the west. The access to 57 Swift Street will be eliminated. The width of the new driveway will be the same as the existing driveway. Lot size/frontage: There will be no change in lot size or frontage for either applicant. Equal amounts of land area and frontage will be exchanged between the two (2) property owners. Memorandum - Planning July 15, 1997 agenda items July 11, 1997 page 4 Coverage/setbacks: Building coverage is 21.40 (maximum allowed is 306). Overall coverage will decrease from 72.8% to 70.0 (maximum allowed is 70a) . Front yard coverage will decrease from 380s to 360 (maximum allowed is 300). The proposed boundary line adjustment will result in the new property line passing through an existing structure and not meeting the 15 foot side yard setback requirement. This structure must be removed prior to conveyance of the parcels. Trailers: There are two (2) trailers on the property which appear to be used for storage. These trailers were not approved as part of the original site plan approval and should be removed. The trailer shown along the south boundary should be removed from the plan. Revised final plat: The revised final plat plans should include the following additional information: --- type of, location, and size of existing utilities. --- indicate that the southerly property boundary line is the boundary between the C1 District to the north and R4 District to the south. --- show reserved strip for future street widening. --- property lines to be dissolved should be clearly indicated as such. 7) WRIGHT & MORRISSEY - OFFICE BUILDING & PUD - FINAL PLAT This project consists of: 1) constructing a 38,428 square foot 4- story general office building (including a bank with drive -through service), 2) combine two (2) contiguous lots into a planned unit development (69 and 85 Swift Street), and 3) construct a parking area at 57 Swift Street. The lot at 57 Swift Street will be combined into the PUD after a boundary line adjustment is approved. The preliminary plat was approved on 5/13/97 (minutes enclosed). These properties located at 57, 69 and 85 Swift Street lie within the C1 District. They are bounded on the east by the access to Farrell Park, on the north by Swift Street and an auto body repair shop, on the south by Farrell Park and several residences, and on the west by a mini -warehouse complex. Access/circulation: Access to the PUD will be provided by a 36 foot curb cut at 85 Swift Street, and a 24 foot curb cut at 69 Swift Street. An internal future access drive is proposed which would connect 69 Swift Street and 85 Swift Street. Sketch plan application of Eldo's Cafe to amend a planned unit development previously approved on 26 March 1996 consisting of a 41,000 sq. ft. general office building and an 11,400 sq. ft. general office building. The amendment consists of converting 500 sq. ft. of general office space in the 41,000 sq. ft. building to bakery and delicatessen restaurant use, 60 Farrell Street: Mr. Webster said that when the building was originally conceived, there was an area set aside for vending machines. Then someone came along wanting to provide fresh sandwiches, etc. This was put in the area that had been set aside for vending machines. Mr. Burgess noted that the only change involved is an additional 4 trip ends. Mr. Teeson said he felt there were a lot of trees that were supposed to remain that appear to be gone. Mr. Webster said the trees that were removed were for the garden space. Mr. Dinklage asked that the site be checked by the City Planner. Mr. Morrisey said they are doing planting now that is more condusive to spring planting. Mr. Weith will check on this. No other issues were raised. 5. Sketch plan application of Albert & Marie St. Amand and Dan Morrissey for a boundary line adjustment between two adjoining property owners involving 7500 sq. ft., 57 and 59 Swift St: Mr. Vock showed the existing storage facilities that will remain. He explained that the present access is through a 50 ft. strip. This will be changed to another 50 ft. strip. Mr. Morrissey said they will eliminate one curb cut and will provide better screening. Mr. Vock said the front yard coverage will change, but they can redo it so there is no change from its current condition. Mr. Weith said this should be done. Mr. Weith said that staff wants a clear indication of which lines are to be dissolved and what the properties will look like in the end. Mr. Vock then showed where new curb cuts would be. There will be one for the current house that will remain in the same place and PLANNING COMMISSION 13 MAY 1997 page 3 be 18 ft. in width. Mr. Weith recommended that the structure that is to be removed be taken down prior to the transfer of land. The applicants agreed to do this. No other issues were raised. 6. Public Hearing: Preliminary plat application of Wright & Morrissey, Inc, for a planned unit development consisting of the existing Vermont Gas building and a new 41,125 sq. ft. building for general office use, and a bank with drive -through service, 69 and 85 Swift Street: Mr. Webster noted that Vermont Gas had an option on this property because they needed more space. After they got their permits, the felt they couldn't use that much space and looked for partners to share it with. They couldn't find any, so they let the option go and rented space at 99 Swift St. Then Mr. Morrissey bought the property. A stock broker has asked Mr. Morrissey to build a building similar to the one done at 60 Farrell Street. North Country Credit Union also wants a drive -through facility, so a PUD would be required. It is therefore proposed to put all the property together as a PUD. Vermont Gas was also concerned with "being stuck" in a neighborhood that may not be progressing. So Mr. Morrissey got some additional space, reduced the footprint of the building and made it higher (4 stories) and turned it 90 degrees. There would also be contiguous parking. Members discussed whether this is truly a PUD. Staff was uncom- fortable with the proposed access and wanted it to consume less of the Conservation Zone. Vermont Gas agreed to this. The question of the road location was then discussed. Members asked for a bond and a time limit on the building of the road. If it is not built in that time, the bond would be used to build the road as shown. The applicant was comfortable with the 3-year time limit recommended by Staff. The Fire Chief has asked for the walk to be extended to the east as well as to the west so that fire trucks can be set up there. This will be done. The building will be fully sprinklered, and new fire hydrants will be added as recommended by the Fire Chief. The plan is 15 spaces short on parking, 8.3%. AMAND & DAN MORRISSEY - BOUNDARY LINE ADJUSTMENT - SKETCH PLAN This project consists of a boundary line adjustment between two (2) adjoining property owners involving 7500 square feet. This boundary adjustment will result in no change in size or frontage to either property. The purpose of the boundary line adjustment is to make the lot at 57 Swift Street owned by Morrissey contiguous with other lands owned by Morrissey at 63 and 69 Swift Street. The 57 Swift Street property is developed with a single family dwelling and accessory structures. These properties located at 57 and 59 Swift Street lie within the Cl District. They are bounded on the west by a commercial building and undeveloped land, on the south by two (2) single family residences, on the east by two ( 2 ) commercial buildings, and on the north by Swift Street. Access: The boundary line adjustment will result in the access to 59 Swift Street being relocated approximately 100 feet to the west. The access to 57 Swift Street will be eliminated. Lot size/frontage: There will be no change in lot size or frontage for either applicant. Equal amounts of land area and frontage will be exchanged between the two (2) property owners. Coverage/setbacks: Building coverage is 21.4% (maximum allowed is 30%). Overall coverage will decrease from 72.8% to 72.2% (maximum allowed is 70%). Front yard coverage will increase from 47.5% to 54.5% (maximum allowed is 30%). The Planning Commission does not have the authority to allow the increase in front yard coverage. The proposed boundary line adjustment will result in the new property line passing through an existing structure and not meeting the 15 foot side yard setback requirement. This structure must be removed prior to conveyance of the parcels. The lot at 57 Swift Street will be combined into the PUD after a boundary line adjustment is approved. The sketch plan was reviewed on 3/11/97 (minutes enclosed). These properties located at 57, 69 and 85 Swift Street lie within the C1 District. They are bounded on the east by the access to Farrell Park, on the north by Swift Street and an auto body repair shop, on the south by Farrell Park and several residences, and on the west by a mini -warehouse complex. Access/circulation: Access to the PUD will be provided by a 36 foot curb cut at 85 Swift Street, and a 24 foot curb cut at 69 Swift Street. An internal future access drive is proposed which would connect 69 Swift Street and 85 Swift Street. Staff recommends that this access road connect with the parking lot at 85 Swift Street at the southwesterly corner instead of the northwesterly corner. This would disturb less green area. This access road should be shown on the site plan for 69 Swift Street. This access drive would be constructed at a later phase of development. Staff recommends that the access drive be constructed within three (3) years. Circulation on the site is adequate. Coverage/setbacks: Combined 57 and 69 Swift Street: Building coverage is 29.9% (maximum allowed is 30%). Overall coverage is 69.9% (maximum allowed is 70%). I would recommend a curve (rather than 90 degrees) in the road where it will be extended to the Munson property. 5. It should be made clear to home buyers that the street will be extended to the Munson property and not remain a dead end. 6. Parking spaces off a street will create snow plowing problems. 7. Seventy per- cent of the 57 foot front yard should be landscaped. However, this consumes more than 75% of the lot and should be waived due to the size and configuration of this lot. It is clear that this lot should be combined with the lot to the west. At a minimum though, the 15 foot buffer should be provided. Traffic: This very small lot allows 3.5 trip ends during the peak hour. The applicant projects 15 to 20 trips per day. I do not have estimates for the trip generation during the Williston Road peaks. (.97 and 1.07 acres) The property has 50 feet of frontage on Swift Street. One lot will be for mini - storage; the second will be sold to Booska's for bulk storage. Any development on these lots requires separate site plan approval. The property is zoned Commercial-1 and is located on the southern side of Swift Street between 57 and 69 Swift Street and backs up to Lindenwood Drive (see enclosed tax map). Access will be provided from a twenty foot wide right-of-way to the two lots in the rear. Circulation and parking will be con- sidered at site plan review. The southern property line abuts a residential district so a 65 foot rear yard setback is required to provide an adequate buffer. Additional landscaping and buffer may be required at site plan review according to Section 19.104C. There are large trees bordering the entire property. These should not be removed since they provide a full grown buffer better than any new landscaping plan.
