6. Site Plan application of Donald & Arnold Marek for
construction of 2 mini -storage buildings for a total of
10,800 sq.. ft on lot #1, 59 Swift St.
Mrs. Lafleur advised the Zoning Board did not grant a waiver
of the 65 ft. setback from the rear property, and this must
now be met. The ordinance is unclear on the question of 2
buildings per lot. There are 5 buildings on the applicant's
lot across the street. Mr. Marek noted lot coverage is 66%
and building coverage is now 23%. Mr Dooley said the plan
should be approved as a "building complex" because of the 2
buildings. Mr. Marek said aisles will stay graveled for a
while, then will be paved. Mr. Jacob asked about dust
control. Mr. Marek said he didn't think there would be much
dust as they expect only 4 cars per day. Night lighting will
be directed downward.
Mr. Dooley moved that the Planning Commission approve the
site plan application of Donald & Arnold Marek for
construction of 2 mini -storage buildings of 10,800 sq. ft.
total as depicted on a plan entitled "Proposed Site Layout
M & M Partnership, 59 Swift Street, South Burlington,
Vermont" prepared by Donald Marek dated 8/19/86 with the
following stipulations:
1. Two buildings are approved for the lot as a commercial
complex for one user.
2. A $2550 landscaping bond shall be posted prior to permit.
3. A drainage plan shall be submitted to the City Engineer
for approval prior to permit. It shall show a piped drainage
system with a series of drop inlets to intercept surface and
road runoff and outlet it to the east.
4. The buildings shall be decreased in length so as not to
infringe on the 65 foot rear yard setback.
5. Revised plans shall be submitted to the -City Planner for
approval within 30 days.
6. The building permit shall be obtained within 6 months.
Mr. Belter seconded, and the motion passed unanimously.
7. Sketch Plan application of Ernest Pomerleau acting for
Charles Bolton, Brassard Automotive & Vermont Federal Bank
for construction of a 110 room hotel, a 28,600 sq. ft.
addition to the Grand Union shopping center, a 520 sq. ft.
addition to the Vermont Federal Bank, and demolition of 3
Landscaping plans show a new buffer of large evergreen trees
along the Cardinal Woods/Foxcroft boundary. They will be 5 to 6
feet in height and planted four feet on center. They will adapt
to the wet clay soils and are fast growing to fill in quickly.

This area was cleared several months ago to make way for future
development and to have a place to store top soil. Several large
trees have been saved on the site; the rest was thick brush that
other than to provide a visual screen was of little value.
Evidently, the neighbors are disturbed by this clearing and want
some buffer restored. The landscaping plans should be sufficient
to accomplish this. Other landscaping will be placed around the
units. There is a good buffer of existing vegetation along the
right-of-way that must be saved. It has a good mix of large trees
including maples and some 8 inch pines.

6), MAREK, LOT #1, 59 SWIFT STREET
Donald and Arnold Marek propose to construct two mini -storage
buildings measuring 30 feet x 180 feet each for a total of 10,800
square feet. The buildings will be 9 feet high.
The Zoning Board will be reviewing this September 22, 1986 for a
dimensional variance since the buildings are proposed within the
65 foot rear yard setback from the residential neighborhood; they
are 52 feet from the property line.
Access: Mr. Marek proposes to access this development through a
20 foot wide access drive located in the fifty foot right-of-way
from Swift Street.

Landscaping and Screening: The plan shows a 5 foot minimum
buffer around the north and western boundary and a 20 foot
greenbelt toward the residential properties to the south. Eight
norway maple and spirea and potentilla line the entrance drive.
A stockade fence is shown along the entrance and an existing
chainlink fence separates the site from the NET property to the
west.

1. Some of the concerns expressed in last memo hsjve not been
addressed mainly the K-Mart sidewalk, the rear drainage, the
waterline.
2. State approval will have to be obtained for connecting the
storm drains to the street system.
5) CARDINAL WOODS PHASE II, FOXCROFT
1. The two drainage pipes north of Hayes Avenue Sta. B+50 should
be joined by a drop inlet. Thi.s will help in the maintenance of
the area. The same recommendation for the end ,f the pipe
draining the area north of Hayes Avenue Sta. 5+50.
2. Water Department shall review the water maim layout.
However, unit curb stops must be within the water main easement.
Plan shows some close to buildings.
3. The grading along the northerly and westerly pr,,Perty lines
should be such that runoff from the development does r:<)t drain on
to these properties. This will occur with the grading as shown.
Floor elevations of units may have to be lowered to accommodate
this grading work.
4. Internal street lighting should be provided.
6) M & M PARTNERSHIP, SWIFT STREET
1. Extensive lot coverage by buildings and pa-.ement will
increase drainage runoff. This increased runoff wil drain upon
the adjacent property especially the property to the west and to
the north. I would recommend a piped system with a series of
drop inlets to intercept surface and road runoff and utlet it to
the east.

ZONING BOARD OF ADJUSTMENT SEPTEMBER 8, 1986
The South Burlington Zoning Board of Adjustment held a regular meeting on
Monday, September 8, 1986 at 7:00 PM in the Conference Room,City Hall,
575 Dorset St.

No. 1 Appeal of Donald and Arnold Marek
Appeal of Donald and Arnold Marek seeking a variance from Section 11.10
Permitted uses, Section 19.104 Landscaping requirements and Section 19.65
Multiple uses, request is for permission to construct two 30' x 180' buildings,
occupying said buildings as a mini -storage facility. Proposed buildings to be
located to within fifty two (52) feet of the southerly rear yard which abuts a
residential district, on a parcel containing approximately 1 acre, located at
59 Swift Street.
Mr. Ward said the area is zoned C-1 District, Section 11.10 Permitted uses
- proposed use prohibited, Storage facility is conditional use in C-2
District. Section 19.104 Landscaping requirements - sub -section C "buffer
strip" - minimum rear yard 65 feet, plus maintain a 15 foot buffer of
evergreens. Proposed set back 52 feet from residential district (Lindenwood
Terrace) with a 20 foot buffer area. Section 19.65 Multiple uses - two
buildings proposed - 30' x 180' used as mini -storage facility. Parcel 1.07
acres with 50' frontage.
Don Marek showed pictures of his present facilities to the board. These
facilities are directly across from New England Telephone. The existing
buildings are 20 x 150' and are 9' high. Mr. Marek said that their office
will be in their existing facility. He said the proposed buildings would not
alter the character of the neighborhood and would not create any hardships
because the existing businesses surrounding the area are Booska Trucking,
Vermont Gas, New England Telephone. There would be just a minimum amount of
traffic - about 5 cars a day - no traffic at night.
Mr. Thibault asked how many units Mr. Marek was planning on. Mr. Marek
replied two buildings with a total of 72 units. Visits per customer are about
twice a month. Mr. Thibault asked who his neighbors were to the east side
and was advised Booska, Benchmark and Vermont Gas.

Mr. Dinklage asked about the land on this property compared to Lindenwood
Terrace. Mr. Marek said that his property was pretty much flat and also
advised that Mr. Booska is in the process of purchasing this property from
them. Mr. Jarrett asked about the right of way going to the east as shown on
the plans. Mr. Marek said he has a 20' right of way which is recorded with the
City.
Mr. Marek presented the board letters from neighbors who had no objections
to Mr. Marek's proposed buildings. Comments were that they were good
neighbors, they lived up to their agreements, no traffic at night, etc. The
letters were from Mrs. Pauline McCaffrey, 38 Swift St., E.M. Grimley from
Benchmark, 69 Swift St., and New England Telephone. (letters on file)
Mr. Aruzza asked what was going to happen to the land at the left and
Mr. Booska said that eventually he would be filling in what he can. Mr. Aruzza
asked if when this filling is done they would have to come to the Zoning
Board. Mr. Blais advised Mr. Aruzza that if they can meet all the requirements
of the Zoning by-laws they would'nt have to come to Zoning but would definitely
be required to go before the Planning Commission.
Mr. Aruzza asked Mr. Marek if he planned to put up a chain link fence.
Mr. Marek said he would be putting up chain link fence, also a stockade fence
on one side for appearance - it will all be enclosed and he will put up a
gate. Mr. Dinklage asked what time they would open and Mr. Marek said at
7 AM. Mr. Dinklage said that we should make that a stipulation and Mr. Marek
said they already have that in their rules now. Mr. Dinklage asked about the
20' buffer and if the trees would be placed the same. Mr. Marek said that 15'
is according to zoning rules and the trees will be laid out the same. He said
they would like to spend money where it's residential and he will be putting up
evergreens to have a natural tree line in the winter. Mr. Dinklage asked
Mr. Marek to describe the lights. Mr. Marek said that they were a low sodium
type of lights - small units 1 1/2' wide 1 1/2' deep attached to building above
doors - probably use 75W - there is nothing shining on residential
neighborhood. Mr. Dinklage asked if the bulb and cone of the light would be
visible from Lindenwood property. Mr. Marek said he didn't think so and if
there is a problem they would rearrange this - could focus lights towards
building.
Mr. Boehm said that since the proposed use is prohibited in the C-1
District and due to the permitted uses listed under Section 11.10, the proper
route would be to go to the Planning Commission.
Mr. Dinklage said that I would like to move that in light of the testimony
that we have heard and in consideration of the proposed for District C-1 as
stated in Section 11.10 that I move the board consider this as a Conditional
use per section 19.057 subject to additional possible stipulations to be made
by the board. This was seconded by Mr. Thibault. After some discussion both
Mr. Boehm and Mr. Jarrett said that warehouses are prohibited in C-1 District.
Mr. Marek said they don't consider mini -storage warehousing. Mr. Dinklage said
is it possible that the type of use being proposed is a much more restrictive
general use. There was more discussion regarding the wording in Section 11.10
and Mr. Dinklage suggested that we either grant a use variance, use the motion

made, or deny it. Mr. Arnold Marek said the buildings we are developing could
be indoor theater, retail business, car wash, hotel - wouldn't it be nicer to
have something like this rather than retail.
Mr. Dinklage said I withdraw the motion and I move that we table this
appeal until the next meeting. This was seconded by Mr. Thibault and voted 3
-2 to table.
Mr. Jarrett moved to send the communication to the Planning Commission
asking them to consider mini -storage facilities as a Conditional use in C-1
District and to make any other changes in Section 11.10 that would go along
with Conditional use for mini -storage. This was seconded by Mr. Thibault and
all voted aye.
No. 2 Tabled Appeal of Green Acres, Inc. Ralph Goodrich
Tabled appeal of Green Acres, Inc., Ralph Goodrich, Hinesburg Road Quarry.
Mr. Ward asked the board if they had received the draft of Suggested
Stipulations to discuss and make changes.
After some discussions the stipulations were changed to read as follows:

Stipulations
1. That the access roads be limited to the two proposed. The access road off
Hinesburg Road at the Semicon entrance, be constructed to conform with
City specifications (installation of the base) both access roads shall be
paved. Proper entrance security shall be installed.
2. An erosion and dust control plan shall be submitted to the Board prior to
any commencement of activity at this site. The erosion control plan shall
include the method of handling any water discharge from the quarry.
3. Management and control of this operation shall remain with Ralph Goodrich.
Any transfer of management shall be subject to approval by the Board.
4. Quarrying limits be reference to the plan dated May 9, 1985. Any
revisions shall be subject to review by the Board.
5. Quarrying practices shall be conducted according to standard accepted
practices and that the resulting side walls be left nearly vertical.
6. If for some reason the recharge source is disrupted and the pond does not
fill, the slope will be covered with 6 inches of soil and the area seeded.
Any other use of the quarry shall be subject to approval by the Board.
7. The hours of operation shall be 6 AM to 6 PM, Monday through Saturday.
8. This project shall be subject to any State approvals or permits.

9. This proposal is subject to site plan review by the Planning Commission.
Adequate screening shall be planted along the Interstate.
10. Any bonding requirements shall be established by the Planning Commission
and the City Engineer.
11. These stipulations are subject to review by the Board within one year
after commencement of operation or at any time at the discretion of this
board upon 30 days notice.
Mr. Pennington asked if there was a need for two access roads and Mr.
Goodrich said there was for convenience due to the number of trucks, closeness
of work and competitiveness. Mr. Pennington asked if the Circumvential Highway
had been approved and Mr. Jarrett advised him that the State is working on
people to administer it right now. Mr. Pennington asked if there had been any
consideration of wild life there. Mr. Ward said this will go to Act 250.
Mr. Dinklage moved that the appeal be approved subject to the stipulations
as changed this evening. This was seconded by Mr. Thibault and all voted aye.
Mr. Jarrett did not vote due to conflict of interest as noted in the minutes of
August 25, 1986.
The minutes of August 25, 1986 were approved on a motion by Mr. Boehm, a second
by Mr. Dinklage and a unanimous vote.
