The Board reviewed the above‐referenced application on September 8, 2021 and continued the hearing to
address outstanding issues. The remainder of this memo presents a summary of what Staff considers to be
outstanding issues. The Board is encouraged to review the September 8 staff notes and discuss any items for
which they feel additional testimony is needed.
PROJECT DESCRPTION:
Preliminary and final plat application #SD‐21‐21 of Donald and Lois Kerwin to amend a previously approved
Planned Unit Development of two lots. The amendment is to subdivide Lot 2 (0.83 acres) into three lots of 0.28
acres each in order to develop a single family home on each, 1420 Hinesburg Road.
OUTSTANDING ISSUES TO BE ADDRESSED:
1. TREES: The Board directed the applicant to add two trees between each building and the eastern lot line in
order to support consistency with the existing neighborhood. The applicant has provided a landscaping
plan prepared by Michael Lawrence & Associates Landscape Architects and dated October 2021 which
provides five maple trees between the buildings and the eastern lot line. The specified size is 3‐6 feet,
which is not consistent with the City’s minimum 2 ½” caliper.
Staff recommends the Board require the applicant to modify the plantings to reference caliper, and provide
a minimum of 2 ½” caliper, for the trees between the buildings and the eastern lot line.
The applicant has also provided a number of additional trees and shrubs around the foundation of each
building. Since no supplemental narrative was provided, it is unclear whether the intention of the applicant
is for the plants to be representative of what may be planted, or if the applicant is proposing some
commitment to these plants.
Staff recommends the Board ask the applicant to describe their intention, and then the Board determine
whether to require all or some of the proposed plantings. Staff notes the specified sizes at planting for any
required trees should be by caliper, with a minimum planting size of 2 ½”.
Finally, the applicant has proposed a vegetated rain garden as mitigation for the proposed wetland
impacts. This rain garden is discussed pertaining to wetland impacts below.
Staff has requested the City Arborist review the plans. Staff anticipates they will have an update at the
time of the hearing.

2. WETLANDS: The project is proposing to impact all 1,742 sf of Class III wetland and all of the associated 50‐
ft buffer (area of impact not provided). On 9/8, the Board provided feedback to the applicant that they
needed more information to determine compliance with LDR 12.02E.
12.02E(3) Encroachment into Class II wetland buffers, Class III wetlands and Class III wetland
buffers, may be permitted by the DRB upon finding that the proposed project’s overall development,
erosion control, stormwater treatment system, provisions for stream buffering, and landscaping plan
achieve the following standards for wetland protection:
As was noted on 9/8, the Board is not obligated to permit wetland encroachment. In the case of this
PUD, the proposed Lot 3 is the location of the home in the previously‐approved but not yet constructed
PUD approval (#SD‐19‐35). The wetland was not identified as part of that application. Staff considers
that since the DRB did not permit the wetland impacts as part of #SD‐19‐35, wetland impacts associated
with that permit are prohibited. Therefore if the DRB does not approve this application, the applicant
would have to reconfigure the previously‐approved lot to avoid wetland or wetland buffer impacts in
order to obtain a zoning permit.
The Board should consider the following standards in determining whether to permit the proposed
wetland encroachment.
(a) The encroachment(s) will not adversely affect the ability of the property to carry or store flood
waters adequately;
The applicant provided the following response to the Board’s request for additional information on
10/5/2021.
Since the wetland is essentially an overgrown lawn, as stated in the original response the
elimination of the wetland or its buffer will not adversely impact the flood water storage capacity.
However, in support of improving on the existing storage potential in the area, a rain garden has
been incorporated into a portion of the wetland area between the homes. The existing
foundation drain is proposed to be day‐lighted into the rain garden and with the improved subsoil,
will better enable the water to infiltrate back into the ground.
(b) The encroachment(s) will not adversely affect the ability of the proposed stormwater treatment
system to reduce sedimentation according to state standards;
The applicant provided the following response to the Board’s request for additional information on
10/5/2021.
The Arrowwood Environmental wetland report indicated that the wetland does not exhibit any
of the function of values set forth by the State including the ability to prevent erosion and trap
sediment. However, the addition of the rain garden will provide some additional treatment and
infiltration of runoff on lots 2 and 3. With the reduced size of the driveways and a fully vegetated
site, it is not anticipated that there will be a lot of sediment that is expected to be generated by
these lots.
(c) The impact of the encroachment(s) on the specific wetland functions and values identified in the
field delineation and wetland report is minimized and/or offset by appropriate landscaping,
stormwater treatment, stream buffering, and/or other mitigation measures.
The wetland memorandum prepared by Arrowwood Environmental and dated 7/1/2021 indicates that
the wetland was determined to be Class III on 6/28/2021, which determination is valid for five years.
The Class III determination indicates that its functions and values do not merit protection under the
Vermont Wetland Rules at this time. This is because the State does not regulate Class III wetlands.

However, the City has chosen to apply the wetland protection standards to Class III wetlands and
buffers.
The ten wetland functions and values are as follows.
1. Water Storage.
2. Water Quality Protection.
3. Fish Habitat.
4. Wildlife Habitat.
5. Sensitive Species.
6. Exemplary Communities.
7. Education and Research.
8. Recreation.
9. Open Space.
10. Erosion Control.
The applicant provided the following response to the Board’s request for additional information on
9/21/2021.
The Arrowwood Environmental report specifically identified that the wetland does not provide
any of the State’s ten (10) function and values review standards. Since there are no identified
functions to be mitigated though design approaches, the design of the proposed rain garden
will provide a dedicated environment for small storm infiltration and will add aesthetic value to
the site that otherwise is not presently found. The grading of lots 2 and 3 has been designed to
provide positive drainage towards the rain garden to be able to provide some supplemental
stormwater treatment on the site. A supplemental landscaping plan has also been developed
for those areas not associated with the proposed rain garden.
Staff considers the provided rain garden to be appropriate mitigation for the impacted wetland
given that it captures flow which previously fed the wetland as well as surface runoff from the
proposed roofs. Staff recommends the Board include a condition requiring the rain garden be
maintained in perpetuity. Staff further recommends the Board require the applicant to update the
civil engineering drawings to reflect the grading and utilities shown on the landscaping plan.
3. DRIVEWAY DRAINAGE: Because the previous proposal routed an existing drainage ditch through 15‐inch
culverts with significantly less than 12‐inches of cover, the applicant indicated to Staff via phone
conversation on 10/5/2021 they would modify the plans to route the existing drainage ditch over the
driveways. However, the plans provided on October 5, 2021 do not reflect this discussed modification. Staff
recommends the Board ask the applicant to provide an update.
4. BUILDING DESIGN: The Board directed the applicant to increase the glazing on the south facing façade of
the sample elevations. The applicant has done so. They have provided a computation indicating that at
least 35% of the area of the south façade will be glazed. As Staff stated at the hearing on 9/8, this is not the
standard. The standard is that 35% of the glazing should be on the south facing façade.
Staff recommends the Board review the provided elevations and floor plans and determine whether to
include a condition that 35% of the south façade be glazed, as proposed by the applicant, or whether to
require the standard of 35% of glazing to be south facing, consistent with the LDR. As much as Staff

supports natural light as a good design principal, Staff considers the provided elevations result in a
potentially untenable amount of glazing relative to interior home design.
RECOMMENDATION
Staff recommends that the Board work with the applicant to address the issues identified herein.
